Award a design -build contract to Landscape Structures, Inc., to design and build an inclusive play area at West Creek Park in the amount of $950,000 and authorize a contingency in the amount of $50,000, for a total contract amount not to exceed $1,000,000. 2. Authorize the continuation of $1,023,789 in Community Development Block Grant (CDBG) funds (Fund 203) previously appropriated to the West Creek Park Inclusive Play Area, Project P4023 expenditure account P4023203-5161.001 from Fiscal Year 2020-21 to Fiscal Year 2021-22. 3. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval. BACKGROUND Following the success of the City of Santa Clarita's (City) first inclusive play area at Canyon Country Park, this project will design and construct the City's second inclusive play area at West Creek Park. The West Creek Park Inclusive Play Area project will provide an inclusive play area that welcomes children and adults of all abilities to interact, play, learn, and grow together. This project will offer play experiences that promote integrated play for residents of all abilities and further develops physical, cognitive, sensory, communication, and social skills. Inclusive play areas also allow adults of varying ages and abilities to actively engage with the children in their care, providing a multigenerational gathering space. Page 1 I Packet Pg. 203 16 This project exemplifies the City's commitment to improving the quality of life of its residents and supports both the Building and Creating Community theme of Santa Clarita 2025 and the focus area identified in the Parks and Recreation 5-Year Plan to maximize accessibility by offering inclusive play elements and design principles for people of all ages and abilities. A Request for Proposal (RFP) was published on BidNet on March 8, 2021. The RFP solicited firms to identify their relevant experience on similar projects and demonstrate their approach for this design -build project. On March 22, 2021, a total of three firms submitted proposals. City staff reviewed the submitted proposals and conducted panel interviews for each firm. Based on their evaluations, the firms were scored on a 100-point scale as follows: Rank Companv 1. Landscape Structures, Inc. 2. Great Western Installations 3. KOMPAN, Inc. Location Score Delano, MN 90.0 Logan, UT 89.8 Austin, TX 76.8 The scoring system was based on the following criteria: an understanding of the scope and approach to the required work and key development tasks, the consultant's previous experience with similar projects and experience working with the City, qualifications of the project team and their resources, and organization of the proposal. Additionally, each consulting firm was asked to provide a detailed scope of work, a conceptual inclusive play design, and a project cost estimate for the project. Landscape Structures, Inc., demonstrated an in-depth understanding of the project needs and provided a detailed scope of work and approach to the project. They analyzed the existing site conditions and identified key design factors that will need to be addressed in the design. Based on their design experience with similar projects and the completeness of their proposal for this project, staff recommends awarding the design -build contract to Landscape Structures, Inc. At the completion of design and prior to commencing construction, the design will be reviewed for design immunity purposes pursuant to Resolution No.19-6. The requested contingency will cover any unforeseen issues or additional needs that may occur during the design and construction process. The remaining funds in the budget will cover staff oversight related to the construction and project management, public works inspection, labor compliance, and administrative costs. California Government Code 4526 prescribes selection of architectural and engineering services to be based on demonstrated competence and professional qualifications necessary for the satisfactory performance of the services required and does not authorize the selection of professional architect and engineering services based on costs. ALTERNATIVE ACTION Other action as determined by the City Council. At Landscape Structures, we believe all kids are created equal. That is why we continue to create inclusive play environments that welcome kids and families of all abilities to learn, play, share, and grow together. We are committed to the idea of "Play for All" because all kids deserve to play. In a survey conducted with parents across the country, 57 percent mistakenly believed that playgrounds are required by the Americans with Disabilities Act (ADA) to include elements designed for children with Down syndrome, sensory disorders, and visual and hearing impairments. In reality, current ADA standards primarily require that playgrounds be accessible for those who use a wheelchair or other mobility aid. At Landscape Structures, we believe in the need to go beyond accessibility and design playgrounds that are truly inclusive. That same survey also revealed changing perceptions from a community standpoint. Nearly 74 percent of parents believe it is important that their children have an opportunity to play with a variety of children, including those with disabilities. There are numerous benefits of inclusive play areas such as allowing children of all abilities the opportunity to play together, as well as bringing together parents with disabilities and an aging population. What does that mean? A well -designed, inclusive play environment enables all children to develop physically, socially, and emotionally. An inclusive play area provides the just -right level of challenge, addresses all levels of ability, and goes beyond minimum accessibility to create play experiences that meet a variety of needs and interests. At an inclusive playground, children of all abilities can interact with each other and do what all kids want to do: play. Creating inclusive play spaces in communities will deliver numerous benefits. Play spaces encourage kids to be socially and physically active, teaching them that active communities are healthy communities. And play spaces that truly welcome everyone invite parents, grandparents, and caretakers to witness the joy of play and create memories that last a lifetime. These spaces will become destination gathering places for visitors near and far. Most importantly, inclusive playgrounds help eliminate bias for children with disabilities. WORK STATEMENT BID SCHEDULE TASK DESCRIPTIONS: