Approve the plans and specifications for the Santa Clarita Valley Sheriff's Station Phase III B - Onsite Construction, Project F3023. 2. Award a construction contract for the Santa Clarita Valley Sheriff's Station Phase III B - Onsite Construction, Project F3023 to Icon West Inc. in the amount of $43,088,790 and authorize a contingency in the amount of $4,308,879, for a total contract amount not to exceed $47,397,669. 3. Award a contract to United -Heider Inspection Group for material testing and inspection services for the Santa Clarita Valley Sheriff s Station in the amount of $436,680 and authorize a contingency in the amount of $43,668, for a total contract amount not to exceed $480,348. 4. Award a contract to CS & Associates, Inc., for labor compliance services for the Santa Clarita Valley Sheriff's Station in the amount of $68,425 and authorize a contingency in the amount of $6,843, for a total contract amount not to exceed $75,268. 5. Extend the current contract and authorize an increased expenditure authority for soils and material testing services with R. T. Frankian & Associates in the amount of $343,400 and authorize a contingency in the amount of $34,340, for a total amount not to exceed $377,740. 6. Extend the current contract and authorize an increased expenditure authority for civil engineering and surveying services with Hunsaker & Associates in the amount of $229,196 and authorize a contingency in the amount of $22,920, for a total amount not to exceed $252,116. Extend the current contract and authorize an increased expenditure authority for project management services with MNS Engineering, Inc., in the amount of $861,570 and authorize a contingency in the amount of $86,157, for a total amount not to exceed $947,727. 8. Extend the current contract and authorize an increased expenditure authority for construction management services with Arcadis U.S. Inc. in the amount of $481,427 and authorize a contingency in the amount of $48,143, for a total amount not to exceed $529,570. 9. Extend the current contract and authorize an increased expenditure authority for architectural services with WLC Architects in the amount of $226,250 and authorize a contingency in the amount of $22,625, for a total amount not to exceed $248,875. 10. Authorize the procurement and installation of specialized communications equipment totaling $1,419,569; utilize $1,244,782 of Federal Forfeiture Funds retained by the County; appropriate $138,950 from the State Forfeiture Fund (259) and $35,837 from the Facilities Fund (723). 11. Appropriate additional funding to the Santa Clarita Valley Sheriff's Station project as follows: $35,467,004 from the Facilities Fund (723) to expenditure account F3023723- 5161.001; $2,057,766 from Law Enforcement Facility Impact Fees (Fund 306) to expenditure account F3023306-5161.001; and $165,000 from the Air Quality Mangement District Fund (232) to expenditure account F3023232-5161.001. 12. Adopt a resolution approving a loan from the Facilities Fund (723) to the Eastside Bridge & Thoroughfare District Fund (301) in the amount of $2,000,000 and appropriate to expenditure account F3023301-5161.001. 13. Appropriate $266,666 to Sheriff's Station Art account A3001602-5161.001; increase Facilities Fund transfers out account 72319500-5501.602 and transfers in account 602- 4711.723 by $266,666. 14. Increase the Facilities Fund Miscellaneous Revenue account 723-4621.001 by $69,628 to account for the use of available construction and demolition funds. 15. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval. BACKGROUND In May 2016, the City of Santa Clarita (City) and Los Angeles County (County) entered into a Memorandum of Understanding (MOU) to construct a new 45,000 -square -foot sheriffs station, along with a 4,000 -square -foot vehicle maintenance facility and helipad to serve the entire Santa Clarita Valley. The current station, located at 23740 Magic Mountain Parkway, was built in 1972 and is no longer adequate to effectively serve the needs of the community. A new Santa Clarita Valley Sheriff's Station (Sheriff's Station) is identified under the Public Safety theme of the City's five-year strategic plan, Santa Clarita 2020. In November 2016, the City Council awarded contracts for Phase I of the project, which included the preparation of the environmental and geotechnical studies, and concept design. Subsequently, Page 2 in June 2017, the initial study and Mitigated Negative Declaration (MND) for the project was completed in compliance with the California Environmental Quality Act as part of Phase L The final MND was approved and certified by the City Council on August 22, 2017. In October 2017, the City Council awarded an architectural and civil design contract for Phase II of the project, which included finalizing the concept design developed in Phase I and the preparation of all associated architectural, structural, and civil engineering drawings and specifications necessary