Award the design contract to Anderson Penna for the McBean Parkway Median Realignment, Project S 1047, in the amount of $272,696 and authorize a contingency in the amount of $27,270 for atotal contract amount of $299,966. 2. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval. BACKGROUND This proposed McBean Parkway Median Realignment project will design the realignment of the existing median on McBean Parkway, west of Orchard Village Road, and will include street improvements along the frontage of Henry Mayo Newhall Hospital. It will also resurface pavement on McBean Parkway in both directions. This work was funded as part of the Henry Mayo Hospital Master Plan. This project supports the Building and Creating Community theme of the Santa Clarita 2020 plan. A Request for Proposal (RFP) for design was issued on April 3, 2017. The RFP asked firms to identify their relevant experience with similar projects and demonstrate their approach for this design project. On April 27, 2017, four firms submitted proposals to the City of Santa Clarita (City). Staff reviewed the proposals and scored the firms on a 100 -point scale. The scoring system was based on understanding of the following: required scope of the work; Page 1 PacketPg. 37 key development items; potential issues and resolutions; the consultant's previous experience on similar projects and experience working with the City; qualifications of the project team and their resources; and organization of the proposal. Based on their design experience on previous City projects and the completeness of their proposal for this project, staff recommends the City Council award the design contract to Anderson Penna. The request contingency of $27,270 will cover costs for additional design efforts due to unforeseen conditions or conflicts uncovered during potholing and any requested scope changes to the project. California Government Code 4526 prescibes selection of architectural and engineering services to be based on demonstrated competence and professional qualifications necessary for the satisfactory performance of the services required and does not authorize the selection of professional architect and engineering services based on cost. ALTERNATIVE ACTION Other action as determined by the City Council. FISCAL IMPACT Adequate funds were appropriated as part of the Fiscal Year 2017-18 budget in expenditure account S1047306-5161.001 (Developer Fees) to support the recommended action. (APP) appreciates this opportunity to present our proposal for this project. APP has established a significant presence in Los Angeles County completing municipal public works engineering projects for numerous agencies. Moreover, APP's design experience on arterial roadway median and rehabilitation projects makes us a perfect fit for the design of the McBean Parkway Median Realignment Project. One of APP's discriminating factors is our desire to understand the project issues at the proposal level, so that we can provide the appropriate personnel and level of effort and so that surprises are eliminated or minimized during the design process. For this specific proposal, our effort has included: Review of the HenryMayo Spedfic Plan. Review of the City's Pavement Preservation Program and Median Landscaping in Santa Clarita. Review of the conceptual realignment plans for McBean Parkway. Detailed field reviews focusing on median geometry, landscaping and impacts to private property. Review of the existing infrastructure maps. As a result, we have identified several preliminary key design ideas which will enhance the design. Chris Bretall, PE, will serve as Project Manager and the City's single point -of -contact. He is responsible for day-to-day management of the project. Chris has nearly 30 years of experience in the design and management of transportation projects, including many with the City of Santa Clarita. As requested in the RFP, our proposal is a firm offer for a 90 -day period, and the proposed work will be performed at a "not - to -exceed" price. We have reviewed the City's professional services agreement (Exhibit 2) and deem it acceptable. We also acknowledge receipt of Addendum 1, dated April 20, 2017, and have provided a signed copy in the Appendix of our proposal. Introduction Project Understanding McBean Parkway is a major six -lane arterial highway in the City of Santa Clarita that extends from Interstate 5 (1-5) on the west to Copper Hill Drive on the east with a posted speed limit of45 mph within the project limits. The project site is located approximately one mile east of the 1-5 Freeway and is adjacent to Henry Mayo Newhall Hospital. The project extends from 1200' feet west of Orchard Village Road to Avenida Navarre, a total project length of 2400'. As a condition of approval of the expansion of Henry Mayo Newhall Hospital campus, the hospital is responsible forthe dedication of right-of-way to the City along the frontage of McBean Parkway and for constructing various public street improvements including: 1) New bus turnout for westbound McBean Parkway, west of Avenida Navarre 2) Lengthen eastbound left turn pocket at McBean Parkway/Avenida Navarre 3) Lengthen northbound left turn pocket at McBean Parkway/Orchard Village Road 4) Widen southbound approach at the main hospital entrance to