You may address the Council once per meeting during Public Participation on any matter within the Council's jurisdiction that is not listed on the agenda. Public Participation speaker's cards must be submitted to the City Clerk BEFORE this portion of the meeting begins. To address the Council regarding an item on the agenda, please fill out a speaker's card and submit it to the City Clerk BEFORE the Mayor announces the item. Each person addressing the Council is given three minutes to speak (with double the time allotted to non-English speakers using a translator) indicated by a colored light system on the Council dais. If you wish to provide information to the Council, please present the City Clerk with 10 copies. Otherwise, your materials will simply be added to the official record. Please note use of City Council Chamber technology equipment to present electronic material during meetings is not allowed. In compliance with the Americans with Disabilities Act, if you need special assistance to participate in this meeting, please contact the City Clerk's Office, (661) 255-4391. Notification 48 hours prior to the meeting will enable the City to make reasonable arrangements to ensure accessibility to this meeting. (28CFR 35.102-35.104 ADA Title II) Pursuant to Government Code 54957.5 any writings or documents distributed to a majority of the members of the City Council regarding any open session item on this agenda will be made available for public inspection in the City Clerk's Office located at 23920 Valencia Boulevard, Suite 120, during normal business hours. INVOCATION Gibbs CALL TO ORDER ROLL CALL FLAG SALUTE EXECUTIVE MEETING This time has been set aside for Councilmembers to review the agenda and obtain any further information that may be needed. Council will also discuss each individual item during the course of the meeting with the exception of the Consent Calendar, which may be approved in its entirety by one motion, unless there is a request to pull an item for discussion. No action will be taken on public agenda items during the Executive Meeting. APPROVAL OF AGENDA AWARDS AND RECOGNITIONS Black History Month Proclamation Recognition for the City of Santa Clarita's Elder Trail Crew American Public Works Association Award PUBLIC PARTICIPATION This time has been set aside for the public to address the City Council on items NOT listed on the agenda. The City Council will not act upon these items at this meeting other than to review and/or provide direction to staff. All speakers must submit a speaker's card to the City Clerk PRIOR to the beginning of this portion of the meeting. Thirty minutes are allotted for public input at this time. The FIRST TEN people to submit a speaker card prior to the beginning of Public Participation will be heard. The items are not individually discussed by the City Council unless a request is made by a member of the public or the Council, in which case, the item(s) will be removed from the Consent Calendar and will be considered separately. Page 2 APPROVAL OF SPECIAL MEETING MINUTES — The minutes of the City Council are submitted for approval. RECOMMENDED ACTION: City Council approve the minutes of the January 25, 2022 Special Meeting. 2. APPROVAL OF REGULAR MEETING MINUTES — The minutes of the City Council are submitted for approval. RECOMMENDED ACTION: City Council approve the minutes of the January 25, 2022 Regular Meeting. 3. CHECK REGISTER NOS. 02 AND 03 - Check Register No. 02 for the Period 12/17/21 through 12/30/21 and 01/06/22. Electronic Funds Transfers for the Period 12/20/21 through 12/31/21. Check Register No. 03 for the Period 12/31/21 through 01/13/22 and 01/20/22. Electronic Funds Transfers for the Period 01/03/22 through 01/14/22_ RECOMMENDED ACTION: City Council approve and ratify for payment the demands presented in Check Register No. 02 and Check Register No. 03. 4. STATE LEGISLATION: ASSEMBLY BILL 916 - Authored by Assembly Member Rudy Salas (D-32-Bakersfield), Assembly Bill 916 prohibits local governments from conducting a public hearing as a condition of approving a project that adds space for additional bedrooms or reconfigures existing space to increase the bedroom count within an existing house, condominium, or apartment and increases the maximum height of an accessory dwelling unit that a local government must enforce from 16 feet to 18 feet. RECOMMENDED ACTION: City Council adopt the City Council Legislative Committee recommendation to oppose Assembly Bill 916 (Salas) and transmit position statements to Assembly Member Salas, Santa Clarita's state legislative delegation, appropriate legislative committees, Governor Newsom, and the League of California Cities. 5. STATE LEGISLATION: ASSEMBLY BILL 1597 - Authored by Assembly Member Marie Waldron (R-75-Escondido), Assembly Bill 1597 reinstates prosecutorial authority to charge someone with a felony and imprisonment of up to three years, if they have been previously convicted three or more times of petty theft, shoplifting, grand theft, burglary, auto theft, robbery, elder financial abuse, or knowingly receiving stolen property. RECOMMENDED ACTION: City Council adopt the City Council Legislative Committee recommendation to support Assembly Bill 1597 (Waldron) and transmit position statements to Assembly Member Waldron, Santa Clarita's state legislative delegation, appropriate legislative committees, Governor Newsom, League of California Cities, and other stakeholder organizations. STATE LEGISLATION: ASSEMBLY BILL 1599 - Authored by Assembly Member Kevin Kiley (R-6-Rocklin), Assembly Bill 1599 repeals Proposition 47 (2014), except for provisions related to reducing the penalty for possession of concentrated cannabis. RECOMMENDED ACTION: City Council adopt the City Council Legislative Committee recommendation to support Assembly Bill 1599 (Kiley) and transmit position statements to Assembly Member Kiley, Santa Clarita's state legislative delegation, appropriate legislative committees, Governor Newsom, and the League of California Cities. 