for the construction of the project. Phase III construction activities for the Sheriff's Station have been divided into the following three sub phases: Phase III A - Onsite Improvements In June 2018, the City Council awarded contracts for Phase III A - Onsite Improvements, which included grading, retaining walls, drainage improvements, traffic control, erosion control, and demolition. This phase has been completed. Phase III B - Onsite Construction This phase includes the main station building, detention facility, helipad, vehicle maintenance building, visitor parking, staff parking, generator, fuel station, wet utilities, dry utilities, radio antenna tower, perimeter walls, landscaping, furnishings, fixtures, and equipment. Phase III C - Golden Valley Road Right -of -Way Improvements In January 2019, the City Council awarded contracts for Phase III C - Golden Valley Road Right -of -Way Improvements. The work includes demolition, water, gas, power, AT&T telephone, AT&T fiber, Spectrum fiber, Spectrum cable TV, City fiber, storm drain, roadway improvements, median modifications, west curb and gutter, west streetlights, southbound lanes repairs and paving, west sidewalk, commercial driveways, and an emergency response traffic signal. This phase is currently in construction and the work is anticipated to be completed by fall 2019. Solicitation Process for the Phase III B - Onsite Construction Contract An invitation to submit bids for Phase III B - Onsite Construction was published three times in The Signal newspaper beginning on February 28, 2019, and was posted to PlanetBids. On April 18, 2019, Purchasing received four bids from the list of five pre -qualified general contractors. The results are shown below: Company Location Bid Amount Icon West Inc. Amoroso Construction Company Costa Mesa, CA $48,577,000 Staff recommends the construction contract be awarded to Icon West Inc., the lowest pre- qualified bidder. Icon West Inc. possesses a valid Class B state contractor's license and is in good standing with the Contractors State License Board. The bid has been reviewed for accuracy Page 3 and conformance to the contract documents and found to be complete. The County has been included throughout the selection process of the contractor and supports the selection of Icon West Inc. Solicitation Process for Material Testing and Inspection Services On February 26, 2019, a Request for Proposal (RFP) for material testing and inspection services for Phase III B - Onsite Construction was advertised on the City's website. The RFP asked firms to identify proposed staffing and their relevant construction experience with similar projects to specify their qualifications for this project. On March 19, 2019, the City received 11 proposals. All 11 proposals were reviewed and evaluated by City staff. Based on the evaluation criteria set forth in the RFP, the following is a summary of the firms' rankings: Rank Company 1. United -Heider Inspection Group 2. RMA Group 3. Geo Tek, Inc. 4. Location Score (Maximum 100 points) Moreno Valley, CA 92.3 Carson, CA 91.7 Corona, CA 85.3 Ventura, CA 84.7 Oxnard, CA 79.0 Monrovia, CA 76.7 Ventura, CA 76.7 Paramount, CA 59.0 Anaheim, CA 58.3 Los Angeles, CA 55.3 Chino, CA 53.0 The rating system heavily emphasized the consultant staff's experience and qualifications as they relate to this Sheriff's Station project and their understanding of law enforcement facilities. After review, City staff interviewed the top two proposed consultants to ensure they will be able to provide full compliance with the plans and specifications as required throughout construction of the project. Based on their experience, completeness of their proposal and interview responses, staff recommends the City Council award the material testing and inspection services contract to United -Heider Inspection Group as the most qualified company to meet the project's needs. The requested contingency of $43,668 will cover costs for additional, as needed services as the construction project continues. California Government Code 4526 prescribes selection of architectural and engineering services to be based on demonstrated competence and professional qualifications necessary for the satisfactory performance of the services required, does not authorize the selection of professional architectural and engineering services based on costs, and does not require the cost proposals to be sealed. Staff opened United -Heider Inspection Group's cost proposal and negotiated a final contract at a fair and reasonable price for the services requested in the RFP. Page 4 Solicitation Process for Labor Compliance Services Citywide labor compliance services are currently being performed by the City's Labor Compliance Specialist. However, the Sheriff's Station is large and multi -dimensional in scope and will require a dedicated effort to ensure full labor compliance for the contractor and all sub- contractors. On February 15, 2019, an