HomeMy WebLinkAbout2020-05-26 - RESOLUTIONS - REVISING THE SCHEDULE OF PUBLIC HEARINGS SET FORTH (2)1 RESOLUTION NO.20-27 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA REVISING THE SCHEDULE OF PUBLIC HEARINGS SET FORTH IN THE RESOLUTION OF INTENTION TO SWITCH TO ELECTION BY DISTRICTS BASED UPON THE MAY 13 EXTENSION OF THE COUNTY SAFER AT HOME ORDER WHEREAS, on March 19, 2020, the City Council of the City of Santa Clarita, California ("City") adopted Resolution No. 20-7 declaring an intent to switch to election by districts and setting forth a schedule for public hearings to be completed no later than June 18, based upon the safe harbor deadlines set forth in Elections Code section 10010; and WHEREAS, the County of Los Angeles issued a "Safer at Home" order that was set to expire originally in April, and then was extended to May 15, 2020, that limited public gatherings and required. physical distancing; and WHEREAS, Governor Newsom issued Executive Order N-34-20 on March 20 and N- 48-20 on April 9, 2020; and WHEREAS, these Executive Orders suspend and toll the timeframes set forth in Elections Code section 10010. Based upon the issuance dates of such orders the City has 89 days ' remaining under the safe harbor provisions of section 10010, running from the time that the suspension set forth in the Executive Orders is lifted; and WHEREAS, the City Council amended the hearing schedule originally adopted based upon the County's extension of the Safer at Home Order through May 15, 2020; WHEREAS, on May 13, 2020, the County of Los Angeles Health Officer further extended the Safer at Home Order indefinitely, indicating that the new order is meant to implement Stage 2 of the County's Roadmap to Recovery program. Presumably the County will next revise the order to accommodate Stage 3 of its Roadmap to Recovery program, but the County has not indicated when that revision will be forthcoming. The City is working directly through its representative on the Board of Supervisors to advocate for an earlier schedule for reopening for north County communities, including Santa Clarita; and WHEREAS, the City Council held a closed session on May 12, 2020 and gave direction to staff to monitor the County health orders and cancel the May 19 and 26 hearings if the County's order did not allow for gatherings of large numbers of the public for purposes of public hearings. Staff was directed to return to the City Council with an agenda item to consider revising the previously adopted hearing schedule. NOW, THEREFORE, based upon the recitals herein and the staff report submitted ' herewith, the City Council of the City of Santa Clarita hereby resolves as follows: Page 1 of 7 SECTION 1. The hearing schedule set forth in Exhibit A to Resolution No. 20-24 (which modified Resolution No. 20-7) is hereby replaced with the hearing schedule attached hereto as Exhibit A, commencing on June 1, 2020. SECTION 2. The City Manager is directed to postpone the hearings in Exhibit A to the Alternate Schedule (which would commence June 5) set forth in Exhibit B in the event that the County Health Officer indicates in -person attendance of large numbers of the public at City Council meetings is not permitted prior to close of business on Friday, May 29. SECTION 3. The City Manager is directed to cancel the first two public hearings on the Alternate Schedule if the County Health Officer has not revised the Order to allow for in -person attendance of large numbers of the public at City Council meetings prior to noon on June 4, 2020. In that instance staff is directed to agendize further consideration of the schedule of hearings by the Council at the Council's June 9, 2020 regular meeting. SECTION 4. The City Clerk shall certify to the adoption of this resolution. PASSED, APPROVED, AND ADOPTED this 26`h day of May 2020.
