RECOMMENDED ACTION
City Council:
Request Los Angeles Regional Interoperable Communications System (LA-RICS) to conduct
public outreach to nearby residents and property owners of all proposed LA-RICS
telecommunications tower sites within the City of Santa Clarita, and to respond to, address
and remediate concerns raised thereto.
2. Request LA-RICS to consider an alternative site location for the proposed tower at Fire
Station 108 based on testimony received by nearby property owners opposed to this proposed
tower.
3. Request the Los Angeles County Board of Supervisors to take action to prohibit the co -
location of commercial (non-governmental) communication equipment at LA-RICS towers.
4. Adopt a resolution withdrawing the City of Santa Clarita from membership in the LA-RICS
Joint Powers Authority.
BACKGROUND
The Los Angeles Regional Interoperable Communications System (LA-RICS) was formed in
2009 under a Joint Powers Agreement (JPA) consisting of representatives from cities, public
safety agencies, and other public agencies in Los Angeles County, including the City of Santa
Clarita. The purpose of LA-RICS is to engage in regional and cooperative planning and
coordination of government services to establish a wide -area public safety communications
network.

Telecommunicalions Towers Within the City ofSanta Clarila
On July 15, 2014, the Los Angeles County Board of Supervisors authorized granting Site Access
Agreements for up to 117 County -owned and County -leased sites throughout Los Angeles
County (County), including seven sites within the City of Santa Clarita. In this situation, Los
Angeles County is exempt from the City's development standards and land use approval process,
oversight, and regulation. In the case of Lawler vs City of Redding (1992) 7 Cal. App. 4th 778,
the court found that Cities and Counties are exempt from each other's zoning ordinances and
general plans.
At the City Council meeting of March 10, 2015, residents expressed opposition to the proposed
tower at Fire Station 108, located on 28799 Rock Canyon Road, due to concerns regarding the
proximity to homes, health and safety, and the potential for co -location of commercial antennas
on the LA-RICS tower. In response to the residents, County Supervisor Michael D. Antonovich
requested LA-RICS cease construction at all Santa Clarita locations until public outreach is
conducted with nearby residents. Furthermore, the City received a letter from Supervisor
Antonovich informing the City of the halt in construction of tower 108 until community outreach
on the proJect was conducted.
The status of proposed tower locations and current construction within Santa Clarita are:
a Fire Station 73 - 24875 Railroad Avenue
Construction halted at the request of Supervisor Antonovich.
• Fire Station 107 - 18239 Soledad Canyon Road
Construction halted at the request of Supervisor Antonovich.
• Fire Station 108 -.28799 Rock Canyon Road
Caisson has been poured. Construction halted at the request of Supervisor Antonovich.
• Fire Station 111- 26829 Seco Canyon Road
Construction halted at the request of Supervisor Antonovich.
• Fire Station 123 - 26321 Sand Canyon Road
Caisson has been poured. Construction baited at the request of Supervisor Antonovich.
• Fire Station 132 - 29' ) 10 Sand Canyon Road
Construction of this site is complete.
• Sheriff's Station - 23740 Magic Mountain Parkway
Pre -construction and bid -walk is complete. Construction halted at the request of
Supervisor Antonovich.

On February 10, 2009, upon the recommendation of staff, the City Council adopted resolution
09-11, approving the Los Angeles Regional Interoperable Communications System (LA-RICS)