allow for exclusive left and right turn lanes 5) Install new traffic signal at McBean Parkway/Orchard Village Road 6) New westbound right turn lane at McBean Parkway/Orchard Village Road 7) Modify eastbound and westbound raised medians at McBean Parkway/Orchard Village Road to accommodate improvements 3) through 6) above 8) New Driveway along the north side of McBean Parkway approximately 800' west of Orchard Village Road 9) New westbound bus turnout/right turn pocket at New Driveway 10) Modify eastbound raised median at McBean Parkway/New Driveway Although shown on the Conceptual McBean Parkway Realignment Exhibit as proposed improvements, Items 1) through 6) have been recently constructed. To complete the remaining improvements, the hospital has provided an in -lieu fee to the City of Santa Clarita forthe design and construction of Items 7) though 10). The project requires both engineering and landscape architecture services and includes pavement rehabilitation for McBean Parkway throughout the project limits (Avenida Navarre to west of New Driveway). The scope ofworkwill include preparation of an updated concept plan, final plans, technical specifications and estimate (PS&E) forthe proposed street improvements. Project construction elements will include: curbs, gutters, drive approaches and sidewalks; rehabilitation of asphalt pavement, relocation of utilities, as necessary; median island landscaping, catch basin/storm drain reconstruction, the replacement of striping, pavement markings and signage, replacement of detector loops, and adjusting utilities to grade. Existing Conditions Based on our review of the project site and review of available documents, we have identified the following existing conditions within the project limits: 2 1 P a g e ANDERSON • PENNA Professional Services for Preparation of Landscape Plans, Specifications and Estimates for the McBean Parkway Median Alignment Project 51047 Wheelchair Ramps Several wheelchair ramps within the project limits that have been recently constructed appear to be ADA compliant. The ramp at the southeast corner of McBean/Orchard Village does not meet current ADA standards. Utilities Storm Drain An existing storm drain located on the west side of Orchard Village Road begins at the intersection of McBean Parkway. The existing 21' catch basin located at the northwest corner of McBean Parkway/Orchard Village Road will require reconstruction for this project. Water Relocation/adjustment of existing fire hydrants, valves and appurtenant facilitieswill be coordinated with the Valencia Water Company who provides water service in this area of the City. Sewer Existing public sewers within the project limits are maintained by the Los Angeles County Department of Public Works Consolidated Sewer Maintenance District and the City of Santa Clarita. Adjusting manholes to grade will be required as part of the project work. Electrical/Telephone Southern California Edison provides electrical facilities within the project area: underground 16 -kilovolt lines and street lighting. An existing vault/vents and the street lighting will be impacted by the proposed widening along the north side of McBean Parkway. There is also existing underground telephone conduit in the sidewalk. The existing access manhole will require adjustment in the area to be widened. Natural Gas The Southern California Gas Company operates a 6 -inch medium -pressure gas main in McBean Parkway and a 4 -inch medium -pressure gas main in Orchard Village Road, terminating at McBean Parkway. Adjusting of existing valve coverswill be required. Below is a summary of anticipated utility impacts (relocations/adjustments): • Fire hydrants/Fire Department Connection • Water vaults/valves • UG Tel manholes/vaults • Streetlights • UG electrical/vents • Sewer MH's • SCE vault/vents • Gasvalves • Cable TV vaults/Pull Boxes 3 1 P a g e /i ANDERSON • PENNA Professional Services for Preparation of Landscape Plans, Specifications and Estimates for the McBean Parkway Median Alignment Project 51047 Median Landscaping The shrub/ground cover areas within the existing raised medians have been allowed to go fallow in keeping with the statewide drought restrictions. Mature trees within the median have overgrown root structures that are encroaching into the curb areas. Our design will take this situation into account to minimize impacts to these trees. Pavement McBean Parkway pavement is in varying states of distress including edge failures, reflective cracking, alligator cracking and surface striping cracking will require rehabilitation and potentially reconstruction in some locations. Key Issues In addition to the following issues, refer to Figure 2. Project Issues Map on the following page. Raised Median Design/Geometry Betore the tinaI design can move torward, the locations and layout for the proposed medians need to be finalized. This requires the development of a final median concept plan. As part of our review of the current concept plan, we have run turning templates. For the intersection of McBean/Orchard Village, a WB -50 semitrailer was used for all movements and it appears the current geometry will work forth is vehicle. The new driveway on the north side of McBean Parkway should be designed to accommodate a smaller single unit truck. The