HomeMy WebLinkAbout2020-03-19 - AGENDAS - CONSIDERATION OF AWARD OF CONTRACT TO NATIONAL DEM (2)O Agenda Item: 2 P CITY OF SANTA CLARITA AGENDA REPORT CITY MANAGER APPROVAL:1 DATE: March 19, 2020 SUBJECT: CONSIDERATION OF AWARD OF CONTRACT TO NATIONAL DEMOGRAPHICS CORPORATION FOR DISTRICTING SERVICES TO TRANSITION FROM AT -LARGE TO DISTRICT -BASED ELECTIONS FOR CITY COUNCIL PURSUANT TO ELECTIONS CODE SECTION 10010 AND GOVERNMENT CODE SECTION 34886 EFFECTIVE FOR THE NOVEMBER 2020 GENERAL MUNICIPAL ELECTION DEPARTMENT: City Manager's Office PRESENTER: Joseph Montes RECOMMENDED ACTION City Council: Award a contract to National Demographics Corporation for Districting Services in an amount not to exceed sixty thousand dollars to transition from at -large to district -based elections for City Council, subject to final language approval by the City Manager and City Attorney. 2. Authorize the transfer of $60,000 from Contingency Account 19300-5401.001 to Non - Departmental Contractual Services Account 19000-5161.001. BACKGROUND On March 20, 2020, the City Council adopted a Resolution of Intention to switch to election by district for the November 2020 election. The background for that decision and explanation of the transition to district process is set forth in the Resolution of Intention and associated staff report. Transition requires the services of a qualified demographer. City staff solicited proposals from National Demographics Corporation ("NDC") and Lapkoff & Gobalet Demographic Research, Page 1 Packet Pg. 37 O Inc. for these services. Both firms have provided such services to numerous jurisdictions and the cost proposals were equivalent. Based upon NDC's familiarity with the Santa Clarita Valley (having done work for Castaic Elementary School District, Newhall Elementary School District, Santa Clarita Valley Water, and Sulphur Springs Elementary School District), as well as the fact that NDC is local (and anticipating potential travel interruptions over the next few months based upon the Covid-19 pandemic), staff recommends the Council award a contract to NDC for districting services. Under Elections Code section 10010 the City has 90 days within which to conduct 5 or more public hearings to consider potential district boundaries, as well as an ordinance that would switch the City Council to election by districts. Prior to consideration of such an ordinance, the City must conduct two public hearings to solicit input from the public regarding the composition of the districts. Subsequent to the two public hearings, proposed district maps are generated by the demographer and posted for at least 7 days and two more hearings are held to solicit input on the proposed district boundaries, as well as the sequencing of districts for staggered terms of office. At the conclusion of these hearings, the Council can adopt an ordinance switching to districts. As outlined in the proposal attached to this staff report, NDC would participate in the public hearings required by the Elections Code as part of the districting process. NDC would also analyze and draft districting maps, as well as provide paper and on-line tools for public participation in map drafting. ALTERNATIVE ACTION Other action as determined by City Council. FISCAL IMPACT Upon approval of the recommended action, the budget will be adjusted accordingly. NDC has 40 years of experience districting and redistricting local jurisdictions, together with unmatched experience working with jurisdictions facing California Voting Rights Act (CVRA) concerns. Based in Glendale, NDC has worked on CVRA analysis and districting efforts for over 100 cities, 250 school districts, and scores of other local California jurisdictions across the state — including the City's 2013-2014 CVRA project. NDC possesses all the hardware and software necessary to the districting and redistricting needs of any jurisdiction, and its personnel have extensive experience in the line -drawing side of districting and redistricting work as well as in developing the databases used for these purposes. The technical demands of a districting effort are high, and NDC is the undisputed leader in this area. But far more important than technical expertise are the interpersonal understanding and experience working with all parties in the process, including the public. NDC's "3 E's" approach to Engaging, Educating and Empowering community residents offers unmatched experience and unique tools for public participation in the districting process. Public Involvement NDC pioneered the "transparent districting" approach which involves the public at every stage of the process. Often five, ten or even twenty or thirty draft maps are proposed by community residents. And NDC developed has a highly refined and proven methodology for efficiently guiding the community and the Council through selecting and refining a map, even when starting from 10, 20, 30 or even 40 initial draft maps. Minority Group Outreach/Partnerships U.S. Supreme Court decisions are constantly changing the rules regarding districting, "race - based districting," and the establishment of districts focused on the electoral power of "protected classes." It is crucial that the consultant work with the racial, ethnic, and other community groups at the beginning of the process to welcome their ideas and develop the appropriate expectations regarding minority representation prospects. No NDC local districting or redistricting plans has ever been overturned in Court, nor have any even faced a Department of Justice challenge (much less lost such a challenge). Openness Any change in election systems can have momentous implications for the distribution of political power in a jurisdiction and for access by groups and individuals to the governance process. Not surprisingly, such changes often attract considerable public attention, sometimes generate intense controversy, and may draw charges of manipulation and abuse of power. It is crucial, therefore, that the jurisdiction establish, at the beginning, a process that is not only fair, but that is seen to be fair, to all contending groups and individuals. Media Outreach NDC's work has been widely praised in the media, and NDC has worked extensively on with all types of press including radio, television, newspaper, and new media. Local Leadership NDC views its role as an advisor and technical resource. The firm advises its clients, but every project remains the client's project. NDC presents advice and options based on its experience and expertise, but ultimately the decisions are made by the jurisdiction itself. Timeline: A timeline will be established in consultation with the client. This typically takes three to nine months, but can be done faster when necessary. NDC has reviewed the City's draft timeline, and we can manage the dates and deadlines in that schedule. Other Potential Project -Related Expenses: The only anticipated additional districting expenses would be any site or staff costs for conducting the community forums; and the cost of printing or copying paper copies of the "Public Participation Kit." In NDC's experience, most public participants will download and print the Kits in their own homes or offices.
