City Council to conduct a public hearing, and open and review the ballots. If no majority protest
exists, adopt a resolution ordering said annexation, and authorize the annual levy and collection
of assessments within the District. If a majority protest exists, no action will be required.
BACKGROUND
Streetlight Maintenance District (SMD) No. 1 was established to collect funds to cover the
expenses for energy and maintenance of City of Santa Clarita (City) streetlights. Southern
California Edison bills the City for the costs of approximately 17,843 streetlights in the City.
The six parcels in Annexation No. L-96 include approximately 13.13 acres, consisting of three
non-residential developments that include one proposed hotel and restaurant development (3.749
acres), a retail shopping center (7.033 acres), and one church property (2.348 acres). The parcels
are generally located in the vicinity of McBean Parkway and Valencia Boulevard, Orchard
Village Road and Lyons Avenue, and Tournament Road and Golfview Drive (detailed project
locations attached).
As a condition of development, these properties are required to annex into SMD No. 1 in order to
pay their fair share toward installation and ongoing maintenance cost of streetlight facilities. All
parcels identified in this annexation receive benefits from SMD services.
All three property owners, whom comprise ownership of the six parcels, were mailed assessment
ballots on or before October 7, 2016. At the close of tonight's public hearing, the ballots for L-
96 will be tabulated. Barring a majority protest, it is recommended the City Council give final
approval of this annexation.

The annual levy of assessments, for the listed parcels, funds anticipated maintenance costs
associated with SMD No. 1. The maximum annual assessment is adjusted annually according to
the change in the Los Angeles, Riverside, and Orange County areas' Consumer Price Index
(CPI), as determined by the United States Department of Labor, Bureau of Labor Statistics. The
City Council, in any given year, may elect to levy an assessment amount that is less than the
maximum; however, they cannot levy an assessment which exceeds the maximum annual rate
allowable by state law.
ALTERNATIVE ACTION
1. Do not annex the parcels into Streetlight Maintenance District No. 1.
2. Other direction as determined by City Council.
FISCAL IMPACT
There is no fiscal impact to the General Fund by this action.

Council Chambers, 23920 Valencia Boulevard, first floor, Santa Clarita, California, on the 22nd day of
November 2016, at or after 6:00 p.m., to consider annexation of six parcels into City Streetlight
Maintenance District No. 1, as described in the Assessment Engineer's Report and pursuant to the
Landscaping and Lighting Act of 1972, being a division of the Streets and Highways Code of the State of
California. Proponents, opponents, and any interested persons may appear and be heard on this matter at that
time.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA CLARITA, CALIFORNIA, DECLARING THE RESULTS OF THE
ASSESSMENT BALLOT TABULATION FOR ANNEXATION L-96,
ANNEXING SPECIFIED PARCELS INTO THE CITY OF SANTA CLARITA
STREETLIGHT MAINTENANCE DISTRICT NO. 1,
ORDERING MAINTENANCE WORK THEREIN,
CONFIRMING THE DIAGRAMS AND ASSESSMENTS, AND PROVIDING FOR THE
LEVY AND COLLECTION OF THE ANNUAL ASSESSMENTS THEREIN
WHEREAS, the City Council of the City of Santa Clarita, California, has initiated
proceedings for the annexation of specified parcels designated as Annexation L-96 (Annexation
Territory) into the City of Santa Clarita Streetlight Maintenance District No. 1, (District) and
levy of annual assessments related thereto, pursuant to the terms of the "Landscaping and
Lighting Act of 1972," being Division 15, Part 2 of the Streets and Highways Code of the State
of California (1972 Act), Article XIIID of the Constitution of the State of California (Article
XIIID) and Proposition 218 Omnibus Implementation Act (Government Code Section 53750 and
following) (Implementation Act). The 1972 Act, Article XIIID, and the Implementation Act
may be referred to collectively herein as the Assessment Law; and
WHEREAS, the City Council did order and subsequently received a report prepared by
Willdan Financial Services (Engineer) prepared in accordance with the Assessment Law the
Assessment Engineer's Report (Engineer's Report); and
WHEREAS, the City Council did set the time and place for a Public Hearing to consider
the annexation of parcels into the District and the authorization to levy annual assessments
therein and did order that notice of such Public Hearing, accompanied by assessment ballots, be
given to the record owners of property within the proposed Annexation Territory in accordance
with the provisions of the Assessment Law; and
WHEREAS, notice of such Public Hearing accompanied by assessment ballots were
mailed to the record owners of property within the proposed Annexation Territory in accordance
with the provisions of the Assessment Law.
NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve
as follows:
SECTION 1. Recitals. The above recitals are all true and correct.
SECTION 2. Procedures. The City Council hereby finds and determines that the
procedures for the consideration of the levy of the assessments have been undertaken in
accordance with the Assessment Law.
SECTION 3. Assessment Ballot Procedures. Assessment ballots were mailed as
required by Assessment Law to the record owners of all properties within the Annexation
Territory which are proposed to be assessed. The assessment ballots completed and received by
the City Clerk prior to the close of the Public Hearing have been tabulated in accordance with the

