You may address the Council once per meeting during Public Participation on any matter within the Council's jurisdiction that is not listed on the agenda. Public Participation speaker's cards must be submitted to the City Clerk BEFORE this portion of the meeting begins. To address the Council regarding an item on the agenda, please fill out a speaker's card and submit it to the City Clerk BEFORE the Mayor announces the item. Each person addressing the Council is given three minutes to speak (with double the time allotted to non-English speakers using a translator) indicated by a colored light system on the Council dais. If you wish to provide information to the Council, please present the City Clerk with 10 copies. Otherwise, your materials will simply be added to the official record. Please note use of City Council Chamber technology equipment to present electronic material during meetings is not allowed. In compliance with the Americans with Disabilities Act, if you need special assistance to participate in this meeting, please contact the City Clerk's Office, (661) 255-4391. Notification 48 hours prior to the meeting will enable the City to make reasonable arrangements to ensure accessibility to this meeting. (28CFR 35.102-35.104 ADA Title II) Pursuant to Government Code 54957.5 any writings or documents distributed to a majority of the members of the City Council regarding any open session item on this agenda will be made available for public inspection in the City Clerk's Office located at 23920 Valencia Boulevard, Suite 120, during normal business hours. These writings or documents will also be available at the meeting. INVOCATION Weste CALL TO ORDER ROLL CALL FLAG SALUTE EXECUTIVE MEETING This time has been set aside for Councilmembers to review the agenda and obtain any further information that may be needed. Council will also discuss each individual item during the course of the meeting with the exception of the Consent Calendar, which may be approved in its entirety by one motion, unless there is a request to pull an item for discussion. No action will be taken on public agenda items during the Executive Meeting. APPROVAL OF AGENDA AWARDS AND RECOGNITIONS Code Enforcement Officer Appreciation Week NRPA Award for Jake's Way Program Proclaim October 12 as Rubber Ducky Day in Santa Clarita PRESENTATIONS Mars Petcare Better City for Pets Certification Recognition PUBLIC PARTICIPATION This time has been set aside for the public to address the City Council on items NOT listed on the agenda. The City Council will not act upon these items at this meeting other than to review and/or provide direction to staff. All speakers must submit a speaker's card to the City Clerk PRIOR to the beginning of this portion of the meeting. Thirty minutes are allotted for public input at this time. The FIRST TEN people to submit a speaker card prior to the beginning of Public Participation will be heard. Speaker cards will be accepted beginning at 5:45 p.m. Any speaker cards received once the first speaker has begun will be heard at the end of the meeting regardless if the ten person limit has been met. STAFF COMMENTS COMMITTEE REPORTS/COUNCILMEMBER COMMENTS Page 2 CONSENT CALENDAR All matters listed under the Consent Calendar are considered routine and will be enacted by one motion by the City Council. The items are not individually discussed by the City Council unless a request is made by a member of the public or the Council, in which case, the item(s) will be removed from the Consent Calendar and will be considered separately. 1. APPROVAL OF REGULAR MEETING MINUTES — The minutes of the City Council are submitted for approval. RECOMMENDED ACTION: City Council approve the minutes of the September 24, 2019 Regular Meeting. 2. CHECK REGISTER NO. 20 - Check Register No. 20 for the Period 08/30/19 through 09/12/19 and 09/19/19. Electronic Funds Transfers for the Period 09/02/19 through 09/13/19. RECOMMENDED ACTION: City Council approve and ratify for payment the demands presented in Check Register No. 20. 3. READING OF ORDINANCE TITLES - Government Code Section 36934 requires that all ordinances be read in full prior to Council taking action on the ordinance. By listing the ordinance title on the Council agenda, Council may determine that the title has been read. RECOMMENDED ACTION: City Council determine that the titles to all ordinances which appear on this public agenda have been read and waive further reading. 4. SECOND READING AND ADOPTION OF AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, ADDING SECTION 13.76.045 TO THE SANTA CLARITA MUNICIPAL CODE CONCERNING STREET TREES - This ordinance will allow for the transfer of ownership and maintenance responsibility for street trees in limited circumstances where such transfer would be in the best interests of the City and private property owners. RECOMMENDED ACTION: City Council conduct a second reading and adopt an ordinance entitled, "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, ADDING SECTION 13.76.045 TO THE SANTA CLARITA MUNICIPAL CODE CONCERNING STREET TREES." Page 3 5. SECOND READING OF AN ORDINANCE CONCERNING COUNCILMEMBER COMPENSATION PER GOVERNMENT CODE SECTION 36516 - Government Code Section 36516(a) allows regular adjustments to the City Council compensation. The second reading of the ordinance increases Councilmember compensation by a total of 10 percent effective 2021. The last increase of Councilmember compensation was effective in 2017. RECOMMENDED ACTION: City Council conduct a second reading and adopt an ordinance entitled "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, AMENDING SECTION 2.04.048 OF THE SANTA CLARITA MUNICIPAL CODE REGARDING CITY COUNCIL SALARY." 6. EASEMENT DEDICATION TO SOUTHERN CALIFORNIA EDISON COMPANY FOR NEEDHAM RANCH - Easement dedication to Southern California Edison Company within Lot 12 of Tract No. 50283-01 (Needham Ranch). RECOMMENDED ACTION: City Council approve and authorize the City Manager or designee to execute the attached Grant of Easement (EAS19-00023)to Southern California Edison Company. 