CALL TO ORDER Mayor Weste called to order the Regular Joint Meeting of the City Council and Board of Library Trustees at 6:03 p.m. ROLL CALL All Councilmembers were present. FLAG SALUTE The Young Marines led the flag salute. EXECUTIVE MEETING This time has been set aside for Councilmembers to review the agenda and obtain any further information that may be needed. Council will also discuss each individual item during the course of the meeting with the exception of the Consent Calendar, which may be approved in its entirety by one motion, unless there is a request to pull an item for discussion. No action will be taken on public agenda items during the Executive Meeting. APPROVAL OF AGENDA Motion by Councilmember Smyth, second by Mayor Pro Tem McLean, to approve the agenda,with a minor edit to language in the minutes, and pulling items 8 and 9 for public comment. RESULT: APPROVED [UNANIMOUS] MOVER: Cameron Smyth,Councilmember SECONDER: Marsha McLean, Mayor Pro Tem AYES: Weste,McLean, Kellar,Miranda,Smyth AWARDS AND RECOGNITIONS Mayor Weste shared the evolution of the Young Marines program and recognized the Young Marines for their research, education, training, and community service; and recognized The Boys & Girls Club of Santa Clarita 2018 Youth of the Year Lluvia Partida for her service to the community, commitment to the Keystone Membership Club, and educational goals. PUBLIC PARTICIPATION Addressing the Council was Alan Ferdman, representing the Canyon Country Advisory Committee, regarding the Canyon Country Community Center; Shawnee Badger and Cher Gilmore,representing Los Angeles Community Choice Energy (LACCE), regarding renewable energy; Caren Knott regarding cell towers; Donna Hansel regarding sanctuary cities; and Steve Petzold regarding sanctuary cities. Two written comment cards were received by Reese Jensen and Lynne Girdlestone, representing LACCE, regarding renewable energy. STAFF COMMENTS City Manager Ken Striplin commented regarding cell towers and stated the proposed plan will be brought before the Planning Commission on April 3, 2018, and encouraged Ms. Knott to attend and present her information. Council requested that staff provide information regarding sanctuary cities. COMMITTEE REPORTS/COUNCILMEMBER COMMENTS Councilmember Miranda invited residents to take part in the 9 p.m. Routine program, created by the City of Santa Clarita and Santa Clarita Valley Sheriffs Station in order to prevent vehicular theft and encouraged residents to use the hashtag#9PMROUTINE to generate awareness; and commented regarding the amenities available at the new Canyon Country Community Center. Councilmember Smyth commented regarding his participation on the City Council Legislative Committee where pending legislation that limits control by local governments was discussed. Councilmember Kellar requested to adjourn in memory of Linda Lambourne. Mayor Pro Tem McLean invited residents to attend Let's Get Moving with Measure M!, a public workshop focusing on transportation projects that benefit the community on March 28, from 6 p.m. to 8 p.m.; commented regarding attending Zonta's Women in Service Celebration and expressed gratitude toward the organization for their service; commented that the City.is partnering with Metro, the Santa Clarita Valley Bicycle Coalition, and the Los Angeles County Bicycle Coalition to provide free bicycle classes in April for residents, and encouraged residents to visit BikeSantaClarita.com/Events for more information; and invited residents to join Elks Lodge for their Night at the Races Fundraiser for Young Marines on May 12, from 4 p.m. to 10 p.m., and encouraged residents to call (661) 645-9614 for tickets and information. Mayor Weste commented regarding the Special Needs Registry and acknowledged volunteers Page 2 Emily Hand and Anja Bozick for their service; commented regarding the 4th of July Parade, "It's a Grand Old Flag" theme, and recognized that this year is the 100 year anniversary of World War I and the 50 year anniversary of the Vietnam War; commented regarding the Earth Arbor Day Festival on April 28, and invited