Award a design contract to Encompass Consultant Group, Inc., for the Magic Mountain Parkway Beautification, Project B1019, in the amount of $625,979 and authorize a contingency in the amount of $62,597, for a total contract amount not to exceed $688,576. 2. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval. BACKGROUND The proposed Magic Mountain Parkway Beautification project will provide full street improvements on the undeveloped segment of Magic Mountain Parkway from Tourney Road to Avignon Drive. The design of this project will generate two separate phases of construction documents. Phase I is proposed to include the landscaped median along the length of the project, edge curb and gutter, and overlay of the six -lane roadway. Phase II will include sidewalks, parkway landscape and irrigation, a Class 1 Bike Lane, lodge pole fencing, signal installation at Iron Horse, and street lighting. This project exemplifies the City of Santa Clarita's (City) commitment to improving the quality of life of its residents and supports the Community Beautification and Sustainability theme of the Santa Clarita 2025 plan. The scope of work for this design contract includes the required civil and traffic engineering along with the landscape design services required to prepare two phases of construction documents for this segment of roadway. These documents will consist of complete plans, specifications, and engineer's estimates for both phases of construction. Bid assistance will also be provided to support the solicitation for a construction contract. Page 1 Packet Pg. 90 A Request for Proposal (RFP) for the design of the project was prepared and posted on BidNet on November 2, 2022. The RFP asked firms to identify their relevant experience with similar projects and demonstrate their design approach for this project. On December 6, 2022, three firms submitted proposals. Staff reviewed the proposals and, based on their evaluations, scored the firms on a 100-point scale as follows: Rank Company Location Score 1. Encompass Consultant Group, Inc. Santa Clarita, CA 94 2. Los Angeles, CA 81 The scoring system was based on the following criteria: responsiveness to the RFP, qualifications and design experience, proposed methodology, ability to meet the scope of work, project approach, and references. Additionally, the consulting firms were asked to provide a detailed schedule and scope of work required for them to prepare the plans, specifications, and an engineer's estimate. Encompass Consultant Group, Inc., (Encompass) demonstrated an in-depth understanding of the project needs and provided a detailed scope of work and approach to the project. Encompass analyzed the project location and identified key design factors that will need to be addressed in the design. Based on their design experience with similar projects, and the completeness of their proposal for this project, staff recommends awarding the design contract to Encompass. The requested contingency will cover the costs of unforeseen design constraints and account for potential design modifications requested by the City, and other permitting agencies, during the design of the project. This includes potential adjustments to the civil and traffic drawings, change order requests made by the design firm, and change orders for additional work requested by the City. California Government Code 4526 prescribes selection of architectural and engineering services to be based on demonstrated competence and professional qualifications necessary for the satisfactory performance of the services required and does not authorize the selection of professional architect and engineering services based on cost. City staff was able to reach an agreement with Encompass Consultant Group, Inc. at a fair and reasonable price. ALTERNATIVE ACTION Other action as determined by the City Council. FISCAL IMPACT Adequate funds are available in expenditure account B1019357-516101 (Landscape Maintenance District Fund) to support the recommended contract and project administrative costs. The improvement of the final stretch of this parkway will provide pedestrians and cyclists safe and accessible passage along this popular corridor. The addition of medians, curb, gutter, sidewalks, lodge pole fencing, lighting and bike trail connections are key enhancements that will improve this lively thoroughfare The following proposal outlines ECG's approach to solve this project's issues in a manner that meets all functional requirements, while being aesthetically pleasing and keeping economic factors in mind. Our plan offers varied options for the Class I Bicycle Path and pedestrian improvements that can be discussed and decided upon with the City's project managers to provide a tailored and flexible approach that meets all of this project's needs. The project consists of 1,900 LF of street improvements in Phase 1 and 700 LF in Phase 2. The planned street improvements include pavement rehabilitation, striping and signage, a bike lane, a widened pedestrian corridor with a landscaped parkway, sidewalks, AC paving and accessible pedestrian curb ramp improvements. Community outreach was performed with resolution of right of way conflicts. This project is in process currently in the 90% Construction Documents phase. This project included typical pedestrian and bicycle improvements to construct curb, gutter, sidewalk, and ADA curb ramps with curb extensions and/or bulb -outs, minor traffic signal modifications (pedestrian push buttons), minor street widening, pavement repair, slurry seal, street tree removal and replacement, bus stop improvements, and existing driveway apron replacements with ADA compliant driveway aprons. The existing striping was removed and replaced with new striping along the entire project corridor to accommodate new bike lanes with painted buffered lane, and some on -street parking. Coordination was performed to monitor existing utilities and their relocation. Community outreach as required and performed along with resolution of right of way conflicts. This project was federally funded and executed accordance with Caltrans Local Assistance Procedures Manual (LAPM), Local Assistance Program Guidelines (LAPG), and the City's federal funding agreements to ensure compliance with all Federal requirements. The following projects were issued under the program and completed by ECG on an on -call basis as contracted by the City of Ventura. This project to repair or reconstruct of portions of Portola Road was part of the 2017-2018 maintenance program and issued as part of an on -call contract. Project area covered Telephone Road to Ralston Street. The repairs included pavement maintenance, pavement evaluations, sidewalk and ADA ramp improvements striping and signage and drainage repairs as related to the curb and gutters. Survey work included conventional topographic measurements combined with ground based lidar (scanning) to provide greater detail and crew safety. TELEGRAPH ROAD IMPROVEMENTS The Telegraph Road improvement project consisted of road repair and reconstruction for approximately 2900 LF of Telephone Road from Main Street to McGrath Street. The repairs included pavement grind and overlay, full depth pavement repair, sidewalk and ADA ramp improvements, drainage repairs, bicycle lanes. striping and signage plans. Survey work included conventional topographic measurements combined with ground based lidar (scanning) to provide greater detail and crew safety. Project was issued under on -call contract. SBm1 JOHNSON DRIVE IMPROVEMENTS As part of an on -call contract, ECG was enlisted to aid in the repair and reconstruct approximately 4300 LF of Johnson Drive from the US-101 Overpass to Bristol Road as part of the California SB®1 Road Repair and Accountability Act. Our team provided topographic mapping and engineering design. The repairs included pavement grind and overlay, full depth pavement repair, sidewalk and ADA ramp improvements, median reconstruction with pedestrian cut-throughs, and drainage repairs. The project also included bicycle lanes, striping and signage plans. Currently Magic Mountain Parkway is built out from Avignon Drive to Railroad Avenue. This project proposes to improve the final approximately 2,500 LF of Magic Mountain Parkway from Avignon Drive to Tourney Road. The project will be divided into two phases. Phase 1 will include the design and construction of a raised landscaped median along the length of the project. Phase 2 will include the design and construction of curb and gutter, sidewalk, parkway with landscape and irrigation, a Class I bike path (from Tourney Road to the Iron Horse Trailhead), lodge pole fencing, signal installation (at the Iron Horse Trailhead) and street lighting. Each phase will consist of a separate full set of plans, specifications and estimates. ECG has prepared a systematic and thoughtful approach to manage this project from start to finish, getting ahead of challenges and preparing solutions to issues upfront. The following table summarizes anticipated key issues and our plan to address them in the most effective and efficient manner to successfully meet this project's requirements. This project proposes to connect to the end of this median and continue the new raised median west to Tourney Road. Openings in the median and turn lanes may need to be provided to maintain adequate access to the existing driveway entrances. ECG will work closely with the City project manager and Traffic Division to determine where openings in the median are necessary and/or desirable. Although the medians are a standalone phase of the project, they will need to designed in their ultimate condition so no rework is needed when Phase 2 is constructed. LID/Green Streets Because a substantial portion of the project corridor is a superelevated curve, there is a portion of the street that will drain toward the median. As a result, we see an