HomeMy WebLinkAbout2015-10-13 - RESOLUTIONS - MC 09-108 (2)A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, APPROVING MASTER CASE NO. 09-108,, CONFIRMING THE ALIGNMENT OF THE VIA PRINCESSA EAST EXTENSION PROJECT IN ACCORDANCE WITH THE GENERAL PLAN, IN THE CITY OF SANTA CLARITA THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES HEREBY RESOLVE AS FOLLOWS. - SECTION 1. FINDINGS OF FACT. The City Council does hereby make the following findings of fact: a. On June 25 199L the City Council adopted the City of Santa Clarita (City) General Plan by adoption of Resolution No. 91-98. On June 14, 2011, the City Council adopted an update to the City General Plan by adoption of Resolution No. 11 -6 1. The City's General Plan presently designates the -project site as Business Park (BP) and Urban Residential 5 (UR5). Zoning on the project site is BP and UR5. b. The Circulation Element of the General Plan and the Joint Highway Plan designate Via Princessa as a major arterial roadway. c. The Circulation Element of the General Plan identifies future roadway improvements needed to implement the build -out of the Joint Highway Plan. Roadway improvements include constructing the Via Princessa, roadway segment, a six -lane major highway, from the existing eastern terminus just east of Clairbome Court, to the western terminus just west of Sheldon Avenue. d. The City received a grant in the amount of $11,577,000 from the 2007 Metro Call for Projects (Proposition C 25%) for the construction of this roadway. e. On August 25, 2009, the City Council awarded a contract to Impact Sciences, Inc. (Consultant), to complete the Environmental Impact Report (EIR) for the project. f. On September 14, 2009, Master Case No. 09-108 was filed for the Via Princessa East Extension project (project). The project consists of a 1.2 -mile extension of Via Princessa, between Golden Valley Road and the eastern terminus near Sheldon Avenue. The roadway would be 116 feet in width and consist of six lanes, a raised median, a sidewalk/parkway on each side, and a two-lane bike path along the south side. g. Surrounding land uses include vacant, undeveloped properties to the north and south of the project, which are zoned BP and UR5. Residential development is located to the northeast of the project site, which is zoned Urban ResidentialAlso located to the north and northwest of the project site is the storage and testing facilities for National Technical Systems, which is zoned BP. Also located to the south of the project site is Golden Valley High School, which is zoned Public/Institutional (PI). I h. In accordance with the California Environmental Quality Act (CFQA.), the City of Santa Clarita is the identified lead agency, with the City Council as the decision- making body for the Via Princessa East Extension project. i. The City prepared an Initial Study for the project, which determined the project may have a significant effect on the environment and that an EIR must be prepared. The Initial Study determined that the following areas must be addressed in the EIR: aesthetics * ,, air quality, biological resources, geology and soils, transportation and circulation, err and water quality, cultural resources, land use and planning, noise, and water services. j. On September 21, 2009, a Notice of Preparation (NOP) was circulated to affected agencies,, pursuant to CEQA statutes and the CEQA Guidelines (Title 14, Cal. Code of Regs. §§ 150,00 et seq.). Numerous comments from agencies and the public were received over the 30 -day review period, which ended on October 21, 2009. Agencies that received the NOP include, but are not limited to, the County of Los Angeles, the California Regional Water Quality Control Board, Santa Monica Mountains Conservancy, South Coast Air Quality Management District, law enforcement agencies, school districts, waste haulers, water agencies, and transportation agencies serving the Santa Clarita Valley, in accordance with CEQA's consultation requirements. Numerous comments from public agencies, organizations, and members of the public were received in response to the NOP. k. On October 29, 2009, a Scoping Meeting was held at City Hall, 23920 Valencia Boulevard, Santa Clarita, to obtain information from the public as to issues that should be addressed in the EIR. Notice of the Scoping Meeting was mailed to all property owners within 1,000 feet of the subject site and was mailed to all affected agencies. 1. A Draft Environmental Impact Report (Draft EIR) for the project was prepared and circulated for review and comment by affected governmental agencies and the public, anct ail issues raised in the NOP and by comments received on the NOP have been considered, in compliance with the CEQA. The Notice of Availability/Notice of Completion for the Draft EIR was filed, posted, and advertised on August 16, 2012, and the public review period ran for 60 days, from August 16, 2012, through October 15, 2012all in accordance with CEQA. All written comments received during the review period were accepted for inclusion in the Final EIR Responses to Comments. m. Two duly -noticed public outreach meetings were held on September 6, 2012, and 0 September 27, 2012, to receive public comments on the Draft EIR. The public outreach meetings were advertised by mailing to all property owners within 1,000 feet of the project site. The meetings were held at City Hall, 23920 Valencia Boulevard, Santa Clarita, at 6.