procedures established by Assessment Law and the City Council, and the results of such
tabulation have been submitted to the City Council.
The City Council hereby finds the assessment ballots submitted in opposition to the levy
of assessments, as weighted in accordance with Assessment Law, do not exceed the assessment
ballots submitted in favor of the levy of assessments, also as weighted in accordance with
Assessment Law. Therefore, no majority protest to the levy of assessments within the
Annexation Territory exists.
SECTION 4. Determination and Confirmation. Based upon the Engineer's Report and
the testimony and other evidence presented at the Public Hearing, the City Council hereby makes
the following determinations regarding the balloted assessments for Fiscal Year 2016-17 and the
maximum annual assessments proposed to be imposed to pay for the estimated costs of the
maintenance of all of the improvements to ultimately be maintained upon the completion and
acceptance of thereof:
a. The proportionate special benefit derived by each parcel assessed has been
determined in relationship to the entirety of the cost of the operations and
maintenance expenses.
b. The assessments do not exceed the reasonable cost of the proportional special benefit
conferred on each parcel.
c. Only the special benefits have been assessed.
The maximum assessments for the Annexation Territory contained in the Engineer's
Report as of Fiscal Year 2016-17 are hereby confirmed. Subsequent annual assessments in
amounts not to exceed the maximum annual assessment of the estimated costs of the
maintenance of all of the improvements to ultimately be maintained upon the completion and
acceptance of thereof as set forth in the Engineer's Report may be subsequently confirmed and
levied without further assessment ballot proceedings pursuant to the Assessment Law. Each
fiscal year after the base year (Fiscal Year 2016-17), the maximum assessment shall be increased
by the Consumer Price Index, (CPI) for all Urban Consumers, Los Angeles, Orange, and
Riverside County areas without further compliance with the assessment ballot procedures
required under the Assessment Law.
SECTION 5. Annexation of Parcels. The City Council hereby orders the Annexation
Territory to be annexed to the District for Fiscal Year 2017-18.
SECTION 6. Ordering of Maintenance. The public interest and convenience requires,
and this legislative body does hereby order, the maintenance work to be made and performed as
said maintenance work is set forth in the Engineer's Report.
SECTION 7. Filing with City Clerk. The diagrams and assessments as set forth in the
Engineer's Report shall be filed in the Special Districts Office. Said diagrams and assessments,
and the certified copy thereof, shall be open for public inspection.

SECTION 9. The City Clerk shall certify to the adoption of this Resolution.

INTRODUCTION
Pursuant to the provisions of the Landscape and Lighting Act of 1972, being Part 2, Division 15, of the
California Streets and Highways Code, commencing with Section 22500 (hereafter referred to as the "1972
Act"), this report is prepared in compliance with the requirements of Article 4, Chapter 1, of the 1972 Act
regarding the annexation of territory into the City's existing Santa Clarita Streetlight Maintenance District No.
1 (hereafter referred to as "SMD No. 1" or "District").
The City Council of the City of Santa Clarita being the legislative body for SMD No. 1, may, pursuant to the
1972 Act, annex territory and levy annual assessments for the operations and administration of SMD No. 1.
In Section 22608 of the 1972 Act, it states "right of majority protest shall be limited to the territory proposed
to be annexed".
In addition, the 1972 Act provides for the levy of annual assessments after annexation into or formation of an
assessment district for the continued maintenance and servicing of the improvements. The 1972 Act further
allows various areas to be annexed into an existing district when the territory in the annexation receives
substantially the same proportional special benefits from the improvements. The costs associated with the
installation, maintenance, and servicing of the improvements may be assessed to properties, which benefit
from the installation, maintenance, and servicing of such improvements.
This report specifically addresses the annexation of approximately thirteen (13.130) acres of territory
consisting of three non-residential developments that include a 3.749 -acre hotel and restaurant development,
a 7.033 -acre retail shopping center, and a 2.348 -acre church property. This territory is more specifically
identified as:
Master Case No. 16.155 (Valencia Suites), which is located on the west side of McBean Parkway north
of Valencia Boulevard. This master case development currently includes the following Assessor's Parcel
Book 2861, Page 062, Parcel 040;
Master Case No. 16-025 (Lyons Center Shopping Center), which is located at the northeast corner
of Lyons Avenue and Orchard Village Road. This master case development includes the following
Assessor's Parcel Book 2855, Page 006, Parcels 008 through 011;
Master Case No. 16-092 (Christ Lutheran Church of Newhall), which is located on the northeast side
of Tournament Road at the corner of Tournament Road and Golfview Drive. This master case