realignment of the raised medians may create design issues thatwill be reviewed during the preparation of the conceptual plan: • Drainage patterns may be impacted and must be reviewed to ensure no low points are created • The proposed location of the median noses at McBean/Orchard Village creates an offset through the intersection. The intersection geometry, including nose widths, will be reviewed to determine if this condition can be improved. • The proposed median opening at the new proposed new driveway along the north side of McBean Parkway is designed to accommodate left-in/right-out movements only. However, the proposed geometry at the end of the median as shown on the concept plan needs to be modify to discourage left turns out. See Figure 1. Median Modification The median opening at the new proposed new driveway will be designed to meet the City's Median Landscaping Guidelines for sight distance (sight triangle) for a 55 -mph design speed. The existing spray irrigation system within the medians will be demolished to allow for construction of anew system that meets the current City LMD design Guidelines as well as State regulations forth@ use of reclaimed water. The existing water meters, point of connection equipment, mainline and roadway crossing conduit will be assessed for protection, demolition, or re -use. Testing of the sub -grade early on during the Preliminary Investigation phase will be used to define how the sub -grade in the planted medians will be treated to ensure permeability in the planted section through the implementation of a sump or similar EPA compliant solution. To minimize the detrimental impact to the existing trees we envision that the existing grading condition will remain. This condition is a gentle crown with the root zone ofthe existing trees sitting slightly above top of curb. In reviewing the existing trees and available space we would not recommend to the City that a gentle Swale be provided due to the undulation in landform and the creation of localized depressions. It wil I also be important to protect the raised root crown ofthe existing trees where new median curb is being constructed. The existing medians include stamped and colored concrete that do not meet the most recent City Standard to provide decorative concrete pavers within newly constructed medians. It is anticipated that the existing stamped concrete will be removed and replaced with decorative concrete pavers meeting the City LMD Guidelines for Medians Design. The overall planting areas ofthe medians will be slightly expanded, allowing for implementation ofthe standard median shrub planting design. The median on Orchard Village Road is already being upgraded to incorporate decorative concrete unit pavers as part of a separate project now under design. In addition, this median is also being replanted and irrigated as part of that separate project. Therefore, we do not anticipate the median on Orchard Village being updated as part ofthis project. However, we anticipate all medians on McBean within project limits receiving upgraded landscaping and decorative concrete unit pavers. Pavement Rehabilitation The City has requested that non-destructive pavement evaluation be performed. However, it has been our experience that deflection testing can often provide recommendations that are not economically feasible. Because of our extensive experience in pavement rehabilitation projects, APP excels at evaluating and considering refinements to the recommendations in pavement reports to develop economical rehabilitation strategies and is an industry leader in the design and implementation of cost effective pavement rehabilitation strategies including cold -in-place recycling, full depth recycling and maintaining the existing aggregate base in place. In conjunction with the pavement evaluation report, we will explore options and provide the City with the best pavement solutions to maximize its budget. Depending on the application, these pavement alternatives can reduce paving costs up to SO percent or more overtraditiona I paving methods: • Full depth reclamation of the existing asphalt section • Reconstruction of asphalt over recompacted existing aggregate base • In-place cold recycling of exiting asphalt Traffic Signal Design Based on our review of the project site and the proposed geometry, a preliminary analysis of the signal mast arm lengths and vehicle head locations for east and westbound is as follows: Westbound: The new signal mast arm length and vehicle heads recently installed forwestbound trafficwill align the heads correctly with the new lane alignment.A second westbound through vehicle head should be added to the signal mast arm on the unused pipe tenon. 