opportunity to utilize a portion of the median for stormwater treatment by incorporating BMPs such as rain or rock gardens. ECG will utilize a geotechnical subconsultant (Earth Systems) to perform soil testing in the areas that have potential for stormwater treatment to measure infiltration rates. ECG will work closely with the City to select the appropriate treatment BMP for each location in accordance with the City of Santa Clarita Green Street LID Manual. It is unknown how thick the existing asphalt section is and it will be important to gather this information during Phase 1 in order to estimate the amount of asphalt and base that will need to be removed during the median construction. ECG will utilize a geotechnical subconsultant (Earth Systems) to perform coring at multiple locations within the limits of median construction in order to verify the existing depth of asphalt and base. Signing and Striping and Traffic Control Interim signing and striping will need to be provided for the new median phase of the project. The interim signing and striping will need to match up with the existing striping conditions at both limits of the project corridor. Additionally, the ultimate striping will need to be designed to a 30% level with Phase 1. Traffic control will also be needed for the median phase of this project. ECG and Lin Consulting (traffic engineering subconsultant) have developed a preliminary striping design concept in Exhibit A, attached. However, ECG and Lin Consulting will work closely with the City to review the advantages and disadvantages of the attached design concept to develop a layout that is most desirable for the City. ECG and Lin Consulting have extensive experience with this type of design on similar recent projects in the City of Santa Clarita. Landscape and Irrigation Landscape and irrigation design will be needed for the new raised medians. ECG's Landscape Architect subconsultant, Pacific Coast Land Design (PCLD) will assess the conditions within the existing nearby medians and the areas of the project where new medians are to be constructed. PCLD will layout trees and shrubs with a proposed plant palette that will be based on the current edition of the LIVID Median Design Guidelines and coordination with LIVID and Urban Forestry Staff. The existing maintenance strip paving in this area is a tan colored and stamped slate stone tile patterned concrete. Based on current project experience where an established paving material is present, the new paving will match the existing in color and pattern. The team is well familiar with the many stamped patterns and concrete colors utilized in all medians across the City and will use the standard details and reference specifications to define the new hardscape. Existing irrigation facilities will be assessed to review the potential of extending the existing system to the new medians. Considerations for irrigation controller station capacity, existing sleeving and length of mainline runs will be key in determining the feasibility of system expansion. New facilities will be proposed as needed. PCLD has extensive experience with this type of design on similar recent projects in the City of Santa Clarita. Street Improvements, Class I Bike Path, Traffic Signal and Street Lighting - 30% Design In order to ensure that the Phase 1 medians will be coordinated with the Phase 2 ultimate street improvements a 30% design of the Phase 2 improvements will need to be completed during Phase 1. ECG and Lin Consulting (traffic engineering subconsultant) have analyzed the corridor and constraints and have developed a preliminary design concept in ECG and Lin Consulting will work closely with the City to review the advantages and disadvantages of the attached design concept to develop a layout that is most desirable for the City. Encompass Consultant Group PAGE 20 An Employee -Owned Company ECG City of Santa Clarita Magic Mountain Beautification Project Proposal # CIP-22-23-B1019 PHASE 2 — CURB AND GUTTER, PARKWAY, SIDEWALK, BIKE PATH, FENCING, SIGNAL AND STREET LIGHTING Phase 2 of the Magic Mountain Parkway beautification project will include the design and construction of curb and gutter, sidewalk, parkway with landscape and irrigation, a Class I bike lane (from Tourney Road to the Iron Horse Trailhead), lodge pole fencing, signal installation (at the Iron Horse Trailhead) and street lighting. On the west side of the project limits, at Tourney Road, the curb -to -curb width of the street appears to be roughly 108'. On the east side of the project limits, west of Avignon Drive, the curb -to -curb width appears to be roughly 129'. The City intends to maintain the existing 6 lane configuration through the project corridor. ECG has analyzed the existing constraints such has utility conflicts, right-of-way widths and grading constraints and we have prepared a preliminary design concept in Exhibit A, attached. This exhibit illustrates what we believe is the most advantageous layout for the project corridor. However, ECG and team will work closely with the City to review the advantages and disadvantages of the attached design concept to develop a layout that is most desirable for the City. ECG and team have extensive experience with this type of design on similar recent projects in the City of Santa Clarita. Class I Bike Path The City intends to construct a Class I Bike path along Magic Mountain Parkway between Tourney Road and the Iron Horse Trailhead for safer and more convenient access to the trailhead for bicyclists. One of the biggest design challenges of this project will be the determination of the optimal location for the bike path. Along the north side of the street there is minimal right-of-way, a steep drop-off and a large Caltrans retaining wall and storm drain outlet headwall. Along the south side of the street there are conflicts with utilities, traffic signal poles and cabinets, trees and a bus stop. Because of the nature of these constraints, we believe that the south side of the street will be the better location for the bike path. This will result in much less impact to the Caltrans right-of-way and much smaller retaining walls needed on the north side of the street. ECG and team will review and field investigate all potential conflicts and will provide the City with detailed recommendations including proposed clearances and conflict relocations. As a result, we see an opportunity to utilize the curb adjacent parkway areas for stormwater treatment in accordance with the City of Santa Clarita Green Street LID Manual. These portions of parkway may be good candidates for vegetated swales, rain/rock gardens, tree box filters or other acceptable LID BMPs. ECG will utilize a geotechnical subconsultant (Earth Systems) to perform soil testing in the areas that have potential for stormwater treatment to measure infiltration rates. ECG will work closely with the City to select the appropriate treatment BMP for each location. Retaining Walls Because there is a steep drop-off along the north side of Magic Mountain Parkway between Tourney Road and the Iron Horse Trailhead, a retaining wall will most likely be needed to support any road widening. Additionally, a new guardrail will be needed on top of the retaining wall. By constructing the bike path on the south side of the street (as recommended above) and utilizing a minimal sidewalk width for this stretch along the north side of the street, the height of this retaining wall can be minimized. ECG will utilize a geotechnical subconsultant (Earth Systems) to perform soil testing in the areas that require retaining walls in order to gather structural design recommendations. Our in-house retaining wall design engineer will provide the structural design and calculations for any required retaining walls and guard rails. The wall and footing design will focus on minimizing the impact to the Caltrans right-of-way, existing retaining wall and drainage outlet headwall to the north. ECG will coordinate with Caltrans and/or LACDPW as needed to obtain any permits or approvals. Driveways There are multiple existing properties along the project limits that will need new driveways for maintained access. Along the south side of the street, east of the Iron Horse Trailhead there are two Edison yard entrances, an LA County Flood Control maintenance entrance and a Valencia Country Club maintenance entrance that will require new driveways. Along the north side of the street, east of the Iron Horse Trailhead there is an entrance to a vacant parking lot and what appears to be an Edison maintenance entrance that will most likely require new driveways. ECG will provide detailed driveway design for all new driveways to comply with SPPWC Standard Plan 110-2 and City details and specifications. We will examine each driveway location individually to account for all surface conflicts and work closely with the City staff to design the type of driveway (Type A, B or C) that is most desirable for the City at each location. ECG has extensive experience with this type of design on similar recent City of Santa Clarita projects. Signing and Striping and Traffic Control Detailed signing and striping design will be needed for Phase 2 of the project. The interim striping from Phase 1 will be removed and the ultimate striping concept designed to a 30% level during Phase 1 will be completed. ECG's traffic engineering subconsultant, Lin Consulting will prepare signing and striping plans for the 6 lane corridor including left turn pockets at existing property entrances where desired. Traffic Signal and Interconnect/Fiber Optic Plan As part of Phase 2 of this project, a new signalized intersection will be added at Magic Mountain Parkway and the Iron Horse Trailhead. This signal will provide safer access to and from the Iron Horse Trailhead for bicyclists and pedestrians. Additionally, traffic signal upgrades will most likely be needed