CITY OF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR CITY MANAGER APPROVAL: �1 A11�44_1) DATE: May 10, 2022 SUBJECT: THE CUBE - ICE AND ENTERTAINMENT CENTER UPGRADES (THE GRILLE EXPANSION), PROJECT F 1025 - APPROVE PLANS AND SPECIFICATIONS AND AWARD CONSTRUCTION CONTRACT DEPARTMENT: Public Works PRESENTER: Cruz Caldera RECOMMENDED ACTION City Council: 1. Approve plans and specifications for The Cube — Ice and Entertainment Center Upgrades (The Grille Expansion), Project F1025. 2. Award construction contract to E.L. Engineering Corporation for the Grille expansion at The Cube — Ice and Entertainment Center in the amount of $352,543 and authorize a contingency in the amount of $22,591 for a total contract amount not to exceed $375,134. 3. Appropriate one-time funds in the amount of $150,000 from the American Rescue Plan Act Fund (Fund 228) to expenditure account F1025228-516101. 4. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval. BACKGROUND The Grille, located at the The Cube - Ice and Entertainment Center, Powered by FivePoint Valencia (The Cube) currently services thousands of patrons for various events and programs offered at the facility seven days a week. The Grille opened to the public in January 2022 and has since expanded to feature Maria's Italian Deli menu items and catering services. The proposed project will provide for the expansion of the kitchen area to include a beverage center, which will accommodate larger groups of patrons and provide new opportunities for additional types of special events. The upgrades will include a countertop area with seating, new fixtures, Page 1 Packet Pg. 57 lighting, flooring, and plumbing. Since its opening, The Cube has transformed into a multipurpose entertainment venue and continues to provide a boost to the local economy through tourism dollars, film revenue, and local sponsorships. The Cube offers in-house programs that cater to a variety of ice sports, and provides a space for birthday parties, meetings, special events, and more. Thousands of patrons have visited The Cube to either participate in or watch a wide variety of offerings, such as California Amateur Hockey Association tournaments, UCLA Men's Ice Hockey team games, high school and club hockey games, figure skating shows, and more. The expanded kitchen area will ensure an optimal guest experience and further enhance the facility's ability to attract large- scale non -ice events. This project exemplifies the City of Santa Clarita's (City) commitment to improving the quality of life of its residents and supports the Santa Clarita 2025 Enhancing Economic Vitality theme action item: Complete the rehabilitation and rebranding of the ice rink to generate tourism and large special events. On March 2, 2022, an invitation to bid was prepared and posted on BidNet. The bid was downloaded by 12 companies and one bid was submitted and opened by Purchasing on March 17, 2022. The bid was deemed non -responsive. In the event the City does not receive a responsive bid for a Public Works project, the Public Contract Code, Section 22038(c) authorizes a public agency to negotiate the award of a contract. Section 22038(c) specifically states: "If no bids are received through the formal or informal procedure, the project may be performed by the employees of the public agency by force account, or negotiated contract without further complying with this article." As a result, staff requested informal bids from the following contractors: Company Location Bid Amount E.L. Engineering Corporation La Verne, CA $352,543 Waisman Construction Inc. Canoga Park, CA $537,000 Staff recommends awarding the contract to E.L. Engineering Corporation, the lowest responsive bidder. E.L. Engineering Corporation possesses a valid Class A State Contractor's License and is in good standing with the Contractors State License Board. Their bid has been reviewed for accuracy and conformance to the contract documents and was found to be complete. Staff conducted a job walk at The Cube, where E.L. Engineering Corporation demonstrated an in-depth understanding of the project needs and provided a detailed scope of work and approach to the project. They examined and identified key construction factors that will need to be addressed based on the design specifications. Based on their experience with similar projects and the thoroughness of their proposal, staff recommends awarding the contract to E.L. Engineering Corporation. Page 2 Packet Pg. 58 Due to the volatile bidding environment and high construction activity throughout Southern California, the City continues to receive fewer bids on projects at ahigher cost. The project budget of $250,000 is insufficient to complete the construction of this project. The appropriation request of $150,000 will cover the remaining contract cost, administrative costs, and staff time. The requested contingency will cover any unforeseen issues or additional needs that may occur during the construction process. The remaining funds in the budget will cover staff oversight, plan checks, building permits, related labor compliance, and administrative costs. ALTERNATIVE ACTION Other action as determined by the City Council. FISCAL IMPACT Upon approval of the recommended actions, adequate funds will be available in project expenditure account F1025228-516101 (American Rescue Plan Act Fund) to support the recommended contract and all anticipated project costs.