Collectively, this annexation territory is proposed to be annexed into SMD No. 1 and levied assessments
commencing in Fiscal Year 2017/2018, and shall be known and referred to as:
Annexation No. L-96, for the Santa Clarita Streetlight Maintenance District No.1
(hereafter referred to "Annexation No. L-96"). The properties associated with and identified herein as
Annexation No. L-96 are shown on the Assessment Diagrams incorporated herein as Part D of this Report.

This Report has been prepared in connection with the annexation of parcels into SMD No. 1 for Fiscal Year
2017/2018, designated as Annexation No. L-96, pursuant to a resolution of the City Council and consists of
five (5) parts:
PART A — PLANS AND SPECIFICATIONS
Contains a description of the improvements to be maintained or serviced through SMD No. 1.
PART B — METHOD OF APPORTIONMENT
Describes the basis on which the costs have been apportioned to each parcel of land within SMD No. 1, in
proportion to the estimated benefits to be received.
PART C — ESTIMATE OF COST
Identifies the estimated cost of the services or maintenance to be provided through SMD No. 1, including
incidental costs and expenses in connection therewith.
PART D —ASSESSMENT DIAGRAM
Contains diagrams showing the existing exterior boundaries of SMD No. 1, which is coterminous with the
boundaries of the City of Santa Clarita, and the location and parcels that receive special benefits from the
streetlight improvements to be provided and maintained as part of Annexation No. L-96. The lines and
dimensions of each lot, parcel, and subdivision of land within Annexation No. L-96 are inclusive of all parcels
listed in Part E — Assessment Roll of this Report and the corresponding Los Angeles County Assessor's
Parcel Maps for said parcels as they existed at the time this Report was prepared and shall include all
subsequent subdivisions, lot -line adjustments, or parcel changes therein. Reference is hereby made to the
Los Angeles County Assessor's maps for a detailed description of the lines and dimensions of each lot and
parcel of land within Annexation No. L-96.
PART E —ASSESSMENT ROLL
Identifies the maximum assessment to be levied on each benefited lot or parcel of land within Annexation
No. L-96.

PART A — PLANS AND SPECIFICATIONS
IMPROVEMENTS AUTHORIZED BY THE 1972 ACT
As applicable or may be applicable to the District, the 1972 Act defines improvements to mean one or any
combination of the following:
The installation or construction of public lighting facilities.
The maintenance and/or servicing of any public lighting facilities.
The acquisition of any existing lighting improvement otherwise authorized pursuant to this section.
Incidental expenses associated with the lighting improvements which include, but are not limited to:
The cost of preparation of the report, including plans, specifications, estimates, diagram, and
assessment;
• The costs of printing, advertising, and the giving of published, posted, and mailed notices;
• Compensation payable to the county for collection of assessments;
• Compensation of any engineer or attorney employed to render services in the proceeding;
• Any other expenses incidental to the construction, installation, or maintenance and servicing of the
improvements;
• Any expenses incidental to the issuance of bonds or notes pursuant to Section 22662.5.
• Costs associated with any elections held for the approval of a new or increased assessment.
The 1972 Act defines "maintain" or "maintenance" to mean furnishing of services and materials for the
ordinary and usual maintenance, operation, and servicing of any improvement, including the repair, removal,
or replacement of all or any part of any lighting improvement.
DESCRIPTION OF IMPROVEMENTS TO BE MAINTAINED AND SERVICED
SMD No. 1 was established to collect funds to cover the expenses for energy and maintenance of a majority
of streetlights in the City. These costs are billed by the Southern California Edison Company for all
approximate 17,843 streetlights currently owned and maintained by Edison and all approximate 989
streetlights owned by the City. The proposed new and/or existing improvements for SMD No. 1 include, but
are not limited to, and may be generally described as follows:
• The installation of streetlighting, traffic signals, and other appurtenant facilities that are necessary for the
daily operation of said lighting located within City road rights-of-way. Installation covers all work
necessary for the installment or replacement of said lighting and all appurtenant work necessary to
complete said installation or replacement.
• The operation, maintenance, and servicing of all existing streetlighting, traffic signals, and other
appurtenant facilities necessary for the daily operation of said lighting located within City road rights-of-
way. Operation, maintenance, and servicing means all work necessary to maintain said lights in proper
operation including providing energy to operate the lights.

