SUMMARY VACATION OF AN OFFER OF DEDICATION, FOR
SUBJECT:
PRIVATE AND FUTURE STREET PURPOSES, ALONG THE EAST
SIDE OF ALDERBROOK DRIVE

RECOMMENDED ACTION
City Council:
1. Adopt a resolution for the summary vacation of an offer of dedication, for private and future
street purposes, along the east side of Alderbrook Drive, as de
of the attached resolution.
2. Direct the City Clerk to record the certified original resolution in the Los Angeles County
Registrar-office.
BACKGROUND
The offer of dedication to be vacated was originally dedicated to the County of Los Angeles by
Parcel Map No. 7045, which recorded on July 26, 1979. The 20-foot-wide dedication is located
along the east portion of Alderbrook Drive, from Cindy Road (formerly known as Pinksand
Road) to Cleardale Street, as shown on the attached Location Map. The offer of dedication on
Parcel Map No. 7045 was for private and future street purposes, however, this small strip of
Alderbrook Drive is not needed for public road purposes.
The 20-foot-wide dedicated private and future street crosses four existing residential lots, and the
owner of these lots has requested the vacation. The remaining 40-foot-wide portion of the private
street, Alderbook Drive, is adequate to serve the existing residential parcels to the southwest and
the four residential lots to the northeast.
In compliance with Section 8340 of the Streets and Highways Code, City staff coordinated with
public utilities and determined that there are no public utility facilities in place that would be

affected by this vacation and no reservation of easement is necessary for prospective public use.
Per Section 8331 of the Streets and Highways Code, the legislative body of a local agency may
summarily vacate a street or highway if both of the following conditions exist:
(a) For a period of five consecutive years, the street or highway has been impassable for
vehicular travel; and
(b) No public money was expended for maintenance on the street or highway during such
period.
Both of these conditions exist, therefore, staff is recommending the offer of dedication be
summarily vacated by adopting the resolution.
ALTERNATIVE ACTION

There is no fiscal impact associated with this action.

RESOLUTION NO. 22- _______
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA,
CALIFORNIA, SUMMARILY VACATING AN OFFER OF DEDICATION FOR
PRIVATE AND FUTURE STREET PURPOSES ALONG ALDERBROOK DRIVE,
CREATED ON PARCEL MAP NO. 7045, FILED IN BOOK 114, PAGE 88 OF MAPS
WHEREAS, the offer of dedication being summarily vacated fully meets the
requirements of Section 8331 of the Streets and Highways Code, which states “The legislative
body of a local agency may summarily vacate a street or highway if both of the following
conditions exist: (a) For a period of five consecutive years, the street or highway has been
impassable for vehicular travel; and (b) No public money was expended for maintenance on the
street or highway during such period.” The current owner requests that a portion of the
dedication for private and future street purposes be vacated; and
WHEREAS, under Chapter 4, Summary Vacation of Part 3 of Division 9 of the
California Streets and Highways Code, no public hearing is required and no public hearing was
held.
NOW, THEREFORE, the City Council of the City of Santa Clarita, California, does
hereby resolve as follows:
SECTION 1. That it is hereby found and determined that an offer of dedication for
private and future street purposes along the east side of Alderbrook Drive, from Cindy Road to
Cleardale Street, as described in Exhibit ‘A’ Legal Description, and as shown on Exhibit “B”
Exhibit Map, attached hereto and incorporated herein by this reference, which real property
located in the City of Santa Clarita, County of Los Angeles, State of California, fully meets the
requirements of Section 8331 of the Streets and Highways Code, which states “The legislative
body of a local agency may summarily vacate a street or highway if both of the following
conditions exist: (a) For a period of five consecutive years, the street or highway has been
impassable for vehicular travel; and (b) No public money was expended for maintenance on the
street or highway during such period” and such offer of dedication is therefore vacated.
SECTION 2. That within the private and future street dedication to be vacated, there
are no public utility facilities that would be affected.
SECTION 3. That the City Clerk of the City of Santa Clarita, California, is instructed
to record the certified original resolution in the office of the Los Angeles County Registrar-
Recorder, at which time the easements summarily vacated will no longer be public service
easements.
SECTION 4. The City Clerk shall certify to the adoption of this resolution.
