(See attached map.) The proposed annexation area consists of 47.36 acres of uninhabited land, 27.13 acres (including "Beale's Cut,' an identified State Historical Landmark) of which are conditioned to be dedicated to the City of Santa Clarita in conjunction with the Valley Gateway Project (Master Case No. 92-012) approval. Proposed Resolution No. 94-86 "Making Findings On Written Protest and Approving and Ordering Annexation No. 1992-02 to the City of Santa Clarita" represents the final action to be taken by the City Council to complete the annexation. If the hearing results in insufficient written protest, the Resolution will be forwarded to the LAFCO for review and certification, and the annexation will be recorded within 15-30 days. On June 15, 1993, the Planning Commission adopted Resolution No. P93-18, approving TTM 51044, CUP No. 92-001 and OTP No. 92-002; certifying Final EIR SC 92041041; and recommending approval of Prezone 92-001 to the Council. On September 14, 1993, the Council adopted Ordinance No. 93-14, amending the Official City Zoning Map for the portion of the Valley Gateway Project site located within the unincorporated area of Los Angeles County. Annexation No. 1992-02 was submitted to the LAFCO for processing on September 15, 1993. On June 22, 1994, the LAFCO approved the annexation and directed the Council to proceed with a duly noticed public hearing. The Resolution states the LAFCO's direction to the Council to proceed with a duly noticed public hearing, and sets forth the reasons for the annexation; terms and conditions established for the annexation by the LAFCO; and a map and legal description of the proposed annexation area. Adopted: ' Age: _ i Item: Annexation No. 1992-02 is defined as "uninhabited," and therefore, pursuant to State law, only property owners may protest. The Council must approve the annexation if protests are filed by less than 50% of the property owners owning property worth less than 50% of the total assessed value of the proposed annexation area; however, the Council must deny the annexation if the same percentage is greater than 50%. Mayor announces decision CITY OF SANTA CLARITA NOTICE OF PUBLIC HEARING TO CONSIDER ANNEXATION TO THE CITY OF SANTA CLARITA OF THAT UNINHABITED TERRITORY IDENTIFIED AS ANNEXATION NO. 1992-02, GENERALLY LOCATED SOUTH OF THE EXISTING CITY BOUNDARIES, BETWEEN THE ANTELOPE VALLEY FREEWAY (SR 14) AND SIERRA HIGHWAY, NORTH OF INTERSTATE 5 AND SOUTH OF SAN FERNANDO ROAD NOTICE IS HEREBY GIVEN: Pursuant to Section 57025 of the Government Code, the City Council of the City of Santa Clarita will hold a public hearing to consider annexation to the City of Santa Clarita of that uninhabited territory identified as Annexation No. 1992-02. The purpose of the hearing will be to receive and consider written protest from owners of land within the proposed annexation area. The hearing will be held by the City Council in the City Hall Chambers, located at 23920 Valencia Boulevard, First Floor, Santa Clarita, California, on July 12, 1994, at or after 6: 30 p.m. 1. Proceedings for the referenced proposal were initiated by the City of Santa Clarita, on behalf of the Valley Gateway Company, and submitted to the Local Agency Formation Commission for Los Angeles County on September 15, 1993. 2. The uninhabited territory consists of 47.36 acres, is comprised of two ownerships, and is generally located south of the existing City boundaries, between the Antelope Valley Freeway (SR 14) and Sierra Highway, north of Interstate 5 and south of San Fernando Road. 3. The proposal shall be subject to all terms and conditions as specified and imposed on June 22, 1994, by the Local Agency Formation Commission for Los Angeles County and reference is hereby made to said resolution.for a full and complete description of the annexation and the terms and conditions. 4. The short -form designation of the proposal is Annexation No. 1992-02. 5. The reason for the proposed annexation is to promote sound planning and land use in the area, and to annex property within the City's Sphere of Influence as amended by the Local Agency Formation Commission on June 22, 1994. 6. Any owner of land within the territory who wishes to file a written protest against annexation No. 1992-02 must do so by written communication filed with the City Clerk, which must be filed at any time prior to the conclusion of this hearing at the hour specified in this notice for commencement of the hearing. Each written protest must state whether it is made by a landowner in the area and must indicate the name and address of the owner of land affected and the street address or other description sufficient to identify the location of the land. The proposal may be reviewed by the public at the city of Santa Clarita Department of Community Development prior to the public hearing of July 12, 1994. Grindey City Clerk City of Santa Clarita Publish Date: June 28, 1994 RESOLUTION NO. 94.86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, MAKING FINDINGS THAT INSUFFICIENT WRITTEN PROTESTS HAVE BEEN FILED AND APPROVING AND ORDERING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED AS "ANNEXATION NO. 1992.02" TO THE CITY OF SANTA CLARITA WHEREAS, on June 22, 1994, the Local Agency Formation Commission of the County of Los Angeles adopted a resolution making determinations and approving the proposed annexation to the City of Santa Clarita of territory described in Exhibit A and mapped in Exhibit B attached hereto and by this reference incorporated; and WHEREAS, the Local Agency Formation Commission of the County of Los Angeles has directed the City of Santa Clarita to proceed with the annexation following a duly noticed public hearing; and WHEREAS, the City Clerk set Tuesday, July 12, 1994, at 6:30 p.m. in the Council Chambers of the City Hall, 23920 Valencia Blvd., 1st Floor, Santa Clarita, California, as the date, time and place for said hearing on the proposed annexation and the property owners in the said territory were duly informed of their right to file a written protest against the annexation with the City Clerk at any time prior to the conclusion of the hearing on the proposed annexation; and WHEREAS, the public hearing was duly and regularly conducted by and before the City Council at its meeting of July 12, 1994; and WHEREAS, the Local Agency Formation Commission approved this proposed annexation subject to the following conditions: 1) The subject territory would also be annexed to the Consolidated Fire Protection District; and 2) The subject territory would be withdrawn from County Road District No. 5; and WHEREAS, the purpose of this annexation is to promote sound planning and land use practices in the affected territory; and WHEREAS, the regular County assessment roll is utilized by this City; and WHEREAS, the affected territory will not be taxed for existing bonded indebtedness of this City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Clarita, California, as follows: SECTION 1. The City Council hereby declares said territory to be uninhabited and a RESOLUTION NO. 94-86 Page 2 legal desciption of the boundaries of the annexation is set forth in Exhibit A and a map of the boundaries is set forth in Exhibit B, attached hereto and made a part hereof. SECTION 2. In accordance with Section 57075 of the Government Code, it is hereby found that written protests, if any, have been filed and not withdrawn by less than 25% of the residents within the territory or by owners of property valued at less than 25% of the total assessed value of land within the territory.. SECTION 3. The City Council hereby orders the territory described in Exhibits A and B annexed and directs the City Clerk to transmit one (1) original and seven (7) certified copies of this resolution with fees as required by Section 54902.5 of the Government Code to the Executive Officer of the Local Agency Formation Commission of Los Angeles County. SECTION 4. The City Clerk shall cerify to the adoption of this resolution and certify this record to be a full, true, correct copy of the action taken.