at Magic Mountain Parkway and Tourney Road. Traffic signal interconnect/fiber optic plans can be provided as an optional task. During the initial site investigation, the team identified a potential conflict between the SCE high voltage overhead power lines and the new signal poles at the Iron Horse Trailhead. ECG and Lin Consulting will coordinate with SCE and the City to strategically place the new signal poles based on CAMUTCD standard pole placement to ensure that the overhead high voltage wires have adequate clearances. Lin Consulting has extensive experience with this type of design on similar recent projects in the City of Santa Clarita. Landscape and Irrigation Landscape and irrigation design will also be needed for the new parkways designed in Phase 2. The existing parkways in proximity to the project limits contain a mix of tree and shrub planting on the south side of the roadway and trees and turf on the north side. It is assumed that the new parkways will include implementation of green streets and LID best practices for water quality improvements and that the planting will be a key component in these improvements. ECG's Landscape Architect subconsultant, Pacific Coast Land Design (PCLD) will layout trees and shrubs based on the current edition of the LIVID Median Design Guidelines, the City Green Street LID Design Manual and coordination with LIVID and Urban Forestry Staff. Existing irrigation facilities will be assessed to review the potential of extending the existing system to the new parkways. Considerations for irrigation controller station capacity, existing sleeving, length of mainline runs and physical barriers within the parkway areas will be key in determining the feasibility of system expansion. New facilities will be proposed as needed. PCLD has extensive experience with this type of design on similar recent projects in the City of Santa Clarita. Encompass Consultant Group PAGE 23 An Employee -Owned Company 1121CG En —pass F Right-of-way / Easement Coordination City of Santa Clarita Magic Mountain Beautification Project Proposal # CIP-22-23-B1019 Upon initial analysis of the project limits and existing right-of-way widths, it appears that Phase 2 of this project will require some right-of-way acquisition and/or construction easement establishment. ECG will perform detailed right-of-way monument research and reconnaissance to establish accurate existing right-of-way lines. Along the north side of the street, the areas that appear to need new right-of-way or easements are between Tourney Road and the Iron Horse Trailhead. There is also a small segment that may be needed on the north side of the street on the far eastern side of the project limits. However, it may be possible to avoid this small area of right-of-way by narrowing the sidewalk. ECG will explore this in detail during the preliminary design. Along the south side of the project, the areas that appear to need new right-of-way or easements are from roughly 250' west of the Iron Horse Trailhead to the eastern project limits. ECG will prepare exhibits as needed for discussions with property owners and prepare legal documentation as required for right-of-way acquisition and construction easement establishment. ECG has extensive experience with this type of work on similar recent City of Santa Clarita projects. EXISTING UTILITY COORDINATION ECG performed a preliminary site walk of the project limits and many potential surface utility conflicts were observed. The types of utility appurtenances that may conflict with the new improvements include manholes, meters, vaults, pull boxes, sprinklers and irrigation systems, air vac cans, storm drain catch basins, traffic signs, monument signs, utility cabinets and traffic signal poles. ECG will perform a detailed topographic survey of the project area in which we will document the size and location of all surface utility items. We will also perform detailed existing utility research to acquire existing as -built plans and, where necessary, we will utilize a subsurface utility location consultant, Spearhead Locators, to locate underground utility lines. With our design, ECG will try to avoid these conflicts wherever possible to minimize costs and construction time frame. Where conflicts are unavoidable, our in-house utility coordinator, will manage adjustments or relocations with the affected utility providers. It will be crucially important to get the affected utility providers onboard as early as possible in the design process. Some of the utility providers and other stakeholders that we anticipate being affected by this project are Santa Clarita Valley Water Agency, Southern California Edison, Southern California Gas Company, Los Angeles County Flood Control District, Caltrans, Los Angeles County Sanitation District, Spectrum, and AT&T. SUBTASK 1.1: PROJECT COORDINATION Subtask 1.1.1: Kick -Off and Monthly PDT Meetings The first step in the process will be to meet with City staff in person to review the details of the project with a Project Kick-off Meeting. We believe it is important for the team to understand the nuances of the project, as well as all special concerns, before proceeding. Members of the PDT shall include Consultant and sub -consultants as required, City staff and other agency representatives, as necessary. ECG will conduct monthly (PDT) meetings via video conferencing to ensure the project stays on schedule and to discuss status, concepts and critical issues that may affect the scheduled completion date. This will be a good opportunity to assign action items to members to the design team. PDT meetings shall also be scheduled at every City review period to discuss City comments. We assume 12 monthly PDT meetings for this project. The following items are included: • Develop a Project Development Team (PDT) • Present a preliminary project schedule. Discuss the project schedule including important milestones, major activity and deliverables. • Discuss the scope to insure it captures all the city departments requirements. • Prepare progress and monthly reports • Coordinate team meetings • Maintain QA/QC plan throughout the project. output.- 1. Within two weeks of the Notice to Proceed (NTP), ECG shall provide a detailed project baseline schedule indicating milestones, major activities, and deliverables to the City for review and comments. Project schedule and update TASK 2: PRELIMINARY ENGINEERING Subtask 2.1.1: Field Reconnaissance Using available mapping our team will walk the entire site to document the existing conditions. Pictures and video will be taken and cataloged for use by the entire design team. We will identify areas requiring topographic surveying (e.g., curb ramps, utilities), as well as any other conditions that may require coordination with our sub -consultants and/or other agencies. ECG shall note existing conditions that may impact the design. Extra time will be spent documenting existing utilities within the locations designated for Class 1 Bike Lane and where existing utilities may require relocation. ECG will identify the items to be catalogued through field surveying existing utilities such as, irrigation facilities, traffic facilities, wet and dry utilities, monument signs and any other conditions that may require team coordination and/ or coordination with other agencies. ECG and its sub consultants shall evaluate all components against current California MUTCD standards, Caltrans Standard Specification and Standard Specifications and Plans for Public Works Construction (Greenbook) The principal objective of gathering the existing information is to be familiar with the field conditions and to observe the traffic operations. ECG and its traffic team will do a complete field review to ensure errors are not missed during the design phase. Our team utilizes field review as a tool to collect and verify information to ensure the accuracy of our plans and specifications. Output, 1. Document and map existing conditions for use on design basemap. 2. Determine topographical survey limits. 3. Photograph/ Video and identify existing utilities 4. Detailed field notes will be prepared Encompass Consultant Group PAGE 27 An Employee -Owned Company ECG Encompass Consultant Grc , Subtask 2.1.2: Document Research, Utility Mapping City of Santa Clarita Magic Mountain Beautification Project Proposal # CIP-22-23-B1019 Along with the initial site investigation, ECG will contact dry and wet utility companies and agencies to obtain record drawing information to document existing utilities within the work area specifically where relocations, grading and removals are proposed. Record utility maps will be compiled onto an existing utility basemap used for design. Out team will reference and review all documents received from the City and agencies including the existing buildings, site facilities, and street improvement drawings. ECG will contact USA Dig Alert to obtain a list of providers and utility owners for the project area. We will send a letter, on City letterhead, and map to each entity on the list with a request for maps or a clearance statement. A log will be maintained documenting the contacted utility companies' responses and coordination notes. Once the existing utilities are compiled onto the survey design basemap, ECG will overlay the proposed improvements and develop a plan showing potential existing utility relocations and conflicts. Existing utility plans will be submitted and reviewed to confirm potential tree removals, utilities conflicts and design options to avoid relocations. Based on the existing utility research and field investigations performed by the team, ECG will verify the plans provided by the City are reasonably accurate. Information gathered will be used to determine the location and feasibility of improvements to be included in the current scope. ECG shall collect and review available data for use and reference associated with the project traffic signals. Prior to the field review LCI will coordinate with ECG on the following assumptions: • The project Class I design location, alignment and width • Utility coordination regarding the overhead clearances. See figure 1. In the preparation of the Preliminary Engineering, our team will: • Review base data information and as-builts, topo, improvement plans, utility information; • Review survey information, and other available record data; 68.13'-100+' 30' NOT TO SCALE Figure 1. SCE Overhead Clearance Standard Our team will conduct a thorough field review at each project site and along the project area, in order to prepare thorough base plans. Our field review will consist, but not limited to collecting the following: • Striping, street lighting, and power poles; • Traffic signal equipment; Encompass Consultant Group PAGE 28 An Employee -Owned Company ECG E.