SUBJECT: JOINT RESOLUTION BETWEEN THE COUNTY OF LOS ANGELES
AND THE CITY OF SANTA CLARITA TO TRANSFER
LANDSCAPE MAINTENANCE DISTRICT (LMD) ZONE 1-113
(VALENCIA AREA -WIDE ANNEX B) FROM THE COUNTY OF
LOS ANGELES TO THE CITY

RECOMMENDED ACTION
City Council adopt a resolution transferring Landscape Maintenance District (LMD)
administration and maintenance responsibilities for LMD Zone 1-1B (Valencia Area -wide
Annex B) from the County of Los Angeles to the City of Santa Clarita.
BACKGROUND
On April 24, 2018, the City Council adopted Resolution No. 18-14, which initiated annexation
proceedings for the Plum Canyon annexation with the Local Agency Formation Commission
(LAFCO). Annexation Application No. 2018-04 was submitted to LAFCO on June 27, 2018.
LMD Zone 1-113 (Valencia Area -wide Annex B) is within the boundary of Annexation No.
2018-04.
On July 10, 2018, the City Council adopted a joint resolution between the City of Santa Clarita
(City) and County of Los Angeles (County), approving and accepting the negotiated exchange of
property tax revenue relating to the pending annexation of areas within the unincorporated
portion of Los Angeles County. Following the Council's action, the Los Angeles County Board
of Supervisors adopted the same joint resolution at their board meeting on September 18, 2018.
LAFCO approved Annexation 2018-04 at their October 10, 2018, meeting and held the protest
hearing at their November 14, 2018, meeting. Annexation 2018-04 was complete on
November 15, 2018, when the annexation was recorded with the state.
Los Angeles County Department of Public Works currently administers LMD Zone 1-1B
contracts responsible for the maintenance of landscaped medians located on Plum Canyon Road.

The City and County have agreed to transfer administrative and maintenance responsibilities for
Zone 1-1B to the City, excluding 222 open space parcels which were not annexed to the City
(see Exhibit A attached to the resolution), pursuant to Section 22612 of the State Streets and
Highways Code. This action is accomplished through the adoption of the attached j oint
resolution.
Pending the approval of both governing bodies, completion of this transfer is set for July 1, 2019,
or on a date mutually agreed to in writing by the City and the County, at which time the City will
assume operational and financial responsibility for the maintenance of improved landscaped
medians located on Plum Canyon Road. Consistent with the provisions of this joint resolution,
60 percent of the LMD Zone 1-1B estimated fund balance of $120,000 will transfer to the City
within 90 days following the formal transfer.
The remaining fund balance will transfer incrementally to the City via two additional
disbursements in six-month intervals. Phasing the transfer of fund balances will allow the County
to handle any outstanding incurred maintenance costs for LMD Zone 1-1B prior to its transfer.
ALTERNATIVE ACTIONS
Other action as directed by the City Council.
FISCAL IMPACT
There is no impact to the General Fund. Landscape Maintenance District revenues currently
held in fund balance by Los Angeles County for the dedicated use within LMD Zone 1-1B will
be transferred from the County to the City in three increments over a period of approximately 15
months.

JOINT RESOLUTION OF THE BOARD OF SUPERVISORS OF THE
COUNTY OF LOS ANGELES AND THE CITY COUNCIL OF THE CITY OF
SANTA CLARITA, CALIFORNIA, TO TRANSFER JURISDICTION OVER THE
LANDSCAPE AND LIGHTING ACT DISTRICT NO. 1, ZONE 1 B (VALENCIA AREA -
WIDE ANNEX B), SITUATED WITHIN THE TERRITORIAL BOUNDARIES OF THE
CITY OF SANTA CLARITA, FROM LOS ANGELES COUNTY TO THE CITY OF
SANTA CLARITA, AND APPROVE AND ACCEPT THE NEGOTIATED EXCHANGE
OF BENEFIT ASSESSMENT PROCEEDS
WHEREAS, Section 22612 of the Streets and Highways Code of the State of
California provides that if all of the territory of district is included within one city as a result
of an annexation or incorporation, the legislative body may transfer jurisdiction over the
district to the city council of the city by a joint resolution setting forth the mutually agreed
upon terms and conditions under which the transfer is to take place; and
WHEREAS, Landscape and Lighting Act (LLA) District No. 1, Zone 1B, Valencia
Area -Wide Annex B (Zone No. 1 B), currently within the jurisdiction of the Los Angeles
County (hereinafter referred to as COUNTY), excluding an area consisting of a number
of non -benefitted and non -assessed parcels, was incorporated into the City of
Santa Clarita (hereinafter referred to as CITY) and is therefore located within the territorial
boundaries of CITY; and
WHEREAS, COUNTY affirms that Zone No. 1 B receives funding through a special
benefit assessment levy established by the Board of Supervisors of the County of
Los Angeles, and collected by the County Tax Assessor, and that this benefit assessment
benefits only Zone No. 1 B (Special Assessment); and
WHEREAS, COUNTY and CITY consent to the transfer of jurisdiction over Zone
No. 1 B located within the territorial boundaries of CITY from COUNTY to CITY; and
WHEREAS, the City Council of CITY hereby authorizes the City Manager or his
designee to accept the transfer of Zone No. 1 B on behalf of CITY, excluding
approximately 222 open -space parcels listed on Exhibit A, which were not annexed to
CITY and receive no special benefit from the maintenance of landscaping that benefits
other parcels in the Zone, and accordingly are not required to pay special assessments.
If further authorizes the City Manager or his designee to execute all documents necessary
to complete the transfer of Zone No. 1 B from COUNTY to CITY; and
WHEREAS, pursuant to Section 99 of the Revenue and Taxation Code of the State
of California, prior to the effective date of any jurisdictional change, the governing bodies
of all agencies whose service areas or service responsibilities would be altered by such
change must determine the amount of Assessment Proceeds to be exchanged between
the affected agencies and approve and accept the negotiated exchange of Assessment

