Approve and authorize the City Manager or designee to execute an entry agreement for use as a temporary construction area on property owned by the City of Santa Clarita, Assessor's Parcel Numbers 2836-002-907 and 2836-002-922. 2. Approve and authorize the City Manager or designee to execute a 15-foot wide perpetual easement on property owned by the City of Santa Clarita, Assessor's Parcel Number 2836- 002-922. 3. Approve and authorize the City Manager or designee to execute a bill of sale to transfer ownership of approximately 650 feet of an existing City -owned sewer located on Assessor's Parcel Numbers 2836-002-922, 2836-002-046, 2836-001-034 and 2836-001-035 to the Santa Clarita Valley Sanitation District. 4. Approve and authorize the City Manager or designee to execute a 10-foot wide perpetual easement located on property owned by the City of Santa Clarita, Assessor's Parcel Number 2836-002-922. 5. Approve and authorize the City Manager or designee to execute quitclaims of the City's 10- foot wide easement located on property owned by the City of Santa Clarita, Assessor's Parcel Numbers 2836-001-034, 2836-001-035, and 2836-002-046. BACKGROUND The Santa Clarita Valley Sanitation District of Los Angeles County (District) is proposing to construct the Soledad Canyon Trunk Sewer Section 4 Project (Project). The purpose of the proposed Project is to construct approximately 2,200 feet of sewer below ground to accommodate current flows and future growth in the City of Santa Clarita (City). Construction of the Project would terminate on Hidaway Avenue at the intersection of Soledad Canyon Road, as shown on the attached map. The sewer alignment would connect to existing City sewers. To comply with the California Environmental Quality Act, a Mitigated Negative Declaration was previously approved for the Project by the District's Board on September 20, 2021. As part of the Project, a new sewer is to be constructed on City -owned property, Assessor's Parcel Number (APN) 2836-002-907 and APN 2836-002-922. An entry agreement is required, allowing the District to access to City property during construction. Also, an easement is necessary to ensure the District has perpetual rights to access, operate, and maintain the segment of new sewer on City property. The easement on APN 2836-002-922 would include the construction of two maintenance holes, allowing the District access to the future sewer. In conjunction with Project, the District requests taking over ownership, operation, and maintenance of approximately 650 feet of existing sewer owned by the City, located on APNs 2836-002-922, 2836-002-046, 2836-001-034, and 2836-001-035. A bill of sale will transfer ownership of the existing 650-foot segment from the City to the District. A 10-foot wide easement is also needed for the District to access, operate, and maintain the segment of existing sewer that is located on City property. This is an easement area of approximately 1,816 square feet. Additionally, the District requests the City quitclaim its existing sewer easements pertaining to the 650-foot segment of sewer. The quitclaims are needed for the District to access, operate, and maintain the portion of existing sewer it will be taking ownership of through the bill of sale. One quitclaim would transfer the City's existing 10-foot wide sewer easement located on APN 2836-001-034 and APN 2836-001-035. A second quitclaim would transfer the City's existing 10-foot wide sewer easement located on APN 2836-002-046. After construction of the new sewer is complete, sewage will be routed into the newly constructed sewer, and the existing sewer will be converted to an airline. Construction is anticipated to begin in September 2022, and should take approximately five months. ALTERNATIVE ACTION Other action as determined by the City Council. If approved, the City will receive $9,000 from the Sanitation District to be placed in Developer Fee revenue account number 306-457501. Grantor hereby represents, warrants and covenants to the District that the Improvements are free and clear of and from all liens, claims, and encumbrances and that Grantor has the right to grant and sell them, and Grantor, its successors and assigns, will warrant and defend the grant and sale of the Improvements against all lawful liens, claims, and encumbrances of all persons claiming under or through them. The District acknowledges and agrees that, except as expressly provided in this Bill of Sale (a) the Improvements are granted and transferred to the District in their "AS -IS AND WHERE - IS CONDITION" and "WITH ALL FAULTS" and (b) Grantor makes no representations or warranties of any kind or nature respecting the condition, physical or otherwise, of the Improvements or their suitability for use by the District.