Plans and Specifications for the improvements for Streetlight Maintenance District No. 1 are voluminous and
not bound in this report but by this reference are incorporated and made a part of this report. The plans and
specifications are on file at the City where they are available for public inspection.
Locations of all streetlights for SMD No. 1 are included on lighting inventory maps available for inspection at
the City. The streetlight facilities in the vicinity and local proximity to parcels within Annexation No. L-96
generally include, but are not limited to public streetlight facilities on and in the vicinity of McBean Parkway,
Valencia Boulevard, Lyons Avenue, Orchard Village Road, Tournament Road and Golfview Drive.

PART B - METHOD OF APPORTIONMENT
The 1972 Act provides that assessments may be apportioned upon all assessable lots or parcels of land
within an assessment district or annexation in proportion to the estimated benefits to be received by each lot
or parcel from the improvements. In addition, the California Constitution Article XIII D requires a parcel's
assessment may not exceed the reasonable cost of the proportional special benefit conferred on that parcel.
Article XIII D further provides that only special benefits are assessable, and the City must separate the
general benefits from the special benefits conferred on a parcel. A special benefit is a particular and distinct
benefit over and above general benefits conferred on the public at large, including real property within the
district or annexation. The general enhancement of property value does not constitute a special benefit.
SPECIAL BENEFIT ANALYSIS
To determine the proportionate special benefit derived by each parcel, the proximity of the parcel to the public
improvements (detailed in Part A above), as well as the capital, maintenance, and operating costs, were
considered and analyzed. Due to the close proximity of the parcels to the improvements, it has been
demonstrated and determined the parcels within SMD No. 1 and within Annexation No. L-96 are uniquely
benefited by, receive a direct advantage from, and are conferred a particular and distinct special benefit over
and above general benefits by said public improvements.
Most of the streetlighting improvements were conditions of approval for the creation or development of the
parcels within SMD No. 1. In order to create or develop the parcels, the City required the original developers
to install and guarantee the maintenance of streetlighting and appurtenant facilities to serve the parcels.
Therefore, these parcels within the District could not have been developed in the absence of the installation
and promised maintenance of these facilities.
The proper maintenance of the streetlighting and appurtenant facilities specially benefit parcels within the
District including those parcels within Annexation No. L-96. The proper maintenance of the streetlighting and
appurtenant facilities reduces property -related crimes (especially vandalism) against properties in the District.
The streetlighting located in SMD No. 1 helps to visually join the various segments of the community, which
enhance property. In addition, all of the above mentioned improvements contribute to a specific enhancement
of the property value of each of the parcels within the District.
The benefit provided by streetlighting consists of safety for pedestrians and motorists living and owning
property in the District during the nighttime hours. This is a particular and distinct special benefit to all
developed parcels in the District.
Streetlights can be determined to be an integral part of streets as a permanent public improvement. One of
the principle purposes of fixed roadway lighting is to create a nighttime environment conducive to quick,
accurate, and comfortable seeing for the user of the facility. These factors, if attained, combine to improve
traffic safety and achieve efficient traffic movement. Fixed lighting can enable the motorist to see detail more
distinctly and to react safely toward roadway and traffic conditions present on or near the roadway.
Streets are constructed for the safe and convenient travel by vehicles and pedestrians. They also provide an
area for underground and overhead utilities.

