Gould RECOMMENDED ACTION City Council: 1. Approve the purchase of 78+/- acres of real property in the Castaic area, Assessor's Parcel Nos. 2865-021-009, 014, and 019 at a total cost of $350,430, which includes escrow, title, appraisal fees, due diligence costs, survey and trail improvements, and annual property taxes. 2. Appropriate $326,930 for escrow, title appraisal fees, and due diligence costs associated with the acquisition from the Open Space Preservation District Fund Balance (Fund 358) to Open Space Preservation District Expenditure Account 12592-5201.004. 3. Appropriate $20,000 from Open Space Preservation District Fund Balance (Fund 358) to Open Space Preservation District Expenditure Account 12592-5201.008 for the purpose of property improvements, including signage, gates, and construction of a trailhead. 4. Appropriate $3,500 as an on-going annual expenditure from Open Space Preservation District Fund Balance (Fund 358) to Open Space Preservation District Expenditure Account 12592-5185.003 for the payment of annual property taxes. 5. Authorize the City Manager, or designee, to execute all documents, subject to City Attorney approval, contingent upon the appropriation of funds by the City Council in the annual budget for such fiscal year. BACKGROUND The subject property is in the Tapia Canyon area, near Castaic, and is contiguous to open space Page 1 PacketPg. 79 as conceptualized in the proposed Tapia Canyon Ranch development and final phase of the Tesoro Ranch development. The subject parcels would be the first acquisition in the northwestern quadrant of the greenbelt, enhancing opportunities for connecting regional open space and trails, both existing and proposed. These parcels are within the Castaic Area Multi - Use Trails Plan Study Area and the Santa Felicia Significant Ecological Area (SEA). In 2016, City staff was contacted by the representative for the property owner, seeking to sell excess land not necessary to the current oil production facility located on the property. The purchase price of the property is $306,930. Closing costs, which include escrow, title, appraisal fees, and due diligence costs are estimated at $20,000. Costs for survey and trail improvements are estimated at $20,000, for a total cost of $346,930, and with the on-going appropriation of $3,500 annually for property taxes, the total requested appropriation is $350,430. This acquisition is in compliance with the mission of the Open Space Preservation District. It has been reviewed pursuant to the California Environmental Quality Act (CEQA) and is exempt under CEQA guidelines Section 15313, Class 13, as an acquisition for conservation purposes, and Section 15325, Class 25, as a transfer of an ownership interest in land to preserve open space and existing natural conditions. Any subsequent or proposed changes in the use or condition of the property will be subject to CEQA guidelines. ALTERNATIVE ACTION 1. Direct staff to cease purchase of the property. 2. Other action as determined by the City Council. FISCAL IMPACT Upon approval of the recommended action, the budget will be adjusted accordingly.