Project Management TASK 1: Project Management is the starting point for the team driven process of designing and constructing an inclusive community play area. Diligent project management will be required to meet the City goals for the project. SUBTASK 1A: With a strong background in team building and community leadership, the Landscape Structures Project Manager (PM), Eric Lewis, will effectively organize regular Project Development Team (PDT) meetings to keep all members in sync and on target to achieve the project goals. A PDT contact distribution list with email addresses and phone numbers will be created and provided to all PDT members. Most meetings will be able to be conducted virtually. These meetings will be arranged and notified in advance by the PM via MS Teams, using its online meeting platform which is usable by all PDT members with West Creek Park Inclusive Play Area Proposal By Landscape Structures, Inc. March 18, 2021 online access, whether or not they have the Teams application. All required in -person meetings will also be notified in advance by the PM, with information provided regarding the meeting goals and requirements. All in -person meetings occurring during the ongoing pandemic will require the observance of required safety protocols such as the use of a mask and social distancing. Any PDT members that feel ill or may have been exposed to the COVID-19 virus shall send a healthy proxy to the meeting in their place. A regular meeting schedule will be created and distributed to the PDT along with follow-up reminders. The meeting schedule will be designed to coalesce the PDT prior to each project schedule milestone with open communication so all issues are addressed in advance of a problem, allowing those milestones to indeed be reached on time, keeping the project on schedule. SUBTASK 113: The first PDT meeting, after issuance of the contract and receipt of the NTP, will involve both the PDT and the community stakeholders. Community outreach is necessary to promote more citizen participation in City government activities and to make City government more responsive to local needs. A well -attended kick-off meeting will open the doors to new ideas to improve life near and at West Creek Park. It will also increase awareness for the PDT about regular life occurrences in and around the park that may be common to the stakeholders there but not necessarily to the PDT. These observations, when shared publicly, can guide decision making for the PDT in a way that positively affects the stakeholders and the project. Local advertisements, City website notifications, flyer campaigns, and word of mouth communication will be effective means to increase attendance at the kick-off and subsequent community meetings, and awareness of the goals of the project. SUBTASK 1C: Proper meeting planning and operation will yield more effective results with an increased awareness amongst the PDT of the goals, needs, and plans for the project at any point during the project. Pre -meeting planning by the PM will produce a meeting agenda as well as any other necessary documentation, reports, images, designs, or other appropriate materials. The agenda will be distributed to the PDT at least 48 hours prior to meetings detailing all topics to be presented during the meeting. The meeting's minutes will be taken by the PM and sent to the PDT within 48 hours after each meeting. In addition, the PM will follow-up via email and/or phone calls as needed post -meeting with any person(s) tasked with something during the meeting and include the action and result as a part of the next meeting agenda. This meeting planning, operation, and follow-up practice will apply to all PDT meetings, as well as those that also involve the community or other City agencies. OUTPUT: Effectively utilizing the voices of the community, the goals of the Proposal, the experience of the City staff, and the expertise of the PM, Consultants, Subconsultants, and Subcontractors to engage and inform the PDT and the City will lead to positive and worthwhile results. Preliminary Investigation TASK 2: Effective design planning requires proper awareness and understanding of every aspect of the West Creek Park site as it relates to play area design and construction. Going beyond basic design is the need to fully grasp every aspect of the project's creation from community needs, to local architecture and traffic patterns, to drainage, to the seasonal path of the sun, to site dimensions, to color design, and even to how the ingress and egress of construction vehicles could affect stakeholders. SUBTASK 2A: It will be necessary for all PDT members to review and re -review the available site information from the City and its agencies. In addition, members will need to re -visit the site personally, preferably at different times of the day, to understand how it involves and affects the community over the course of a typical week. West Creek Park Inclusive Play Area Proposal By Landscape Structures, Inc. March 18, 2021 SUBTASK 213: Site plans and topographical information are necessary tools to properly complete this project on time. The PDT design subconsultant, Chad Kennedy of O'Dell Engineering, will perform a thorough topographical land survey with his crew of the proposed inclusive play area and its immediate surrounding area, once the PDT has been properly notified to begin their work on this project. Their topographic survey will be performed on a 25-foot grid of all hardscape and softscape within 50' of project area. They will locate grade breaks, high points, low points, surface -visible improvements, and surface - visible utility features, such as: signs, fences, walls, buildings, striping, driveways, walkways, drainage, structures, lights, poles, bollards, general limits of vegetated or landscaped areas, USA markings, vaults, valves, meters, boxes, pedestals, cleanouts, manholes, drain inlets, catch basins, culverts, outfalls, and standpipes. At manholes and accessible structures, they will measure invert elevation of all gravity storm drains and sewer pipes. O'Dell Engineering will also annotate on the topographic survey drawing with invert elevation, approximate diameter, and orientation of each pipe visible at the time of the survey. Where access is not practical, they shall indicate by notation on the mapping deliverable. The topographic map will be prepared at a 1" = 20' scale. O'Dell Engineering will maintain a database of site information and disseminate all