7. STATE LEGISLATION: ASSEMBLY BILL 1603 - Authored by Assembly Member Rudy Salas (D-32-Bakersfield), Assembly Bill 1603 amends Proposition 47 (2014) by reducing the threshold amount for petty theft and shoplifting from $950 to $400. RECOMMENDED ACTION: City Council adopt the City Council Legislative Committee recommendation to support Assembly Bill 1603 (Salas) and transmit position statements to Assembly Member Salas, Santa Clarita's state legislative delegation, appropriate legislative committees, Governor Newsom, League of California Cities, and other stakeholder organizations. 8. STATE LEGISLATION: SENATE CONCURRENT RESOLUTION 5 - Authored by Senator Melissa Melendez (R-28-Lake Elsinore), Senate Concurrent Resolution 5 declares the state of emergency proclaimed by the Governor on March 4, 2020, is at an end, thereby terminating the emergency powers granted to the Governor as a result of the proclamation. RECOMMENDED ACTION: City Council adopt the City Council Legislative Committee recommendation to support Senate Concurrent Resolution 5 (Melendez) and transmit position statements to Senator Melendez, Santa Clarita's state legislative delegation, appropriate legislative committees, Governor Newsom, League of California Cities, and other stakeholder organizations. 9. NOTIFICATION OF INTENT TO COMPLY WITH SENATE BILL 1383 REGULATIONS - The proposed Notice of Intent to Comply, in accordance with SB 619, will state the City of Santa Clarita's intent to comply with the recently adopted regulations of SB 1383. Failure to comply with SB 1383 will result in penalties. RECOMMENDED ACTION: City Council: 1. Adopt a resolution approving a Notice of Intent to Comply with Senate Bill 1383 regulations. 2. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval. Page 4 10. CITY HALL RESTROOMS REMODEL, PHASE I, PROJECT M1037 - APPROVE PLANS AND SPECIFICATIONS AND AWARD CONSTRUCTION CONTRACT - Phase I remodel of the restrooms at City Hall, which includes the removal and replacement of all ceramic tile, plumbing fixtures, countertops, partition doors, and lighting. RECOMMENDED ACTION: City Council: 1. Approve the plans and specifications for the City Hall Restrooms Remodel, Phase I, Project M1037. 2. Award the construction contract to G2K Construction, Inc., in the amount of $207,000 and authorize a contingency in the amount of $20,700, for a total contract amount not to exceed $227,700. 3. Appropriate one-time funds in the amount of $130,000 from the General Fund - Capital Projects Fund (Fund 601) to expenditure account M1037601-516101. 4. Authorize the City manager or designee to execute all documents, subject to City Attorney approval. 11. APPROVE THE PURCHASE OF A SPECIALIZED DUMP TRUCK - Approve the purchase of a 2023 Freightliner M2 112 CNG dump truck, using Sourcewell contract 052417-PBL. RECOMMENDED ACTION: City Council: 1. Approve the "piggyback" purchase of a 2023 Freightliner M2 112 CNG dump truck, using Sourcewell cooperative purchasing contract #052417-PBL in an amount not to exceed $221,959. 2. Appropriate one-time funds in the amount of $21,959 from the Gas Tax Fund (Fund 230) to expenditure account 2304504-520103. 3. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval. NEW BUSINESS 12. BALLOT INITIATIVE: PROVIDES THAT LOCAL LAND -USE AND ZONING LAWS OVERRIDE CONFLICTING STATE LAWS - This ballot initiative is a constitutional amendment to allow for city and county land -use and zoning laws to supersede all conflicting state laws, except in circumstances related to the California Coastal Act of 1976, siting of power plants, or development of water, communication, or transportation projects. Page 5 RECOMMENDED ACTION: City Council discuss and consider adopting a position on the proposed ballot initiative. PUBLIC PARTICIPATION This time has been set aside for any speakers that have turned in speaker cards and were not heard in the first thirty minutes allotted to address the City Council on items that are NOT on the agenda. Mary Cusick City Clerk Santa Clarita, California Page 6 PROCLAMATION Black History Month February 2022 WHEREAS, Black History Month allows for a special opportunity to celebrate the history of African Americans, and to honor the many African Americans who have contributed to the progress of our nation; and WHEREAS, such recognition and knowledge can strengthen the insight of our community regarding the numerous accomplishments and contributions made by African Americans; and WHEREAS, many African Americans have made important contributions to our society, including Martin Luther King, Jr., one of the nation's greatest civil rights activists; Rosa Parks, whose famous decision to remain in her bus seat symbolized the spirit and defining moment of the Civil Rights Movement; Jackie Robinson and Earl Lloyd, the first African Americans to integrate Major League Baseball and the National Basketball Association, respectively; and Thurgood Marshall, the first African American United States Supreme Court Justice; and WHEREAS, it is important to recognize the courage and strength demonstrated by each of these leaders, along with many other African Americans by celebrating their success and national achievement. NOW, THEREFORE, the City of Santa Clarita does herby proclaim February 2022, as Black History Month. Signed this 8th day of February, 2022.
