RESOLUTION NO.20-29
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA,
CALIFORNIA, PROCLAIMING THE EXISTENCE OF A LOCAL EMERGENCY DUE TO
CIVIL UNREST AND ORDERING A CURFEW
WHEREAS, California Government Code Section 8630 provides that a local emergency
may be proclaimed by the governing body of a city and Government Code Section 8634
empowers the Santa Clarita City Council and delegated officials to promulgate orders and
regulations necessary to provide for the protection of life or property, including, but not limited
to, the imposition of a curfew; and
WHEREAS, in the days following the May 25, 2020 death of George Floyd by members
of the Minneapolis Police Department, conditions of disaster or extreme peril to the safety of
persons and property arose as a result of civil unrest that have resulted in numerous acts of
violence throughout the United States and in particular, Los Angeles County (County); and
WHEREAS, there has been widespread criminal acts of arson, looting, assaults, rioting
and vandalism to public and private property in nearby cities throughout Los Angeles County
since May 30, 2020, and continuing to present; and
' WHEREAS, these criminal acts have created conditions that are or likely to be beyond
the control of local resources and require the combined forces of other political subdivisions to
address; and
WHEREAS, peaceful demonstrations are essential to our democratic system, however,
during these protests, some individuals have engaged in dangerous and unlawful activity
threatening the safety of lawful demonstrators, surrounding businesses, communities, and first
responders; and
WHEREAS, a planned protest of 500 people occurred in the City of Santa Clarita (City)
on May 30, 2020, with ongoing smaller protests occurring since. A planned protest on June 4,
2020 at 12:00 p.m. is expected with upwards of 800 participants in the City; and
WHEREAS, Los Angeles County proclaimed the existence of a local emergency
beginning on May 30, 2020, due to conditions of disaster or of extreme peril to the safety of
persons and property as a result of the George Floyd Protests, in addition to the Governor of
California declaring a state of emergency to exist in Los Angeles County and the City of Los
Angeles; and
WHEREAS, the City's ability to mobilize local resources, coordinate interagency
response, accelerate procurement of vital supplies, use of mutual aid, and allow for future
' reimbursement by the State and Federal governments will be critical to successfully respond to
this emergency; and

WHEREAS, these conditions warrant and necessitate that the City of Santa Clarita
declare the existence of a local emergency. ,
NOW, THEREFORE, the City Council of the City of Santa Clarita, California,
proclaims a local emergency and gives authority, pursuant to Chapter 2.40 of the Santa Clarita
Municipal Code (Ordinance No. 89-6), to the Director of Emergency Services to take the
necessary steps for the protection of life, health and safety in the City of Santa Clarita and does
hereby resolve as follows:
SECTION 1. It is hereby proclaimed and ordered that a local emergency shall be
deemed to continue to exist until its termination is proclaimed by the City Council of the City of
Santa Clarita, California. Such determination shall be revisited by the City Council no less
frequently than every sixty days until deemed no longer necessary.
SECTION 2. It is hereby proclaimed and ordered that during the existence of said
local emergency the powers, functions, and duties of the emergency organization of the City
shall be those prescribed by State law, by local ordinances and resolutions.
SECTION 3. It is hereby proclaimed and ordered that a copy of this proclamation be
forwarded to the Los Angeles County Office of Emergency Management to be forwarded to the
Director of California Governor's Office of Emergency Services requesting that the Director find
it acceptable in accordance with State law; that the Governor of California, pursuant to the
Emergency Services Act, issue a proclamation declaring an emergency in the City of Santa '
Clarita under Los Angeles County; that the Governor waive regulations that may hinder response
and recovery efforts; that response and recovery assistance be made available under the
California Disaster Assistance Act; and that the State expedite access to State and Federal
resources and any other appropriate federal disaster relief programs.
SECTION 4. The City Council hereby imposes a curfew citywide that shall take
effect on June 4, 2020. The hours of curfew are between 6:00 p.m. and 6:00 a.m. of the following
day, June 5, 2020. No person, except as set forth in Section 5 below, shall be upon a public
street, avenue, boulevard, place, walkway, alley, park or any public area or unimproved private
realty within the City between 6:00 p.m. and 6:00 a.m. of the following day. Either the City
Council or the City Manager as Director of Emergency Services may renew, amend, or extend
this curfew in accordance with California Government Code Section 8634 and Section 2.40.060
of the Santa Clarita Municipal Code.
SECTION 5. This curfew shall not apply to peace officers; fire fighters; National
Guard or other military personnel deployed to the area; emergency medical services personnel;
individuals traveling to and from work; individuals working on a public work of improvement
construction project; credentialed media representatives involved in news gathering; people
experiencing homelessness and without access to viable shelter; and individuals seeking medical
treatment.
SECTION 6. Any violation of this resolution is a misdemeanor, punishable by a fine '
not to exceed $1,000 or imprisonment for a period not to exceed six months, or both, as provided

by Santa Clarita Municipal Code Section 2.40.100, Government Code Section 8665 or any
Iapplicable state or municipal law.
SECTION 7. The City Clerk shall certify to the adoption of this resolution.
