Adopt the Santa Clarita Valley Sanitation District's resolutions approving and accepting the negotiated exchange of property tax revenues resulting from Santa Clarita Valley Sanitation District Annexation Nos. 1110, 1111, 1113, 1115, 1117, 1118, 1119, and 1120. 2. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval. BACKGROUND The Santa Clarita Valley Sanitation District (District), formerly known as County Sanitation District Nos. 26 and 32, provides wastewater treatment services within the District's service area. To provide wastewater treatment service to properties located outside the District's service area, the boundary must be expanded through the annexation process. As part of this process, a tax - sharing resolution to provide the required funding to the District is adopted by the public agency responsible for providing services to the subject property. Local agencies receiving an apportionment of the property tax from the annexing area, including cities and utility districts, must determine the percentage of tax revenues to be exchanged between the affected agencies. Listed below are the annual tax increment percentages attributable to the land area involved in the corresponding annexation and to be transferred to the District: 0.9532326% for Annexation No. 1110 Page 1 Packet Pg. 180 0.9641973% for Annexation No. 1111 0.9683037% for Annexation No. 1113 0.9981438% for Annexation No. 1115 for Tax Rate Area 00913 1.0101070% for Annexation No. 1115 for Tax Rate Area 15957 0.9485660% for Annexation No. 1117 0.9639333% for Annexation No. 1118 0.9532326% for Annexation No. 1119 0.9751865% for Annexation No. 1120 For this total, the City of Santa Clarita is contributing the following percentage of its revenues from the annual tax increment for this annexation area: For the City of Santa Clarita: Annexation No. 1110: .0985864% Annexation No. 1111: .1004021% Annexation No. 1113: .1002010% Annexation No. 1115: .0996427% for Tax Rate Area 00913 Annexation No. 1115: .1314778% for Tax Rate Area 15957 Annexation No. 1117: .0978548% Annexation No. 1118: .1004021% Annexation No. 1119: .0985864% Annexation No. 1120: .1004021% There is a separate tax -sharing resolution for Santa Clarita Library for each annexation. The following is the percentage of revenues from the annual tax increment for each annexation area: For the Santa Clarita Library: Annexation No. 1110: .0396553% Annexation No. 1111: .0384204% Annexation No. 1113: .0383927% Annexation No. 1115: .0395536% for Tax Rate Area 00913 Annexation No. 1115: .0395536% for Tax Rate Area 15957 Annexation No. 1117: .0401809% Annexation No. 1118: .0381587% Annexation No. 1119: .0396553% Annexation No. 1120: .0374022% There is a separate tax -sharing resolution for Santa Clarita Street Lighting Maintenance District No. 2 for two of the annexation areas. The following is the percentage of revenues from the annual tax increment for the area: For Santa Clarita Street Lighting Maintenance District: Annexation No. 1118: .0198211% Annexation No. 1120: .0361886% Page 2 Packet Pg. 181 The annexations consist of the following (see attached resolutions with corresponding maps): Annexation No. 1110 - One existing single-family home, located east of Sand Canyon Road at 16320 Lost Canyon Road. Annexation No. 1111 - One existing single-family home, located at 15949 Live Oak Springs Canyon Road. Annexation No. 1113 - 84 proposed apartments, located west of Sierra Highway and north of Eternal Valley. Annexation No. 1115 - 195 proposed single-family homes and 170 proposed condominiums, located on Bouquet Canyon Road, north of Plum Canyon Road. Annexation No. 1117 - One existing single-family home, located at 18009 Beneda Lane. Annexation No. 1118 - One existing medical clinic, identified by APN 2839-019-021, and is located at 17970 Sierra Highway. Annexation No. 1119 - One existing office building, identified by APNs 2839-014-032, -032. -033, and is located southeast of the intersection of Sierra Highway and Sierra Cross Avenue. Annexation No. 1120 - One proposed mix -use commercial development, identified by APNs 2834-021-134, 2834-022-067, 2834-001-007, and is located north of 12th Street and west of Alderbrook Drive. ALTERNATIVE ACTION Other action as determined by the City Council. FISCAL IMPACT As proposed, the annexations to Santa Clarita Valley Sanitation District should result in no adverse fiscal impact to the City. "ANNEXATION NO. 1110" WHEREAS, pursuant to Section 99 and 99.01 of the Revenue and Taxation Code, prior to the effective date of any jurisdictional change which will result in a special district providing a new service, the governing bodies of all local agencies that receive an apportionment of the property tax from the area must determine the amount of property tax revenues from the annual tax increment to be exchanged between the affected agencies and approve and accept the negotiated exchange of property tax revenues by resolution; and WHEREAS , the governing bodies of the agencies signatory hereto have made determinations of the amount of property tax revenues from the annual tax increments to be exchanged as a result of the annexation to Santa Clarita Valley Sanitation District entitled Annexation No. 1110; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: I . The negotiated exchange of property tax revenues resulting from the annexation of territory to Santa Clarita Valley Sanitation District in the annexation entitled Annexation No. 1110 is approved and accepted. 