CITY OF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR CITY MANAGER APPROVAL: 1 DATE: June 14, 2022 SUBJECT: SUMMARY VACATION OF EASEMENTS FOR STORM DRAIN, STORM DRAIN INGRESS AND EGRESS AND SANITARY SEWER, AND AN OFFER OF DEDICATION FOR PRIVATE AND FUTURE STREET PURPOSES, BEAZLEY DRIVE (BRIDGE TO HOME) DEPARTMENT: Public Works PRESENTER: Amalia Marreh RECOMMENDED ACTION City Council: 1. Adopt a resolution for the summary vacation of easements for storm drain, storm drain ingress and egress and sanitary sewer, and an offer of dedication for private and future street purposes. 2. Direct the City Clerk to record the certified original resolution in the Los Angeles County Registrar -Recorder's office. BACKGROUND The easements and offer of dedication to be vacated by this action were originally dedicated to the County of Los Angeles by Tract No. 40079, which recorded on June 2, 1982. The 84-foot- wide dedication is located within the Bridge to Home property located at 23031 Drayton Street, as shown on the attached Location Map. Bridge to Home has requested that the City of Santa Clarita (City) vacate its interest in these easements and offers. The easements and offer of dedication on Tract No. 40079 were for storm drain, storm drain ingress and egress and sanitary sewer, and an offer of dedication for private and future street purposes. Based on the criteria outlined below, City staff has determined that the easements and offer of dedication are not needed for future public utilities or public road purposes. In compliance with Section 8340 of the Streets and Highways Code, City staff coordinated with public utilities and determined that there are no public utility facilities in place that would be affected by this vacation and no reservation of easement is necessary for prospective public use. Page 1 Packet Pg. 205 Per Part 3, Section 8333 of the California Streets and Highways Code, the legislative body of a local agency may summarily vacate an easement if any of the following conditions exists: (a) The easement has not been used for the purpose for which it was dedicated or acquired for five consecutive years immediately preceding the proposed vacation. (b) The date of dedication or acquisition is less than Five years, and more than one year, immediately preceding the proposed vacation, and the easement was not used continuously since that date. (c) The easement has been superseded by relocation, or determined to be excess by the easement holder, and there are no other public facilities located within the easement. City staff has determined that the easements have not been used for the purpose for which it was dedicated or acquired for and there are no other public facilities located within the easement. Therefore, staff is recommending the easements be summarily vacated by adopting the resolution. Per Part 3, Section 8331 of the Streets and Highways Code, the legislative body of a local agency may summarily vacate a street or highway if both of the following conditions exist: (a) For a period of five consecutive years, the street or highway has been impassable for vehicular travel; and (b) No public money was expended for maintenance on the street or highway during such period. City staff has determined that both of these conditions exist, therefore, staff is recommending the easements and offer of dedication be summarily vacated by adopting the resolution for the summary vacation of easements for storm drain, storm drain ingress and egress and sanitary sewer, and an offer of dedication for private and future street purposes, as described in Exhibit "A" Legal Description and as shown on Exhibit `B" Exhibit Map of the attached resolution. ALTERNATIVE ACTION Other action as determined by the City Council. FISCAL IMPACT There is no fiscal impact associated with this action. ATTACHMENTS Resolution and Exhibits Location Map Page 2 Packet Pg. 206 15.a RESOLUTION NO. 22- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, SUMMARILY VACATING EASEMENTS FOR STORM DRAIN, STORM DRAIN INGRESS AND EGRESS AND SANITARY SEWER, AND AN OFFER OF DEDICATION FOR PRIVATE AND FUTURE STREET PURPOSES CREATED ON TRACT NO. 40079, FILED IN BOOK 1006, PAGE 1 THROUGH 5, INCLUSIVE, OF MAPS WHEREAS, the easements being summarily vacated fully meet the requirements of Section 8333 of the Streets and Highways Code, which states the legislative body of a local agency may summarily vacate a public service easement if it has not been used for the purpose for which it was dedicated or acquired for, and there are no other public facilities located within the easement; and WHEREAS, the offer of dedication being summarily vacated fully meets the requirements of Section 8331 of the Streets and Highways Code, which states "The legislative body of a local agency may summarily vacate a street or highway if both of the following conditions exist: (a) For a period of five consecutive years, the street or highway has been impassable for vehicular travel. (b) No public money was expended for maintenance on the street or highway during such period"; and WHEREAS, under Chapter 4, Summary Vacation of Part 3 of Division 9 of the California Streets and Highways Code, no public hearing is required and no public hearing was held. NOW, THEREFORE, pursuant to the provisions of the California Streets and Highways Code, the City Council of the City of Santa Clarita, California, does hereby resolve as follows SECTION 1. That it is hereby found and determined that the easements for storm drain, storm drain ingress and egress and sanitary sewer purposes, as described in Exhibit "A" legal description, and as shown on Exhibit "B" exhibit map, attached hereto and incorporated herein by this reference for real property located in the City of Santa Clarita, County of Los Angeles, State of California, fully meets the requirements of Section 8333 of the Streets and Highways Code, which states "The legislative body of a local agency may summarily vacate an easement if any of the following conditions exists: (a) The easement has not been used for the purpose for which it was dedicated or acquired for five consecutive years immediately preceding the proposed vacation. (b) The date of dedication or acquisition is less than five years, and more than one year, immediately preceding the proposed vacation, and the easement was not used continuously since that date. That it is hereby found and determined that an offer of dedication for private and future street purposes, as described in Exhibit "A" legal description, and as shown on Exhibit "B" exhibit map, attached hereto and incorporated herein by this reference, which real property located in the City of Santa Clarita, County of Los Angeles, State of California, fully meets the requirements of Section 8331 of the Streets and Highways Code, which states "The legislative body of a local agency may summarily vacate a street or highway if both of the following conditions exist: (a) For a period of five consecutive years, the street or highway has been impassable for vehicular travel. (b) No public money was expended for maintenance on the street or highway during such period." and such offer of dedication is therefore vacated. SECTION 3. That within the private and future street dedication to be vacated, there are no public utility facilities that would be affected. SECTION 4. That the City Clerk of the City of Santa Clarita is instructed to record the certified original resolution in the office of the Registrar -Recorder of the County of Los Angeles, at which time the easements summarily vacated will no longer be public service easements.
