HomeMy WebLinkAbout2021-09-14 - AGENDA REPORTS - LEASE AGMT SENATOR WILK OFFICE (2)8 Agenda Item:7 CITY OF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR CITY MANAGER APPROVAL: DATE: September 14, 2021 LEASE AGREEMENT AMENDMENT FOR SENATOR SCOTT SUBJECT: WILK'S FIELD OFFICE AT CITY HALL SUITE 250 DEPARTMENT: Recreation and Community Services PRESENTER: Amy Seyerle RECOMMENDED ACTION City Council authorize the City Manager, or designee, to execute on behalf of the City of Santa Clarita an Amendment to the Lease Agreement with the Senate Rules Committee, California Legislature, in a monthly amount of $1,013.43, with an annual increase of three percent through the duration of the agreement, for the continued use of approximately 600 square feet of commercial space for the field office of Senator Scott Wilk, subject to City Attorney approval. BACKGROUND The Senate Rules Committee, California Legislature, has held a field office in City Hall Suite 250 since 2011. The purpose of this field office is to allow for Senate field staff to carry out various duties within the State government agencies. The term of the agreement extended through November 30, 2020. The amendment would further extend the lease agreement through February 25, 2025. During the first year of the amended lease, the monthly rent is $1,013.43, which includes utilities, except telephone and data/internet services/cable. The rent will then increase annually by three percent. ALTERNATIVE ACTION Other action as determined by the City Council. FISCAL IMPACT Upon approval of the recommended action, the budget will be adjusted accordingly. It is agreed between Lessor and State to modify the lease by amending paragraphs 2,3, and 6 as follows: 2. TERM -- TO HAVE AND HOLD said leased premises, together with the appurtenance, rights, and st easements thereunto belonging or appertaining unto State, for a term commencing on the 1 day of August, th 2021 and ending on the 28 day of February, 2025 with such rights of termination as are hereinafter set forth. 3. RENT The total amount to be paid is as follows: $1.69 PER SQUARE FOOT for 600 SQUARE FEET. TOTAL MONTHLY RENTAL $1,013.43 (One thousand thirteen dollars and 43 cents) 3% annual increases as follows: Beginning 8/1/22 rent shall become $1,043.83 Beginning 8/1/23 rent shall become $1,075.14 Beginning 8/1/24 rent shall become $1,107.39 with rental payable by State in arrears on the last day of the month, unless sufficient funds have not been made available in the annual budget act for the purpose of funding Senate Rules Committee Lease agreements, in an amount that follows: The State shall pay any rental payments that are not paid under this paragraph due to budgetary constraints, as soon as funds are made available under the annual budget act. 6.