2. For each fiscal year commencing on and after July 1, 2022, or after the effective date of this jurisdictional change, whichever is later, the County Auditor shall transfer to Santa Clarita Valley Sanitation District a total of 0.9532326 percent of the annual tax increment attributable to the land area encompassed within Annexation No. 1110 as shown on the attached Worksheet. 3. No additional transfer of property tax revenues shall be made from any other tax agencies to Santa Clarita Valley Sanitation District as a result of annexation entitled Annexation No. 1110. No transfer of property tax increments from properties within a community redevelopment project, which are legally committed to a Community Redevelopment Agency, shall be made during the period that such tax increment is legally committed for repayment of the redevelopment project costs. 5. If at any time after the effective date of this resolution, the calculations used herein to determine initial property tax transfers or the data used to perform those calculations are found to be incorrect thus producing an improper or inaccurate property tax transfer, the property tax transfer shall be recalculated and the corrected transfer shall be implemented for the next fiscal year. The foregoing resolution was adopted by the Board of Supervisors of the County of Los Angeles, the Board of Directors of Santa Clarita Valley Sanitation District of Los Angeles County, and the governing bodies of Greater Los Angeles County Vector Control District, Antelope Valley Resource Conservation District, City of Santa Clarita, Santa Clarita Library, and Santa Clarita Valley Water Agency, signatory hereto. "ANNEXATION NO. 1111" WHEREAS, pursuant to Section 99 and 99.01 of the Revenue and Taxation Code, prior to the effective date of any jurisdictional change which will result in a special district providing a new service, the governing bodies of all local agencies that receive an apportionment of the property tax from the area must determine the amount of property tax revenues from the annual tax increment to be exchanged between the affected agencies and approve and accept the negotiated exchange of property tax revenues by resolution; and WHEREAS, the governing bodies of the agencies signatory hereto have made determinations of the amount of property tax revenues from the annual tax increments to be exchanged as a result of the annexation to Santa Clarita Valley Sanitation District entitled Annexation No. 1111; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The negotiated exchange of property tax revenues resulting from the annexation of territory to Santa Clarita Valley Sanitation District in the annexation entitled Annexation No. III I is approved and accepted. 2. For each fiscal year commencing on and after July 1, 2022, or after the effective date of this jurisdictional change, whichever is later, the County Auditor shall transfer to Santa Clarita Valley Sanitation District a total of 0.9641973 percent of the annual tax increment attributable to the land area encompassed within Annexation No. 1111 as shown on the attached Worksheet. 3. No additional transfer of property tax revenues shall be made from any other tax agencies to Santa Clarita Valley Sanitation District as a result of annexation entitled Annexation No. I111. Packet Pg. 194 13.c 4. No transfer of property tax increments from properties within a community redevelopment project, which are legally committed to a Community Redevelopment Agency, shall be made during the period that such tax increment is legally committed for repayment of the redevelopment project costs. 5. If at any time after the effective date of this resolution, the calculations used herein to determine initial property tax transfers or the data used to perform those calculations are found to be incorrect thus producing an improper or inaccurate property tax transfer, the property tax transfer shall be recalculated and the corrected transfer shall be implemented for the next fiscal year. "ANNEXATION NO. 1113" WHEREAS, pursuant to Section 99 and 99.01 of the Revenue and Taxation Code, prior to the effective date of any jurisdictional change which will result in a special district providing a new service, the governing bodies of all local agencies that receive an apportionment of the property tax from the area must determine the amount of property tax revenues from the annual tax increment to be exchanged between the affected agencies and approve and accept the negotiated exchange of property tax revenues by resolution; and WHEREAS , the governing bodies of the agencies signatory hereto have made determinations of the amount of property tax revenues from the annual tax increments to be exchanged as a result of the annexation to Santa Clarita Valley Sanitation District entitled Annexation No. 1113; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The negotiated exchange of property tax revenues resulting from the annexation of territory to Santa Clarita Valley Sanitation District in the annexation entitled Annexation No. 1113 is approved and accepted. 