-D.- of Santa Clarita Magic Mountain Beautification Project Proposal # CIP-22-23-B1019 • Communication type and associated equipment (e.g., Ethernet switches, fiber distribution units, splice closures, fiber optic cable, terminal servers, fiber optic modems, wireless radio and equipment, twist-pair/copper cable, termination blocks, etc.); • Communication conduit sizes, pull boxes, conduit sweeps, and cables; • Other field conditions that might affect a design decision; Upon completion of the above items, our team shall identify potential constraints that may be encountered in relation to the proposed improvements. This information will be used to prepare base mapping and proposed improvements at the project improvements. This information will also be used as our foundation for our inventory and assessment of existing conditions, recommended improvements and preparation of the project plans. Our goal is to develop a basemap that is as accurate as possible utilizing the most current information available. output, 1. Existing utility basemap 2. Existing utility response log 3. Field notes Subtask 2.1.3 Supplement Survey Perform field survey to locate pavement, curbs, drives, walks, building footprints, fences, walls, planters, and visible surface utilities, together with topographic features such as tops, toes, flow lines, grade breaks, etc. within the project limits (See Exhibit A) Pavement and surface materials will also be identified. Trees larger than 4" in diameter will be located and shown on the map. Download and compute survey data, and prepare an AutoCAD drawing file. The mapping will be compiled at a scale of 1" = 20' with a 1-foot contour interval. Each surveyed feature will be clearly labeled or noted by symbol as identified in the field. Subtask 2.1.4 Record Right of Way Compilation Perform field survey to search for and recover existing record monuments sufficient in number to compile the record documents. The monuments will be tied to the project control survey, and will be used to orient the boundary to the project mapping datum. Research of pertinent recorded maps and documents. Compile project right of way based on the information contained in the latest available assessor site information (no title reports are proposed during the preliminary engineering phase). The computed rights of way will be added to the AutoCAD drawing base map. Resolving boundary problems, such as conflicting descriptions, gaps/overlaps and misclosures, are beyond the scope of this proposal. Output, 1. Topographic survey of existing conditions. 2. Existing rights of way as determined from available records and County assessor maps. Deliverables: AutoCAD drawing files via email, FTP or DVD as appropriate and a PDF signed and sealed digitally by a California Licensed Lands Surveyor. Sheet layout will include title sheet with surveyor's notes, vicinity map, legend, and a control point listing with descriptions and coordinates for use in construction documents. Hardcopies available upon request. Subtask 2.1.5: Utility Potholing and Utility Locating Pothole and map existing utilities to evaluate potential utility conflicts during project design. - will perform potholing services to confirm critical utilities. An assumed 5 field days (approx. 4 to 6 locations per day) for potholing will be budgeted if needed. We estimate approximately 33 street lights and 2 signal poles. Potholing shall be performed after proposed utility locations have been approved by the City. Pothole information shall be identified on the plans. ECG will prepare pothole locations exhibit to identify the proposed potholing based on utilities encountered. Perform subsurface utility locating for areas designated for the Class I Bike Lane. Spearhead Locating Services will locate and mark underground utilities including gas, water, electric, fiber optic, storm drain, water and sewer. They will utilize electromagnetic location equipment to positively identify utilities in the median to be removed. Once the utilities are marked, and paint is still fresh, our survey crews will collect the markings during the supplemental survey field work. Findings will be photographed and documented in a report. An assumed 5 field days for utility location services will be budgeted. After the 30% Conceptual Plan is approved, ECG shall work with the City prior to authorization of the potholing and utility locations services to determine the amount of effort required to complete these tasks. ECG will work with our subs to adjust their agreements based on the revised scope. Both potholing and utility location services will be provided during Phase 1. Output, 1. Potholing report 2. Subsurface utility location report. Subtask 2.1.5: Geotechnical Investigations and Report Perform geotechnical investigations and provide recommendations for design. ECG will review the survey topographical map to identify locations for potential retaining wall locations. Hight of the retaining walls will be considered. Investigations shall include six (6) AC coring and four (4) percolation testing in various locations. The percolation testing results will be used to prepare LID Green Street Options. ECG will coordinate with the geotechnical subconsultant Earth Systems to identify testing locations and report revisions. Earth Systems will use the field exploration data and laboratory testing results to base their recommendations. Retaining walls may be necessary but will not be determined until after the 30% conceptual plan is approved. Output, 1. Geotechnical report including AC coring, percolation testing, and seismic design criteria Subtask 2.1.6: Utility Coordination We anticipate adjustments and relocations of existing utilities and will require extensive coordination. ECG will lead the utility coordination effort throughout the project. ECG shall gather the potholing information, subsurface identification data, and existing utility markings onto a single existing utility basemap. The proposed improvements will be overlayed to create and utility conflict plan. The existing utilities identified to be in conflict and require relocation will be coordinated. ECG will engage the utility agencies to coordinate and meet with each agency. Early utility coordination will help minimize the duration required to resolve conflicts. ECG shall coordinate with Southern California Edison Sub -Station representatives to ensure the Design maintains access to their facilities. Robert Briggs Robert. ECG currently holds an on -call contract with Santa Clarita Valley Water Agency and will coordinate their representatives on the Backcountry Pump Station project on Magic Mountain Parkway to ensure both projects are designed and constructed with minimal impact. In addition to the utility notices requesting record drawings noted in Subtask 2.2, ECG will be prepared and send the following notices for the following: 1. Record drawings Request (Per subtask 2.2) 2. Notice for potential conflicts- Follow up meetings may be required with utility agencies to coordinate and discuss their utilities in conflict. Our goal is to obtain an understanding with the utility agency on the plan for relocation. Plans and exhibits will be prepared in support of these meetings. 3. Notify agency to relocated utility- Once the utilities to be relocated and have been agreed upon, ECG will prepare and send a notice to relocate the utility. The goal is to put the utility agency on notice to prepare for relocation either prior or during construction. 4. Notice for construction. This will be the final notice identifying the estimated construction date and provide copies of the final construction plans. Utility notification letter Subtask 2.2: Design Phasing City of Santa Clarita Magic Mountain Beautification Project Proposal # CIP-22-23-B1019 We understand that the City of Santa Clarita is interested in separating this project into two phases. ECG's project manager will coordinate all aspects of the proposed phasing with the design team and will work with the city to fine tune the approach to the phasing including timing. The project schedule will include both phases and will provide updates as necessary to the City. It is understood between Phase I and Phase II an asphalt overlay project will occur (not under this contract). New asphalt will be installed within the project limits. The City has recommended to design the median, curb, gutter and all underground utilities be designed and constructed for Phase I prior to the asphalt overlay project The following are the proposed phasing for the project. The final phasing will be determined after the 30% conceptual plan is completed. 