SUBJECT: SUMMARY VACATION OF EASEMENTS FOR SLOPE, DRAINAGE
AND FLOOD CONTROL PURPOSES LOCATED AT THE
SOUTHWEST CORNER OF GOLDEN VALLEY ROAD AND
VALLEY CENTER DRIVE (APPROVED SELF -STORAGE
FACILITY)

RECOMMENDED ACTION
City Council:
1. Adopt a resolution for the summary vacation of an easement for slope purposes as described
and shown on Exhibit "A" Legal Description and Exhibit "B" Exhibit Map, and an easement
for drainage and flood control purposes as described and shown on Exhibit "C" Legal
Description and Exhibit "D" Exhibit Map of the attached resolution.
2. Direct the City Clerk to record the certified original resolution in the Los Angeles County
Registrar -Recorder's office.
BACKGROUND
On February 9, 2006, a slope easement was granted to the City of Santa Clarita (City) as
Instrument No. 06-0307035, and a drainage and flood control easement was granted to the City
as Instrument No. 06-0307038, both of which are shown on Parcel Map No. 71725. These
easements were for the construction of Valley Center Drive. On November 10, 2020, the City
Council passed Ordinance No. 20-9, approving Master Case 19-089. This approval allowed for
the construction and operation of a 156,060-square-foot self -storage facility at the southwest
corner of Golden Valley Road and Valley Center Drive, as shown on the attached Location Map.
A portion of the slope easement and all of the drainage and flood control easement will no longer
be necessary, due to the proposed development of the self -storage facility and the modification to
the site layout, per the approved project site plan. Staff is recommending the unnecessary
easements be vacated. The remaining portion of the slope easement, which is adjacent to Valley

Center Drive, will remain and is not being vacated.
Per Division 9, Part 3, Section 8333 of the California Streets and Highways Code, the legislative
body of a local agency may summarily vacate an easement if any of the following conditions
exists:
(a) The easement has not been used for the purpose for which it was dedicated or acquired
for five consecutive years immediately preceding the proposed vacation.
(b) The date of dedication or acquisition is less than five years, and more than one year,
immediately preceding the proposed vacation, and the easement was not used
continuously since that date.
(c) The easement has been superseded by relocation, or determined to be excess by the
easement holder, and there are no other public facilities located within the easement.
City staff has determined that the easements as described and shown on Exhibits "A" through
"D" of the attached resolution have been determined to be excess by the easement holder, and
there are no other public facilities located within the easement. Therefore, staff is recommending
the easements be summarily vacated by adopting the resolution.
ALTERNATIVE ACTION
Other actions as determined by the City Council may be considered.
FISCAL IMPACT
There is no fiscal impact associated with this action.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA,
CALIFORNIA, SUMMARILY VACATING AN EASEMENT FOR SLOPE PURPOSES
AND AN EASEMENT FOR DRAINAGE AND FLOOD CONTROL PURPOSES
LOCATED AT THE SITE OF THE APPROVED SELF -STORAGE FACILITY AT
VALLEY CENTER DRIVE
WHEREAS, the easements being summarily vacated fully meet the conditions of
Division 9, Part 3, Section 8333 of the California Streets and Highways Code, which states: "The
legislative body of a local agency, or any public officer or employee authorized by the legislative
body as provided in subdivision (a) of Section 8335, may summarily vacate a public service
easement in any of the following cases: (a) The easement has not been used for the purpose for
which it was dedicated or acquired for five consecutive years immediately preceding the
proposed vacation. (b) The date of dedication or acquisition is less than five years, and more than
one year, immediately preceding the proposed vacation, and the easement was not used
continuously since that date. (c) The easement has been superseded by relocation, or determined
to be excess by the easement holder, and there are no other public facilities located within the
easement." The current owner requests that these easements be vacated; and
WHEREAS, under Division 9, Part 3, Chapter 4 of the California Streets and
Highways Code, no public hearing is required and no public hearing was held.
NOW, THEREFORE, pursuant to the provisions of Division 9, Part 3, Section 8333
of the California Streets and Highways Code, the City Council of the City of Santa Clarita,
California, does hereby resolve as follows:
SECTION 1. That it is hereby found and determined that a portion of an easement for
slope purposes, along the east side of Valley Center Drive, as described in Exhibit "A" Legal
Description and as shown on Exhibit "B" Exhibit Map, and an easement for drainage and flood
control purposes, along the east side of Valley Center Drive, as described in Exhibit "C" Legal
Description, and as shown on Exhibit "D" Exhibit Map, attached hereto and incorporated herein
by this reference, which real property located in the City of Santa Clarita, County of Los
Angeles, State of California, fully meets the requirements of Section 8333 of the Streets and
Highways Code, which states: "The legislative body of a local agency, or any public officer or
employee authorized by the legislative body as provided in subdivision (a) of Section 8335, may
summarily vacate a public service easement in any of the following cases: (a) The easement has
not been used for the purpose for which it was dedicated or acquired for five consecutive years
immediately preceding the proposed vacation. (b) The date of dedication or acquisition is less

SECTION 2. That within the easements to be vacated, there are no public utility
facilities that would be affected.

SECTION 3. That the City Clerk of the City of Santa Clarita is instructed to record
the certified original resolution in the Los Angeles County Registrar -Recorder's office, at which
time the easements summarily vacated will no longer be public service easements.
SECTION 4. The City Clerk shall certify to the adoption of this resolution.