7. THE MAIN LEASE AGREEMENT - Approval of a one-year lease agreement with MAGA L.P. for the rental of the property known as The MAIN, located at 24266 Main Street, from January 1, 2020, to December 31, 2020, with a one-year optional renewal. RECOMMENDED ACTION: City Council: Approve a one-year lease agreement with MAGA L.P. for the rental of the property known as The MAIN, located at 24266 Main Street from January 1, 2020, to December 31, 2020, with an optional one-year renewal, in the amount not to exceed $60,360 annually. 2. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval. 8. AWARD CONTRACTS FOR DRAINAGE BENEFIT ASSESSMENT AREA PREVENTATIVE MAINTENANCE, INSPECTION, AND REPAIR SERVICES - Award contracts to Flo -Services, Inc., for Drainage Benefit Assessment Area preventative maintenance, inspection, and repair services. RECOMMENDED ACTION: City Council: 1. Award a two-year contract to Flo -Services, Inc., for Drainage Benefit Assessment Area preventative maintenance, inspection, and repair services for an annual amount of $76,202 and authorize an annual contingency of $11,431 to address unforeseen maintenance and repairs, for a total two-year amount not to exceed $175,266. 2. Authorize the City Manager or designee to execute up to three additional, one-year Page 4 renewal options beginning in year three, not to exceed the annual contract amount, inclusive of a contingency of $11,431, plus an adjustment consistent with the appropriate Consumer Price Index, upon request of the contractor, and contingent upon the appropriation of funds by the City Council in the annual budget for such fiscal year. 3. Award a contract to Flo -Services, Inc., for one-time repairs at Drainage Benefit Assessment Areas 6 and 18 for an amount of $119,619 and authorize a contingency of $17,943 to address unforeseen repair issues, for a total contract amount not to exceed $137,562. 4. Authorize $137,562 in one-time base budget appropriations from Fund 357 for Fiscal Year (FY) 2019-2020 to expenditure account 12516-5161.013. 5. Authorize the City Manager or designee to execute all contracts and associated documents, modify the awards in the event impossibility of performance arises, and execute all documents subject to City Attorney approval. NEW BUSINESS 9. CONSIDERATION OF AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, ADOPTING A MORATORIUM ON THE ESTABLISHMENT OF NEW TOBACCO RETAILERS WHO SELL FLAVORED TOBACCO PRODUCTS - This urgency ordinance would place a 45 -day moratorium on new tobacco retailers who sell flavored tobacco products in the City of Santa Clarita. The urgency ordinance requires a minimum 4/5 vote. RECOMMENDED ACTION: City Council: 1. Consider adoption of an urgency ordinance entitled: "AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, ADOPTING A MORATORIUM ON THE ESTABLISHMENT OF NEW TOBACCO RETAILERS WHO SELL FLAVORED TOBACCO PRODUCTS." 2. Direct staff to set a public hearing and return within 45 days with a further report and ordinance extending this moratorium for Council consideration. PUBLIC PARTICIPATION This time has been set aside for any speakers that have turned in speaker cards and were not heard in the first thirty minutes allotted to address the City Council on items that are NOT on the agenda. No further speaker cards will be accepted once Public Participation begins. Speaker cards may not be submitted relating to any items listed on the agenda. Mary Cusick City Clerk Santa Clarita, California Page 6 PROCLAMATION WHEREAS, Code Enforcement Officers provide for the safety, health, and welfare of citizens in communities throughout the State of California through the enforcement of local, state, and federal laws and ordinances dealing with various issues of building, zoning, housing, animal control, environmental, health, and life safety; and WHEREAS, Code Enforcement Officers have challenging and demanding roles and often do not receive recognition for the job they do in improving quality of life for residents and businesses of local communities; and WHEREAS, the role of many Code Enforcement Officers has expanded in recent years, with jurisdictions increasingly relying on the expertise and training of Code Enforcement Officers in their communities; and WHEREAS, Code Enforcement Officers are dedicated, highly qualified, and highly trained professionals who share the goals of preventing neighborhood deterioration, enhancing communities, ensuring safety, and preserving property values through knowledge, training, and application of housing, zoning, and nuisance laws; and WHEREAS, Code Enforcement Officers often have a highly visible role in the communities they serve, and regularly interact with the public and a variety of federal, state, county, and local officials in their capacity as Code Enforcement Officers; and WHEREAS, the City of Santa Clarita wants to recognize and honor the Code Enforcement Officers that serve our community and acknowledges their role in leading the way to improve quality of life within the City. NOW, THEREFORE, the City of Santa Clarita, California, hereby proclaims the second week of October in 2019, as Code Enforcement Officer Appreciation Week in the City of Santa Clarita, and calls upon Santa Clarita residents to join in recognizing and expressing their appreciation for the dedication and service by the individuals who serve as our Code Enforcement Officers. Marsha McLean, Mayor Santa Clarita, California PROCLAMATION Rubber Ducky Festival Day October i WMREAS, Samuel Dixon Family Health Centers, Inc. along with their sponsors, focus on improving patient care for the underinsured and uninsured of the Santa Clarita Valley, and will be hosting a Rubber Ducky Festival; and WBEREAS, the community has the opportunity to participate by "adopting" a rubber duck, Quack Pack, Quacker's Dozen or Duck Flock to compete in a the duck race at the 17' annual family festival; and WWEAEAS, numerous community and media partners involved in the Rubber Ducky Festival demonstrate their dedication to the overall well being of the Santa Clarita Valley with their involvement in this event; and WBEREAS, funds raised by the Rubber Ducky Festival go towards helping our friends and neighbors in the Santa Clarita Valley with all proceeds benefiting patient care. NOW, TBEREFORE, the City of Santa Clarita proudly proclaims October 12, 2019, as Rubber Ducky Festival Day in anticipation of the Rubber Ducky Festival fundraiser and festival sponsored by Samuel Dixon Family Health Centers, Inc. to be held at Bridgeport Park and urges Santa Clarita residents to adopt a duck!