pertinent information to the PDT as it is available. SUBTASK 2C: O'Dell Engineering will use the survey information to create an accurate CAD background for use in the play area design process. The survey information deliverables will include digital copies of the topographic survey in AutoCAD Civil 3D format as well as DWG CAD files of the record parcel boundaries. These files will be shared with the PDT and City as necessary to maintain complete awareness of the site situation. Their work will be securely archived with appropriate computer firewalls in place to protect the data from malware and other issues. OUTPUT: Properly studying, surveying, documenting, and archiving every physical facet of the park and how each affects other facets, as well as stakeholders, is crucial and necessary to a successful design. Design TASK 3: Creating worthwhile initial designs, as well as subsequent revisions, requires multiple aspects to be understood and best practices to be followed in order to create a final inclusive design in a timely manner that meets the needs of the stakeholders, City agencies, Community Development Block Grant requirements, environmental necessities, and budget. SUBTASK 3A: In advance of the kick-off meeting, the PM shall re -review the City document for the West Creek Inclusive Play Area Proposal, # CIP-20-21-P4023B. As part of the meeting preparation, an outline will be created by and for the PM noting the broad project requirements for design, equipment selection and placement, project schedule, and cost estimates so as to facilitate efficient responses to inquiries from stakeholders and City staff at the kick-off meeting. Additional meeting preparation will be conducted involving a review of the as -built plans, City GIS data, subdivision planning documents, and existing topographical information with the design subconsultant to discuss grading and other site elements including drainage. Such preparation will be conducted in coordination with the City's project manager so as to keep all parties up to date with information ahead of the kick-off meeting. SUBTASK 313: The kick-off meeting will provide the PDT, and specifically the design subconsultant, with useful information to guide the early development of two additional play space concepts to complement the initially proposed plan. Each concept option will offer differing equipment choices, colors, configurations, placements, shade styles, and themes to offer stakeholders and City staff a bevy of useful information to further guide the design process. Careful attention will be made to address and provide for the large population of disabled adults in the vicinity of the site. West Creek Park Inclusive Play Area Proposal By Landscape Structures, Inc. March 18, 2021 SUBTASK 3C: The PM will coordinate with the City staff and PDT to conduct an evening public outreach session once the preliminary designs, or 25% plans, are developed. The consultant and design subconsultant will work together to create video demonstrations of each design concept. This outreach meeting will allow stakeholders and City staff to review the concepts and weigh in on such design topics as the inclusive equipment and site amenity selections. The PDT will continue to meet regularly or as needed while the concepts are developed further based upon notes, requests, and suggestions from the outreach meeting. SUBTASK 3D: As the three design concepts develop, another public outreach session will be coordinated by the PM, with notice provided to the community stakeholders. The meeting will be held approximately three weeks after the preliminary design meeting, in accordance with the project schedule, when the design concepts have reached 75% completion. As word-of-mouth spreads through the community, a greater level of stakeholder attendance will be anticipated for the meeting. This will add further input and opinions to the conversations and Q&A at the meeting, which will increase the number of ideas for the design but also increase the chance that some stakeholders will end up unhappy that their idea did not make it into the final design. Awareness of this will allow the PM and PDT to listen to stakeholders more discerningly so as to filter out the suitable ideas from the unusable ones. The design subconsultant will address this through a variety of viable play possibilities shown in the three different concepts. SUBTASK 3E: Upon completion of all three design concepts, the PDT will meet with all City staff members involved with the project to select and fine-tune the final inclusive design. This selection process will yield a final play area design that is inclusive, challenging, fun, aesthetically pleasing, environmentally conscience, and, most importantly, in recognition of the play area needs and wishes of the local community. The consultant and design subconsultant will coordinate to create digital and physical design layout drawings, 3D-rendered images, and other informational documents, as well as video demonstrations. SUBTASK 3F: To keep on schedule and continue the process towards design finalization, the consultant and design subconsultant shall promptly collaborate to create schematic design drawings for the play and shade equipment. The first set of shop drawings will be sent electronically to the City's project staff for review and feedback. The consultant and design subconsultant will adjust the designs if necessary, based upon this feedback, so as to create the basis for the engineered construction documents. SUBTASK 3G: With a final design at the ready, the design subconsultant, a licensed landscape architect, will provide landscaping plans to add to the foliage present at the park. Drought tolerant plants will generally be selected, while still providing plants that bring color and beauty to the site. No plants that produce fruit or berries will be included in the design. Furthermore, foliage that has thorns or spikes, or attracts an abundance of bees will not be selected. The City project team will review the landscaping designs and offer feedback. The feedback will be utilized by the design subconsultant to create a revised landscape design, which will become final upon approval of the City. SUBTASK 3H: The design subconsultant will meet with the construction sub -consultant and the City's Parks Maintenance staff to discuss the new landscaping plans and the irrigation needs of the species that will be planted at the site towards the end of the construction. Any