CLOSED SESSION CONFERENCE WITH LEGAL COUNSEL - THREAT TO PUBLIC SERVICES OR FACILITIES Government Code Section 54957 - Consultation with: City Manager and Captain Justin Diez, Los Angeles County Sheriffs Speaking on this item were Elaine Ballace and Steve Petzold. Three written comment cards were received. RECESS TO CLOSED SESSION - TO BE HELD IN THE CENTURY ROOM City Attorney Joseph Montes made an announcement to request to recess into closed session under government code section 54957 and requested a roll call vote. Councilmember Weste moved and Councilmember Kellar seconded the motion to recess to close session for an Emergency Meeting. On Roll Call Vote: Ayes: McLean, Miranda, Kellar, Weste, Smyth Notes: None Absent: None Mayor Smyth recessed the meeting to Closed Session at 4:08 p.m. Packet Pg. 11 O RECONVENE TO OPEN SESSION Mayor Smyth reconvened the meeting to Open Session at 5:05 p.m. CITY ATTORNEY ANNOUNCEMENT City Attorney Joseph Montes announced that the Council received a briefing from the City Manager and Captain Justin Diez, and in open session, Council is to consider a resolution proclaiming the existence of a local emergency due to civil unrest and ordering a curfew on June 4, 2020, commencing at 6:00 p.m. and ending at 6:00 a.m. on June 5, 2020, amending the draft resolution from the curfew beginning at 4:00 p.m. to 6:00 p.m. OPEN SESSION CONSIDERATION OF AN EMERGENCY DECLARATION AND CURFEW RESOLUTION Government Code Sections 8630 and 8634 U) C U Speaking on this item were Elaine Ballace, Thomas Hart, and Daniel Kulick. Seven written comment cards were received. Mr. Montes addressed the public comments. Councilmember McLean inquired and Mr. Montes confirmed that the curfew is for one day only but can be renewed, adjusted, or extended by the Council or the Director of Emergency Services, who is the City Manager. Councilmember McLean moved and Mayor Pro Tem Miranda seconded the motion to adopt Resolution 20-29 to proclaim the existence of a local emergency due to civil unrest and order a curfew. On Roll Call Vote: Ayes: Kellar, Weste, Miranda, McLean, Smyth Notes: None Absent: None ADJOURN Mayor Smyth adjourned the emergency meeting at 5:17 p.m., and commented on conducting a press conference immediately following adjournment.