Streetlights are installed on and are for street purposes, and are maintained and serviced for optimum use
of the streets as intended in their design. Assessments for the maintenance and servicing of streets may
include streetlights.
Streetlights are considered an integral part of the entire street, the same as curbs, gutters, pavement,
signage, and striping. They are the elements that provide a safe route for motorists and pedestrians.
Streetlights are installed to make streets safer.
Streetlights are installed to provide better visibility for drivers. One hundred percent (100%) of the illumination
from the lights is directed to the street, ninety percent (90%) on the street side of the curb and ten percent
(10%) behind the curb. The spacing of the lights is based on the speed of the vehicles and the natural ability
of the motorists' eyes to adjust to light and dark areas.
The systems of streets within the District are established to provide access to each parcel in the District.
Streetlights provide a safer street environment for owners of the parcels served. If the parcels were not
subdivided to individual parcels within the District, there would be no need for providing a system of streets
with safety lighting for the owners of the individual parcels.
The City has determined that streetlights are also an integral part of the quality of life within the City. This
quality of life is a special benefit to some degree to all parcels, except government owned parcels, including
easements, and flood channel parcels.
Therefore, the installation, operation, and maintenance of streetlights are for the express, special benefit of
the parcels within the District, including Annexation No. L-96.
GENERAL BENEFIT ANALYSIS
In addition to the special benefits received by the parcels within the proposed annexation, there are incidental
general benefits conferred by the improvements.
It is estimated the general benefit portion received from the improvements for any annexation is less than
one (1) percent of the total benefit. Nonetheless, the City has agreed to ensure that no property is assessed
in excess of the reasonable cost of the proportional special benefit conferred on that property.
The total benefits are thus a combination of the special benefits to the parcels within SMD No. 1 and the
general benefits to the public at large. The portion of the total streetlight maintenance costs which are
associated with general benefits will not be assessed to the parcels in SMD No. 1, but will be paid from other
City Funds. These general benefits are more than adequately offset by the substantial contribution from the
ad -valorem streetlighting assessment.
APPORTIONMENT
The following provides a summary of the proportional unit count, per parcel assignment, established for SMD
No. 1 for calculating each parcel's proportional special benefit assessment. This same method of
apportionment is applicable to Annexation No. L-96.

ninety-five percent (95%) are single-family homes or condominiums, and the remainders are duplexes,
triplexes, or apartments. In view of this and the benefits derived by the family unit, both at and in the proximity
of their property, a value of 1.00 has been assigned to the basic family unit or Equivalent Benefit Unit (EBU),
i.e. the single-family home or condominium. The existing District includes some developed properties that
may not actually have streetlights in their block, but which do receive a neighborhood benefit from the lights
in the area. These properties were also included in the District. Therefore, a weighted value of 0.50 was given
to People Use, while Security and Intensity were each assigned a weighted value of 0.25 to form the basic
unit (1.00 EBU). Parcels in other land use categories were assigned weighted values by comparison with this
basic EBU.
In the remainder of the residential category, which is comprised of multiple rental type properties, the
weighted value for Intensity would remain at 0.25, but the other two items would increase in proportion to the
number of family dwelling units on the parcel. For example, a duplex was assigned 1.00 for People Use, 0.50
for Security, and 0.25 for Intensity for a total of 1.75 EBU's. The owner of such property would therefore pay
1.75 times as much for lighting as the owner of a single-family unit. In consideration of the distance some
units would be from the lighted roadway, Security in the residential category would not be increased beyond
a weighted value of 1.00. Thus, a 5 -unit apartment would be assigned 2.50 for People Use, 1.00 for Security,
and 0.25 for Intensity for a total of 3.75 EBU's. As the number of apartments on a parcel increases, the
service charge units assigned for people would follow a declining scale.

NON-RESIDENTIAL PARCELS
The non-residential lots or parcels are separated into 38 land use categories as determined by the County
Assessor. Equivalent Benefit Units (EBU's) are assigned on the basis of average benefits for different groups
of land uses, Groups A -K. Properties within the 10 land use categories in Group K varied widely; therefore,
these lots or parcels were considered on an individual basis. The total number of EBU's determined for Group
K is based on the lot or parcel area as shown in the table below. A minimum of 3.00 EBU's would be assessed
to each lot or parcel to be compatible with Group D, which contains many of the smaller business categories.
Several large lots or parcels in outlying areas within the existing lighting District have no lights in the
immediate proximity and therefore those lots or parcels would be assessed the minimum amount.
Since benefits have been related to property use, no charge would be assessed on vacant parcels within
SMD No. 1.

