SUBJECT: EXCHANGE OF REAL PROPERTY OF INTEREST WITH SANTA
CLARITA VALLEY WATER AGENCY FOR THE REMOVAL OF
BUILDING RESTRICTION ON A PORTION OF LOT 90 IN
EXCHANGE FOR THE DEDICATION OF BUILDING
RESTRICTION ON A PORTION OF LOT 94 FOR THE VISTA
CANYON RECYCLED WATER TANK PHASE 2B PROJECT

RECOMMENDED ACTION
City Council:
1. Authorize the City Manager or his designee to approve the removal of building restriction on
a 0.44-acre portion of open space Lot 90, Tract No. 52833, for the construction of the Vista
Canyon Recycled Water Tank, Phase 2B Project.
2. Authorize the City Clerk to accept the open space dedication for a 0.56 acre portion of Lot
94, Tract No. 52833, for open space purposes.
BACKGROUND
The City of Santa Clarita (City) received a request from the Santa Clarita Valley Water Agency
(SCVWA) requesting the removal of a building restriction on a portion of open space Lot 90,
Tract No. 52833, for the construction of the Vista Canyon Recycled Water Tank, Phase 2B
project (Project) in exchange for offering the same restrictions for a portion of lot 94 which is
currently owned by SCVWA. Lot 90 is approximately 119.83 acres near the Fair Oaks Ranch
community. The final Tract Map No. 52833, recorded on March 6, 2011, assigned the right to
the County of Los Angeles, and now the City to prohibit the construction of any buildings or
structures within open space Lot 90.

Lot 90 is currently owned in fee by Pardee Homes and a portion is being purchased by SCVWA.

This Project supports SCVWA's objective of expanding recycled water in the Santa Clarita
Valley. Completion of this Project will provide recycled water to the east side of SCVWA's
service area by using surplus recycled water that will be distributed from the new water
reclamation plant, The Water Factory, that was recently constructed as part of the Vista Canyon
development.
The Project incorporates a recycled water system that is connected to a network of recycled
water distribution pipelines that extend from the Water Factory to irrigation water users within
the Vista Canyon and Fair Oaks Ranch communities. The Project will also provide water storage
through recycled water tanks that are necessary to support high irrigation demand periods and
sustain minimum system pressures to recycled water users.
The recycled water tanks designated for this Project were originally intended to be constructed
on Lot 94 of Tract No. 52833, a parcel that is owned in fee by SCVWA. However, the initial
geologic and geotechnical investigative findings suggested evidence of a landslide and slope
stability deficiencies in the immediate vicinity of the property. Creating a significant geologic
hazard for the tank project.
To offset the 0.44-acre reduction in open space at Lot 90 for the City, as a result of the Project's
recycled water tanks, SCVWA is dedicating the right to prohibit the construction of any
buildings within a portion of Lot 94 (0.56 acres) to the City for open space purposes. See
attached open space dedication (Exhibit Q.
The dedication for lot 94 to the City will record after the work is completed to allow SCVWA
use of lot 94 for construction staging.
Community Outreach
On December 3, 2020, SCVWA transmitted a Notice of Proposed Water Improvements to the
Fair Oaks Ranch Home Owners Association (HOA) Board of Directors notifying them of the
proposed Project. On December 15, 2020, SCV Water staff held an online meeting with the
HOA Board of Directors to present the Project and provide a forum for questions and answers.
No significant concerns were expressed for the Project by the HOA members. As part of the
improvements, landscaping will be completed to provide screening of proposed water tanks on
lot 90.
Schedule
The Project is partially funded by a Proposition 84 Integrated Regional Water Management
Grant that requires the pipeline and tanks to be constructed and operational by December 31,
2021.