6lPage ANDERSON - PENNA Professional Services for Preparation of Landscape Plans, Specifications and Estimates for the McBean Parkway Median Alignment Project 51047 Eastbound: The existing signal mast arm length will be approximately 10' short of the center of the new left -turn pocket and vehicle head locations for eastbound traffic will not properly align with the new lane alignment. Most likely a second eastbound through vehicle head could not be added to the existing signal mast arm because the head location would be incorrect and the mast arm loading may preclude it. As a result, a traffic signal modification plan for McBean Parkway at Orchard Village Road will be required to install a new Caltrans 29-5-100 signal pole with a 50' signal mast arm for eastbound traffic. The new signal pole/signal mast arm is necessary to align the vehicle heads with the new lane alignment. A second through vehicle head will also be added to the signal mast arms for both the east and westbound directions to increase visibility for the third travel lane, and the existing video detection zones will be realigned to the new lane alignments. An alternative to replacing the signal pole/signal mast arm for eastbound traffic that will be explored with the City is installing a programmed visibility head for the eastbound left -turn with head programmed and angled towards the left turn lane; however, with this alternative the through vehicle head will not align with the through travel lanes. The preferred method of installing the new signal pole/signal mast arm is to install it next to the existing signal pole to maintain the existing signal operation until the cutover to the new signal equipment. This approach assumes that there is enough room for the new foundation and that there are no underground conflicts. To avoid costly delays and the re -ordering of the signal pole/signal mast arm, potholing is advised in these situations to verify the existing conditions and location of utilities before ordering the signal pole/signal mast arm. Another method of installing the new signal pole/signal mast arm is to install it in the same place as the existing signal pole/signal mast arm. The existing signal pole/signal mast arm would require removal, which means installing temporary traffic signal equipment to maintain the existing operation of the traffic signal. For the McBean Parkway/Orchard Village Road traffic signal this would involve the use of a temporary wood pole and span wire to position the vehicle heads during the signal construction. This method is not preferred as it increases the overall project costs. McBean Parkway Widening The proposed widening on the north side of McBean Parkway will impact the frontage of the adjacent medical building complex. Although the right-of-way has been dedicated by the property owner, there will be impacts to landscaping, signage, utilities, pedestrian access and parking. We have assumed that the design will be limited to joining the adjacent property and that no reconfiguration of the parking lots will required. Based on our site visit, it appears the Fire Department Connection near the Hospital Entrance may be within the proposed right-of-way. Work Statement Task 1: Preliminary Investigation Subtask 1.1 Research A thorough search ofthe available records will be conducted to acquire relevant data to assist in the design ofthe project. The information accumulated will include as -built drawings, utility information, and horizontal and vertical control data. APP staff has already assembled some of this information in the preparation ofthe proposal. Subtask 1.2 Field Review The Project Teamwill reviewthe project inthefield to evaluate existing conditions, including damaged concrete improvements, and take photographs of potential problem areas or items that need special attention. The photographs will be filed in photo albums. The albums serve as a constant reference during design and are invaluable when discussing issues at meetings. As a part ofthe field review, key existing surface topographical features perthe survey data will be verified. Any discrepancies will be noted and resolved with the surveyor. Subtask 1.3 Utility Coordination Utility research and notification will consist ofthe following tasks: • Transmit lettersto utility companies notifying them ofthe project and to receive plans of existing utility facilities. • Obtain plans showing location and size of all utility lines and appurtenances within the project area. • Plot utilities on base map. • Cross-check plotted locations above with field review information to verify that existing lines are shown in the proper location. • Coordinate with utility owners to determine potential conflicts and identify potholing locations, if needed. • Upon completion of preliminary construction plans, which will show all existing underground and overhead utilities, transmit to each utility company to verify location of utility facilities and coordinate relocation of facilities affected by the project. • Upon approval ofthe final construction plans, transmit to each utility company having facilities inthe project area. The letterwill identify anticipated bid dates, start of construction and whetherthe facilities will require relocation priorto or in conjunction with the construction ofthe project. Coordination with the utilitieswill continue throughout the design ofthe project. Notices will besenttoall franchise utilities thatwill be impacted bythe project, requesting the relocation and/or adjustment ofthe pertinent facilities. Required relocations/adjustments will also be noted in the project specifications so that the Contractor will be aware of utility work to be done by others. Relocation plans of affected facilities will be prepared by the respective utility company and coordinated with the project plans. The adjustment/relocation