necessary modifications that will be needed for the irrigation system will be planned out at this meeting to confirm the City's requirements as well as eliminate the need for such meetings during the middle of construction. In addition to irrigation issues, the PDT will discuss the landscaping and site seating plans during regular PDT meetings. Any concerns from the City's Parks Maintenance staff will be discussed and addressed by the PDT as is found necessary. SUBTASK 3H: With the final play area and landscaping design selections made, the consultant will coordinate with the design subconsultant to prepare and deliver to the PDT an Engineer's Opinion of Probably Cost, or construction cost estimate. This estimate will be reviewed by City staff for any budget West Creek Park Inclusive Play Area Proposal By Landscape Structures, Inc. March 18, 2021 related issues. Based on input from the City's project team, the consultant will direct the design subconsultant to adjust the design as necessary to address the findings. Once the final design for the inclusive play area and surrounding landscape is determined and approved, final improvement plans will be drawn and disseminated to the PDT and other interested City staff. These finalized plans will be the basis for the construction drawings. OUTPUT: A ten -week collaborative effort from the community, PDT, and other City staff will produce a final, approved design that meets the needs of both the City staff and the community stakeholders. Construction Documents TASK 4: In accordance with the project schedule, the consultant shall have all necessary construction drawings prepared to detail and address all common aspects of architecture and construction. SUBTASK 4A: The consultant shall coordinate through the PDT meetings to commence the creation of all civil drawings or improvement plans. All plans will be consistent with State of California water efficiency ordinances. Such plans shall include the following routine information as required by the State of California and the City of Santa Clarita: Topography and Demolition Plan, Site Dimension Plan, Grading & Drainage Plan, Utility Plan, Erosion Control Plan, Construction notes & details, Project information, Water Efficient Landscape Worksheet including hydro -zone tables and water budget calculations, Soil Management Report, Irrigation Design Plans including design and schedule, Planting Design Plans, Site Furnishing and Finishes Plan, Construction details, and Cost opinion and Quantity take -offs. As detailed, attention will be payed to include drawings that address any demolition requirements for the design, as well as the construction of the play area and surrounding park areas. The design subconsultant will work with their team to produce such shop drawings in a timely manner so as to keep on schedule. Site aspects including construction for stormwater compliance, ADA access and code compliance, and underground utility connections and crossings will also be included in drawing sets. The design subconsultant will create civil drawings that include factors such as grading and drainage, as well as any retaining walls necessary for the design. SUBTASK 413: The consultant, in collaboration with the PDT, will instruct the consultant's and design subconsultant's teams to create all required architectural drawings, clearly detailing architectural, structural, electrical, and plumbing aspects in these professional drawings. These drawings will include all necessary details and notes to enable the construction of the play, shade, and furnishings equipment. SUBTASK 4C: To provide for the construction of the site, prior to the equipment installation, the consultant, in cooperation with the PDT, will work with the landscape architect design subconsultant to create all necessary drawings for both the landscaping and the hardscaping involved with the play area and surrounding park areas. These drawing will serve as guide for the PM to confirm the selection and placement of the foliage during construction. SUBTASK 4D: To confirm the City's awareness of the specifications of the components involved in the final design selection, the consultant shall work with their team and the design subconsultant to create documents specifying important aspects such as fabrication, quality, installation, performance or method of construction. These documents will be supplied electronically to the PDT for review. SUBTASK 4E: The consultant will arrange with their team and the design subconsultant's team to provide that all plans, documents, and specifications are thorough, professional, complete, coordinated between disciplines, and ready for plan check submission. The PM will arrange a PDT meeting to review all documents before they are submitted to the City's Building and Safety Division. SUBTASK 4F: In order to provide electronic documents and files that can be utilized by City staff, the consultant will verify that AutoCAD drawings are made with the most recent software version. The West Creek Park Inclusive Play Area Proposal By Landscape Structures, Inc. March 18, 2021 consultant will also ensure that all other documents and specifications are made with software from Microsoft, such as their programs "Word" and "Excel". Such files will be provided to the City at all design milestones, including providing progress plans for the preliminary 25% stage, 75% stage, and the near final 95% stage. The files will be discussed during PDT meetings so that the consultant has adequate time to produce all such required documents, etc. without causing project schedule delays. SUBTASK 4G: Through meetings with the PDT and the City, the consultant will verify final approval of the improvement plans and shop drawings for permit issuance. The consultant will submit two physical sets of final plans to the City, as well as an electronic set. The City will use these plans at their discretion to facilitate the project or any other use deemed necessary to the City and will maintain ownership of all final plans. OUTPUT: The professional construction drawings review process will facilitate the creation of a final set of plans to present for permit approval in a manner conducive to maintain the project schedule while mitigating the possibilities of problematic discoveries being made during plan check. Plan Review & Permits TASK 5: Submit all drawings, specifications, plans, and calculations to the City's Building and Safety Division for the plan review. SUBTASK 5A: The