RECOMMENDED ACTION
City Council adopt the City Council Legislative Subcommittee's recommendation of an "oppose"
position for Assembly Bill 806 (Dodd) and transmit position statements to Assembly Member
Dodd, Santa Clarita's state legislative delegation, appropriate legislative committees, Governor
Brown, and the League of California Cities.
BACKGROUND
Assembly Bill 806 (AB 806) was amended into its current form on July 13, 2015, by Assembly
Member Bill Dodd (D -4 -Napa).
The goal of AB 806 is to require state and local agencies to encourage the installation of
broadband by eliminating barriers that are viewed by some broadband proponents as restricting
broadband deployment, specifically by exempting strand -mounted antennas installed on
previously permitted communications infrastructure from local permit requirements.
Establishing permit exemptions for strand -mounted antenna installations would allow for
modifications to existing communications infrastructure that increase the size and impacts of
these facilities in residential communities. Under AB 806, local governments would be required
to allow these modifications regardless of the potential negative impacts associated with them,
such as blight, noise and environmental impacts, which could prove to be disruptive to overall
quality of life. Examples of strand -mounted antenna installations are attached to this report.
Allowing a permit exemption to strand -mounted antenna installations that are made to existing
communications infrastructure would allow facility operators to make modifications to structures
within the public right-of-way without the City's advanced knowledge. Under the City's current
policy for performing maintenance within the public right-of-way, encroachment permits must
be obtained to ensure the work being performed is consistent with applicable standards and to

ensure the public's safety. Additionally, permit applications to perform work on communications
infrastructure are reviewed to ensure the proposed work is consistent with the conditions of the
franchise agreement between the City and service provider. These permit applications are
typically reviewed and approved by the City within 24 hours. Removing the requirement to
obtain encroachment permits would result in work being performed in the public right-of-way
that could negatively impact traffic and public safety.
While AB 806 is the most recent attempt to erode local government authority related to
communications infrastructure at the state level, the City Council has historically been opposed
to similar efforts at the federal level. Included within the 2015 City of Santa Clarita Legislative
Platform, adopted by the City Council on November 24, 2014, is a provision related to wireless
communication facilities at the federal level: "Oppose regulatory efforts by the Federal
Communications Commission to erode or eliminate local government authority regarding siting
of cellular communications towers or transmission sites." The provisions proposed under AB
806 would not allow for modifications that are as expansive as what has been discussed at the
federal level; however, the bill does fall within similar boundaries of the City Council's existing
policy statement to oppose these efforts.
AB 806 is now a two-year bill and will be eligible to proceed in the legislative process in 2016.
The City Council Legislative Subcommittee met on August 31, 2015, and recommends that the
City Council adopt an "oppose" position on AB 806.
ALTERNATIVE ACTION
1. Adopt a "Support" position on AB 806
2. Take no position on AB 806
3. Refer AB 806 back to the Legislative Subcommittee
4. Other direction as determined by the City Council
FISCAL IMPACT
No additional resources, beyond those contained within the adopted Fiscal Year 2015/16 City
budget, are required for implementation of the recommended action.

The Permit Streamlining Act governs the approval process that a
city, county, or city, and county is required to follow when approving,
among other things, a project that is located within a flood hazard zone,
a permit for a hazardous waste facility project, and a permit for
construction or reconstruction for a development project for a wireless
telecommunications facility.
This bill would require state and local agencies to encourage the
installation of broadband by eliminating barriers that restrict broadband
deployment. The bill would also require that strand -mounted antennas,
as defined, that were previously in accordance with state or local
government permitting requirements be exempt from additional permit

regard including that this constitutes a matter of statewide concern.

The people of the State of California do enact as follows:
SECTION 1. Section 65964.5 is added to the Government Code,
to read:
65964.5. (a) (1) The Legislature hereby finds and declares
that communications technology and services, particularly
broadband, are criticial the the economic success of this state in
the 21st century. Broadband can drive local and state economic
growth, as well as improve education, business services, public
safety, health care, and energy efficiency.
(2) The Legislature finds and declares that the implementation
of consistent statewide policies to achieve timely and cost-effective
deployment of broadband is a matter of statewide concern and
that this section shall apply to charter cities and charter counties.
The provisions of this section shall supersede any inconsistent
provisions in the charter of any city, county, or city and county.
(b) It is the intent of the Legislature that state and local agencies
not adopt ordinances, resolutions, or regulations that create
unreasonable barriers to the installation of broadband. State and
local agencies shall encourage the installation of broadband by
eliminating barriers that restrict broadband deployment.

1 (c) (1) A strand -mounted antenna used for the provision of
2 video, voice, or data service that is attached to communications
3 infrastructure that were previously constructed in accordance with
4 state or local permitting requirements shall be exempt from
5 additional permitting requirements.
6 (2) For the purposes of this section, "strand -mounted antenna "
7 means a low powered antenna embedded in or attached to
8 communications cables that are part of a pole -supported overhead
9 communications infrascture. "Strand -mounted antenna "shall not
10 include a commercial mobile radio services (CMRS) antenna.