residents to visit GreenSantaClarita.com for more information; and requested to adjourn in memory of Nancy Carol Waterman and Nokie Edwards. CONSENT CALENDAR RESULT: APPROVED [UNANIMOUS] MOVER: Bob Kellar,Councilmember SECONDER: Cameron Smyth, Councilmember AYES: Weste,McLean,Kellar, Miranda, Smyth ITEM 1 APPROVAL OF REGULAR MEETING MINUTES —The minutes are submitted for approval. RECOMMENDED ACTION: City Council approve the minutes of the March 13, 2018, Regular Meeting. ITEM 2 READING OF ORDINANCE TITLES Government Code Section 36934 requires that all ordinances be read in full prior to Council taking action on the ordinance. By listing the ordinance title on the Council agenda, Council may determine that the title has been read. RECOMMENDED ACTION: City Council determine that the titles to all ordinances which appear on this public agenda have been read and waive further reading. ITEM 3 APPOINT A CITY DELEGATE AND ALTERNATE DELEGATE FOR THE ANNUAL SOUTHERN CALIFORNIA ASSOCIATION OF GOVERNMENTS' 2018 GENERAL ASSEMBLY SCAG holds an annual Regional Conference and General Assembly Meeting where the Delegates take part in panel discussions with fellow elected officials and stakeholders throughout Southern California. RECOMMENDED ACTION: City Council appoint Mayor Pro Tern Marsha McLean as the City of Santa Clarita's delegate and Councilmember Bill Miranda as the City of Santa Clarita's alternate delegate to the Southern California Association of Governments' 2018 General Assembly. Page 3 ITEM 4 NORTH LOS ANGELES COUNTY TRANSPORTATION COALITION JOINT EXERCISE OF POWERS AGREEMENT The City of Santa Clarita, City of Lancaster, City of Palmdale, and County of Los Angeles are seeking to form a Joint Powers Authority(JPA) for purposes of advocating for and receiving funds for transportation projects in North Los Angeles County. RECOMMENDED ACTION: City Council: 1. Approve the City of Santa Clarita's participation in the North Los Angeles County Transportation Coalition Joint Powers Authority. 2. Authorize the City Manager, or his designee, to execute the North Los Angeles County Transportation Coalition Joint Exercise of Powers Agreement, subject to City Attorney review and approval. ITEM 5 FEDERAL LEGISLATION: S. 1926 Authored by Senator Kamala Harris (D-CA), S. 1926 proposes to establish a national memorial and national monument to commemorate the victims of the Saint Francis Dam collapse of March 12, 1928. RECOMMENDED ACTION:' City Council adopt the Legislative Committee's recommendation to support S. 1926 (Harris) and transmit position statements to Senator Kamala Harris; Senator Dianne Feinstein; Representative Steve Knight; the Senate Committee on Energy and Natural Resources; and other Members of the Senate and committees, as appropriate. ITEM 6 STATE LEGISLATION: SENATE BILL 827 Authored by Senator Scott Wiener(D-11-San Francisco), Senate Bill 827 restricts local authority regarding density, height, parking, and design standards related to specific residential developments near a transit stop or transit corridor. RECOMMENDED ACTION: City Council adopt the Legislative Committee's recommendation to oppose Senate Bill 827 (Wiener) and transmit position statements to Senator Wiener, Santa Clarita's state legislative delegation, appropriate legislative committees, Governor Brown, and the League of California Cities. Page 4 ITEM 7 ADOPT RESOLUTION TO INCORPORATE SENATE BILL 1, ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017, LOCAL STREETS AND ROADS, ROAD MAINTENANCE AND REHABILITATION FUNDS, INTO THE CAPITAL IMPROVEMENT PROGRAM Senate Bill 1, Road Repair and Accountability Act of 2017, Local Streets and Roads, Road Maintenance and Rehabilitation Account funds will increase the City budget by$3,592,719 and requires the City to identify project(s)using these funds through the adoption of a resolution at a regular public meeting. RECOMMENDED ACTION: City Council: 1. Adopt a resolution declaring the incorporation of a list of projects proposed to be funded by Senate Bill 1, Road Repair and Accountability Act of 2017, Local Streets and Roads, Road Maintenance and Rehabilitation for Fiscal Year 2018-19 into the Capital Improvement Program. 2. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval. Adopted Resolution No. 18-08 ITEM 8 SANTA CLARITA PERFORMING ARTS CENTER AT COLLEGE OF THE CANYONS AGREEMENT A review of the agreement between the City of Santa Clarita and the Santa Clarita Community College District regarding the Santa Clarita Performing Arts Center at College of the Canyons. RECOMMENDED ACTION: City Council approve and authorize the City Manager or designee to execute an agreement with Santa Clarita Community College District for the Santa Clarita Performing Arts Center at College of the Canyons, subject to City Attorney approval. Addressing the Council on this item was Executive Director of the Canyon Theatre Guild TimBen Boydston. ITEM 9 NEWHALL FAMILY THEATER FOR THE PERFORMING ARTS AGREEMENT A review of the agreement between the City of Santa Clarita and the Newhall School District regarding the newly restored Newhall Family Theater for the Performing Arts at Newhall Elementary School. RECOMMENDED ACTION: City Council: 1. Approve and authorize the City Manager or designee to execute an agreement with Newhall School District for the Newhall Family Theater for the Performing Arts, in the amount of Page 5 $75,000, subject to City Attorney approval. 2. Authorize the transfer of$75,000 from the General Fund Capital expenditure account 60119500-5501.100 to General Fund revenue account 100-4711.601, and appropriate to expenditure account 15400-5161.002. Addressing the Council on this item was Executive Director of the Canyon Theatre Guild TimBen Boydston; Tom Lund, representing the Newhall Family Theater for the Performing Arts; Kai Mayer; Lisha Yakub Sevanian; and Steve Petzold. Council commented regarding their support of arts in the community, clarified that the City would not be the operator of the theater, and congratulated and thanked all involved in developing the theater. Councilmember Kellar invited staffs comment, and City Manager Ken Striplin responded that staff conducted research, spoke to agencies, and worked with the Newhall School District Governing Board to form a plan for the theater that supports the Arts Master Plan. ITEM 10 CHECK REGISTER NO. 5 Check Register No. 5 for the Period 02/02/18 through 02/15/18 and 02/22/18. Electronic Funds Transfers for the Period 02/05/18 through 02/16/18. RECOMMENDED ACTION: City Council approve and ratify for payment the demands presented in Check Register No. 5. PUBLIC HEARINGS ITEM 11 FIRST READING OF AN ORDINANCE PROHIBITING CANNABIS-RELATED COMMERCIAL LAND USES AND RESTRICTING THE HOME CULTIVATION OF CANNABIS IN A MANNER CONSISTENT WITH PROPOSITION 64 (MASTER CASE NO. 17-266) An ordinance prohibiting commercial cannabis businesses and regulating the home cultivation of cannabis. RECOMMENDED ACTION: City Council conduct a public hearing, and introduce and pass to second reading an ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, APPROVING MASTER CASE NO. 17-266, CONSISTING OF UDC AMENDMENT 17-003, AMENDING VARIOUS CHAPTERS OF TITLE 17 (UNIFIED DEVELOPMENT CODE) OF THE SANTA CLARITA MUNICIPAL CODE CONCERNING CANNABIS-RELATED COMMERCIAL LAND USES AND THE HOME CULTIVATION OF CANNABIS. Mayor Weste opened the public hearing. Page 6 City Clerk Mary Cusick reported that all notices required by law have been provided. Associate Planner David Peterson provided the staff report. Addressing the Council in opposition of this item was Gary Pintar; Logan Smith; Laurie Finkelstein; Bart Joseph; and Cis Herskovitz. One speaker card was received from Bart Joseph in opposition of this item. Mayor Weste closed the public hearing. Council discussed cannabis usage, the current ordinance, cannabis growth, and delivery services; invited staff to comment, and City Manager Ken Striplin invited Lieutenant Justin Diaz and Detective William Velek to comment regarding their experience working with juveniles and cannabis usage in the community. Councilmember Kellar made a motion to approve the ordinance, including the prohibition of cannabis growth in garages.
