16 of sXNTA C< U � PUBLIC HEARINGS CITY OF SANTA CLARITA AGENDA REPORT CITY MANAGER APPROVAL: DATE: June 8, 2021 J 11 J� �, Agenda Item: 16 SUBJECT: ANNUAL ADJUSTMENT TO FEES AND AMENDMENTS TO THE FEE SCHEDULE DEPARTMENT: Administrative Services PRESENTER: Johanna Medrano RECOMMENDED ACTION City Council: 1. Conduct the public hearing on the proposed fee adjustments. 2. Adopt a resolution establishing a schedule of fees and charges for City services. BACKGROUND In 1990, the City Council directed staff to prepare a study identifying the full cost of providing services. The result of this effort was the adoption of City Council policy establishing cost - recovery standards, adoption of the City's first full -cost based fee schedule, and an ongoing mechanism to assess the cost of City of Santa Clarita (City) services and to adjust fees accordingly. Propositions 4 and 13 establish the "costs reasonably borne" philosophy. The philosophy necessitates the determination of the full business cost of each City -provided service, the identification of the beneficiary of each service, and the evaluation of services to determine an appropriate level of cost recovery for each. "Costs reasonably borne" implies a direct relationship between payment of fees and charges and receipts of services. The direct fee/service and tax equity relationship does not exist when tax monies are used to subsidize services received by only a small portion of the taxpaying public, or by non-residents. As a best practice, every five years the City examines the costs associated with providing services to the public. Fiscal Year (FY) 2018-19 was the last time the comprehensive study was conducted. During the current fiscal year, staff worked in conjunction with an independent third party, Revenue and Cost Specialists, LLC, to conduct atime-motion study and create a cost allocation plan to determine the most accurate cost of providing services to the public. All Page 1 Packet Pg. 105 16 City departments participated in the study to determine the amount of time the employee is involved in each City service. Proposed Fees and Charges for Fiscal Year 2021-22 Development -Related Fees: For FY 2021-22, staff recommends development -related fees and charges be increased by the December year-end Consumer Price Index (CPI) for the urban consumers of the Los Angeles, Riverside, and Orange County areas. The percentage increase, as reported by the United States Department of Labor, is 1.5 percent. While the majority of development -related fees and charges are recommended to increase by the December 2020 CPI of 1.5 percent, certain development fees will be adjusted according to the FY 2018-19 fee study. These fees were identified in the City's last comprehensive study as needing to be adjusted through a phased approach over a period of up to five years in order to reach an appropriate level of cost recovery. In accordance with the Accessory Dwelling Unit (ADU) Ordinance adopted by City Council on January 26, 2021, staff is recommending the adoption of a new fee for ADUs Application Review. This fee, as permitted by state law, will recover the associated cost of reviewing proposed ADUs. Additionally, Assembly Bill 1414: Solar Energy Systems Permits revised and reduced the maximum permit fees for photovoltaic systems. Staff is recommending the permit fees for plan check and inspection be adjusted to comply with state mandate. Other development fees, will be adjusted according to adopted City resolutions. The California Government Code Section 66017(a) requires a development -related fee to be effective no sooner than 60 days following adoption of the fee, charge, or increase. The City historically has allowed for a 90-day waiting period between fee adoption and implementation with the exception of last fiscal year. Due to the economic impacts caused by COVID-19, City Council deferred the adoption of development -related fees for six months. With the economy beginning to show signs of improvement, staff recommends that the City Council reinstate the 90-day waiting period between fee adoption and implementation of development -related fees, which will have an effective date of September 8, 2021. The Building Industry Association, Valley Industry Association, Santa Clarita Valley Economic Development Corporation, Santa Clarita Valley Chamber of Commerce, Southern California Edison, and Southern California Gas Company were directly contacted regarding the proposed development -related fees. Other Miscellaneous Non -Development Related Fees: Like development -related fees, the City's fee schedule identifies other miscellaneous non - development related fees needing to be adjusted by CPI or a greater amount in order to reach an appropriate level of cost recovery. Examples of these fees include Vehicle Impound Release, Handicap Parking Citation Process, and Lobbyist Registration fees, as well as Film fees. Like development -related fees, staff recommends the increase to these fees be reinstated on July 1, Page 2 Packet Pg. 106 16 2021. Recreation Fees: Recreation and Community Services remain unchanged and will continue to follow standard effective dates. The pandemic gave rise to new program opportunities in adult sports, birthday parties, and other programming, including Tote to Go, City Cinema, Santa Claus is Coming to Town drive -up event, and the Incredible Chase. Furthermore, the City's fee schedule includes programming fees for the newly acquired ice rink facility, The Cube. Fees provided are currently in effect and are in line with the market rate and consistent with other facilities, operated by the City's operator, American Sports Entertainment Company (ASEC) and the LA Kings, collectively referred to as JV Ice at The Cube. Facility Rental Fees: In anticipation of the opening of the new Canyon Country Community Center, staff is recommending fees be added to the City's fee schedule for rental space of this new facility. In an effort to provide consistency, staff is recommending the fees mirror other City facilities comparable in space and amenities. Parking Violations: Staff recommends no change for the FY 2021-22 bail schedule. Effective Dates: This resolution shall go into full force and shall be effective immediately but shall be subject to the terms and conditions of Chapter 3.32 of the Santa