RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA CLARITA, CALIFORNIA, CALLING FOR AN ASSESSMENT BALLOT
PROCEDURE AND SETTING A DATE FOR A PUBLIC HEARING FOR FORMING A
WASTEWATER STANDBY DISTRICT AND FIXING STANDBY CHARGES
(VISTA CANYON)
WHEREAS, wastewater service for the Vista Canyon development is proposed to be
provided by a wastewater collection and treatment system that serves the Vista Canyon
development and Assessor's Parcel Number 2840-004-009. Documents more fully describing
the wastewater facilities are on file with the City of Santa Clarita (City) and are incorporated
herein by reference; and
WHEREAS, the City has caused an engineer's report for the proposed standby charge
to be prepared. Said report details, among other things, the total amount of the standby charge to
be assessed in the Vista Canyon development, the amount chargeable to each parcel that will be
benefitted by the wastewater facilities, and the basis for which the charges were calculated. The
engineer's report is on file with the City and is incorporated herein by refcren.ce; and
WHEREAS, the wastewater standby charge is proposed to be imposed on parcels
until such time as the parcels become developed and a certificate of occupancy has been issued;
whereupon, a wastewater user service fee will be collected in place of the standby charge for
subsequent years. The standby charge is proposed to be assigned to each parcel by Equivalent
Benefit Unit (EBU). The EBU method is more fully detailed in the engineer's report; and,
WHEREAS, the wastewater standby charge is proposed to be imposed by the City
pursuant to Health and Safety Code Section 5470, and Article XIIID of the State Constitution.
NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby
resolve as follows:
SECTION 1. The above recitals are true and correct, and the City so finds and
determines.
SECTION 2. A public hearing on the establishment of the standby charges shall be
held on Tuesday, November 28, 2017, at 6:00 o'clock p.m., or as soon thereafter as practicable,
at the City of Santa Clarita Council Chambers, 23920 Valencia Boulevard, Santa Clarita,
California 91355.
SECTION 3. At the time and place set forth above for the public hearing, any
interested person may appear and be heard. The City Council will hear and consider all protests,
whether written or verbal.
SECTION 4. At the close of the public hearing, all returned assessment ballots will be
tabulated and the results announced. In the absence of a majority protest, the City Council may
authorize the standby charges.
SECTION 5. The City Clerk shall certify to the adoption of this Resolution.
