Approve the purchase of 0.47 +/- acres of real property contiguous to City -owned property in Newhall, Assessor's Parcel Numbers 2831-018-019, -020, -021, -022, -023, and -024 at a total cost of $2,320,000, which includes the property purchase price of $2,300,000 and $20,000 for title, escrow, and due diligence costs. 2. Appropriate $2,320,000 from the American Rescue Plan Act (ARPA) COVID-19 Response Fund to Expenditure Account 19009-5201.004 (Land) and increase Revenue Account 228- 4621.001 in the same amount for the purchase of the property and due diligence costs. 3. Authorize the City Manager, or designee, to enter into a Purchase and Sale Agreement to acquire the property and to execute all documents needed for the purchase of this property, subject to City Attorney approval. BACKGROUND The subject property is located in the Newhall area and is currently being leased by the City of Santa Clarita (City) for use as a public lot to allow patrons access to parking, free of charge, in support of the Old Town Newhall merchants. This action is supported by the Old Town Newhall Specific Plan, which was approved by the City Council in 2005, regarding plans for public parking to be provided. By purchasing the subject property, the City would be able to continue to provide public parking in the area, as well as look at other future opportunities for public/private partnerships to further enhance the economic vitality of Old Town Newhall. Page 1 Packet Pg. 224 P*-] Further, the property consisting of six separate parcels is contiguous to other City owned properties on Main Street, including the former Roger Dunn and Moore's Restaurant properties, Assessor's Parcel Numbers 2831-018-900 and 2831-019-901 and -902, respectively. The total cost of the property acquisition is $2,320,000, which includes the $2,300,000 purchase price and $20,000 for title, escrow, and due diligence costs. On March 11, 2021, the American Rescue Plan Act (ARPA) was signed into law by the President, which established the Coronavirus Local Fiscal Recovery Fund (ARPA COVID-19 Response Funds) intended to combat the public health and economic impacts of the COVID-19 pandemic. According to the U.S. Department of the Treasury's (Treasury) Interim Final Rule (IFR) published on May 17, 2021, guidelines for the use of ARPA COVID-19 Response Funds include the following: 1) respond to the public health emergency or its negative economic impacts; 2) provide premium pay to eligible workers; 3) replace lost public sector revenue; and 4) and make necessary investments in water, sewer, or broadband infrastructure. The COVID pandemic brought significant impacts and economic challenges to the Santa Clarita community, including negative economic impacts to Santa Clarita's small business community. The City remains committed to supporting local small business under the ARPA COVID-19 Response Funds and Treasury's IFR guidelines. The property has economic significance to the overall health of the business community in Old Town Newhall. The recommendation to appropriate ARPA COVID-19 Response Funds for the acquisition of property on Main Street is supported as an eligible expense under the category of responding to the negative economic impacts of the pandemic, is in line with the Old Town Newhall Specific Plan, and supports the Santa Clarita 2025 theme of Enhancing Economic Vitality: Develop a public/private partnership to address parking needs in Old Town Newhall. The proposed acquisition has been reviewed pursuant to the California Environmental Quality Act (CEQA) and is exempt under CEQA Guidelines Section 15061(b)(3), as no change to the current use of the property is contemplated in connection with this acquisition. Any subsequent or proposed changes in the use or condition of the property will be subject to CEQA Guidelines. ALTERNATIVE ACTION Other action as determined by the City Council. FISCAL IMPACT Upon approval of the recommended action, the budget will be adjusted accordingly, $2,320,000 will be appropriate from the American Rescue Plan Act (ARPA) COVID-19 Response Fund to Expenditure Account 19009-5201.004 (Land) and Revenue Account 228-4621.001 will be increased in the same amount.