2. For each fiscal year commencing on and after July 1, 2022 or after the effective date of this jurisdictional change, whichever is later, the County Auditor shall transfer to Santa Clarita Valley Sanitation District a total of 0.9683037 percent of the annual tax increment attributable to the land area encompassed within Annexation No. 1113 as shown on the attached Worksheet. 3. No additional transfer of property tax revenues shall be made from any other tax agencies to Santa Clarita Valley Sanitation District as a result of annexation entitled Annexation No. 1113. No transfer of property tax increments from properties within a community redevelopment project, which are legally committed to a Community Redevelopment Agency, shall be made during the period that such tax increment is legally committed for repayment of the redevelopment project costs. 5. If at any time after the effective date of this resolution, the calculations used herein to determine initial property tax transfers or the data used to perform those calculations are found to be incorrect thus producing an improper or inaccurate property tax transfer, the property tax transfer shall be recalculated and the corrected transfer shall be implemented for the next fiscal year. "ANNEXATION NO. 1115" WHEREAS, pursuant to Section 99 and 99.01 of the Revenue and Taxation Code, prior to the effective date of any jurisdictional change which will result in a special district providing a new service, the governing bodies of all local agencies that receive an apportionment of the property tax from the area must determine the amount of property tax revenues from the annual tax increment to be exchanged between the affected agencies and approve and accept the negotiated exchange of property tax revenues by resolution; and WHEREAS , the governing bodies of the agencies signatory hereto have made determinations of the amount of property tax revenues from the annual tax increments to be exchanged as a result of the annexation to Santa Clarita Valley Sanitation District entitled Annexation No. 1115; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The negotiated exchange of property tax revenues resulting from the annexation of territory to Santa Clarita Valley Sanitation District in the annexation entitled Annexation No. 1115 is approved and accepted. 2. For each fiscal year commencing on and after July 1, 2022 or after the effective date of this jurisdictional change, whichever is later, the County Auditor shall transfer to Santa Clarita Valley Sanitation District a total of 0.9981438 percent of the annual tax increment attributable to the land area encompassed within Annexation No. 1115 for Tax Rate Area 00913 as shown on the attached Worksheet. 3. For each fiscal year commencing on and after July 1, 2022 or after the effective date of this jurisdictional change, whichever is later, the County Auditor shall transfer to Santa Clarita Valley Sanitation District a total of 1.0101070 percent of the annual tax increment attributable to the land area encompassed within Annexation No. 1115 for Tax Rate Area 15957 as shown on the attached Worksheet. No additional transfer of property tax revenues shall be made from any other tax agencies to Santa Clarita Valley Sanitation District as a result of annexation entitled Annexation No. 1115. 5. No transfer of property tax increments from properties within a community redevelopment project, which are legally committed to a Community Redevelopment Agency, shall be made during the period that such tax increment is legally committed for repayment of the redevelopment project costs. 6. If at any time after the effective date of this resolution, the calculations used herein to determine initial property tax transfers or the data used to perform those calculations are found to be incorrect thus producing an improper or inaccurate property tax transfer, the property tax transfer shall be recalculated and the corrected transfer shall be implemented for the next fiscal year. The negotiated exchange of property tax revenues resulting from the annexation of territory to Santa Clarita Valley Sanitation District in the annexation entitled Annexation No. 1117 is approved and accepted. 2. For each fiscal year commencing on and after July 1, 2022, or after tine effective date of this jurisdictional change, whichever is later, the County Auditor shall transfer to Santa Clarita Valley Sanitation District a total of 0.9485660 percent of the annual tax increment attributable to the land area encompassed within Annexation No. 1117 as shown on the attached Worksheet. 