30% Conceot Plan (All Phases): 30% Concept Plans for the entirety of the proposed street improvements. Street improvements include a 6-lane roadway with a new raised landscaped center median, existing median modifications, curb, gutter, sidewalk, Class I bike trail, utility improvements, utility relocations, lodge pole fencing, retaining wallsand parkway landscaping, a signal at Iron Horse Trail Head/ MMP, street lighting and LID Green Streets improvements. Phase I - Work shall include: • Complete set of Plans, Specifications and Estimates for improvements between the north and south back of curb from Avignon Drive to Tourney Rd. Improvements include, but not limited to the following: New street median and modifications including the relocation of the existing City of Santa Clarita Monument including foundation, street curb and gutter, utility relocations, retaining walls, striping and signage, interim striping and signage plan, interim street lighting plan, new traffic signal, traffic control plans, SWPPP and LID green street improvements, For the purposes of this proposal, we assume that the traffic signal will be installed during Phase 1 in preparation for the street overlay project (by others). If the traffic signal plan is be part of Phase 2 after the 30% conceptual design phase is completed, then ECG will work with the city to reallocate the bucket from Phase 1 scope to the Phase 2 scope of work. Work is to include but not be limited to extension of the curb, gutter, utility relocations, sidewalk, landscape, Class 1 Bike trail, signing/striping of the existing 6 land roadway, street lighting, traffic signal modifications, driveway, ADA improvements, SWPPP and LID Green Street improvements, . Construction work in this Phase shall include an overlay of the 6-lane roadway to be designed by separate consultant and included in the bid package for the phase 2 construction project. Phase]] PS&E 4. 100% Final complete PS&E (All Phases) Subtask 2.3: Concept Plans - 30% Design Documents ECG will utilize the utility research, potholing, subsurface utility locating data, survey, ROW research, geotechnical report to prepare a 30% conceptual plan for the entire project. The plan will include routing option for the Class I Bike Lane to avoid utility relocations where possible. Once the plan is complete, ECG will submit the plan for city review. We anticipate 2 iterations may be required to insure buy off from the city staff. The 30% approved plan will be used as our basis for design for both Phase I and Phase 11. Our project manager will coordinate the concepts with the design team. ECG shall evaluate the most cost-effective route for the proposed pedestrian and Class I Bike Lane. The North and South side of the street will be considered. Our in-house structural engineer will provide input on the potential retaining wall design if the North alignment is selected. The 30% conceptual plans for both Phase I & Phase 11 shall include the following: • Prepare geometric approval drawings (GAD) of the project, including the extent and limits of the roadway improvements, centerline, road profile, and right-of-way alignment and connection/tie-in with project limits from Magic Mountain Parkway at Tourney Rd and Magic Mountain Parkway at Avignon Drive. • Prepare conceptual cost estimates for each phase. • Prepare a preliminary demo plan • Prepare preliminary utility relocation plan • Prepare a proposed street improvement plan that includes a proposed street section, median placement and the proposed striping configurations. • Prepare a preliminary pedestrian and Class 1 Bike Lane alignment • Prepare a preliminary drainage plan. • Prepare LID Green Street options based on the percolation test results. • SUSMP concepts • Prepare retaining wall concepts • Prepare a preliminary landscaping and irrigation plan. • Prepare preliminary striping and signage plans. Phase I and Phase II 30% Conceptual Plans Subtask 2.4: Design Alternates There is an existing traffic signal fiber optic system along MMP between Tourney Rd and Fairways/Avignon Dr. LIN Consulting (LCI) will prepare on the traffic signal plan, detailed construction notes on how to connect the proposed signal system to the existing fiber optic system. (Optional) Should the fiber optic lines and conduits conflict with the proposed street improvements, and relocating the fiber line is necessary, LCI will prepare a separate interconnect plan to relocate the fiber optic system. The interconnect plan will be drawn at 1"=40' scale and show detailed information on how to relocate the fiber lines and to install new fiber from the new traffic signal to the existing fiber optic network. (Optional) Should a future interconnect conduit cross MMP within the project limits, LCI will include an Interim Interconnect plan in Phase I PS&E, to have interconnect conduit installed prior to the Asphalt Overlay Project. Output, 1. Fiber Optic Plan Subtask 2.5: Quality Control Quality Assurance and Quality Control is are two critical steps that is applied to all of ECG projects. ECG has developed and will implement a QA/ QC plan throughout the entire duration of the project. An internal constructability review shall be performed by one of our Principals with extensive construction management and inspection experience to provide perspective from the contractor's point of view. Plans shall comply with the latest City of Santa Clarita Standards, City of Santa Clarita Landscape Maintenance District Standards, Standard Specifications for Public Works Construction (Greenbook), LA County Department for Public Works (LACDPW), Caltrans, City of Santa Clarita Green Street LID and City of Santa Clarita Urban Forestry Standards. ECG will prepare 2 sets of complete construction documents (PS&E) for Phase I and Phase II of this project. It is understood that Phase I plans are to be completed by Fall 2023. Plan sheets shall be compiled and grouped in such a way that they can be easily referenced during construction. It is understood that the project may require a permit for the relocation of existing facilities associated with the proposed, street, pedestrian and the Class I Bike Path improvements. These impacts will be coordinated with our traffic consultant, LIN Consulting, to ensure that traffic and signalization designs are integrated in with the proposed street improvements. It is understood that the proposed improvements, including relocations that may impact private property improvements. These impacts will be coordinated with the City and the utility providers. ECG will make every effort practicable to avoid relocations by including meandering sidewalk options. The sidewalk, class I bike path and ADA design shall consider existing drainage patterns, existing improvements, utilities and pedestrian safety. The plan shall comply with the City of Santa Clarita standards and Greenbook. The median design shall consider curbs with shedding gutters in areas where drainage flow away from the median and curbs with collecting gutters where drainage comes toward the median. The plan shall comply with the City of Santa Clarita standards. Plan shall include profiles as necessary. Grading and drainage plans shall consider the geotechnical finding for the design of concrete improvements. The potential for expansive soils will be reviewed and mitigated in design. Class I Bike Path Plans Utility Relocation Plans (Phase I & II) ECG shall prepare a Utility Relocation Plan for existing utilities in conflict with the proposed ADA and class I bike path improvements. The plan will include existing information compiled from information gathered during Task 2 Preliminary Investigations phase. Proposed utility relocations will be presented to the City during the 30% conceptual plan submittal prior to submitting relocation plans to the corresponding agencies. It is anticipated that relocations will be necessary and plan approvals from outside agencies will be required. Relocations may include, but not limited to include fiber optic, street lights, electrical, water, gas and storm drain. ECG shall coordinate with utility companies throughout the design phase of the project. Subsurface location information shall be identified on the plan, in addition to any existing and proposed easements. It is anticipated that Storm Drain relocations and improvements may be necessary and plan approvals from LACFCD and Caltrans will be required. ECG will work with the City to coordinate and provide support for approvals. Other relocations may include, but not limited to include fiber optic, street lights, electrical, water (SCVWA) and gas. Proposed striping may include crosswalks, left turn pockets, pavement markings, as well as the corresponding signs. Two (2) signing and striping plans and two (2) Class I Bike Path plans are anticipated for the project. The signing and striping plans will show centerlines, right-of-way lines, existing and proposed street improvements, driveway locations, all existing, proposed and removed signs, striping, pavement markings, curb markings, and parking restrictions. Any work required to transition the proposed stripes to join with existing stripes will also be provided. The plans would conform to the City of Santa Clarita requirements, and would be prepared for final plotting on D-sized sheets at 1" = 40'. Plans shall be prepared drawn on 24 inch by 36 inch format, with a City specified border, title block, and signature block. Final plans will be signed and stamped by a Registered Civil Engineer. Assessment of the turning radius of each turn lane shall be achieved using the program Autoturn to analyze the left turn potential conflicts. Output, 1. Signing and Striping Plans 2. Autoturn exhibits Traffic Signal Plans (Phase 1) LIN Consulting (LCI) will prepare a traffic signal plan at 1" =20' scale for the intersection of Iron Horse Trailhead/MMP. The traffic signal plan will show center lines, right-of-way lines, relevant existing and proposed street improvements and utilities of record. All street furniture would be inventoried in the field and shown on the plan. Proposed facilities will be designed and shown on the drawing, with all general and construction notes, phase diagram, and pole schedule to create a complete traffic signal plan. The plan would