Harris r DATE: August 23, 1994 �I, SUBJECT: COUNTY MONITORING - THE VALENCIA MARKETPLACE PROJECT (PROJECT NO. 92-075) STATUS REPORT DEPARTMENT: Community Development BACKGROUND City staff reviewed and commented on the project and Draft Environmental Impact Report (EIR) in response to the October 15, 1993, Notice of Completion. The Regional Planning Commission (RPC) held their first public hearing to consider the project on December 15, 1993, at which time Councilmember Heidt gave testimony regarding the City's position. The RPC continued the public hearing for a field trip to the project site (on January 31, 1994) to February 2, 1994, for further discussion. On March 30, 1994, the RPC: • Approved entitlements for the tract map, conditional use permit, and oak tree permit. • Recommended approval of a general plan amendment and zone change to the Board of Supervisors. • Recommend certification of the EIR and approval of the project. On April 6, 1994, the City filed an appeal of the RPC action to the Board of Supervisors. On May 5, 1994, the Board of Supervisors held a public hearing to consider the RPC recommendation and the concerns of all appellants. The public hearing was continued to July 7, 1994, at which time Councilmember Heidt and Deputy City Manager Harris gave testimony supporting denial of the project as proposed. The Board took action to certify the EIR, and directed staff to prepare final project conditions and return in September 1994 for final approval. CITY COUNCIL REQUEST FOR INFORMATION At the meeting of July 12, 1994, the City Council authorized the City Attorney and City staff to analyze the Valencia Marketplace project and DEIR for compliance with the County's DMS, and to be supplied with any market analysis information that could be made readily available. (� �n J-L000� iZG6� Item The analyses requested by City Council are underway. These analyses cannot be completed until County staff releases the conditions of approval for the Marketplace Project. Staff expects this to happen in late August. The analyses will be completed and transmitted to City Council at that time. The City Attorney has advised that any applicable time deadlines for further response on the project do not begin until the County Board of Supervisors takes final action on conditions of approval. RECOMMENDATION Receive staff presentation and review the new information prepared by staff and provide staff further direction. ad0.,htp125my