RFP for labor compliance services for Phase III B - Onsite Construction was advertised on the City's website. The RFP asked firms to identify proposed staffing, relevant construction experience with similar projects and specify their qualifications for this project. On March 18, 2019, the City received four proposals. All four proposals were reviewed and evaluated by City staff. Based on the evaluation criteria set forth in the RFP, the following is a summary of the firms' rankings: Rank Company Location Score (Maximum 100 points) 1. CS and Associates, Inc. Fontana, CA 46.7 The rating system heavily emphasized the consultant's commitment and qualifications of the project team as they relate to this Sheriff's Station project. Based on their experience, completeness of their proposal, and understanding of the community as a local company, staff recommends the City Council award the labor compliance services contract to CS and Associates, Inc., as the most qualified company to meet the project's needs. The requested contingency of $6,825 will cover costs for additional, as needed services as the construction project continues. In November 2016, the City Council approved contracts with MNS Engineers Inc., R.T. Frankian & Associates, and Hunsaker & Associates for various components of Phases I and II of the project. MNS has provided project management services, R.T. Frankian & Associates has provided geotechnical site studies and soil testing, while Hunsaker & Associates has provided civil engineering and surveying for the design of the facility and grading. The knowledge and expertise of each firm continues to be valuable to the project and are needed to ensure compliance with the design specifications and environmental documents. Staff has negotiated a fair and reasonable fee with these firms for the work required to complete Phase III B - Onsite Page 5 Construction. The recommended action to extend the current contracts for each firm will provide for an uninterrupted transition from the current phase to Phase III B - Onsite Construction and successful completion of the project. With regard to the purchase and installation of specialized communications equipment, the City will transfer $174,787 to the Los Angeles County Sheriff's Department for the procurement and installation of the following specialized equipment: various communication antennas, telecom equipment, transceivers, security electronics, dispatch radios, dispatch consoles, and network interface devices. The remaining costs in the amount of $893,897 will provide for City staff time, public works inspection, landscape inspection, permit fees, legal fees, temporary construction utilities, offsite and onsite property maintenance, project management software, and miscellaneous project administrative costs. In addition, this project will have a civic art component that will be accessible to the public at the main building of the new Sheriff's Station. Under the Civic Art Policy, the Sheriff's Station qualifies as a City capital improvement project that allocates 1 percent of eligible project costs towards civic art. The requested budget of $266,666 will provide for costs related to labor, material, and installation of the art component. It is anticipated that the Arts Commission will recommend the approval of the selected artist and concept to the City Council in fall 2019. ALTERNATIVE ACTION Other action as determined by the City Council. FISCAL IMPACT Upon approval of the recommended actions, adequate funds will be available in the budget to provide for the Santa Clarita Valley Sheriff s Station Phase III B construction and construction support contracts as well as all anticipated project costs. The requested appropriations of $39,864,557, available funds of $11,513,440 in trust account 102-2010.073 (SCV Sheriff's Station -County Contribution), and $1,244,782 Federal Drug Forfeiture Funds retained by the County will fund the total remaining project need of $52,622,779. The County's recent contribution of $3 million has increased their total contribution to $18 million towards this project. Additionally, adequate funds will also be available to fund the Sheriffs Station art component. NOW, THEREFORE, the City Council of the City of Santa Clarita, California, does hereby resolve as follows: SECTION 1. It is agreed that $2,000,000 from the City's Facilities Fund will be loaned to the Eastside Bridge & Thoroughfare District. SECTION 2. The amount of the loan will be paid back at a future time when funds in the amount of $2,000,000 are available to repay the loan back to the City's Facilities Fund. SECTION 3. The loan will be paid back at an interest rate equivalent to the yield of the average monthly investment portfolio. SECTION 4. The City Clerk shall certify to the adoption of this resolution. V. Task, Sub Task and Output Labor Compliance services will be managed, developed, coordinated, and implemented by CS & Associates' staff, or