BACKGROUND The City of Santa Clarita (City) regularly reviews the Santa Clarita Municipal Code (SCMC) to ensure it reflects the needs of the community; is current with federal, state, and local legislation; Page 1 Packet Pg. 33 O and is consistent with the direction of the City Council. This review process includes gathering feedback from residents on areas that need improvement, incorporating observations by enforcement staff, and considering modifications to clarify the intent of the regulations within the SCMC and improve the quality of life in Santa Clarita. The City's Parking Enforcement Program (Program) works to improve the quality of life for the community by enforcing State of California (State) and City vehicle regulations with empathy and integrity. Parking regulations help maintain traffic flow and enhance public safety while complementing the City's commitment to promoting a safe environment for residents, businesses, and visitors. The Program operates 24 hours a day, seven days a week, with services provided by a third -party contractor. The Program primarily addresses parking violations on a reactive or complaint -driven basis. However, health and safety violations (i.e., handicap, red curb, and fire hydrant violations) are addressed on a proactive and reactive basis. Parking Enforcement Officers also proactively patrol areas in the City where resident complaints are high, such as areas near apartment and condominium complexes, select major thoroughfares, and school zones, which have limited street parking. In 2022, the Program addressed 10,102 parking -related Resident Service Center (RSC) requests, with the top concern being vehicles parked over 72 hours. Additional commonly submitted concerns include failure to obey signs, parking in fire lanes and handicap spaces, and oversized vehicle (OSV) issues. The following updates are being recommended to improve the overall effectiveness of the City's current parking regulations in helping to address concerns regarding safety and quality of life. Chapter 12.64 (Vehicle Parked Over 72 Hours): Chapter 12.64 of the SCMC establishes a 72-hour limit on street parking, meaning that vehicles cannot be parked on a public street for more than 72 consecutive hours without moving. As currently defined in the SCMC, a vehicle is considered in compliance if it is moved any distance in either direction within the 72-hour timeframe. Staff is finding that vehicle owners, after receiving a warning notice for the 72-hour restriction, will oftentimes move their vehicles a few inches forward or backward to remain in compliance. In effect, the vehicle continues to be stored on the public right-of-way, in the same place, prohibiting the use of the roadway for other vehicle owners. It has also been observed and noted that with no established minimum distance, vehicle owners are able to physically push non -operational vehicles forward or backwards a few inches to meet the requirements of the SCMC. Both of the aforementioned practices create challenges for residents parking in already dense areas with limited parking. As a result, the Program has seen a significant increase in the volume of resident complaints related to the topic. In 2022, the Program received 4,711 RSC requests regarding abandoned vehicles, which represents a 30 percent increase over 2021. The current parameters of the SCMC, as previously stated, make enforcement of the matter a challenge and provide little relief for negatively affected residents. To more effectively address abandoned and/or inoperable vehicles being parking on City streets, staff is proposing a minimum distance of 150 feet for a vehicle to be moved from its original marked location within the required 72 hours. Staff performed a benchmark study of other cities Page 2 Packet Pg. 34 O with 72-hour parking rules, and it is common to stipulate a minimum distance. The prevailing minimum distance across benchmark cities is 300 feet or the length of one block. The recommended distance of 150 feet would effectively resolve the aforementioned challenges, while not creating an undue burden on Santa Clarita residents as it relates to parking their vehicles on public roadways. In addition to the establishment of a minimum distance, updates to various definitions are being recommended for additional clarity. The complete list of redline changes to SCMC Chapter 12.64 is included as Exhibit A of the proposed ordinance. Chapter 12.94 (Oversized Vehicle Parking Regulations): Chapter 12.94 of the SCMC prohibits OSVs from parking on any public street, except for the purposes of loading, unloading, and minor repairs, provided that these activities do not exceed 48 consecutive hours. Owners of OSVs additionally have the option of applying for an Oversized Vehicle Parking Permit, which allows them to park their OSV on the public street for up to 72 hours under the provisions of the permit. The SCMC allows for a maximum of three OSV parking permits per registered owner within any 90-day period. By definition, OSVs are larger than standard vehicles, which can create potential issues with line of site for vehicular and pedestrian traffic. For this reason, and to protect the safety and welfare