CITY OF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR CITY MANAGER APPROVAL: DATE: May 10, 2022 SUBJECT: AUTHORIZATION OF THE DESIGN -BUILD PRODUCT DELIVERY METHOD FOR THE TRANSIT MAINTENANCE FACILITY HYDROGEN FUELING STATION DEPARTMENT: Neighborhood Services PRESENTER: Adrian Aguilar RECOMMENDED ACTION City Council authorize the design -build product delivery method for the Transit Maintenance Facility Hydrogen Bus Refueling Station. BACKGROUND In December 2018, the California Air Resources Board adopted the Innovative Clean Transit (ICT) regulation. The ICT regulation requires all public transit agencies to gradually transition to 100 percent zero -emission bus fleets. Beginning in 2029, all new bus purchases made by transit agencies must be zero -emission buses. The goal of the ICT regulation is that all transit operators, including the City of Santa Clarita (City), make the full transition to zero -emission fleets by 2040. The ICT regulation applies to all transit agencies that own, operate, or lease buses with a gross vehicle weight rating greater than 14,000 lbs. It includes standard, articulated, over -the - road, double-decker, and cutaway buses. To prepare for this transition, staff analyzed various options and determined that hydrogen fuel cell buses were the best option currently available that meet the needs of the City. This determination was based on range, need for additional infrastructure, and long-term operating costs. In December 2021, the City obtained the services of Zen and the Art of Clean Energy (Zen), a consulting firm, to help the City in the analysis, determination of method, specification development, and project management of hydrogen fueling infrastructure at the Transit Maintenance Facility. A Request for Proposals (RFP) for station design and construction is in development, and expected to be released this summer. After much research, a design -build Page 1 Packet Pg. 25 O procurement approach for the Hydrogen Bus Fueling Station, a common practice for the creation of fueling infrastructure, is recommended. The design -build project delivery method combines architectural and engineering design services with construction performance under one contract. Under their current contract with the City, Zen will act as a bridging architect/consultant/construction manager. In this role, Zen will develop the bridging documents, consisting of concept drawings and performance criteria, to a specific point, usually schematic level, prior to engaging the design -build contractor, who will then finish the design and construct the project. Advantages to this approach include the following: • Collaboration between architect and general contractor throughout design and construction that increases cost efficiencies and reduces likelihood of change orders during the project. Reduction of escalation costs by locking in the total contract price 6 to 12 months earlier than the traditional design -bid -build process. Single point of accountability for design and construction. Use of the design -build procurement approach will also allow the City to choose a competitively superior design -build contractor based on a best value evaluation approach, rather than being constrained by choosing the contractor that submits the lowest price. This can result in a much greater value to the City for a comparable price. As part of the selection of the design -build contractor, a fixed price is established to complete the design and construction of the facility. Once underway, the design -build contractor is then responsible for completing the design and construction of the project, and for all coordination between the design and construction phases. The following process has been identified for the project procurement approach: 1. Receive authorization from City Council to use the design -build method of procurement (required by Public Contract Code section 22162). 2. Issue a Request for Statement of Qualifications to interested design -build teams required by Public Contract Code sections 22160, et seq., to generate a "shortlist" of qualified responders to the design -build RFP. 3. Issue an RFP to prequalified design -build teams based on the performance criteria and concept drawings prepared by Zen. 4. Award the design -build contract. It is anticipated that the design -build team would be selected and the award of the contract brought to City Council for consideration in October 2022.