consultant and PM will communicate and coordinate with the PDT regarding supplying the plans, etc. electronically to the City's Building and Safety Division, per their submission instructions. The consultant will verify that subsequent submissions will also be made electronically to Building and Safety until they are approved. Once approved, a building permit will be issued for the project. SUBTASK 513: During the plan check, the consultant will work with the design subconsultant to respond accordingly to any input supplied by Building and Safety. Proper demonstration of compliance will be facilitated by the consultant in regard to all State and local building codes and regulations. Such noted compliance involved with the approved plans will allow for the issuance of a building permit. As is found necessary from City agencies, the consultant will supply all other plan submittals, reviews, or clearances with a goal to provide 100% complete plans, calculations, and specifications for permit issuance. OUTPUT: The consultant will facilitate properly submitted improvement plans, drawings, etc. for plan check, and will work with Building and Safety and any other City agencies until the building permit is issued. Construction Administration & Management TASK 6: With all construction plans finalized and approved, the construction phase will commence upon receipt of a Notice to Proceed for Construction. This final task will involve most members of the PDT as they work to complete the construction on time. SUBTASK 6A: The PM will include pre -construction planning in the agenda for the meeting prior to the commencement of the construction. The PDT will work with the construction subcontractor to discuss and prepare for the construction phase of the project. The PM will coordinate delivery of the play and shade equipment at a time that is appropriate for a project of this size, and so as to avoid delays. SUBTASK 613: The landscape architect design subconsultant will provide assistance with construction administration and management by responding to RFI's, reviewing submittals and shop drawings, and attending the final job walk. The landscape architect will provide response memoranda, an RFI/submittal log, site visit notes, and final record drawings. SUBTASK 613: The consultant will coordinate with the construction subcontractor's site foreman regarding mobilization in an effort to minimize any community concerns regarding excessive noise, dust, trash, or debris. The consultant will over -see the initiation of the construction and will remain in charge of West Creek Park Inclusive Play Area Proposal By Landscape Structures, Inc. March 18, 2021 construction administration and management until the successful completion of the third -party CPSI's equipment and surfacing state certification. SUBTASK 6C: The consultant and PM will meet with the site foreman regularly and as part of PDT meetings to ensure that the contract stipulations are met, and the project schedule is on track. As construction schedule milestones are reached, the consultant and PM will provide written progress reports to the PDT and City detailing the ongoing work and adherence to the project schedule. SUBTASK 6D: The consultant will coordinate with the construction subcontractor to review all Special Inspection reports for accuracy and completeness before they are submitted to the City Building Inspector. The consultant will review inspection reports with the site foreman so as to discuss any substandard work found and ways to remedy such situations. SUBTASK 6E: The consultant will communicate between the construction subcontractor and the surfacing installation subcontractor to ensure a seamless transition between the site construction/play and shade equipment installation, and the safety surfacing installation. With years of experience between the construction subcontractor and the surfacing subcontractor working on local play area projects together, it is anticipated that no issues or delays will occur upon such project transition. SUBTASK 6F: As the surfacing installation nears completion, the PM will schedule the CPSI to perform the compliance audit once the unitary surfacing has completed curing. Upon the receipt of a successful compliance report, the consultant will arrange a post -installation job walk with the City to comprehensively review the project. Any issues found will be documented on a punch -list by the consultant and addressed with the appropriate subcontractor so as to remedy the situation(s) promptly. SUBTASK 6G: Upon successful completion of all items on the punch -list, the consultant will relay the information to the City and arrange for a final job walk if deemed necessary. Prior to the project close-out, the consultant will provide the City with the equipment warranty information, the maintenance package including touch-up paint, the CPSI's report, and all other necessary equipment information. SUBTASK 6H: The consultant will coordinate with the design subcontractor to provide the City with all as -built drawings of the project within 15 working days after the project is completed, so as to document the construction and installation. These drawings will include the specifications and locations of any underground utility lines. The consultant will endeavor to ensure the accuracy of such drawings and will be held liable for any errors or omissions discovered, should they require financial expenditures to remedy. OUTPUT: A well-built plan executed by experienced professionals will yield a well-built play area that the City and stakeholders can be proud of for decades to come. 4. INCLUSIVE DESIGN CONCEPT The Landscape Structures design concept for the West Creek Park Inclusive Play Area is based upon a design collaboration between O'Dell Engineering and Landscape Structures. This conceptual design involves utilizing the existing topography to transform the two existing play areas as well as about half of the lawn area into new, inclusive play and seating areas. In recognizing the depth of the sidewalks and curbing at the existing play areas, and the costs that would be expected to alter them, it is this design concept's intention to keep all existing sidewalks intact in an effort to focus budget resources to providing inclusive play events and innovative equipment as well as shade coverage. The larger, western -most, existing 3,535 SF play area will be converted into an accessible seating area for families and groups. The surfacing will be