HomeMy WebLinkAbout2018-12-11 - AGENDA REPORTS - CANYON COUNTRY CMTY CENTER, PROJ F3020 - AWARD CON (2)Agenda Item: 14 DATE: December 11, 2018 SUBJECT: CANYON COUNTRY COMMUNITY CENTER, PROJECT F3020 - AWARD CONSTRUCTION MANAGEMENT CONTRACT AND PURCHASE OF MITIGATION CREDIT DEPARTMENT: Public Works PRESENTER: Damon Letz RECOMMENDED ACTION City Council: Award a contract to Griffin Structures Inc. for the construction management and constructability review of the Canyon Country Community Center, Project F3020 in the amount of $1,432,000, and authorize a contingency in the amount of $143,200, for a total contract amount not to exceed $1,575,200. 2. Authorize the purchase of one acre of mitigation credit from the Peterson Ranch Mitigation Bank sponsor, Land Veritas Corp. in the amount of $85,000. 3. Appropriate $1,660,200 from the Park Dedication Fund (Fund 305) to the Canyon Country Community Center contractual services expenditure account F3020305-5161.001. 4. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval. BACKGROUND On June 28, 2016, the City Council approved the Conceptual Master Plan for the Canyon Country Community Center (C4) project following a public engagement process. The Conceptual Master Plan includes the construction of a 25,000 square foot community center, plaza and courtyards, parking, walkways, landscaping, and street improvements. The plan also includes improvements to the Mint Canyon Channel and on-site drainage which are being coordinated with the Los Angeles County Flood Control District. The total improved area of the project, including channel improvements, is approximately ten acres. This project supports the Page 1 Building and Creating Community theme of the City's five-year strategic plan, Santa Clarita 2020. The City Council awarded civil and architectural design contracts for the project in August and December 2016, respectively. In addition, a Mitigated Negative Declaration was approved and certified at the July 11, 2017, City Council meeting, satisfying the California Environmental Quality Act (CEQA). Since the adoption of the CEQA document, the design work for the C4 project has been ongoing. The C4 project will be constructed in two phases. Phase I includes the site rough grading, and Mint Canyon Channel and storm drain improvements. Phase II will include the construction of the community center building, parking lots, walkways, play area, outdoor basketball court, landscaping, and street improvements. Phase I is scheduled to begin construction in April 2019 with Phase II construction to follow immediately upon completion of Phase I. Construction Management On October 16, 2018, a Request for Proposal (RFP) for the construction management for Phases I and II and constructability review for Phase II services was advertised on the City of Santa Clarita's (City) website. The RFP asked firms to identify proposed staffing and their relevant construction experience with similar projects and specify their qualifications for this project. A total of eight proposals were received on November 14, 2018. All proposals were reviewed and evaluated by staff based on the evaluation criteria set forth in the RFP. After review of the proposals, staff interviewed the top four consultants as part of the selection process to ensure the most qualified firm was selected. Based on the experience, completeness of their proposal, and interview responses, staff recommends the City Council award the construction management and constructability review services contract to Griffin Structures Inc. Griffin Structures Inc. demonstrated an in-depth understanding of the project and provides the most qualified construction managers and supporting staff. The requested contingency of $143,200 will cover costs for additional, as -needed services as the construction project continues and unforeseen issues arise. California Government Code 4526 prescribes selection of architectural and engineering services Page 2 to be based on demonstrated competence and professional qualification necessary for the satisfactory performance of the services required, does not authorize the selection of professional architectural and engineering services based on costs, and does not require the cost proposals to be sealed. Staff negotiated a final contract at a fair and reasonable price for the services requested in the RFP. Environmental Mitigation _ Phase I construction includes the improvement of the Mint Canyon Channel and on-site storm drains. These drainage improvements provide added flood protection and increase the useable area for the C4 project from eight to nine acres. The Mint Canyon Channel is currently a soft bottom channel as is the open v -ditch that runs through the site. The proposed improvements to the channel as part of the C4 project impact 1.16 acres of California Department of Fish and Wildlife (CDFW) jurisdictional stream. Through negotiations, the City and CDFW have agreed to a one acre mitigation requirement to compensate for the permanent impacts to this jurisdictional stream. This mitigation requirement can