3. No additional transfer of property tax revenues shall be made from any other tax agencies to Santa Clarita Valley Sanitation District as a result of annexation entitled Annexation No. 1117. No transfer of property tax increments from properties within a community redevelopment project, which are legally committed to a Community Redevelopment Agency, shall be made during the period that such tax increment is legally committed for repayment of the redevelopment project costs. 5. if at any time after the effective date of this resolution, the calculations used herein to determine initial property tax transfers or the data used to perform those calculations are found to be incorrect thus producing an improper or inaccurate property tax transfer, the property tax transfer shall be recalculated and the corrected transfer shall be implemented for the next fiscal year. "ANNEXATION NO. 1118" WHEREAS, pursuant to Section 99 and 99.01 of the Revenue and Taxation Code, prior to the effective date of any jurisdictional change which will result in a special district providing a new service, the governing bodies of all local agencies that receive an apportionment of the property tax from the area must determine the amount of property tax revenues from the annual tax increment to be exchanged between the affected agencies and approve and accept the negotiated exchange of property tax revenues by resolution; and WHEREAS , the governing bodies of the agencies signatory hereto have made deterininations of the amount of property tax revenues from the annual tax increments to be exchanged as a result of the annexation to Santa Clarita Valley Sanitation District entitled Annexation No. 1118; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: l . The negotiated exchange of property tax revenues resulting from the annexation of territory to Santa Clarita Valley Sanitation District in the annexation entitled Annexation No. 1118 is approved and accepted. 2. For each fiscal year commencing on and after July 1, 2022, or after the effective date of this jurisdictional change, whichever is later, the County Auditor shall transfer to Santa Clarita Valley Sanitation District a total of 0.9639333 percent of the annual tax increment attributable to the land area encompassed within Annexation No. 1118 as shown on the attached Worksheet. 00 Packet Pg. 238 13.k 3. No additional transfer of property tax revenues shall be made from any other tax agencies to Santa Clarita Valley Sanitation District as a result of annexation entitled Annexation No. 1118. 4. No transfer of property tax increments from properties within a convnunity redevelopment project, which are legally committed to a Community Redevelopment Agency, shall be made during the period that such tax increment is legally committed for repayment of the redevelopment project costs. 5. If at any time after the effective date of this resolution, the calculations used herein to determine initial property tax transfers or the data used to perform those calculations are found to be incorrect thus producing an improper or inaccurate property tax transfer, the property tax transfer shall be recalculated and the corrected transfer shall be implemented for the next fiscal year. "ANNEXATION NO. 1118" WHEREAS, pursuant to Section 99 and 99.01 of the Revenue and Taxation Code, prior to the effective date of any jurisdictional change which will result in a special district providing a new service, the governing bodies of all local agencies that receive an apportionment of the property tax from the area must determine the amount of property tax revenues from the annual tax increment to be exchanged between the affected agencies and approve and accept the negotiated exchange of property tax revenues by resolution; and WHEREAS , the governing bodies of the agencies signatory hereto have made determinations of the amount of property tax revenues from the annual tax increments to be exchanged as a result of the annexation to Santa Clarita Valley Sanitation District entitled Annexation No. 1118; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The negotiated exchange of.property tax revenues resulting from the annexation of territory to Santa Clarita Valley Sanitation District in the annexation entitled Annexation No. 1118 is approved and accepted. 2. For each fiscal year commencing on and after July 1, 2022, or after the effective date of this jurisdictional change, whichever is later, the County Auditor shall transfer to Santa Clarita Valley Sanitation District a total of 0.9639333 percent of the annual tax increment attributable to the land area encompassed within Annexation No. 1118 as shown on the attached Worksheet. No additional transfer of property tax revenues shall be made from any other tax agencies to Santa Clarita Valley Sanitation District as a result of annexation entitled Annexation No. 1118. 4. No transfer of property tax increments from properties within a community redevelopment project, which are legally committed to a Community Redevelopment Agency, shall be made during the period that such tax increment is legally committed for repayment of the redevelopment project costs. 