changed to ADA-compliant, accessible, decomposed granite (DG) flush with the surrounding sidewalks. Included in the seating area are five (5) Landscape Structures West Creek Park Inclusive Play Area Proposal By Landscape Structures, Inc. March 18, 2021 picnic tables with two (2) benches each. An Additional Alternate is available in the Cost of Services to change the furnishings to three (3) steel and recycled plastic picnic tables with two (2) benches each, and two (2) ADA-accessible steel and recycled plastic picnic tables with two (2) benches each. All tables and benches will be mounted within the area onto new, concrete pads. This area will remain uncovered. The smaller existing play area will be converted into a 1,980 SF 2-5-year-olds inclusive play area with 1,980 SF of poured -in -place rubber safety surfacing flush to the existing, surrounding sidewalks, on a compacted aggregate sub -base. The play area will be covered parallel to the south sidewalk with a trapezoidal -shaped free-standing shade sail, approximately 1,650 SF in size. A second Additional Alternate is available in the Cost of Services to add a triangular shade sail over the northernmost section of the 2-5-year- olds play area. Inclusive play equipment from Landscape Structures includes the multi -person OmniSpin Spinner, the collaborative We -Saw, and a fun playhouse made of multiple Learning Wall sensory play panels, to create a universally accessible play area with space to roam around. This area will be enclosed with approximately 200 linear feet of a 4' tall chain -link fence, similar in style to the fencing by the basketball courts. A welcome sign and hand sanitizing station will be installed in the play area by the gated entrance. The drinking fountain located next to the picnic shade shelter, by the lawn and existing play areas, will be replaced with an accessible bottle filler with bi-level drinking fountain. The drain sump for the drinking fountain will be reconstructed as necessary. While the drinking fountain is not shown in the attached 3D- rendered playground images, an image and details are included with the informational attachments. The northern half of the lawn area will be converted to an 8,106 SF 5-12-year-olds play area with approximately 8,306 SF of poured -in -place rubber safety surfacing installed on top of a compacted aggregate sub -base. The surfacing color is designed with long stripes of alternating colors of blue and green that run through both of the play areas. The topography at this area will be utilized to create a safe, fun, hill slope with play events accessible from the sidewalk including the unique Cozy Dome climber, an exciting Slidewinder slide, and a Rollerslide, the industry's original inclusive slide. A large, ramped, inclusive play structure with slides, a climbing net, and several other fun play events and sensory panels will also be accessible from the sidewalk. Outdoor musical instruments and multiple inclusive, free-standing play events will be installed around the play structure, including the inclusive -designed Roller Table, the wheelchair - accessible We -Go -Round, and the revolutionary We -Go -Swing, the first no -transfer inclusive swing able to be integrated into a play area with other equipment. The 5-12-year-olds play area also includes two swing bays: one with a belt seat and inclusive -designed molded harness seat, and the other swing bay with the Friendship Swing, which allows multiple riders to have a face-to-face swinging experience. The unique Friendship Swing is set at a transfer height for easy transfer from a wheelchair. A Double Bobble Rider spring play event and a Chill Spinner that is sized right for kids and adults adds to the inclusive fun for all ages. And a Learning Wall will offer more fun sensory play panels to engage kids. Landscape Structures recognizes the City's request for shade coverage over the play equipment. This play area will have two large, free-standing shade sails overhead covering approximately 5,185 SF. This conceptual design has another Additional Alternate available in the Cost of Services to add a third shade sail over the southern section of the 5-12-year-olds play area for complete shade coverage. The shade sails will run from east to west casting a cooling shadow on the play equipment that will shift as the day goes along. A concrete sidewalk of approximately 988 SF will be installed that bisects the lawn to create a southern perimeter for the 5-12-year-olds play area. While the north side of this play area will remain open to allow access to the slides, structure, and play hill; approximately 204 linear feet of 4' tall chain -link fencing will be West Creek Park Inclusive Play Area Proposal By Landscape Structures, Inc. March 18, 2021 installed along most of the west and east sides and the entire south perimeter sidewalk. A welcome sign and hand sanitizing station will be installed in the play area on the south side near the entrance gate. An entrance planter area will separate the 5-12-year-olds play area from the parking lot for safety and aesthetic design reasons. The existing irrigation system will be reconfigured to provide the minimal irrigation needed for the drought -tolerant foliage that will be planted within the new entrance area planter. The low water use, climate appropriate, lower -than -average allergen level species to be planted are Arctostaphylos edmundsii 'Carmel Sur', Chondropetlaum tectorum 'El Campo', Cistus x pulverulentus'Sunset', Dianella 'Baby Bliss', Grevillea x'Noellii', Lomandra longifolia'Platinum Beauty', Salvia greggii, Westringia'Wynabbie Gem', and the small accent tree Cercis occidentalis. These species are different than the foliage shown in the attached 3D renderings. An Inclusive Play Area Design Attachment is included after this Proposal, with three -dimensionally rendered color images and two-dimensional design layout drawings. Evergreen Environment also regularly works with the safety surfacing installation team at SpectraTurf, the unitary surfacing subcontractor. PROJECT DEVELOPMENT TEAM SUB -CONSULTANT As detailed in the Statement of Qualifications (SOQ) section, Landscape Structures is collaborating with O'Dell Engineering for all design work, land surveys, and associated construction drawings necessary for the West Creek Park Inclusive Play Area Proposal By Landscape Structures, Inc. March 18, 2021 City permit process. A licensed, skilled, and qualified firm, O'Dell Engineering brings 27 years of