offacilities such as manhole/va Ive covers, fire hydrants, water meters and water lines will be shown on the plans a nd/or addressed in the specia I provisions. Subtask 1.4 Design Survey Aerial Mapping We will set Aerial Control Panels and provide horizontal and vertical control. The project datums will be California State Coordinate System and Benchma rk Network NAD 1983 (2011.00 Epoch) for the Horizontal Datum and NAVD 1988 for the Vertical Datum. Planimetric mapping will be produced at a sca le of 1"=20'. This level of mapping will show basic street features. Any features not picked up on the aerial photos will be supplemented and identified during the ground survey and field review. lglpage ANDERSON . The grou nd surveys will include shots on all BCR's, ECR'S, driveways, curb drains, a nd a II visible utilities. The survey shall NOT include the Standard monumentation and record mapping requirements (Record of Survey) of the California Professional Land Su rveyor's Ad. Subtask 1.5 Pavement Analysis Pavement Coring and Soil Boring Pavement coring of the in-situ roadway materials shall be performed to determine pavement thicknesses and to obtain samples of the alpha It concrete, aggregate base (if present), a nd subgrade materials forfurther analysis. • A total often (10) pavement coring and subsurface sampling locations will be performed at pre -selected locations throughout the roadway segment, within all travel lanes, to determine the thickness ofthe existing structural section. Borings extend to a maximum four (4') foot depth from finish surface. Sample locations will be backfilled and patched with asphalt concrete, per City requirements. • Pavement cores, aggregate base (where present) a nd subsurface soils shall be la beled and transport back to our lab forfu rther a nalysis. • Underground Service Alert (USA Dig -Alert) will be notified and a meeting held, if requested, with concerned utilities to relocate test sites as necessary. Sample locations will be backfilled and patched with asphalt concrete, per City requirements. • Traffic Control shall be provided perWATCH standards. Laboratory Testing Subgrade soil samples taken in the field will be identified, labeled and measured during the sampling process. Evaluation of the present pavement thicknesses utilizing component analysis with R -value data will be combined with future traffic estimates (Traffic Index provided by Client) for design and development of suitable, alterative replacement sections. The following laboratory tests will be performed: • Moisture Content • R -Value In -Place Strength Testing/Deflection Testing As requested in the RFP, in-place deflection testing will be performed. Non -Destructive Pavement Deflection (CA 3S6) data shall be gathered from each existing traveled lane on each roadway segment at specific testing intervals using the 11LS Falling Weight Deflectometer, imposing a series of 9,000 pound loads per California Test Method 3S6. • Data obtained will include ten (10) sensor readings recorded withinthe deflection basin at eachtest point. During deflection testing operations, notes of visual pavement conditions and/or distress, cross streets, presence or absence of curb and gutter, and other such observations shall be logged. Correlating data will include pavement temperature and GPS documentation at each test location. • Data Analysis shall provide a typed tabulation of all deflection measurements and field notes locating cross streets, pertinent landmarks, field conditions, etc shall be included within the final report. The tabulation shall includethe reading of all sensors, aswell as an equivalent Traveling Deflectometerdeflection atthe loading point. • An engineering review oftest data to isolate orselparate limits of similar deflection response for statistical summary of data (providing the 80th percentile deflection) shall be performed. • Professional Traffic Control shall be provided perWATCH standards. 191Page ANDERSON . PENNA Professional Services for Preparation of Landscape Plans, Specifications and Estimates for the McBean Parkway Median Alignment Project 51047 Visual Site Evaluations A site evaluation of all asphalt concrete segments will be performed and pavement conditions recorded forth@ purposes of compiling the recommendation plan(s) and report. Compare field conditions with measured pavement strengths determined during deflection testing. Comparefield conditions with thickness data obtained during core sampling. Compare field cond itions with component analysis based on laboratory subgrade strength testing. Structural Design Alternatives A Registered Civil Engineer shall supervise all operations and incorporate results of materials testing with observed pavement conditions. Engineered recommendations for alternate methods of pavement rehabilitation and reconstruction shall be based upon the California Hig hway Design Manual for Flexible Pavement a nd Roadway Rehabilitation. Final Pavement Evaluation Report The final pavement structural investigation report shall include all data developed during the investigation with design rehabilitation alternatives; structural replacement sections for areas of reconstruction, in place strength testing data a nd field and la boratory test data. The recommendations shall be within the