CANYONS AGREEMENT

RECOMMENDED ACTION
City Council approve and authorize the City Manager or designee to execute a three year
agreement with Santa Clarita Community College District for the Santa Clarita Performing Arts
Center at College of the Canyons, from July 1, 2019, to June 30, 2022, subject to City Attorney
approval.
BACKGROUND
In 1999, the City of Santa Clarita (City) and the Santa Clarita Community College District
(District) signed a Memorandum of Understanding (MOU) for what became the Santa Clarita
Performing Arts Center at College of the Canyons (PAC). The MOU was signed prior to the
opening of the PAC and it recognized the City's contribution of $2.4 million toward the
construction of the PAC. Among other items, the MOU outlined availability of the PAC for the
community's use. The term of the most recent agreement is from July 1, 2018, to June 30, 2019.
The following are highlights of the PAC agreement:
• City and District will enter into a three year agreement, which will begin on July 1, 2019,
and terminate on June 30, 2022.
• The District is responsible for coordinating and scheduling the use of the PAC by
community organizations.
• The City's contribution to the District is $80,000 annually for each year of the three year
agreement.
• Community organizations will be entitled to 21 percent of the days that the College of the
Canyons and the PAC are open, which is consistent with historical usage patterns and
Page 1
Packet Pg. 17
past agreements. This equals the use of 70 days a year, with 40 days during the week
(Monday to Thursday) and 30 days during the weekends (Friday to Sunday).
The City and the District will work together to coordinate cross marketing efforts such as
coverage of the PAC in the City's Seasons magazines, City websites and various
publications and brochures.
Insurance coverage by the City to the District is $5 million.
There are two terms in this agreement that have been changed, in comparison to past agreements.
The District formally requested that the annual compensation be increased from $75,000 to
$80,000. This request is to address the increases in costs at the PAC, particularly as it relates to
maintenance and upkeep. One of the primary ways the District utilizes City funds is to keep the
venue state-of-the-art, which includes stage re -flooring, seat replacement, and lighting and sound
equipment replacement and upgrades. The second request is to increase the insurance coverage
from $2 million to $5 million. The increase in insurance coverage is consistent with the amount
now required of the community users. The PAC continues to serve the community as a vital part
of the artistic and cultural landscape and as a venue that allows many community groups to offer
performances for the benefit of the entire community.
The Arts Commission reviewed and recommended approval to the City Council for the Santa
Clarita Performing Arts Center at College of the Canyons Agreement at their meeting on
February 25, 2019.
FISCAL IMPACT
Funds to support the recommended action are contingent upon appropriation of monies by the
City Council in the annual budget for such fiscal year.
