Nisich/ � U SUBJECT: COUNTY LIGHTING MAINTENANCE DISTRICT CONSENT AND JURISDICTION ANNEXATION OF TRACT NO. 37802 Resolution No. 94.43 DEPARTMENT: Community Development BACKGROUND This item is for the Council to consider granting consent and jurisdiction to the County Lighting Maintenance District to annex territory located in the City to the District.. The proposed district is Tract No. 37802 at Sand Canyon Road and Mandalay Road. (See attached Resolution with map.) As development occurs throughout the City, the installation of street lights is required. The developer is required to pay the cost of installing the lights and the cost of energy and maintenance until the area is annexed Into a lighting maintenance district. The County's Lighting Maintenance District was established to provide for the cost of this maintenance. The lights, once installed, are owned by the Southern California Edison Company. Each year they charge the District for the cost of energy and maintenance. The District then assesses their costs against the property owners within the District. There is no fiscal impact to the City In granting consent. RECOMMENDATION The City Council adopt the Resolution granting consent and jurisdiction to the County of Los Angeles in the matter of Project No. 73-37. Santa Clarita; and WHEREAS, all of the land included in the proposed annexation lies within the boundary of the City of Santa Clarita, NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Santa Clarita, as follows: SECTION I That the public interest, convenience, and necessity, require the maintenance of a street lighting system located within said territory as shown on the maps of the annexation of County Lighting Maintenance District1867 and the City of Santa Clarita Landscaping and Lighting Act District on file in the office of the Department of Public Works. SECTION III That this City Council hereby finds and determines that the land included within the boundary of the proposed annexation lying within the boundary `of the City of Santa Clarita, will be benefitted by the said proposed annexation, and hereby consents to r/ 1 the inclusion of said land within the proposed annexation and to the assessment thereof. SECTION IV That the consent of this City is hereby given to the commencement of the proceedings for said annexation to County Lighting Maintenance District 1867 and the City of Santa Clarita Landscaping and Lighting Act District by the Board of Supervisors of the County of Los Angeles, and to the exercise of exclusive jurisdiction of said Board of Supervisors over all proceedings necessary thereto for the purpose of consummating the same, all in accordance with the provisions of Divisions 7 and 15 of the Streets and Highways Code. SECTION V That the Clerk of the City Council is hereby directed to certify and deliver two copies of this Resolution to the Department C� of Public Works of the County of Los Angeles.