experience, including many years of inclusive play design experience, to the Project Development Team to work with the subcontractors, project manager, and City project team members assigned to the Project Development Team. O'Dell Engineering will perform the topographical site survey after receipt of an NTP for Design, prior to the completion of the design work. As described in the SOQ, Mr. Chad Kennedy offers a unique skillset that makes him highly qualified to design inclusive play areas. He and his team will be responsible for the creation of all initial and revised designs and the final design, including drought -tolerant landscaping specifications. The firm will handle the creation of all Survey, Civil, and Landscape Improvement Plans that will need to be submitted to and approved by the City. Mr. Kennedy and O'Dell Engineering bring an expertise and excellent track record of success which, combined with their spirit of inclusivity for all, assure a successful project. Please see the attached Designation of Subconsultants Form and Professional License of Design for additional information. The cost estimate for O'Dell Engineering's scope of work is included in the Cost File. 7. PROJECT DEVELOPMENT TEAM SUBCONTRACTORS As detailed in the Statement of Qualifications (SOQ) section, Landscape Structures is collaborating with Evergreen Environment for all site construction work and play and shade equipment installation. As a certified Landscape Structures installer, Evergreen Environment is a qualified and capable member of the Project Development Team, able to handle all aspects of receiving, verifying, mobilizing, and installing the play and shade equipment, while also collaborating with the City staff assigned to the Team. As described in the SOQ, Mr. Juan Sandoval and his crew will be responsible for the demolition of the existing play areas, construction of the picnic area and 2-5-year-olds play area, excavation of the new 5-12-year-olds play area, construction of the new 5-12-year-olds play area, and installation of the planter entrance, fencing, sidewalk, and play and shade equipment. Evergreen will prepare the site for the surfacing installation crew. They will also address and remedy any issues found during the Punch Walk. The thorough and reliable work offered by Mr. Sandoval and Evergreen Environment also brings an excellent track record of success to the Team. Please see the attached Designation of Subcontractors Form for additional information. The cost estimate associated with Evergreen Environment's scope of work is included in the Cost File. Also detailed in the Statement of Qualifications section, Landscape Structures has selected SpectraTurf as the Project Development Team Member responsible for installing the compliant, poured -in -place, rubber safety surfacing. For decades, Mr. Mark Hollowell and the team at SpectraTurf have been providing high - quality safety surfacing for play areas across Southern California. Their work is bar none —superior to the industry standard —with few problems or compliance issues ever found post -installation. Their expertise and craftsmanship will be evident upon completion of the safety surfacing installation. Upon a receipt of an NTP, Landscape Structures will ensure to include all necessary and pertinent Section 3 Clause language for all subcontracts in excess of $100,000. Landscape Structures will also ensure that each subcontractor with a subcontract over $100,000 completes the Subcontractor's Certification for Section 3 Coordinator and the Contractor's Section 3 Affirmative Action Plan, which includes the Estimated Project Workforce Breakdown and a Summary of Subcontracts over $100,000. Landscape Structures will also ensure that each subcontractor with a subcontract over $100,000 provides all potential employees with the opportunity to complete the Certification for Section 3 Residents in order to request preference in hiring and training, and that each of those subcontractors also provides all potential businesses the opportunity to complete the Certification for Section 3 Business Concerns. West Creek Park Inclusive Plav Area Proposal By Landscape Structures Inc. March 17, 2021 8. TOTAL COST The cost estimate information for each task identified by Landscape Structures in this West Creek Inclusive Play Area Proposal has been supplied separately as the Cost of Services document. 9. STATEMENT OF OFFER This Proposal is a firm offer from Landscape Structures for a period of 120-days from the date of the Proposal. All work shall be performed as detailed at a "not -to -exceed" price of one -million dollars ($1,000,000). Landscape Structures accepts the contract language and requirements found in the City of Santa Clarita's Standard Capital Improvement Project (CIP) Agreement as well as the Community Development Block Grant documentation with no deviations requested. The Saddle Spinner, besides a source of vestibular and proprioceptive input, elicited positive social interactions such as turn -taking. On the Double Swoosh TM Slide, children learned cooperative play. They were observed waiting at the top of the slide, controlling their anticipation and excitement, until their companion was ready. SUMMARY OF CONTRACT REQUIREMENTS a. A contract is required for any service performed on behalf of the City of Santa Clarita (City). Contract language will be negotiated upon acceptance of proposal and prior to commencement of work. Work cannot begin until the contract has been fully executed by both parties. 2. SUMMARY OF INSURANCE REQUIREMENTS a. These are the Insurance Requirements for Contractors providing services or supplies to the City. By agreeing to perform the work or submitting a proposal, you verify that you comply with and agree to be bound by these requirements. When Contract documents are executed, the actual Contract language and Insurance Requirements may include additional provisions as deemed appropriate by City's Risk Manager. b. You should check with your Insurance advisors to verify compliance and determine if additional coverage or limits may be needed to adequately insure your obligations under this agreement. These are the minimum required and do not in any way represent or imply that such coverage is sufficient to adequately cover the Contractor's liability under this agreement. The full coverage and limits afforded under Contractor's policies of Insurance shall be available to Buyer and these Insurance Requirements shall not in any way act to reduce coverage