Joint Powers Agreement (JPA), thus authorizing the City's membership in the LA-RICS
Authority, and authorizing the City Manager to execute the JPA agreement.
As a contract city served by the Los Angeles County Sheriff, and being within the service
territory of the Consolidated Fire Protection District of Los Angeles County, and given we do not
anticipate needing to utilize the LA-RICS communication system for our non-public safety city
operations, staff believes continued membership in LA-RICS is unnecessary. Therefore, staff
recommends opting out of and withdrawing from the LA-RICS JPA at this time, well before the
November 24, 2015, deadline for withdrawing without incurring a financial cost. Opting out of
and withdrawing from the JPA, however, would not prevent LA-RICS from being able to install
communication towers on County -owned property within the City of Santa Clarita (as explained
above). However, given we have no need to utilize the services provided by LA-RICS, opting
out and withdrawing from LA-RICS would eliminate any perceived conflict related to the City
opposing the installation of communication equipment by LA-RICS while being a member
agency. In addition, opting out of and withdrawing from LA-RICS will save the City the
approximate annual membership cost of $20,000.
ALTERNATIVE ACTION
Other action as determined by the City Council.
FISCAL IMPACT
Withdrawing from the LA-RICS JPA will save the City the approximate future annual
membership cost of $20,000.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA CLARITA, CALIFORNIA,
WITHDRAWING FROM MEMBERSHIP IN THE
LOS ANGELES REGIONAL INTEROPERABLE
COMMUNICATIONS SYSTEM AUTHORITY
WHEREAS, the Los Angeles Regional Interoperable Communications System Joint
Powers Authority (LA-RJCS) was established in 2009 in furtherance of establishing an area -wide
radio system; and
WHEREAS, the City of Santa Clarita, previously joined LA-RICS; and
WHERE, AS, the LA-RICS Governance Board, of which Santa Clarita is not a member,
has adopted a funding plan projecting the cost of continued participation in LA-RICS; and
WHEREAS, pursuant to section 5.01 of the JPA agreement, as well as deadlines
established by the Governance Board, any member City may withdraw from LA-RICS without
any financial liability no later than November 24, 2015 (see letter attached hereto and
incorporated herein as Exhibit A).
NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve as
follows:
SECTION 1. The City of Santa Clarita hereby elects to withdraw from LA-RICS. The
City Manager is directed to provide written notice of this withdrawal to LA-RICS and is further
authorized to execute any necessary documents to effectuate this withdrawal.
SECT ION 2. The City Clerk shall certify to the adoption of this resolution and certify this
record to be a full, true and correct copy of the action taken.

Please be advised that the Board of Directors for the Los Angeles Regional
Interoperable Communications System (LA-RICS) Authority ("Authority") at a Special
Meeting held August 21, 2014, unanimously voted to extend the deadline for
submission of written notices of withdrawal from November 24, 2014 to November 24,
2016. The Board of Directors is also allowing members who have previously notified LA-
RICS of their desire to opt out, to amend their decisions within 90 days, if they so
choose.
As you may recall, on June 3, 2014, you received notice that on May 28, 2014, the
Board of Directors approved adoption of the -Funding Plan, delegating authority to the
Executive Director to notify Authority Members of the same and setting November 24,
2014 as the deadline to submit written notice of withdrawal from the Authority.
You were also notified at that time that if withdrawal of Authority Members or the
amounts of grants that are available to fund the LIVIR and PSBN projects impacts the
financing structure of the Funding Plan, the Board of Directors can consider whether it is
prudent to revise the Funding Plan. If a revised Funding Plan is adopted by the Board
of Directors which substantially increases the financial obligations of the Members, then
any Member so affected will have a further right to withdraw within a period no less than
45 days after the adoption of the revised Funding Plan, as set by the Board.
The Authority also wants to alert you to recent developments. The outstanding balance
of the Broadband Technologies Opportunities Program (BTOP) required cash match
was included in FY 2014-15 Adopted Budget, as an advance by the County of Los
Angeles, thus providing for 100% of the required cash match. It is anticipated that a
significant portion of the cash match can be offset through purchase of required User
Equipment. Member Funded JIPA Operation costs through November 24, 2015 will
also be advanced by the County of Los Angeles. Extending the period of withdrawal
through November 24, 2015, will provide Members sufficient time to budget for
respective LA-RICS expenses due effective November 25, 2015.
As further information, should your City desire to withdraw from the Authority and
pursuant to Article V, Section 5.01 (Adoption of Funding Plan) of the Joint Powers

Agreement ("JPA Agreement"), there will be no costs for any Member that withdraws
from the Authority during this time period. Your last day to withdraw as a Member under
Section 5.01 of the JPA Agreement now expires on November 24, 2015. Notices of
withdrawal must be done in writing, and can be given by personal delivery, e-mail, U.S.
Mail, certified U.S. Mail, or facsimile. My Executive Assistant, Wendy Stallworth-Tait,
will be the staff person to receive your official notices of withdrawal. She can be

Based on the most recent action of your Board, it is our hope that you will continue as a
full Member in the Authority and participate in both the LMR and LTE systems for the
benefit of your jurisdiction, the Authority, and the region. As you know, interoperable
communications represents the greatest regional need in the area of emergency
preparedness and homeland security. Thank you for your continued support and
leadership on the effort to improve communications for first responders in the greater
Los Angeles region.