guidelines presented in the Citys Five VearPavement Preservation Plan. All services will be supervised by the Civil Engineer specializing in the evaluation and design of pavement systems and Registered in the State of California. Subtask 1.6 Potholina We have included the potholing of 10 locations to determine the depth and location of critica I utilities including underground irrigation sleeves. Subtask 1.7 Soils Testina Soils testing will be performed within the existing medians at 6locations determined by the City a nd PCLD during the initial Site Investigation. We anticipate one 3.S -inch diameter hand auger boring will be advanced within the existing planter areas without the need to core through concrete. All borings will be adva nced to depths of approximately S feet, and logged by the soil scientist. Core samples of the soils that are encountered will be obtained from each boring at depths of 24 and 60 inches below existing grade. Borings will be backfilled with cuttings generated during the excavation process. Testing will include approximately 12 (i.e. 2 per boring) measurements of in-situ density and moisture content (to help determine whether soils are native or previously compacted fill materials), and approximately 6 (i.e. one per boring) short hydrometer tests (to determine clay contents for correlation with permeability characteristics). 6 sa mples will be processed for nutrient analysis agronomic testing. The scope ofthe median planter area coring is based on the City requested data to be gathered on the soil su bgrade. It is anticipated that this scope item will be reviewed with the City PM at the Project Kick-off meeting and assessed during the initial site visit to determine if the number of testing locations ca n be reduced. Agronomic/soils permeability report • Survey data Task 2: Project Management The keyto ourapproachto management is based upon a single point of authority, the Project Manager, who is responsible for all aspects ofthe project. A project schedule will be prepared using Microsoft Project. After approval of the schedule by the City, it will be updated periodically to reflect progress and to facilitate early identification of problem areas. The project budget will be closely monitored at the task and Subtask level to identify problems early and ensure effective use of resources. In addition, a project - specific quality control plan will be prepared. Subtask 2.2 Meetings Conduct kick-off meeting with City staff to review previously prepared project documents, scope of work and project schedule. Points of contact and project assignments/responsibilities will also be discussed. In additiontothe kick-off meeting, APP staffwill attend monthly PDT coordination meetings throughout the duration ofthe project. It assumed two APP staff (Project Manager and Project Engineer) will attend these meetings. Subtask 2.3 Progress Reports Progress reports will be prepared and submitted monthlywith a narrative describing the work accomplished during the reporting period, summary of meetings held, discussion of outstanding issues, and action items. The reports will also include updated progress schedules, comparisons ofactual versus planned expenditures, and any concerns orsignificant problemswith recommendations for corrective actions. The progress reports will correspond to the accounting cycles used for the preparation of invoices to faci I itate project oversight. Task 2.4 Ouality Assurance/Quality Control (OA/00 Quality control will bean ongoing taskthroughout the duration of the project. The initial effort will be in the development of a project specific checklist that will establish specifictasks that need to be accomplished, the estimated completion date and a signature blockfor the project managerto sign that the task has been completed and reviewed. The survey information collected during Subtask 1.4 will be used as the base map. The concept plan will include the horizontal alignment of the roadway and median islands. The concept plan will show all proposed median openings, including storage lengths forth@ leftturn lanes. Subtask 3.2 Preliminary Design (60%) Using the revised concept plan as abase, improvement plans will be prepared and will include the following disciplines: Subtask 3.2.1 Street Improvements Based on the approved concept plan, street rehabilitation/median planswill be prepared. Based on the proposed pavement rehabilitation strategy, the proposed roadway cross -falls will be evaluated to ensure that they are within an acceptable range. Using the preliminary alignment plan as a base, prepare roadway improvement plans at a scale of 1" = 20' and a vertical scale of 1"= 4'. These plans will include the following information: • Pavement reconstruction/rehabilitation • Profiles showing proposed top of curb and crown elevations, • Curb and gutter/median construction • Improvements to private property • Existing utilities and adjustments • Typical sections and construction details • Sidewalks, driveways and wheelchair ramps • Final design cross sections showing proposed finished surfaces, crossfalls and top of curb elevationswill be prepared butwill not be a part of the final Bid Documents Subtask 3.2.2 Traffic ADVANTEC will prepare the following plans: • Signing and Striping at a scale of 1" = 