Clarita Municipal Code. Development - related fees will go into effect September 8, 2021; Recreation fees will go into effect October 1, 2021; aquatic fees and special event fees will go into effect January 1, 2022, while all other fees will go into effect on July 1, 2021. ALTERNATIVE ACTION Other action as determined by Council. FISCAL IMPACT It is estimated that if adopted and implemented, the proposed schedule of fees and charges for service will result in additional annual revenue to the General Fund of approximately $235,000. Revenues will be reviewed at mid -year and adjustments deemed appropriate will be recommended at such time. Dated: May 14, 2021 Mary Cusick, MMC City Clerk Publish Date: May 21, 2020 and May 28, 2020 C:\users\asantos\appdata\roaming\igm2\minutetraq\santaclaritacityca@santaclaritacityca.igm2.com\work\attachments\7336.docx Packet Pg. 108 16.b RESOLUTION NO. 21- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA ESTABLISHING A SCHEDULE OF FEES AND CHARGES FOR CITY SERVICES WHEREAS, the City of Santa Clarita has conducted an extensive and exhaustive analysis of its services, the costs reasonably borne of providing those services, the beneficiaries of those services, and the revenues produced by those paying fees and charges for special services; WHEREAS, the City wishes to comply with both the letter and the spirit of Article XIIIB of the California Constitution and limit the growth of taxes; WHEREAS, the City desires to establish a policy of recovering the full costs reasonably borne of providing special services of a voluntary and limited nature, such that general taxes are not diverted from general services of a broad nature and thereby utilized to subsidize unfairly and inequitable such special services; WHEREAS, heretofore the City Council adopted Ordinance 90-17 on the IOth day of July 1990, establishing its policy as to the recovery of costs and more particularly the percentage of costs reasonably borne to be recovered from users of City services and directing staff as to the methodology for implementing said Ordinance as codified in Chapter 3.32 of the Santa Clarita Municipal Code; WHEREAS, pursuant to Government Code Section 66016, the specific fees to be charged for services must be adopted by the City Council by Ordinance or Resolution, after providing notice and holding a public hearing; WHEREAS, notice of public hearing has been provided per Government Code Section 6062a, oral and written presentations made and received, and the required public hearing held; WHEREAS, a schedule of City service fees and charges to be paid by those requesting such special services need to be adopted so that the City might carry into effect its policies; WHEREAS, it is the intention of the City Council to develop a revised schedule of fees and charges based on the City budgeted and projected costs reasonably borne for the fiscal year beginning, July 1, 2021; WHEREAS, pursuant to the California Government Code Section 6062a, a general explanation of the hereinafter contained schedule of fees and charges has been published as required; WHEREAS, all requirements of California Government Code Sections 66016- 66018 are hereby found to have been complied with; and Page 1 of 3 Packet Pg. 109 16.b WHEREAS, it is equitable that this new surcharge, and any future federal, state, or county surcharges on parking citations be added to the total fee, as reflected in attached Exhibit C, so that the City remains revenue neutral. NOW, THEREFORE, the City Council of the City of Santa Clarita, California, does hereby resolve as follows: SECTION 1: Fee Schedule Adoption. The following schedule of fees and charges, as outlined in Exhibits A, B, C, and D are hereby directed to be computed by and applied by the various City departments and to be collected by the City's Administrative Services Department for the herein listed special services when provided by the City or its designated contractors. SECTION 2: Separate Fee for Each Process. All fees set by this resolution are for each identified process; additional fees shall be required for each additional process or service that is requested or required. Where fees are indicated on a per -unit of measurement basis, the fee is for each identified unit or portion thereof within the indicated ranges of such units. A. Added Fees and Refunds. Where additional fees need to be charged and collected for completed staff work, or where a refund of excess deposited monies is due, and where such charge or refund is fifteen dollars ($15.00) or less, a charge or refund need not be made, pursuant to California Government Code Sections 50055 and amendments thereto. B. Defining and Timing of Fee Schedule: Definitions regarding and the timing of the implementation of the hereinafter enumerated fee schedules shall be as stipulated in Chapter 3.32 of the Santa Clarita Municipal Code. SECTION 3: New Fees. Any fees for new services established throughout the year shall be incorporated into the City's fee structure and collected with recovery percent consistent with similar services. SECTION 4: Intemretations. This resolution may be interpreted by the several City Department Heads in consultation with the City Manager, and should there be a conflict between two fees, then the lower in dollar amount of the two shall be applied. A. Intent. It is the intention of the City Council to review the fees and charges as determined and set out herein, based on the City's next Annual Budget and all of the City's costs reasonably borne as established at that time and, if warranted, to revise such fees and charges based thereon. SECTION 5: Constitutionality. If any portion of this resolution is declared invalid or unconstitutional, then it is the intention of the City Council to have passed the entire resolution and all its component parts, and all other sections of this resolution shall remain in full force and effect. Effective Date. This resolution shall go into full force and effect immediately but shall be subject to the terms and conditions of Chapter 3.32 of the Santa Clarita Municipal Code. Development -related fees will go into effect September 8, 2021; Recreation fees will go into effect October 1, 2021; aquatic fees and special event fees will go into effect January 1, 2022, while all other fees will go into effect on July 1, 2021.