that is broader or includes higher limits than those required. The Insurance obligations under this agreement shall be: 1—all the Insurance coverage and limits carried by or available to the Contractor; or 2—the minimum Insurance requirements shown in this agreement, whichever is greater. Any insurance proceeds in excess of the specified minimum limits and coverage required, which are applicable to a given loss, shall be available to City. c. Contractor shall furnish the City with original Certificates of Insurance including all required amendatory endorsements and a copy of the Declarations and Endorsement Page of the CGL policy listing all policy endorsements to City before work begins. City reserves the right to require full -certified copies of all Insurance coverage and endorsements. a. General Insurance Requirements All insurance shall be primary insurance and shall name City of Santa Clarita as an additional insured. The naming of an additional insured shall not affect any recovery to which such additional insured would be entitled under the policy if not named as an additional insured, and an additional insured shall not be held liable for any premium or expense of any nature on the policy or any extension thereof solely because they are an additional insured thereon. ii. If the operation under this Agreement results in an increased or decreased risk in the opinion of the City's Risk Manager, then Consultant agrees that the minimum limits hereinabove designated shall be changed accordingly upon written request by the Risk Manager. iii. Consultant agrees that provisions of this Section as to maintenance of insurance shall not be construed as limiting in any way the extent to which Consultant may be held responsible for the payment of damages to persons or property resulting from Consultant's activities, the activities of its subconsultants, or the activities of any person or persons for which Consultant is otherwise responsible. iv. A Certificate of Insurance, and an additional insured endorsement (for general and automobile liability), evidencing the above insurance coverage with a company acceptable to the City's Risk Manager shall be submitted to City prior to execution of this Agreement on behalf of the City. v. The terms of the insurance policy or policies issued to provide the above insurance coverage shall provide that said insurance may not be amended or canceled by the carrier, for nonpayment of premiums otherwise, without 30 days prior written notice of amendment or cancellation to City. In the event the said insurance is canceled, Consultant shall, prior to the cancellation date, submit new evidence of insurance in the amounts heretofore established. vi. All required insurance must be in effect prior to awarding this Agreement, and it or a successor policy must be in effect for the duration of this Agreement. Maintenance of proper insurance coverage is a material requirement of this Agreement, and the failure to maintain and renew coverage or to provide evidence of renewal may be treated by the City as a material breach of contract. If Consultant, at any time during the term of this Agreement, should fail to secure or maintain any insurance required under this Agreement, City shall be permitted to obtain such insurance in Consultant's name at Consultant's sole cost and expense, or may terminate this Agreement for material breach. vii. Without limiting any other Consultant obligation regarding insurance, should Consultant's insurance required by this Agreement be cancelled at any point prior to expiration of the policy, Consultant must notify City within 24 hours of receipt of notice of cancellation. Furthermore, Consultant must obtain replacement coverage that meets all contractual requirements within 10 days of the prior insurer's issuance of notice of cancellation. Consultant must ensure that there is no lapse in coverage. b. General Liability and Property Damage Insurance L Consultant agrees to procure and maintain general liability and property damage insurance at its sole expense to protect against loss from liability imposed by law for damages on account of bodily injury, including death therefrom, and property damage, suffered or alleged to be suffered by any person or persons whomsoever, resulting directly from any act or activities of Consultant, its subconsultants, or any person acting for Consultant or under its control or direction, and also to protect against loss from liability imposed by law for damages to any property of any person caused directly or indirectly by or from acts or activities of Consultant, or its subconsultants, or any person acting for Consultant, or under its control or direction. Such public liability and property damage insurance shall also provide for and protect City against incurring any legal cost in defending claims for alleged loss. Such general liability and property damage insurance shall be maintained in the following minimum limits: A combined single -limit policy with coverage limits in the amount of $1,000,000 per occurrence will be considered equivalent to the required minimum limits. c. Automotive Insurance i. Consultant shall procure and maintain public liability and property damage insurance coverage for automotive equipment with coverage limits of not less than $1,000,000 combined single limit. If Consultant does not use automobiles in performing its work under this Agreement, Consultant shall provide a waiver releasing City from all liability resulting from Consultant's use of personal vehicles under this Agreement. d. Worker's Compensation Insurance i. Consultant shall procure and maintain Worker's Compensation Insurance in the amount of $1,000,000 per occurrence or as will fully comply with the laws of the State of California and which shall indemnify, insure, and provide legal defense for both Consultant and City against any loss, claim, or damage arising from any injuries or occupational diseases happening to any worker employed by Consultant in the course of carrying out this Agreement. ii. Waiver of Subrogation: The insurer(s) agree to waive all rights of subrogation against City, its elected or appointed officers, officials, agents, volunteers and employees for losses paid under the terms of the workers compensation policy which arise from work performed by Consultant for City. Questions and requests for modification of these terms must be negotiated and approved prior to contract execution and are at the full discretion of the City.
