SUBJECT: Issuing the Notice of Completion for the
Soledad Median Improvement - Phase II

BACKGROUND

The construction of the Soledad Median Improvement per plans and specifications provided by
Willdan Associates has been completed to the satisfaction of the Director of Parks, Recreation,
and Community Services. The contractor who completed the work is Marina Contractors, Inc.
The project construction was completed on May 14, 1992, at which time Marina filed several
claims against the City.
As of May 4, 1994, the City Attorney had received a settlement agreement signed by Marina
Contractors, Inc. A settlement check in the amount of $98,000 was sent to Marina. In addition,
Brian Pierik of Burke, Williams & Sorensen, representing the City in the lawsuit filed by Marina,
has received dismissal of all claims filed by Marina Contractors, Inc.
The total original contract amount for this project was $387,654. The total expense, including the
settlement agreement, for this project is $418,258.
RECOMMENDATION
The City Council accept the work performed by Marina Contractors, Inc. and direct the City Clerk
to file the Notice of Completion for this project.

NOTICE OF COMPLETION OF
PUBLIC IMPROVEMENT AND WORK
SOLEDAD MEDIAN IMPROVEMENT - PHASE II
NOTICE IS HEREBY GIVEN that the City of Santa Clarita, Los Angeles County, California,
has caused a public improvement, to wit:
PROJECT ACCOUNT NOS. 25-99005-227 and 25-99013-227
to be constructed upon the property hereinafter described. The contract for furnishing of all labor,
services, materials, and equipment, and all utilities and transportation, including power, fuel and
water, and performing all work necessary to construct and complete, in a good and workmanlike
manner, in strict accordance with the specifications, plans, and drawings therefore on file in the
office of the City Clerk of the City of Santa Clarita, for the construction, installation, and
completion of the above described public improvement and work, was heretofore made and
entered into by Marina Contractors, Inc. on the 9th day of August, 1991, and filed for record in
the office of the City Clerk of the City of Santa Clarita; that the work upon said public
improvement was actually completed on the 14th day of May, 1992, and that the Director of
Parks, Recreation, and Community Services has notified the City Council that he has made and
completed a firfal inspection of the materials furnished and installed and the work performed in
the construction, installation, and completion of said public improvement hereinabove more
particularly described and set forth, and has certified in writing to the City Council that all of the
provisions of the contract and contract documents for the furnishing of all labor, services,
materials, and equipment, and the performing of all work necessary for the construction,
installation, and completion of said public improvement above described have been complied with

to his satisfaction as required by the contract documents; that final acceptance of the
construction, installation, and completion of said public improvement above described was made
on the 4th day of May, 1994.