administered in conjunction with designated members of the City of Santa Clarita staff to meet the needs of the of the respective project(s). CS & Associates, Inc. proposes to provide a complete Labor Compliance Program, or selected components thereof, which ensure compliance with all categories of Labor Code Section 1771.5 as well as the Davis Bacon Act: A. Task- Pre -Construction Services: Necessary services rendered prior to the start of construction which are facilitate overall compliance or are required pursuant to Labor Code or DIR requirements. • Work with the City of Santa Clarita to ensure that all project legal notices contain the proper LCP notifications to bidders; and statement of payment of prevailing wage requirements as stated in Labor Code Section 1771.5. • Inform bidders of LCP requirements during the Project's pre-bid job walk and pre -construction meeting, as requested by the City of Santa Clarita. • Provide direction and guidance to bidders in their queries regarding compliance with the LCP, including payment of prevailing wages, identification of labor classifications, and proper completion and submission of forms and notices. • Conduct a comprehensive, hands-on training with payroll administrators employed by contractors submitting certified payroll records. Trainings are conducted at the start of each project for the prime contractor and all subcontractors, and on an "as needed basis" throughout the life of the project. Output: The consistent and thorough delivery of pre -construction services is not only required, as in the case of the pre -construction meeting, but is an excellent opportunity to disseminate essential information and required materials to the contractor and subcontractor. This also assists in building early and cooperative communication with the contractor and subcontractor which increases the level of compliance and reduces violations on the overall project. B. Task- Construction Services: Necessary and required services delivered after the start of construction and during the life of the project through project completion and close out. Routinely perform the following services during the course of construction of the Project: • Collect and record the receipt of weekly Certified Payroll Records Pursuant to Labor Code Sections 1771.5(4), 1776, and California Code of Regulations 16401, 16402, 16403 as well as any applicable Federal statutes. • Conduct a thorough review and examination of all Certified Payroll Records as necessary to ensure the required payment of prevailing wage per the applicable craft and worker classification. • Conduct random audits of Certified Payroll Records. Note the number of workers on the site and interview a sufficient number to ensure that they are receiving the proper prevailing wage rate for the duties performed. • Maintain interview data and later compare to relevant Certified Payroll Records • Investigate all allegations of failure to pay prevailing wage rates and/or worker complaints per project. • Make a formal request for payroll and time reporting documentation to the contractor and conduct an objective comparison of records to source documents and Certified Payroll Records. • Prepare a report and/or memo to the file summarizing the investigation and findings. • Process public records requests for certified payroll records and ensure that privacy considerations are observed pursuant to the Labor Code and California Code of Regulations. • Conduct all follow up activities and ensure overall compliance with record keeping and reporting requirements. • Coordinate with the City of Santa Clarita staff, Project Manager, and DSA Project Inspector as necessary to ensure that the City of Santa Clarita's employees and agents are informed of LCP issues that may impact the completion of the project. Attend and participate in on-site meetings, or other meetings, as requested by the City of Santa Clarita. Output: The routine and methodical implementation of the above referenced services is not only required pursuant to Labor Code Section 1771.5, but they facilitate the consistent enforcement of the payment of prevailing wage rates as work progresses. The consistent collection, review and random auditing of certified payroll records and required submittals facilitates compliance efforts as well as prevents the late discovery of violations or lengthy investigations at project close out. In addition, the weekly collection, review and reporting of records allows the City to verify compliance prior to the release of each pay request. C. Task - Record Keeping: The accurate maintenance and storage of collected records. Archive and store Certified Payroll Records and LCP documentation for the requisite period of time. • Provide progress updates, submitted to designated departments or persons within the City of Santa Clarita, on a monthly basis or as necessary to keep the City of Santa Clarita apprised of ongoing or developing LCP