EXEMPT PARCELS
The following are exempt from the assessment: areas of streets, avenues, lanes, roads, drives, courts, alleys,
public easements, rights-of-way, and parkways. Also exempt are utility rights-of-way used exclusively for
utility transmission, common areas (such as in condominium complexes), land dedicated as open space or
parks, landlocked parcels, and small parcels vacated by the City, as these parcels do not benefit from the
improvements.
ASSESSMENT RATE
The SMD No. 1 maximum assessment rate approved for Fiscal Year 2016/2017 was $77.34 per equivalent
benefit unit (per EBU). This maximum assessment rate may increase each fiscal year based on the annual
change in the Consumer Price Index (CPI), during the preceding year, for All Urban Consumers, for the Los
Angeles, Riverside, and Orange County areas, published by the United States Department of Labor, Bureau
of Labor Statistics (or a reasonably equivalent index should the stated index be discontinued). This maximum
assessment rate and annual CPI increase to the maximum assessment rate shall be applied to the
assessments established for Annexation No. L-96.
For purposes of this Report and the balloting of property owners within Annexation No. L-96, the Fiscal Year
2016/2017 maximum assessment rate of $77.34 has been utilized for the calculation of the proportional
special benefit assessment for each parcel and the amounts to be balloted. Ultimately, the maximum
assessment rate approved for Fiscal Year 2017/2018 (the first year the parcels are to be assessed as part
of Annexation No. L-96) is subject to the annual change in the Consumer Price Index (CPI) adjustment and
the assessment rate authorized by the City Council when the Fiscal Year 2017/2018 assessments rates for
SMD No. 1 are adopted as part of the annual assessment process for SMD No. 1.

PART C -ESTIMATED COST OF THE IMPROVEMENTS
The 1972 Act provides that the estimated costs of the improvements shall include the total cost of the
improvements, including incidental expenses, which may include reserves to operate the District until funds
are collected on the County tax rolls and are transferred to the City from the County around December 10 of
the current fiscal year.
The 1972 Act also provides that the amount of any surplus, deficit, or contribution be included in the estimated
cost of improvements. The net amount to be assessed on the lots or parcels within SMD No. 1 is the total
cost of installation, maintenance, and servicing with adjustments either positive or negative for reserves,
surpluses, deficits, and/or contributions.
The estimated annual improvement costs for SMD No. 1 including Annexation No. L-96, are voluminous and
not bound in this report, but by reference are incorporated and made a part of this report. The estimated
costs are on file at the City where they are available for public inspection.

PART E -ASSESSMENT ROLL
All assessed lots or parcels of real property within Annexation No. L-96 are listed on the assessment roll
below. Each parcel's corresponding Balloted Maximum Assessment is based on the parcel's proposed land
use and the maximum assessment rate for Fiscal Year 2016/2017 ($77.34). The balloted maximum
assessments are subject to the annual CPI adjustment and therefore, the maximum assessment rate and
applied assessments for each parcel within Annexation No. L-96 in Fiscal Year 2017/2018 (first fiscal year
the parcels will be assessed) will likely be greater than the Balloted Maximum Assessments indicated below.
Both the maximum assessment rate and the applied assessment rate for Fiscal Year 2017/2018 will be
finalized and adopted by the City Council, after the public hearing for the annual levy and collection of SMD
No. 1 assessments for Fiscal Year 2017/2018.
The maximum assessment rate for SMD No. 1 and the calculated proportional assessment amount for each
parcel, including Annexation No. L-96 as established herein, includes an annual inflationary adjustment
(yearly increase) based upon the percentage increase in the Consumer Price Index for All Urban Consumers,
for the Los Angeles, Riverside, Orange County areas (CPI), as determined by the United States Department
of Labor, Bureau of Labor Statistics, or its successor. Each fiscal year, the assessment engineer shall
compute the percentage difference between the CPI of the current year and the CPI for the previous year,
and shall then adjust the existing maximum assessment rate by the increase in this percentage for the
upcoming fiscal year. Should the Bureau of Labor Statistics revise such index or discontinue the preparation
of such index, the engineer shall use the revised index or a comparable system as approved by the City
Council for determining fluctuations in the cost of living. The assessment rate applied in any one fiscal year
will not exceed this adjusted maximum assessment rate.