of Santa Clarita residents, a time restriction of 48 consecutive hours is imposed on OSVs. The challenge is an additional exemption within Chapter 12.94 of the SCMC, which allows for OSVs to be parked on a public roadway during holidays and weekends. In effect, if timed correctly, OSV owners can combine both exemptions and potentially have their OSVs parked on a public roadway for in excess of 96 consecutive hours. Staff has observed this practice being frequently leveraged, causing a significant number of complaints regarding OSVs that are effectively being stored on public streets. Given the current language of the SCMC, enforcement of the matter has been ineffective and difficult, thereby infringing on traffic safety and resulting in complaints to the City. In 2022, the City responded to 783 complaints regarding OSVs parked on public roadways, which represents an increase of 8 percent compared to 2021. To address the aforementioned issues, staff recommends eliminating the weekend and holiday exemption for OSVs. In effect, OSVs would need to be completely removed from the public right-of-way within 48 hours, regardless of whether it falls on a weekend or holiday. In addition, staff recommends changing the allowed frequency of permit issuance. A maximum of three OSV parking permits would be allowed per registered owner within any 120-day period, as opposed to the current 90-day period. These changes will allow Parking Enforcement to more effectively address OSV violations, while still providing OSV owners an appropriate amount of time to park their vehicles on a public right-of-way for the purposes and intent of the SCMC. The complete list of redline changes to SCMC Chapter 12.94 is included as Exhibit A of the proposed ordinance. City Policy I-11.1 (Enforcement of Oversized Vehicle Ordinances): The City Council adopted the City's Enforcement of Oversized Vehicle Ordinances Policy on January 9, 2001, establishing guidelines for the enforcement of Chapter 12.94 of the SCMC regarding oversized vehicle parking regulations. To reflect the proposed changes to Chapter Page 3 Packet Pg. 35 O 12.94 discussed above, staff recommends conforming updates to the Enforcement of Oversized Vehicle Ordinances Policy. The complete list of redline changes to City Policy I-11.1 is included as Exhibit B. Upon approval of the recommended actions, the proposed changes will be brought back to the City Council for a Second Reading on April 25, 2023, and if approved, take effect on May 25, 2023. The ordinance amends the following Chapters of the Santa Clarita Municipal Code: Chapter 12.08, entitled "Definitions" and Chapter 12.64.200, entitled "Vehicles Parked Over 72 Hours." The City of Santa Clarita (City) operates a Parking Enforcement program to enforce parking regulations. The City is empowered to enact rules to ensure that members of the public park upon the public right-of-way in a manner that is consistent with the purposes of these places and promotes the public's common benefit. The proposed amendments to Title 12 will promote and encourage a safe, fair application of vehicles parked within the public right-of-way, and are intended to ensure that the public can use and enjoy such places for their intended purposes. SECTION 2. Chapter 12.08 of the SCMC is hereby amended to read in its entirety as shown in Exhibit A, which is attached hereto and incorporated herein by this reference. SECTION 3. If any section, subsection, sentence, clause, phrase, part, or portion of this ordinance is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of the ordinance. The City Council declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase, part, or portion thereof, irrespective of the fact that any one or more section, subsections, sentences, clauses, phrases, parts, or portions be declared invalid or unconstitutional. SECTION 4. This ordinance shall be in full force and effect thirty (30) days from its passage and adoption. SECTION 5. "Oversized vehicle" shall mean any motor vehicle, boat or trailer, which meets or exceeds at least two (2) of the following criteria, exclusive of fixtures, accessories or property: 1. Twenty-three (23) feet in length; or 2. Eight (8) feet in height; or 3. Seven (7) feet in width. (Ord. 01-3, 1 /9/01) 12.94.020 Oversized Vehicle Parking Regulations —Penalties —Appeals. A. The parking of oversized vehicles, as defined in Section 12.94.010 of this chapter, shall be prohibited on any public street, or public place within any residential, commercial, industrial, or business park zone. The prohibitions set forth in this chapter shall not apply to the parking of commercial vehicles. C. Any violation of the herein stated provisions pertaining to the parking of oversized vehicles shall be subject to penalties as established by a schedule of fees adopted by resolution of the City Council. D. Every person who is issued a notice of parking violation pursuant to this chapter may request review of that notice under Section 40215 et seq., of the California Vehicle Code. (Ord. 01-3, 1 /9/01) 12.94.030 Oversized Vehicle Parking Permits. An oversized vehicle may be parked on any public street if the City issues an oversized vehicle parking permit pursuant