Approve the plans and specifications for the Santa Clar Phase III C Golden Valley Road Right-of-Way Improvements, Project F3023. 2. Award a construction contract for the Phase III C Golden Valley Road Right-of-Way Improvements, Project F3023, to Toro Enterprises, Inc., in the amount of $2,617,851, and authorize a contingency in the amount of $523,570, for a total contract amount not to exceed $3,141,421. 4. Extend the current contract and authorize an increased expenditure authority for material testing services with R. T. Frankian & Associates, in the amount of $98,815, and authorize a contingency in the amount of $9,882, for a total contract amount not to exceed $108,697. 5. Extend the current contract and authorize an increased expenditure authority for civil engineering and surveying with Hunsaker & Associates, in the amount of $82,872, and authorize a contingency in the amount of $8,287, for a total contract amount not to exceed $91,159. 6. Appropriate funding in the amount of $6.5 million from the Facilities Fund (723) to expenditure account F3023723-5161.001 . 7. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval. Page 1 Packet Pg. 59 9 BACKGROUND In May 2016, the City of Santa Clarita (City) and Los Angeles County (County) entered into a Memorandum of Understanding (MOU) to construct a new 45,000 square foot sheriff's station, along with a 4,000 square foot vehicle maintenance facility and helipad to serve the entire Santa Clarita Valley. The current station, located at 23740 Magic Mountain Parkway, was built in 1972 and is no longer adequate to effectively serve the needs of the community. A new Santa Clarita -year strategic plan, Santa Clarita 2020. In November 2016, the City Council awarded contracts for Phase I of the project, which included the preparation of the environmental and geotechnical studies, and concept design. Subsequently, in June 2017, the initial study and Mitigated Negative Declaration (MND) for the project was completed in compliance with the California Environmental Quality Act as part of Phase I. The final MND was approved and certified by the City Council on August 22, 2017. In October 2017, the City Council awarded an architectural and civil design contract for Phase II of the project, which included finalizing the concept design developed in Phase I and the preparation of all associated architectural, structural, and civil engineering drawings, and specifications necessary for the construction of the project. three sub phases: Phase III A - Onsite Improvements In June 2018, the City Council awarded contracts for the Phase III A onsite improvements, which included grading, retaining walls, drainage improvements, traffic control, erosion control, and demolition. This phase is completed. Phase III B - Onsite Construction Includes the main station building, detention facility, helipad, vehicle maintenance building, visitor parking, staff parking, generator, fuel station, wet utilities, dry utilities, radio antenna tower, perimeter walls, landscaping, furnishings, fixtures, and equipment. This phase is currently in design. Phase III C - Golden Valley Road Right-of-Way Improvements Includes demolition, water, gas, power, AT&T telephone, AT&T fiber, Spectrum fiber, Spectrum cable TV, City fiber, storm drain, roadway improvements, median modifications, west curb and gutter, west streetlights, southbound lanes repairs and paving, west sidewalk, commercial driveways, and an emergency response traffic signal. An invitation to bid for the Golden Valley Road Right-of-Way Improvements and associated work was published three times in The Signal newspaper starting on November 20, 2018, and on November 19, 2018, and opened by Purchasing on December 20, 2018. Pasadena, CA $3,263,936 Staff recommends the construction contract be awarded to Toro Enterprises, Inc., the lowest responsive bidder. Toro Enterprises, Inc., possesses a valid Class A state contractor's license and is in good standing with the Contractors State License Board. The contractor's bid has been reviewed for accuracy and conformance to the contract documents and found to be complete. The contract for the Phase III C Golden Valley Road Right-of-Way Improvements is subject to approval by the County. The County has been included throughout the selection process for the contractor and supports the selection of Toro Enterprises, Inc. While the City maintains a Support of Local Businesses policy that can be utilized by the City Council when warranted, the City is governed by the California Public Contract Code with regard to public works project procurement. In this type of procurement, the California Public Contract Code does not permit a city to utilize a Support of Local Businesses policy and instead requires the contract be awarded to the lowest responsible bidder. The requested construction