Proceeds by resolution, but if the affected agency is a special district, the Board of
Supervisors must negotiate on behalf of the district.
NOW THEREFORE, the Board of Supervisors of the County of Los Angeles acting
as the governing body of LLA District No. 1, Zone No. 1B, and the City Council of CITY
hereby resolve as follows:
SECTION 1. That COUNTY and CITY agree to transfer jurisdiction over Zone
No. 1 B from COUNTY to CITY, excluding approximately 222 open -space parcels listed
on Exhibit A, which were not annexed to CITY and receive no special benefit from the
maintenance of landscaping that benefits other parcels in the Zone, and accordingly are
not required to pay special assessments.
SECTION 2. That the transfer shall take effect on the later of (a) July 1, 2019, or
(b) at such time that this joint resolution has been adopted by both the City Council of
CITY and COUNTY Board of Supervisors (Effective Date).
SECTION 3. Any funds levied and collected pursuant to the Special Assessment
(Assessment Proceeds) prior to the Effective Date of the transfer will be deposited into a
specific account held by COUNTY to be used only for Zone No. 1 B (Account).
SECTION 4. Commencing after the Effective Date and thereafter, CITY shall be
responsible for the administration of Santa Clarita LLA Zone No. 1 B, or whatever
designation that CITY assigns to this zone, including the collection of the annual
assessments. To the EXTENT that Assessment Proceeds are remitted to COUNTY after
the Effective Date, COUNTY shall deposit them in the Account and transfer such funds
to CITY in accordance with the schedule set forth in Section 5 of this Resolution.
SECTION 5. Upon the Effective Date, COUNTY shall provide to CITY all funds
currently in the Account and all funds that may be forwarded to the Account in the future
pursuant to the following schedule:
a. On or about 90 days after the Effective Date of the transfer, COUNTY shall
transfer to CITY 60 percent of the amount in the Account at that time. This transfer
shall constitute the first installment of the funds in the Account.
b. On or about 180 days after the payment of the first installment of the funds in
the Account to CITY, COUNTY shall transfer to CITY 80 percent of the remaining
funds in the Account. This transfer shall constitute the second installment of the
funds in the Account.
c. On or about 180 days after the second installment of the funds in the Account
to CITY, COUNTY shall transfer to CITY all outstanding funds in the Account. This
amount will include all prior unspent funds, including any Assessment Proceeds
for Fiscal Year (FY) 2018-19 and FY 2019-20, which have been received to date,
less any invoices to be paid by the County from these funds and less Zone No. 1 B's

pro -rata share of administrative expenses, if any. Copies of any invoices paid by
COUNTY from these funds shall be provided to CITY, upon request. COUNTY and
CITY may amend the amount of payment and/or the date of payment pursuant to
written agreement.
d. If for any reason after the final payment of the balance of the funds in the
Accounts there are Assessment Proceeds or other funds in the Accounts, COUNTY
shall forward those Assessment Proceeds or funds in the Account to CITY within
60 days of County's knowledge of those Assessment Proceeds or funds.
SECTION 6. COUNTY represents that to the best of its knowledge, there are no
pending or threatened claims, or administrative or court proceedings against Zone No. 1 B
to be transferred herein. CITY, as governing body and administrator of Zone No. 1B,
shall provide landscape maintenance services and agrees to indemnify, defend, and hold
harmless COUNTY and its agents, officers, and employees from any damages of any
nature whatsoever, including but not limited to, bodily injury, death, personal injury, or
property damage, worker compensation suits, liability or expense, damage to Zone
No. 1B, or damage to applicable homeowner association and CITY property and
equipment, arising from landscape services performed on behalf of CITY for Zone No. 1 B.
SECTION 7. CITY and COUNTY agree to the terms of this Joint Resolution as
adopted by the City Council and Board of Supervisors on the date below. Should any
terms or conditions herein be changed or altered in any form or manner, after the date of
execution by CITY, this joint resolution shall be deemed null and void.
SECTION 8. The City Clerk shall certify to the adoption of this resolution.