-00 p.m. The following occurred at the public outreach meetings: September 6 and 27, 2012, City staff conducted public outreach meetings on the project. Staff provided a summary of the project description and the Draft EIR and received public testimony regarding the project. Approximately 50 people attended the public outreach meetings. Comments received during these meetings include, but are not limitedconcerns related to existing traffic conditions and vehicle speeds along Isabella Parkway and requests for multiway stop controls along Isabella Parkway. n. As a result of comments received at the public outreach meetings, City staff evaluated traffic conditions along Isabella Parkway and recommended that two multiway stop controls be placed along Isabella Parkway. On March 26, 2013, the City Council approved the installation of two multiway stop controls for the intersections of Isabella Parkway and Gratland Drive, and Isabella Parkway and Aurora Lane. o. Following the public outreach meetings, the City prepared the Final EIR (June 2015; SCH No. 2009091110). The Final EIR contains copies of all written comment letters and responses to all oral and written comments received on the Draft EIR. p. Notice of the Final EIR's availability was provided on June 15, 2015, to commenting agencies, organizations, and persons. q. The City Council held a. noticed meeting on the Via Princessa East Extension project and Final EIR on October 13, 2015, at City Hall, 23920 Valencia Boulevard, Santa Clarita, at 6:00 p.m. At this meeting, the City Council received a presentation on the Via Princessa East Extension project from staff and the environmental consultant, and received public testimony regarding the project. At the conclusion of the item, the City Council adopted all of the necessary approval documents (resolutions, findings of fact, responses to comments, mitigation monitoring, reporting program, etc.) for certification of the Via Princessa East Extension Final EIR and for approval of the Via Princessa East Extension project. r. Based upon the Draft EIR (August 2012) and Final EIR (June 2015), staff and consultant presentations, staff reports, and public comments and testimony, the City Council finds the project will not adversely affect the health, peace, comfort, or welfare of persons residing in the area-, nor will the project be materially detrimental to the use,, enjoyment, or valuation of property in the vicinity of the project site-, nor will the project j eopardize, endanger or otherwise constitute a menace to the public health,, safety, or general welfare since the project conforms with the General Plan and is compatible with surrounding land uses. s. Additionally, the City Council finds all public meetings pertaining to the project were duly noticed in accordance with the noticing requirements for the project. The pro*ect was advertised by direct first-class mailing to property owners within 1,000 feet of the project site. t. The location of the documents and other materials that constitute the record of proceedings upon which the decision of the City Council is based for the Master Case 09-108 project file is with the Community Development department; the record 'fically is in the custody of the Director of Community Development. speci SECTION 2. CALIFORNIA ENVIRONMENTAL QUALITY ACT REQUIREMENTS. Th City Council does hereby make the following findings of facts: I a. On October 13, 2015, the City Council certified the Final EIR (SCHNo. 2009091110) by separate resolution for Master Case 09-108, which was prepared in compliance with CEQA. For purposes of this finding, the Final EIR is comprised of the Draft EIR (August 2012) and Final EIR (June 2015). SECTION 3. WATER SUPPLY ASSESSMENT. Pursuant to California Water Code Section 1091 L the City Council hereby determines, based on the above findings of fact and recitals and the entire record, including, without limitation, the entire Via Princessa East Extension EIR, oral and written testimony and other evidence received at the City Council meeting, reports and other transmittals from City staff to the City Council, and upon studies and investigations macte by the City Council, including, without limitation, the water supply assessment prepared for the project and attachments thereto, projected water supplies will be sufficient to satisfy the demands of the project, in addition to existing and planned future uses. SECTION 4. Based upon the testimony and other evidence, if any, received at the City Council meeting, and upon studies and investigations made by the City Council and on its behalf, the City Council further finds and determines that this proposal is consistent with the City's General Plan. SECTION 5. The City Council hereby approves Master Case 09-108, for the alignment and tevelopment of the Via Princessa East Extension Project. SECTION 6. This resolution will take effect upon the adjournment of the City Council' October 13,, 2015, City Council meeting. i SECTION. 7. The City Clerk shall certify to the adoption of this Resolution and certify thi record to be a fult, complete, and correct copy of the action taken.
