DEPARTMENT: Recreation, Community Services, Arts, and Open Space PRESENTER: Richard E. Gould RECOMMENDED ACTION City Council: 1. Approve the purchase of 52 +/- acres of real property from the Los Angeles County Treasurer and Tax Collector, Assessor Parcel Nos. 2848-009-041 and 2848-036-008, in an amount not to exceed $17,000, which includes the property purchase price not to exceed $15,000, and $2,000 for annual property tax payments. 2. Appropriate $15,000 from Open Space Preservation District Fund Balance (Fund 358) to Open Space Preservation District Expenditure Account 12592-5201.004 for the purchase of the property. 3. Appropriate $2,000 as an on -going annual expenditure from Open Space Preservation District Fund Balance (Fund 358) to Open Space Preservation District Expenditure Account 12592-5185.003 for the payment of annual property taxes. 4. Authorize the City Manager, or designee, to execute all documents, subject to City Attorney approval, contingent upon the appropriation of funds by the City Council in the annual budget for such fiscal year. BACKGROUND Pursuant to the provisions of the Los Angeles County Revenue and Taxation Code, tax defaulted properties may be sold through a Chapter 8 process. The two subject properties identified as Assessor Parcel Nos. 2848-009-041 and 2848-036-008, are undeveloped open space located in Page 1 Packet Pg. 33 the Golden Valley Ranch area. The City of Santa Clarita (City) owns the adjacent open space property, and was notified by the Los Angeles County in 2014 of the opportunity to purchase these tax defaulted properties. The properties have been subject to several tax defaulted proceedings. In Fall of 2014, these parcels were presented to the City Council for consideration in Closed Session. On May 31, 2016, the Los Angeles County Board of Supervisors approved Purchase Agreement No. 2724, which was also approved by the State Controller's Office. The effective date of the sale will be October 12, 2016, with payment due in early November 2016. Staff has determined that purchasing the subject tax defaulted properties is consistent with the goals and policies of the Open Space Preservation District and may enhance opportunities for trail connections. Acquiring these parcels will work in conjunction with our open space plan to improve vital wildlife corridors and better ensure a high quality of life for our residents. The original price of the two parcels was $8,181.80 for the delinquent taxes. Additional acquisition costs include publications, taxes, and other fees incurred by the Los Angeles County Treasurer and Tax Collector. The total amount of the purchase price including publication taxes and other fees is in amount not to exceed $15,000. This acquisition is in compliance with the mission of the Open Space Preservation District. It has been reviewed pursuant to the California Environmental Quality Act (CEQA) and is exempt under CEQA guidelines Section 15313, Class 13, as an acquisition for conservation purposes, and Section 15325, Class 25, as a transfer of an ownership interest in land to preserve open space and existing natural conditions. Any subsequent or proposed changes in the use or condition of the property will be subject to CEQA guidelines. ALTERNATIVE ACTION Other action as determined by the City Council. FISCAL IMPACT Upon approval of the recommended action, the budget will be adjusted accordingly. PURPOSE/JUSTIFICATION OF RECOMMENDED ACTION The TTC will sell the property described in this Agreement in accordance with the provisions of Division 1, Part 6, Chapter 8 of the Revenue and Taxation Code (R&TC), and the Board of Supervisors' policy adopted on November 24, 1970. Exhibit A of the Agreement indicates the legal descriptions and selling prices of the properties. The TTC will recover all defaulted property taxes and costs. The city's proposed use of the properties is for a qualifying public purpose. Strategic Asset Management Principles Compliance Not Applicable. FISCAL IMPACT/FINANCING The revenue generated from this sale will recover all defaulted property taxes, penalties, interest owed on the property, and costs related to conducting the sale of the properties, with proceeds apportioned among the affected taxing agencies. FACTS AND PROVISIONS/LEGAL REQUIREMENTS The Chapter 8 Agreement Sale procedure permits eligible public agencies to acquire tax -defaulted property subject to the Tax Collectoes power to sell, pursuant to RUC Section 3791, et seq. The Purchaser initially requested to purchase five tax -defaulted properties and subsequently withdrew its intent to purchase one of the properties. The remaining two properties were since redeemed and are thus ineligible for purchase. This Agreement is for the purchase of two properties The Agreement includes Exhibit A, Real Property Descriptions and Purchase Prices, and Assessors Plat Maps. Attachment A contains the Application to Purchase Tax -Defaulted Property from the County, purchase request letter, Certified Resolution, Mission Statement, and Sphere of Influence Map of the City of Santa Clarita. County Counsel has approved the Agreement as to form. R&TC Section 3794.3 indicates that the Agreement shall take place only if approved by the Board of Supervisors. In accordance with RUC Section 3795, following adoption by the Board of Supervisors, the TTC shall submit the Agreement to the State Controller's Office for final approval. Further, R&TC Section 3798 requires the TTC to publish a notice of the Agreement once a week, for three consecutive weeks, in a newspaper of general circulation published in the County. Finally, pursuant to RUC Section 3799, the TTC will attempt to contact the owner(s) and parties of interest to inform them of their tax liabilities and the provisions for the redemption of the properties prior to completing the Agreement Sale.