conform to the requirements of the City of Santa Clarita Standards, and would be designed in the specific format required by the City to meet their approval. One traffic signal plan sheet is anticipated for the project. Since this intersection does not have a service feed point to energize the traffic signal controller and signal equipment. LCI will coordinate with Southern California Edison (SCE) for service feed point. LCI will fill out the required SCE forms, submit our preliminary plan showing the location of the service point, and request SCE to verify the service feed point on the plan or provide us with a new feed point location. Any information received form SCE will be updated on the plan for the 90% and final submittals. Fees to SCE will be provided by others. The plans will include laydown openings for contractors' equipment. LCI will prepare WTCP plans to conform to the requirements of the latest California Manual on Uniform Traffic Control Devices (MUTCD) and Work Area Traffic Control Handbook Manual standards with consideration for the needs of the Contractors' construction operations. These plans will take into consideration signalized intersections and roadway geometrics and other factors that will influence the design of the temporary traffic control. The 30% conceptual, 60%, 90%, 100% plans will be delivered to ECG for City of Santa Clarita's review and comments. The WTCP plans will be prepared at 1"=40' scale in accordance with the requirements of the City of Santa Clarita. The temporary traffic control design will include the following plans: • Magic Mountain Parkway between State Highway Interstate 5 and Avignon Dr median construction (2 stages) • Magic Mountain Parkway between State Highway Interstate 5 and Avignon Dr curb and gutter construction (2 stages) The WTCP plans will utilize accepted methods of lane closure delineation, signage and barricading. Specific work areas will be protected from traffic based on the construction phase, type of work and construction equipment required within the work area. The plans will be designed to maximize lane usage for all traffic movements, maintain pedestrian access routes, and provide a workable construction area. LCI will coordinate with ECG and the City for the distribution of plans to Caltrans District 7. LCI will respond and correct the Traffic Control Plans according to Caltrans and the City's comments. Permits and processing will be done by others. Traffic Control Plans for Phase I LCI assumes the traffic control median construction will be done in two (2) stages. 1st stage will be along MMP from 1-5 Fwy to Iron Horse Trailhead Rd. Approximately 1,000' of work zone area. The 2nd stage will be along MMP from Iron Horse Trailhead Rd to Avignon Dr, approximately 2,00' of work zone area. Additional Traffic Control staging is not included in the scope of work. Traffic Control Plans for Phase II LCI assumes the traffic control curb and gutter construction will be done in two (2) stages. 1st stage will be along MMP from 1-5 Fwy to Iron Horse Trailhead Rd. ECG and our in-house structural engineer will review the geotechnical report for the seismic design criteria and apply the data to the footing and wall design calculations. ECG will review the standard APWA Green book retaining wall for reference. We believe that a custom wall design will allow for a reduced footing width. This will allow the back of wall to be set closer to the right of way and will maximize the bike path and pedestrian improvements. ECG will prepare a wall calculation package and prepare wall profiles with cross sections and details. Output, 1. Retaining wall calculations 2. Landscape Electrical Plans The proposed landscape design anticipates two (2) irrigation controllers within the project. Service connection is required for both irrigation controllers. LCI will prepare a Landscape Electrical Service Plan for PS&E design package. The landscape service plan will include electrical service design for the installation of proposed irrigation controller cabinets. The PS&E landscape service plan will be prepared in a scale of 1"=40' and will conform with the City of Santa Clarita's electrical guidelines. Gather relevant project info (estimated construction schedule, Legally Responsible Person/Party [LRP] contact information, existing soil characteristics from USDA database, etc.). 3. Prepare Risk Level calculations to determine the appropriate project Risk Level based on construction timeline, soil slope characteristics, and existing soil erosivity. 4. Prepare Sediment & Erosion Control Plans at a plan scale of 1"=40' or larger. Plans will indicate proposed Best Management Practices (BMPs) to be implemented during construction. The plans will also indicate stormwater discharge points, proposed sampling locations, and materials/vehicle storage areas. 5. Prepare the SWPPP binder in accordance with City and State Water Board requirements. The SWPPP will include Risk Level calculations, construction site monitoring measures, sampling guidelines (if sampling is required), Sediment & Erosion Control Plans, and other appurtenant information. 6. Assist the City in filing the Notice of Intent (NOI) permit application on the State's SMARTS web database. a. NOTE: as Data Submitters, we will fill -out the NOI application and upload pertinent attachments, but the City will need to officially certify the application as the LRP. 7. ECG will look for opportunities to implement LID BMPs to the maximum extent practicable, with potential application of bioretention parkways/medians, vegetated swales, and/or tree well filters, dependent on technical feasibility. SUSMP Construction Cost Estimates (Phase I & II) Estimates of probable implementation cost will be maintained throughout the course of the design. The estimates are prepared using the project quantity takeoffs and current unit prices. Unit costs for civil, landscape and traffic items such as standards, mast arms, detector loops, conduit, interconnect cable, pull boxes, AC paving, curb and gutter, striping and other such work items are all maintained in a spreadsheet and updated whenever new cost information is available. ECG will prepare solicitation bid documents in compliance with the City's requirements and Greenbook standards. Bid documents will be prepared as MS Word format and delivered in electronic and hardcopy format. Estimates shall be submitted at the 30%, 60%, 90%, 100% and Final milestones. The estimate should include a breakdown of costs for each item of work and match the bid schedule, item by item, included in the specifications. Project Cost Estimates shall include all anticipated project costs identified in concept design cost including but not limited to environmental mitigation, permits, right of way costs, project soft costs and project contingencies. Our estimate has assumed five (5) parcels, and includes a "per parcel" unit cost estimate which includes the acquisition of a Preliminary Title Report for each encumbered parcel. The 30% conceptual design details will ultimately determine the final level of effort for easement preparation. The "per parcel" unit scope is as follows: Prepare five(5) legal description and accompanying exhibit for each encumbered parcel to clearly define a permanent Right of Way Easement and associated Temporary Construction and/or Slope Easements. It is understood any execution, deed preparation, coordination and/or recording will be handled by client. Includs a title report. Output - Legal descriptions with accompanying exhibits, signed by Licensed Land Surveyor. Closure calculations and other supporting exhibits necessary for review and approval. 2. Since 1969, the Earth Systems group of companies has provided expert geo-professional services to assist our clients through all aspects of geotechnical and geologic engineering, environmental engineering, and construction related materials testing and inspection services. Through our previous work in the region, our dedicated staff understands the diverse geotechnical, geologic, and construction -related issues that may affect the proposed project and will work to develop practical and economical geotechnical engineering solutions through innovative approaches. We have prepared this proposal based on our understanding of preliminary project information provided in emails from Mr. Sal Contreras on November 21, 2022. We understand that the proposed project will be developed under the regulation of the 2019 California Building Code (CBC). Based upon the anticipated conditions, the following sections describe our understanding of the project and our anticipated scope of services in order to meet the above requirements. This project will be managed by Ms. Renee Morales, GE 3170, who will also oversee the engineering evaluation and report preparation. Mr. Anthony Mazzei, GE 2823 will be the Principal on the project. PROJECT UNDERSTANDING Earth Systems understands the proposed project will consist of improvements along both sides of Magic Mountain Parkway from Tourney Road to Fairways Drive in the City of Santa Clarita, California. Based on our review of the scope exhibit, the development may consist of new pedestrian flatwork and curbs along both sides of Magic Mountain Parkway, pavement improvements, a retaining wall along the northern portion of Magic Mountain Parkway, and infiltration basins. At this time the height of the retaining wall was not made available. We understand that the proposed project will be developed under the regulation of the 2019 California Building Code (CBC). December 5, 2022 2 Proposal No.: PAL-22-12-001 Preliminary design plans were not available at the time that this proposal was prepared; however, most of the improvement areas are generally flat and, as such, we have assumed that proposed finished grades will likely be within five feet of existing site grades. The purpose of our study will