HomeMy WebLinkAbout2020-04-28 - AGENDA REPORTS - APPLICATION FOR AND RECEIPT OF STATE TRANSIT ASSIS (2)Agenda Item: 17 P CITY OF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR CITY MANAGER APPROVAL:1 DATE: April 28, 2020 SUBJECT: APPLICATION FOR AND RECEIPT OF STATE TRANSIT ASSISTANCE FUNDS DEPARTMENT: Neighborhood Services PRESENTER: Adrian Aguilar RECOMMENDED ACTION City Council adopt a resolution allowing the City Manager or designee to submit an annual claim to the Los Angeles County Metropolitan Transportation Authority for State Transit Assistance funds. BACKGROUND The City of Santa Clarita (City) is eligible to receive State Transit Assistance (STA) funds through the Los Angeles County Metropolitan Transportation Authority (Metro) for transit operating assistance. To receive the revenue, the City must submit an annual claim form to Metro, authorized by the City Council. STA funds are derived from the statewide sales tax on diesel fuel and are appropriated by the California State Legislature to the State Controller's Office (SCO). The SCO then allocates the tax revenue, by formula, to planning agencies and other selected agencies. In Los Angeles County, STA is administered by Metro and is used to finance various transportation projects. All Transit operators within Los Angeles County must file claims in order to receive their fair share. In the past, the City received an equivalent share of STA funds from the Proposition A Discretionary Fund, but not from STA directly. Due to a recent change made by the SCO, the City is now eligible to receive a direct allocation of STA funds; therefore, requiring the annual claim process to be followed. The claim to be submitted must include a Statement of Standard Assurances, historical and projected financial data for capital and operational expenditures, justification statements, a statement from the Chief Financial Officer certifying full funding of the City's retirement system, and a current California Highway Patrol Certification. In addition, adoption of a resolution by the agency's governing body is required, authorizing the City Manager or designee to submit the annual claim package to Metro. This resolution only allows the City to submit the annual claim form and enter into agreements to receive the annual allocation. These funds are already included in the annual budget. ATTACHMENTS STA Resolution Page 2 Packet Pg. 156 17.a RESOLUTION NO. 20- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, AUTHORIZING THE FILING OF THE ANNUAL CLAIM WITH THE LOS ANGELES METROPOLITAN TRANSPORTATION AUTHORITY FOR STATE TRANSPORTATION ASSISTANCE FUNDS WHEREAS, the State Transportation Development Act (TDA), as amended by the Mills- Alquist-Deddeh Act (Public Utilities Code Section 99200 et seq.) provides for the allocation of State Transit Assistance (STA) funds, derived from the statewide sales tax on diesel fuel; and WHEREAS, these funds are available for use by eligible claimants for various transportation purposes; and WHEREAS, pursuant to the provisions of the TDA, as amended, and pursuant to the applicable rules and regulations thereunder (Cal Code of Regulations, Title 21, Sections 6600 et seq.), a prospective claimant wishing to receive an allocation from the STA shall file its annual claim with its county transportation authority; and WHEREAS, the City of Santa Clarita is an eligible claimant and desires to file a claim for STA funds with the Los Angeles County Metropolitan Transportation Authority (Metro). NOW, THEREFORE, the City Council of the City of Santa Clarita, California does hereby resolve as follows: SECTION 1. The City Council is hereby authorized and directed to apply and submit the annual claim for STA funds. SECTION 2. The City Manager or designee is hereby authorized to execute and file an appropriate claim with Metro pursuant to the terms of the STA, as amended, and pursuant to the applicable rules and regulations promulgated thereunder, together with all necessary supporting documents, for annual allocation of STA funds. SECTION 3. A copy of this resolution shall be transmitted to Metro in conjunction with the filing of the annual claim. SECTION 4. The City Clerk shall certify to the adoption of resolution.