be satisfied through the purchase of stream preservation credits from the Peterson Ranch Mitigation Bank which has been approved by the CDFW as satisfactory habitat. The purchase of the one acre credit will preserve in perpetuity the amount of habitat impacted by the C4 project. The mitigation bank sponsor, the Land Veritas Corp., will be responsible for the ongoing expenses and maintenance of the credit sold. The per acre price for habitat mitigation varies depending on the type of habitat purchased and can range between $85,000 per acre to over $300,000 per acre at the Peterson Ranch Mitigation Bank. Due to the nature of the habitat disturbed at the C4 project site, the CDFW has approved the purchase of one acre of mitigation credit for habitat valued at $85,000 per acre. Staff has evaluated other mitigation banks and have found this to be the most cost effective approach to satisfying this requirement. Staff recommends the City Council approve the purchase of one acre of mitigation credit from the Peterson Ranch Mitigation Bank. ALTERNATIVE ACTION Other action as determined by the City Council. FISCAL IMPACT Upon approval of the recommended actions, adequate funds will be available in expenditure account F3020 to support the recommended contracts for the Canyon Country Community Center. (Bank Sponsor) and City of Santa:Clarit (Project Proponent), jointly referred to as the "Parties," as follows: RECITALS A. The Bank Sponsor has developed the Petersen Ranch Mitigation Bank (Bank) located in Los Angeles County, California; and B. The Bank has been developed pursuant to a Bank Enabling Instrument (BEI) entered into by and between Bank Sponsor, LV -BP Investors Ranch, LLC, LV Lake Elizabeth, LLC (jointly "Property Owner"), the US. Army Corps of Engineers (USACE), the Environmental Protection Agency (EPA), the Lahontan Regional Water Quality Control Board (Lahontan RWQCB), and the California Department of Fish and Wildlife (CDFW) on May 11, 2016, and is currently in good standing with these agencies; and C. Project Proponent is seeking to implement the project described on Exhibit "A" attached hereto (Project), which would unavoidably and adversely impact 1.16 acres of Waters of the State, and seeks to compensate for the loss of 1.16 acres of Waters of the State by purchasing credits from Bank Sponsor; and 0r �, ��upon confirmation by the Bank Sponsor of credit availability/adequate balance of credits remaining for sale; and E. Project Proponent desires to purchase from Bank Sponsor and Bank Sponsor desires to sell to Project Proponent Credits from the Bank; NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS: 1. Bank Sponsor hereby sells to Project Proponent and Project Proponent hereby purchases from Bank Sponsor Credits for the purchase price of eighty five thousand dollars ($85,000). The Bank Sponsor will then deliver to Project Proponent an executed Bill of Sale in the manner and form as attached hereto and marked Exhibit "B". The purchase price for said Credits shall be paid by cashier's check or, at the option of Bank Sponsor, wire transfer of funds according to written instructions by Bank Sponsor to Project Proponent. 2. The sale and transfer herein is not intended as a sale or transfer to Project Proponent of a security, license, lease, easement, or possessory or non -possessory interest in real property, nor the granting of any interest of the foregoing. Project Proponent shall have no obligation whatsoever by reason of the purchase of the Credits, to support, pay for, monitor, report on, sustain, continue in perpetuity, or otherwise be obligated or liable for the success or continued expense or maintenance in perpetuity of the Credits sold, or the Bank. Pursuant to the BEI and any amendments thereto, Bank Sponsor shall monitor and make reports to the appropriate agency or agencies on the status of any credits sold to Project Proponent. Bank Sponsor shall be fully and completely responsible for satisfying any and all conditions placed on the Bank or the Credits by all state or federal jurisdictional agencies. 4. The Credits sold and transferred to Project Proponent shall be non -transferable and non -assignable, and shall not be used as compensatory mitigation for any other project or purpose, except as set forth herein. 5. Project Proponent must exercise his/her/its right to purchase the Credits within 30 days of the date of this Agreement. After the 30 day period this Agreement will be considered null and void. 6. Upon purchase of the Credits specified in paragraph D above, the Bank Sponsor shall submit to the parties listed in the Notices section of the BEI, copies of the: a) Agreement for Sale of Credits; b) Bill of Sale; c) Payment Receipt; and d) an updated ledger. The updated ledger must detail: i) Project Proponent; ii) Project Name; iii) Status (sale complete/sale not complete); iv) Credit Sale Date; v) Permitting Agency File/Tracking Number; vi); vii) Total Number of credits Authorized to Sell; viii) Total Number of credits Sold to Date (inclusive); and ix) Balance of all credits Available.