be to explore the subsurface conditions and provide geotechnical recommendations for project design. This proposal contains a brief project description, our proposed approach to the project based upon our initial assessment of site conditions and readily available information, our proposed scope of services, schedule, and proposed fee. Since detailed services may involve greater expense, we ask that our clients participate in determining the level of service, that will provide adequate information for their purposes. Please review this information and our proposed scope. If you should have any questions or suggested revisions to our scope, please do not hesitate to contact the signatory of this proposal. Our proposal is based upon the assumption that we will be provided full access to the site during normal business hours (M-F, 7am to 6pm) to complete field activities and that drilling with a gasoline powered drill rig equipped with a 140-pound hammer to drive the soil samplers can be used at the site. PROPOSED SCOPE OF SERVICES Our scope will include performing subsurface exploration, laboratory testing, and preparing one report of our findings in accordance with the 2019 CBC. Once field and laboratory testing are completed, the data will be organized by a member of our professional staff to develop conclusions and recommendations relevant to site development as we understand it. As required by the CBC, our report will be signed and stamped by a California registered Engineer. Task 1— Coring of Existing Pavement Section Earth Systems will begin fieldwork preparation by marking the exploratory boring locations. Once the boring locations are marked, we will contact Underground Service Alert (USA) to determine if proposed exploratory locations are within a public utility right-of-way. The City will need to provide Earth Systems with the locations of any on -site utilities not marked by USA prior to commencement of our drilling activities. Earth Systems will not be held responsible for damage to any utilities that were not marked or that were not brought to our attention prior to beginning our drilling activities. The project will require advancing borings at various locations along Magic Mountain Parkway. It is anticipated that traffic control plans will be required. The cost associated with preparation of the traffic plan and preparation of the encroachment permit applications has been included in our estimated costs. However, Earth Systems has assumed that the encroachment permit fees from the City of Santa Clarita will be waived. Earth Systems will drill six (6) exploratory test borings within the project area. The test borings will be drilled to a depth of 5 feet below the existing pavement surface. The existing structural pavement section will be measured at each test boring location. As the borings are drilled, standard penetration tests will be performed (ASTM D 1586) and soil samples will be obtained EARTH SYSTEMS PACIFIC December 5, 2022 3 Proposal No.: PAL-22-12-001 using a ring -lined barrel sampler (ASTM D 3550). Bulk soil samples will also be obtained from the auger cuttings. The boreholes will be backfilled with pea gravel to the bottom level of the existing pavement section, and the remainder of the borehole will be backfilled with cold -patch asphalt. Traffic control will be provided throughout the drilling activities in accordance with the traffic control plans. Traffic control services will be subcontracted by Earth Systems to Traffic Management, Inc. The cost for providing traffic control has been included in our estimated cost. Task 2 — Percolation Testing (Optional) Four test borings will be drilled during our above field exploration and will be used for the boring percolation test procedure. We are proposing approximately 5-foot to 10-foot percolation tests. Our percolation tests will be performed concurrently at the time of the geotechnical exploration. Perforated PVC pipe and gravel will be placed into the test hole to hold it open during the test, and the test hole will be pre-soaked and allowed to sit overnight. The gravel will be accounted for in our calculation. Percolation testing will consist of adding approximately two feet of clean water to the test hole. Adding the water will allow measuring the rate at which the water percolates into the subsurface by periodically measuring the drop of the water surface over time. The tests will last approximately four to eight hours depending on if a stabilized rate is achieved and upon the soil types encountered. Percolation results will be converted to infiltration results where needed using empirical techniques (Porchet) in general accordance with the Los Angeles County criteria. Testing will be performed in accordance with the Small Diameter Boring, Shallow Infiltration Test procedure in the Los Angeles County Public Works Geotechnical and Materials Engineering Division manual. Encompass Consultant Group should confirm the testing method above satisfies the project requirements prior to the start of work. Task 3 — Geotechnical Investigation for Retaining Wall (Optional) Earth Systems will begin fieldwork preparation by marking the exploratory boring locations. Once the boring locations are marked, we will contact Underground Service Alert (USA) to determine if proposed exploratory locations are within a public utility right-of-way. The City will need to provide Earth Systems with the locations of any on -site utilities not marked by USA prior to commencement of our drilling activities. Earth Systems will not be held responsible for damage to any utilities that were not marked or that were not brought to our attention prior to beginning our drilling activities. Earth Systems assumes that the exploratory borings for the retaining wall can be drilled along the shoulder of the Magic Mountain Parkway, and that traffic control will not be needed. Earth Systems Assumes that this will be satisfactory to the City. Earth Systems will drill 3 to 4 exploratory test borings along the retaining wall alignment. The test borings will be drilled to depths ranging from 15 to 50 feet below the existing ground surface. Because the site lies within a liquefaction hazard zone, the 50-foot-deep boring will be drilled to evaluate the liquefaction potential. As the borings are drilled, standard penetration tests will be performed (ASTM D 1586) and soil samples will be obtained using a ring -lined EARTH SYSTEMS PACIFIC December 5, 2022 4 Proposal No.: PAL-22-12-001 barrel sampler (ASTM D 3550). Bulk soil samples will also be obtained from the auger cuttings. The boreholes will be backfilled with pea gravel to the bottom level of the existing pavement section, and the remainder of the borehole will be backfilled with cold -patch asphalt. Laboratory testing will be performed on soil samples collected during the field exploration to help identify and evaluate subsurface site characteristics. Tests should include, but may not be limited to: measuring in -place moisture and density, direct shear testing of remolded samples of bearing soils; consolidation testing of in -situ soils within the influence of anticipated loading; expansion index testing of anticipated bearing soils; grain size and plasticity analyses of key soil types; and pH, resistivity, soluble chloride and soluble sulfate testing of soils anticipated to be in contact with foundations. Once field and laboratory tests are complete the data will be organized and analyzed by a member of our professional staff in order to develop conclusions and recommendations relevant to site development as we understand it. A Geotechnical Engineering Report will be prepared based on evaluation of the data obtained from the exploration and testing programs, and on experience and judgment. Included in the report will be discussion of regional and local geologic conditions; descriptions of the field and laboratory tests performed during our studies, discussions pertaining to the engineering properties of soil types encountered on -site, and recommendations for site improvement based on the geological and geotechnical conditions. Recommendations will include: criteria for grading; seismic design parameters; vertical, lateral and bearing pressures for use in structural design; estimated total and differential settlements; minimum foundation design criteria; and geohazard mitigation measures that should be implemented into the project (if any). Task 4 — Consultation If needed, we have included 6 hours of consultation during report preparation and design, or unforeseen issues that may occur during our exploration or analysis. This fee is Time and Materials and will only be used if needed. FEES It is our desire to provide you with the highest quality services at reasonable fees. The fee for Tasks 1-3 should be sufficient to provide a report typically approved by reviewing agencies. However, if there is request for additional review, responses, plan reviews, reporting, meetings, information beyond the normal review process and reporting requirements detailed herein, or any other service not specifically detailed, additional fees will be required. Additionally, our fee does not include testing or observation during construction or consultation. If required, services in addition to the scope of work described above can be billed on a time -and -expense basis, based on the fee schedule in effect at that time. SCHEDULE Based on the requested information, we feel confident that we can provide the geotechnical engineering report as outlined in this proposal in an expeditious manner. Typically, once authorization to enter the property and a signed contract is received, we can mark respective boring locations in the field. Subsequent to field marking, we will contact Underground Service Alert which requires 48 hours notification prior to any underground excavation or drilling. Depending on subcontractor