to the following: A. Purpose. The purpose of authorizing the issuance of oversized vehicle parking permits is to give owners of oversized vehicles an opportunity, for a limited time, to park their oversized vehicle on a public street. B. Requirements for Oversized Vehicle Parking Permits. Any person may obtain an oversized vehicle parking permit to park a designated oversized vehicle on a public street, for a limited period of time, as described in subsection D of this section. C. Issuance of Permits. The City Manager or designee shall establish policies and procedures for the issuance of such permits. Each peFsea--registered owner desiring an oversized vehicle parking permit shall file with the City Manager or designee a completed City application form containing the following: a. The name, address and phone number of the registered owner .y. appliGaRt of designated oversized vehicle- b. The license number, make and model of designated oversized vehicle; c. The dates for which the permit is requested pursuant to subsection (D) of this section; d. The dates and duration of any and all oversized vehicle permits issued to the applicant within the immediately preceding RiRet� one hundred and twenty (48120) day period, Packet Pg. 49 3.b e. Additional information the City Manager or designee may require; The applicant must sign application under penalty of perjury. 2. Oversized vehicle parking permits issued and approved by the City Manager or designee shall include the license plate number of the designated oversized vehicle, the date of issuance and the day of its expiration. 3. All permits shall be placed at the lower driver's side of the windshield of the oversized vehicle to which it relates so that it is clearly visible from the exterior of the oversized vehicle. Should the oversized vehicle not have a windshield, the permit shall be affixed to the front portion of the oversized vehicle in a location that is plainly visible from in front of said oversized vehicle. 4. All oversized vehicle parking permits shall be issued at no expense to the applicant. D. Permit Duration and Renewal. An oversized vehicle parking permit shall be valid for a period not to exceed three (3) consecutive yVaeo days (seventy-two (72) hours). Upon expiration of an oversized vehicle parking permit issued under this section, the applicant may apply for and be granted additional oversized vehicle parking permits, if the applicant still qualifies under the conditions set forth herein. In no event shall any person and/or designated oversized vehicle be issued more than three (3) oversized vehicle parking permits within any RiRetgone hundred and twenty (48120) r-aleAdar day period. The prohibitions provided in this chapter shall not apply to the parking of any oversized vehicle during the pendency of any state of emergency declared to exist within the City of Santa Clarita by the City Council. PURPOSE The purpose is to establish guidelines for enforcing Chapter 12.94 of the Santa Clarita Municipal Code regarding oversized vehicle parking regulations. H. GENERAL Chapter 12.94 of the Santa Clarita Municipal Code prohibits oversized vehicles from parking on any public street within any residential, commercial, industrial, or business park zone. This ordinance defines "oversized vehicle' as any motor vehicle, boat, or trailer which meets or exceeds at least two of the following criteria: A. Twenty-three feet in length; or B. Eight feet in height; or C. Seven feet in width weekend (Satufday and Sunday) or- on a national koliday. Weekday and nNen 1404day eExemptions are else -given to oversized vehicles that are being loaded or unloaded, as observed by a City Code Enforcement Officer, Parking Enforcement Officer, or Sheriff's Deputy, or in the case of emergency repairs being performed to the vehicle, provided that these activities do not exceed 48 consecutive hours. "Emergency Repairs" are defined as any repair of a minor nature (i.e. changing a flat tire, or jumping a discharged battery) performed to restore a vehicle's operability. Oversized vehicles displaying a disabled license plate are exempt from the provisions set forth in the Code, but must adhere to other codes where exemptions are not granted, such as Vehicles Parked over 72 hours. Owners of oversized vehicles have the option of applying for an Oversized Vehicle Parking Permit, issued by the City Manager or designee, which allows owners of oversized vehicles to park their oversized vehicle on the public street for up to 72 hours. 0 a r c m E r Q Packet Pg. 52 1 I 3.c I III. POLICY It is the declared policy of the City that the above stated provisions are enforced by the Sheriff's Department and other persons designated by the City Manager, such as Code Enforcement Officers and Parking Enforcement Officers. In addition, it is the declared policy of the City to address enforcement of the aforementioned provisions on a reactive or complaint basis unless an oversized vehicle poses an immediate risk to public health and safety. Oversized vehicle owners who fail to comply with the provisions of this policy shall be subject to citation and/or tow as outlined within Chapter 12.94 of the Santa Clarita Municipal Code. IV.