issues. • Compile a record of LCP activities, which fulfills the annual LCP reporting requirements to the City of Santa Clarita, DIR and DOL, if applicable, and submit same to the City on or before the designated due date each year. Output: The organized archiving and storage of records during the life of the project and the proper close out and reconciliation of the data base to the physical file. Ensure there are no gaps in records and not missing submittals. D. Tasks - Violation Investigations and Audits: Engage in the actions necessary to escalate a matter to the level of a formal enforcement action. • Calculate back wages and penalties for each worker complaint, for each project. • Review preliminary findings with contractor and or subcontractor and provide an opportunity to submit mitigating evidence and/or explanation. Upon receipt of approval, file a "Notice of Withholding of Contract Payment" with the required parties. • Work with the City of Santa Clarita staff and legal counsel conduct settlement conferences and negotiate a resolution where possible. • Conduct or facilitate training, as requested by the City of Santa Clarita. • Work with the City of Santa Clarita and its legal counsel to conduct appeal hearing preparation and participate in all required pre -hearing conferences. • Attend and testify on behalf of the City of Santa Clarita at appeal hearing(s). • Assist in litigation related to LCP issues brought by third parties. • Perform other duties as requested by the City of Santa Clarita. Output: Engage in all necessary activities to ensure the proper collection of back wages and penalties. Follow the case through to completion; engage in settlement discussion for a swifter case resolution. E. Supplemental Services CS & Associates, Inc. is prepared to fully administer all of the requirements of your Labor Compliance Program whether the City of Santa Clarita requires the electronic submission of records by contractors or accepts hard copies. CS & Associate's customized software permits staff to maintain a comprehensive data base for the collection and verification of Certified Payroll Records in a time efficient manner. The software generates notices when certain inconsistencies or inaccuracies are detected by the system. CS & Associates' trained staff will conduct all necessary follow up, as well as random audits, to achieve compliance and ensure the payment of prevailing wage rates. No additional work will be performed based upon signed field tickets unless contractual accommodations are made prior to starting the project. Items of work that are not clearly defined prior to the authorization to proceed will be performed on a time and material basis per attached fee schedule or upon such a lump sum addition to the contract, as agreed upon by the Contractor prior to proceeding with such items of work. 3. Work may be requested that, due to the Contractor's schedule, requires work to be performed during non -business hours. If such work is required, a request for a premium time may be made. Premium time shall be deemed extra work and will apply to scope items or non -scope items. Premium time will be paid at 150% of the hourly rates. August -September 2018 Floor Plan Changes........................................................ $46,800.00 Redesign of the Type I Jail area and approximately 60 floor plan changes from adding square footage to detective bureau, to walls moving, adding and omitting casework, adding, moving doors that affected up to 200 drawing sheets and all disciplines from structural, MEP and low voltage. 3. Create Conformed Set of Construction Documents ............................................... $8,250.00 Incorporate all Bid Addenda and bid RFI responses into the project drawings and specifications for City Project Team's use as well as the contractors use. 4. Construction Administration Services for 2 months added to Construction Schedule. $50,200.00 The original schedule had 19 months for construction of the project. While providing services to the City, decisions were made between the City and the L.A. County Sheriff's Department which affectively changed the original Substantial Completion and Project Completion dates which were used to establish our fee proposal. Our original contracted Fee Schedule had Arcadis providing services for approximately 19.5 months. The City's project manager is now projecting our services will be required for approximately 26 months (through April 2021) based on the new Substantial Completion date of 2/5/21 and projected `closeout paperwork' through April 2021. The additional 6.5 months of CM services is reflected in the attached Staffing Fee Schedule. B. We have included in the Staffing Fee Schedule our recommendation for a nominal monthly increase of scheduling support to review the contractors monthly cost loaded schedule and an allowance of time to review potential Time Impact Analysis (TIA) per month on an as needed basis.