availability, we anticipate excavating our field borings within two to three weeks after the minimum 48 hours wait required by Underground Service Alert. Drilling operations for Task 1 will take approximately one day, whereas the drilling for Task 3 (optional) will take approximately one to two days. Infiltration testing for Task 2 (optional) will take approximately 2 to 3 days. Laboratory testing for Task 2 (optional) is anticipated to take four weeks after drilling is completed. This time frame is governed by the type of testing performed as certain tests anticipated for this project require at least one week to run. Normal time frames from receipt of authorization to report submittal is approximately six to eight weeks. If requested, we can provide design data in the interim period before the report is finalized. Our proposal is based on the understanding that our services, as outlined in this proposal, are not subject to Prevailing Wage Law for non-professional field staff (i.e., drillers and helpers). TERMS FOR SERVICE The following terms and conditions shall be incorporated into the agreement for services and form the basis for the fees developed within. Contract terms more onerous than presented within or insurance greater than $1,000,000 typical limit could incur greater fee. 1. STUDY, MONITORING & INSPECTION: If the services include monitoring or inspection of soil, construction and/or materials, Client shall authorize and pay for Consultant to provide sufficient observation and professional inspection to permit Consultant to form opinions according to accepted statistical sampling methods as to whether the work has been performed in accordance with recommendations. Such opinions, while statistically valid, do not guaranty uniformity of conditions or materials. Similarly, soils and geology investigations do not guaranty uniformity of subsurface conditions. Client hereby represents and warrants that it has provided and shall provide to Consultant all information and sufficient advance notice necessary in order for Consultant to perform the appropriate level of services. No EARTH SYSTEMS PACIFIC December 5, 2022 6 Proposal No.: PAL-22-12-001 statement or action of Consultant can relieve Client's contractors of their obligation to perform their work properly. Consultant has no authority to supervise or stop the work of others. 2. SITE ACCESS & UTILITIES: Client has sole responsibility for securing site access, locating utilities, and any repair. 3. BILLING AND PAYMENT: Client will pay Consultant the proposal amount or, if none is stated, according to the fee schedule in effect at the time our services are provided. Prior to initiation of fieldwork, a retainer may be required. This retainer shall be maintained throughout the project and shall be applied to the final invoice. Payment is due on presentation of invoices, and is delinquent if Consultant has not received payment within 30-days from date of an invoice. Client will pay an additional charge of 1-1/2 (1.5) percent per month (or the maximum percentage allowed by law, whichever is lower) on any delinquent amount. Each payment will first be applied to accrued interest, costs and fees and then to the principal unpaid amount. All time spent and expenses incurred (including any in-house or outside attorney's fees) in connection with collection of any delinquent amount will be paid by the Client to Consultant per Consultant's current fee schedule. Payment by Credit Card is subject to a 3% additional fee. 4. OWNERSHIP OF DOCUMENTS: Consultant owns all documents it creates and grants Client limited license to use the documents for the purposes stated in the documents. Consultant reserves the right to withhold delivery of documents to Client until payment in full of current invoices has been received. S. TERMINATION: This agreement may be terminated by either party effective seven (7) days from the date of written notice, or if the client suspends the work for three (3) months. In the event of termination, Consultant will be paid for services performed prior to the date of termination plus reasonable termination expenses. If Consultant has not received payment for any invoice within 30 days from the date of the invoice, or in the event of anticipatory breach by Client, Consultant may suspend performance of its services immediately and may terminate this contract. 6. RISK ALLOCATION: In order for Client to obtain the benefit of a fee which includes a lesser allowance for compensating Consultant for its litigation risk, Client agrees to indemnify, hold harmless and defend Consultant, its agents, employees, or officers, from and against any and all loss, claim, expenses, including attorney's fees, injury, damages, liability or costs arising out of non -design services (i.e., services other than as defined by Civil Code Section 2784) performed by Consultant on this project, except where such loss injury, damage, liability, cost, expenses or claims are the result of the sole negligence or willful misconduct of Consultant. Client further agrees to limit the total aggregate liability of Consultant, its agents, employees, and officers to Client on the entire project, to the greater of $25,000.00 or total fees charged by Consultant, except that Consultant's liability for willful misconduct shall not be limited. These terms may be negotiable depending on the particular facts of your project. You should consult with an attorney experienced in construction contracts and litigation regarding this provision. 7. HAZARDOUS MATERIALS: Consultant is responsible only for hazardous materials brought by Consultant onto the site. ASSIGNS AND THIRD PARTIES: This Contract is intended only to benefit the parties hereto. No person who is not a signatory to this Contract shall have any rights hereunder to rely on this Contract or on any of Consultant's services or reports without the express written authorization of Consultant. This Contract shall not be assigned by Client without the Consultant's written consent. This Contract is binding on any successor companies to Client or Consultant, and on the surviving corporation in the event of a merger or acquisition. 9. STANDARD OF CARE: Consultant agrees to strive to perform its services that are intended solely for the use of the Client, in a proper and professional manner in accordance with current standards of environmental practice in this community at this time. The Client agrees to pay for and look to Consultant only for such performances. No warranty or guarantee is expressed or implied. Consultant and the Client agree that there are risks of earth movement and property damage inherent in land development and repair and that Consultant has not been authorized to perform the exhaustive and economically unfeasible investigation necessary to eliminate such risks. 10. EFFECTS OF SITE EXPLORATION: It is understood that in the normal course of providing these services, Consultant may be required to access the site to perform field exploration. All boreholes will be backfilled at completion; however, some settlement should be anticipated. Consultant will attempt to minimize the effects of the exploration operations on the site. However, it must be understood that some damage to existing roadways, vegetation, or other improvements may occur. Consultant does not propose to restore the site to the same condition as was present prior to the exploration operations. 11. GOVERNING LAW, SURVIVAL AND FORUM SELECTION: The contract shall be governed by laws of the State of California. If any of the provisions contained in this agreement are held invalid, the enforceability of the remaining provisions will not be impaired. Limitations of liability, indemnities, representations and warranties by Client will survive termination of this agreement. The signatories represent and warrant that they are authorized by the entities on whose behalf they sign to enter into this contract and that their principals have filed fictitious business name statements, if required. All disputes between Consultant and client related to this agreement will be submitted to the court of the county where Consultant's principal place of business is located and client waives the right to remove the action to any other county or judicial jurisdiction. 13. CALIFORNIA PREVAILING WAGE LAW: Client represents and warrants that the Project is not a public works project which is subject to California Prevailing Wage ("Code"). Client acknowledges that Consultant is relying on this representation and warranty in good faith and has negotiated the terms of this contract based on such reliance. In the event that it is determined by any federal, state or local agency, or any appropriate judicial or administrative body, that any of the services performed by Consultant on the Project are subject to the provisions of the Code and that Consultant is required to pay a specified prevailing wage rate for all or any portion of such services, Client agrees to defend, indemnify and hold Consultant harmless from and against any and all claims, actions, demands, deficiencies, levies, EARTH SYSTEMS PACIFIC December 5, 2022 8 Proposal No.: PAL-22-12-001 assessments, judgments, penalties, interest, expenses and recoveries arising from or related to Consultant's noncompliance with the Code based on Consultant's reliance on Client's aforesaid representation and warranty. This indemnity shall include, but shall not be limited to, Client's obligation to pay any additional compensation necessary to adjust Consultant's employees' wages to conform with the Code, including for past services on this Project, costs to comply with the apprenticeship requirements, certified payrolls and other administrative costs to comply with the Code. No refunds will be provided to the Client in the event of any subsequent determination that Consultant's services or the project is not subject to the Code.