5. If at any time after the effective date of this resolution, the calculations used herein to determine initial property tax transfers or the data used to perform those calculations are found to be incorrect thus producing an improper or inaccurate property tax transfer, the property tax transfer shall be recalculated and the corrected transfer shall be implemented for the next fiscal year. "ANNEXATION NO. 1119" WHEREAS, pursuant to Section 99 and 99.01 of the Revenue and Taxation Code, prior to the effective date of any jurisdictional change which will result in a special district providing a new service, the governing bodies of all local agencies that receive an apportionment of the property tax from the area must determine the amount of property tax revenues from the annual tax increment to be exchanged between the affected agencies and approve and accept the negotiated exchange of property tax revenues by resolution; and WHEREAS , the governing bodies of the agencies signatory hereto have made determinations of the amount of property tax revenues from the annual tax increments to be exchanged as a result of the annexation to Santa Clarita Valley Sanitation District entitled Annexation No. 1119; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The negotiated exchange of property tax revenues resulting from the annexation of territory to Santa Clarita Valley Sanitation District in the annexation entitled Annexation No. 1119 is approved and accepted. 2. For each fiscal year commencing on and after July 1, 2022, or after- the effective date of this jurisdictional change, whichever is later, the County Auditor shall transfer to Santa Clarita Valley Sanitation District a total of 0.9532326 percent of the annual tax increment attributable to the land area encompassed within Annexation No. 1119 as shown on the attached Worksheet. 3. No additional transfer of property tax revenues shall be made from any other tax agencies to Santa Clarita Valley Sanitation District as a result of annexation entitled Annexation No. 1119. No transfer of property tax increments from properties within a community redevelopment project, which are legally committed to a Community Redevelopment Agency, shall be made during the period that such tax increment is legally committed for repayment of the redevelopment project costs. 5. If at any time after the effective date of this resolution, the calculations used herein to determine initial property tax transfers or the data used to perform those calculations are found to be incorrect thus producing an improper or inaccurate property tax transfer, the property tax transfer shall be recalculated and the corrected transfer shall be implemented for the next fiscal year. "ANNEXATION NO. 1120" WHEREAS, pursuant to Section 99 and 99.01 of the Revenue and Taxation Code, prior to the effective date of any jurisdictional change which will result in a special district providing a new service, the governing bodies of all local agencies that receive an apportionment of the property tax from the area must determine the amount of property tax revenues from the annual tax increment to be exchanged between the affected agencies and approve and accept the negotiated exchange of property tax revenues by resolution; and WHEREAS , the governing bodies of the agencies signatory hereto have made determinations of the amount of property tax revenues from the annual tax increments to be exchanged as a result of the annexation to Santa Clarita Valley Sanitation District entitled Annexation No. 1120; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The negotiated exchange of property tax revenues resulting from the annexation of territory to Santa Clarita Valley Sanitation District in the annexation entitled Annexation No. 1120 is approved and accepted. 2. For each fiscal year commencing on and after July 1, 2022 or after the effective date of this jurisdictional change, whichever is later, the County Auditor shall transfer to Santa Clarita Valley Sanitation District a total of 0.9751865 percent of the annual tax increment attributable to the land area encompassed within Annexation No. 1120 as shown on the attached Worksheet. 3. No additional transfer of property tax revenues shall be made from any other tax agencies to Santa Clarita Valley Sanitation District as a result of annexation entitled Annexation No. 1120. No transfer of property tax increments from properties within a community redevelopment project, which are legally committed to a Community Redevelopment Agency, shall be made during the period that such tax increment is legally committed for repayment of the redevelopment project costs. 5. If at any time after the effective date of this resolution, the calculations used herein to determine initial property tax transfers or the data used to perform those calculations are found to be incorrect thus producing an improper or inaccurate property tax transfer, the property tax transfer shall be recalculated and the corrected transfer shall be implemented for the next fiscal year.