40' • Lighting Relocation at a scale of 1"=40' • Traffic Signal and Intersection Lighting at a scale of 1" =20' • Stage Construction/traffic Handling at a scale of 1"=40' We have assumed that temporary traffic signal planswill not be required. Subtask3.2.3 Drainage Based on the information gathered during the proposal preparation, there is an existing storm drain in Orchard Village Road. The upstream end of this system terminates at McBean Parkway. Due to the widening on the north side of McBean Parkway, an existing 21'wide catch basin will require reconstruction. We have assumed that the net increase in impervious area will be negligible and that preparation of hydrology and hydraulic calculations will not be required. The waiver applies only to the person or organization designated in such contract. N. UNINTENTIONAL ERRORS OR OMISSIONS The following is added to Paragraph B.2., Con- cealment, Misrepresentation, Or Fraud, of SECTION IV — BUSINESS AUTO CONDITIONS: The unintentional omission of, or unintentional error in, any information given by you shall not prejudice your rights under this insurance. PLEASE READ IT CAREFULLY BLANKET ADDITIONAL INSURED (ARCHITECT, ENGINEERS AND SURVEYORS) This endorsement modifies insurance provided under the following: COMMERCIAL GENERAL LIABILITY COVERAGE PART A. The following is added to WHO IS AN INSURED (SECTION II): Any person or organization that you agree in a "contract or agreement requiring insurance" to include as an additional insured on this Coverage Part, but only with respect to liability for "bodily injury", "property damage" or "personal injury" caused, in whole or in part, by your acts or omissions or the acts or omissions of those acting on your behalf: a. In the performance of your ongoing operations, b. In connection with premises owned by or rented to you, or c. In connection with "your work" and included within the "products -completed operations hazard". Such person or organization does not qualify as an additional insured for "bodily injury", "property damage" or "personal injury" for which that person or organization has assumed liability in a contract or agreement. The insurance provided to such additional insured is limited as follows: d. This insurance does not apply on any basis to any person or organization for which coverage as an additional insured specifically is added by another endorsement to this Coverage Part. e. This insurance does not apply to the rendering of or failure to render any "professional services". f. The limits of insurance afforded to the additional insured shall be the limits which you agreed in that "contract or agreement requiring insurance" to provide for that additional insured, or the limits shown in the Declarations for this Coverage Part, whichever are Iess.This endorsement does not increase the limits of insurance stated in the LIMITS OF INSURANCE (Section III) for this Coverage Part. B. the following is added to Paragraph a. of 4. Other Insurance in COMMERCIAL GENERAL LIABILITY CONDITIONS (Sections IV): However, if you specifically agree in a "contract or agreement requiring insurance" that the insurance provided to an additional insured under this Coverage Part must apply on a primary basis, or a primary and non-contributory basis, this insurance is primary to other insurance that is available to such additional insured which covers such additional insured as a named insured, and we will not share with the other insurance, provided that: (1) The "bodily injury" or "property damage" for which coverage is sought occurs, and (2) The "personal injury" for which coverage is sought arises out of an offense committed, after you have entered into that "contract or agreement requiring insurance". But this insurance still is excess over valid and collectible other insurance, whether primary, excess, contingent or on any other basis, that is available to the insured when the insured is an additional insured under any other insurance C. The following is added to Paragraph 8. Transfer Of Rights Of Recovery Against Others To Us in COMMERCIAL GENERAL LIABILITY CONDITIONS (Section IV): We waive any rights of recovery we may have against any person or organization because of payments we make for "bodily injury", "property damage" or "personal injury" arising out of "your work" performed by you, or on your behalf, under a "contract or agreement requiring insurance" with that person or organization. COMMERCIAL GENERAL LIABILITY rights only where you have agreed to do so as part of the 'contract or agreement requiring insurance" with such person or organization entered into by you before, and in effect when, the "bodily injury" or "property damage" occurs, or the "personal injury" offense is committed. D. The following definition is added to DEFINITIONS (Section V): "Contract or agreement requiring insurance" means that part of any contract or agreement under which you are required to include a person or organization as an additional insured on this Coverage Part, provided that the "bodily injury" and "property damage" occurs, and the "personal injury" is caused by an offense committed: a. After you have entered into that contract or agreement, b. While that part of the contract or agreement is in effect, and c. Before the end of the policy period.
