AGENDA REPORT CONSENT CALENDAR CITY MANAGER APPROVAL: I ,�✓��� DATE: October 13, 2015 SUBJECT: TAX -SHARING RESOLUTIONS FOR SANITATION DISTRICT ANNEXATION NOS. 1080, 1082, and 1083 DEPARTMENT: Public Works PRESENTER: Travis Lange RECOMMENDED ACTION City Council adopt the Santa Clarita Valley Sanitation District's resolutions approving and accepting the negotiated exchange of property tax revenues resulting from Santa Clarita Valley Sanitation District Annexation Nos. 1080, 1082, and 1083. BACKGROUND The Santa Clarita Valley Sanitation District (District), formerly known as County Sanitation District Nos. 26 and 32, provides wastewater treatment services within the District's service area. To provide wastewater treatment service to properties located outside the District's. service area, the boundary must be expanded through the annexation process. As part of this process, a tax - sharing resolution to provide the required funding to the District is adopted by the public agency responsible for providing services to the subject property. Local agencies receiving an apportionment of the property tax from the annexation area, including cities and utility districts, must determine the percentage of tax revenues to be exchanged between the affected agencies. Listed below are the annual tax increment percentages attributable to the land area involved in the corresponding annexation, which will be transferred to the Santa Clarita Valley Sanitation District: • 0.9695013 for Annexation No. 1080 • 1.0279480 for Annexation No. 1082 • 0.9837837 for Annexation No. 1083 `ts-Cel-, IS -Cel , � S-Cei lol Page 1 Packet Pg. 50 For this total, the City of Santa Clarita (City) is contributing the following percentage of its revenues from the annual tax increment for these annexation areas: • 0.001000145 for Annexation No. 1080 • 0.001026180 for Annexation No. 1082 • 0.000967711 for Annexation No. 1083 There is a separate tax -sharing resolution for Santa Clarita Public Library. The following is the percentage of the annual tax increment attributable to the land area involved in this annexation and the percentage of revenues from the annual tax increment for these annexation areas: • 0.9695013 and 0.000410677 for Santa Clarita Public Library for Annexation No. 1080 • 1.0279480 and 0.000407346 for Santa Clarita Public Library for Annexation No. 1082 • 0.9837837 and 0.000511476 for Santa Clarita Public Library for Annexation No. 1083 The annexation consists of the following (see attached resolutions with corresponding map): • Annexation No. 1080 - One existing single-family home and four proposed single-family homes along Lost Canyon Road. • Annexation No. 1082 - One existing industrial building on Santa Clara Street. • Annexation No. 1083 - 29 proposed single-family homes north of Copper Hill Drive at the terminus of Phantom Trail. ALTERNATIVE ACTION Other action as determined by the City Council. FISCAL IMPACT As proposed, the annexations to the Santa Clarita Valley Sanitation District should result in no adverse fiscal impact to the City. "ANNEXATION NO. 1080" WHEREAS, pursuant to Section 99 and 99.01 of the Revenue and. Taxation Code, prior to the effective date of any ,jurisdictional change which will result in a special district providing a new service, the governing bodies of all local agencies that receive an apportionment of the property tax from the area must determine the amount of property tax revenues from the annual tax increment to be exchanged between the affected agencies and approve and accept the negotiated exchange of property tax revenues by resolution; and WHEREAS, the governing bodies of the agencies signatory Hereto have made determinations of the amount of property tax revenues from the annual tax increments to be exchanged as a result of the annexation to Santa Clarita Valley Sanitation District entitled Annexation No. 1080; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The negotiated exchange of property tax revenues resulting from the annexation of territory to Santa Clarita Valley Sanitation District in the annexation entitled Annexation No. 1080 is approved and accepted. 2. For each fiscal year commencing on and after July 1, 2015 or after the effective date of this jurisdictional change, whichever is later, the County Auditor shall transfer to Santa Clarita Valley Sanitation District a total of 0.9695013 percent of the annual tax increment attributable to the land area encompassed within Annexation No. 1080 as shown on the attached Worksheet. Packet Pg. 63 3. No additional transfer of property tax revenues shall be made from any other tax agencies to Santa Clarita Valley Sanitation District as a result of annexation entitled Annexation No. 1080. 4. No transfer of property tax increments from properties within a community redevelopment project, which are legally committed to a Community Redevelopment Agency, shall be made during the period that such tax increment is legally committed for repayment of the redevelopment project costs. S. If at any time after the effective date of this resolution, the calculations used herein to determine initial property tax transfers or the data used to perform those calculations are found to be incorrect thus producing an improper or inaccurate property tax transfer, the property tax transfer shall be recalculated and the corrected transfer shall be implemented for the next fiscal year, and any amounts of property tax received in excess of that which is proper shall be refunded to the appropriate agency. The foregoing resolution was adopted by the Board of Supervisors of the County of Los Angeles, the Board of Directors of Santa Clarita Valley Sanitation District of Los Angeles County, and the governing bodies of Greater Los Angeles County Vector Control District, Antelope Valley Resource Conservation District, City of Santa Clarita, Santa Clarita Library, and Castaic Lake Water Agency, signatory hereto. The negotiated exchange of property tax revenues resulting from the annexation of territory to Santa Clarita Valley Sanitation District in the annexation entitled Annexation No. 1083 is approved and accepted. 2. For each fiscal year commencing on and after July 1, 2015 or after the effective date of this Jurisdictional change, whichever is later, the County Auditor shall transfer to Santa Clarita Valley Sanitation District a total of 0.9837837 percent of the annual tax increment attributable to the land area encompassed within Annexation No. 1083 as shown on the attached Worksheet. No additional transfer of property tax revenues shall be made from any other tax agencies to Santa Clarita Valley Sanitation District as a result of annexation entitled Annexation No. 1083. 4. No transfer of property tax increments from properties within a community redevelopment project, which are legally committed to a Community Redevelopment Agency, shall be made during the period that such tax increment is legally committed for repayment of the redevelopment project costs. 5.