contingency amount of 20 percent will cover the cost of unforeseen site conditions, such as potential for utility conflicts, abandoned utilities not shown in record drawings, change order requests made by the contractor, and change orders for additional work ordered by the City. The MOU between the City and the County stipulates: "All offsite improvements required for the completion of construction of the New Station (including without limitation offsite water tanks, cabling for TV and internet, improvements related to gas and electricity, road work, and any improvements required by the Fire Department or any other agency having jurisdiction) will In an effort to move forward with Phase III C offsite improvements, which include the installation of the water line on Golden Valley Road, staff presented the waterline contract with Santa Clarita Valley Water Agency to the City Council on June 26, 2018. The City Council approved this agreement in the amount of $2,262,570. That agenda report appropriated funds from the 102 Trust Account, County Contributions, to fund the waterline construction. However, per the stipulations in the MOU mentioned above, staff determined the County Contribution Account cannot fund the wa $2,262,570 in the 102 Trust Account with $2,262,570 from Facilities Fund (723). In November 2016, the City Council approved contracts with R.T. Frankian & Associates and Hunsaker & Associates for various components of Phases I and II of the project. R.T. Frankian & Associates has provided geotechnical site studies and soil testing, while Hunsaker & Associates has provided civil engineering and surveying for the design of the facility and grading. The knowledge and expertise of each firm continue to be valuable assets to the City and are needed to ensure compliance with the design specifications and environmental documents. Page 3 Packet Pg. 61 9 Staff has negotiated a fair and reasonable price with these firms for the work required to complete Phase III C. The recommended action to extend the current contracts for each firm will provide for an uninterrupted transition from Phase III A to Phase III C. The requested budget will allow for awarding the construction and construction engineering support contracts and will provide for staff time for project management, public works inspection, labor compliance, temporary construction utilities, permanent utility installation to the site, project software, construction cameras, Storm Water Pollution Prevention Plan monitoring, and miscellaneous project administrative costs. ALTERNATIVE ACTION Other action as determined by the City Council. FISCAL IMPACT Upon approval of the recommended actions, adequate funds will be available in expenditure account F3023723-5161.001 to support the recommended contracts, the water infrastructure, and other associated costs for the Santa Clarita Valley Sheriff's Station Phase III C Golden Valley Road Right-of-Way Improvements. All work not set forth in the scope of work above shall be deemed additional work. All additional work will be authorized in writing by an authorized representative of the Client prior to commencing the work. No additional work will be performed based upon signed field tickets unless contractual accommodations are made prior to starting the project. Additional work will be charged at regular hourly rates, per the attached fee schedule, and includes the time for travel to the jobsite. 2. Items of work that are not clearly defined prior to the authorization to proceed will be performed on a time and material basis per attached fee schedule or upon such a lump sum addition to the contract, as agreed upon by the Contractor prior to proceeding with such items of work. 3. Work may be requested that, due to the Contractor's schedule, requires work to be performed during non -business hours. If such work is required, a request for a premium time may be made. Premium time shall be deemed extra work and will apply to scope items or non -scope items. Premium time will be paid at 150% of the hourly rates. For extra work or for items limited to this scope of work, 100% of the hourly rate shall be paid. Items considered additional work includes: a. Non -sequential work (400 LF per trip minimum). b. Re -staking (a second set of stakes for any item). c. Excess or extra staking (stakes not normally provided or defined in scope and/or beyond industry standards. d. Work not specifically identified in the Scope of Services. 4. Contract Payment and Reimbursable Expenses: a. Payments are due and payable according to monthly billings as the work progresses, no retention. b. Courier service, blueprinting, and reproduction cost are not included in the cost outlined above and shall be at the Contractor's expense. The cost for any outside services will be billed at their direct cost plus 10%. 5.
