RECOMMENDED ACTION
City Council adopt an Ordinance entitled, "AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF SANTA CLARITA, CALIFORNIA, AMENDING SANTA CLARITA
MUNICIPAL CODE SECTIONS 2.75.030 AND 2.75.040 TO ADD CERTAIN LIBRARY
CLASSIFICATIONS TO THE PERSONNEL SYSTEM BUT EXCLUDE THE CITY
LIBRARIAN AND PTS LIBRARY AIDE FROM THE COMPETITIVE SERVICE."
BACKGROUND
At the regular meeting of the City Council on January 9, 2018, the City Council introduced and
passed to second reading an ordinance pertaining to the Santa Clarita Public Library (SCPL)
transition.
On January 9, 2018, the City Council adopted a resolution to amend the City of Santa Clarita's
(City's) position classification plan to add the classifications of City Librarian, Library
Administrator, Senior Librarian, Librarian, Library Assistant, and PTS Library Aide, and
establish the salary ranges for each classification. This purpose of this ordinance is to clearly
document that all of the library classifications will be included in the City's personnel system,
with the classifications of Library Administrator, Senior Librarian, Librarian, and Library
Assistant included in the City's Competitive Service under Section 2.75.040 and the City
Librarian and PTS Library Aide excluded from the City's Competitive Service under Section
2.75.040. The ordinance includes a non -substantive revision to Section 2.75.030 of the
Municipal Code to clarify the City Manager's authority over the City's entire personnel system,
both the Competitive Service and those excluded from the Competitive Service.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SANTA CLARITA, CALIFORNIA, AMENDING SANTA CLARITA MUNICIPAL
CODE SECTIONS 2.75.030 AND 2.75.040 TO ADD CERTAIN LIBRARY
CLASSIFICATIONS TO THE PERSONNEL SYSTEM BUT EXCLUDE THE CITY
LIBRARIAN AND PTS LIBRARY AIDE FROM THE COMPETITIVE SERVICE
The City Council of the City of Santa Clarita does hereby ordain as follows:
SECTION 1. Findings:
A. The City Council has amended the City's position classification plan to add the
classifications of City Librarian, Library Administrator, Senior Librarian, Librarian,
Library Assistant, and PTS Library Aide (collectively Library Classifications) and
establish associated salary ranges for each. The City Librarian classification/position has
been established as a Division Manager.
B. Section 45002 of the California Government Code grants discretion to the City Council
to include library personnel, other than the Board of Library Trustees, in any personnel
system established by the City.
C. The Board of Library Trustees for the City of Santa Clarita has delegated any authority
over City Library Classifications to the City Council.
D. Pursuant to Section 2.75.010 of the Santa Clarita Municipal Code (SCMC), the City
Council has adopted a personnel system for all City employees, which is intended to
include the Competitive Service and employees in classifications excluded from the
Competitive Service under SCMC 2.75.040.
E. Pursuant to Section 2.75.030 of the SCMC, the City Council has delegated authority to
the City Manager, as the Personnel Officer, to administer the City's personnel system.
F. Pursuant to Section 2.75.040.E, the City has excluded Division Manager -level
classifications from the Competitive Service.
G. Pursuant to Section 2.75.040.J, the City has excluded PTS classifications from the
Competitive Service.
SECTION 2. Section 2.75.030 of the SCMC is amended to read: The City
Manager shall administer the City personnel system, including the Competitive Service and
those classifications excluded from the Competitive Service, and shall serve as the Personnel
Officer.
A. Act as the appointing authority for the City, except for the City Attorney who shall be
appointed by the City Council.

B. Administer all the provisions of this chapter and of the personnel rules not specifically
reserved to the City Council.
C. Prepare and recommend to the City Council personnel rules and revisions and
amendments to such rules.
D. Prepare or cause to be prepared a position classification plan, including class
specifications, and revisions of the plan.
E. Have the authority to discipline employees in accordance with this chapter and the
personnel rules of the City.
F. Provide for the publishing or posting of notices of tests for positions in the competitive
service; the receiving of applications therefor; the conducting and grading of tests; the
certification of a list of all persons eligible for appointment to the appropriate position in
the competitive service; and performing any other duty that may be required to
administer the personnel system.
G. The City Manager may delegate those portions of his/her responsibilities which he/she
deems appropriate.
SECTION 3. Section 2.75.040 of the SCMC is amended to read: The provisions
of this chapter shall apply to all offices, positions and employments in the service of the City,
except:
A. Elective officers;
B. The City Manager, Assistant or Deputy City Managers, and any Assistants to the City
Manager;
C. The City Attorney and any Assistant or Deputy City Attorneys;
D. Members of appointive boards, commissions, and committees;
E. All Department Directors and Division Managers;
F. Persons engaged under contract to supply expert, professional, technical or any other
services;
G. Volunteer personnel;
H. All Council -appointed officers;
I. Emergency employees who are hired to meet the immediate requirements of any
emergency condition, such as extraordinary fire, flood, or earthquake which threatens
life or property;

Employees, other than those listed elsewhere in this section, who are not employed in
regular positions. "Employed in regular positions" means an employee hired into an
indefinite term into a budgeted position, who is regularly scheduled to work no less than
one thousand forty (1,040) hours per year, and has successfully completed the
probationary period and been retained as provided in this chapter and the personnel
rules;
K. Any position primarily funded under a state or federal employment program;
L. Any newly created position, which is designated at the time of its creation as being
exempt from the competitive service; and
M. The City Librarian and PTS Library Aide classifications are excluded from the
competitive service. The classifications of Library Administrator, Senior Librarian,
Librarian, and Library Assistant are included in the Competitive Service.
N. Employees not included in the competitive service under this section shall serve at the
pleasure of their appointing authority. They may be terminated or disciplined at will by
the City Manager at any time, without any right of appeal.
SECTION 4. Severability: If any section, subsection, sentence, clause, or phrase
of this ordinance is for any reason held to be invalid or unconstitutional by a decision of any
court of competent jurisdiction, such decision will not affect the validity of the remaining
portions of this ordinance. The City Council declares that it would have passed this ordinance
and each and every section, subsection, sentence, clause, or phrase not declared invalid or
unconstitutional without regard to whether any portion of the ordinance would be subsequently
declared invalid or unconstitutional.
SECTION 5. Effective Date: This ordinance takes effect 30 days from the date of
its adoption.
SECTION 6. Publication: The City Clerk is directed to certify this ordinance and
cause it to be published in the manner required by law.
