CITY OF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR 14) CITY MANAGER APPROVAL: ' DATE: May 23, 2023 SUBJECT: RESOLUTION AUTHORIZING THE APPLICATION FOR THE LAND AND WATER CONSERVATION FUND GRANT-IN-AID PROGRAM DEPARTMENT: Public Works PRESENTER: Melody Bartlette RECOMMENDED ACTION City Council: 1. Adopt a resolution authorizing the City Manager or designee to submit an application for the Land and Water Conservation Act Grant -In -Aid Program for the Via Princessa Park project. 2. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval. BACKGROUND The Land and Water Conservation Fund (LWCF) was established by Congress in 1964 to safeguard natural areas, water resources, cultural heritage, and to provide recreation opportunities to all. In 2020, the Great American Outdoors Act was signed into law, authorizing $900 million annually in permanent funding for LWCF. The LWCF provides competitive grants to states for local preservation and recreation projects, along with a federal portion to acquire land and water for public recreation or cultural resource preservation. The California Department of Parks and Recreation administers these funds for the State and provides grants through the Office of Grants and Local Services (OGALS). The LWCF Grant -In -Aid Program (LWCF Program) is a funding opportunity available to all local governments in the State of California and is awarded through a competitive program. The LWCF Program seeks applications that develop public outdoor recreation facilities and improve the quality of life and vitality of its users. The OGALS evaluates applications, and, if selected, National Parks Service provides approval to award the funds with a maximum grant request of 50 percent of the total project cost. Local agencies who receive LWCF grants pay for the cost to Page 1 Packet Pg. 40 O construct the project upfront and are then reimbursed for half of the construction cost of the awarded scope of work. Additionally, once a LWCF Program project is complete, the property is placed under federal protection to preserve outdoor recreational use in perpetuity. As part of the LWCF Program application process, the City of Santa Clarita (City) must obtain authorization from City Council in the form of a signed resolution. The authorizing resolution certifies the City will abide by the terms and conditions of the grant funds and delegates authority to the City Manager or designee to execute all necessary program documentation. The City has identified the Via Princessa Park project as an appropriate submission and, if awarded, is eligible to receive up to $6 million through the LWCF Program. ALTERNATIVE ACTION Other action as determined by the City Council. FISCAL IMPACT There is no fiscal impact from this action. If an application for grant funding is approved, staff will return to the City Council to appropriate the funding and for the required expenditure authority. ATTACHMENTS Resolution Page 2 Packet Pg. 41 7.a RESOLUTION NO. 23- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, APPROVING THE APPLICATION FOR THE LAND AND WATER CONSERVATION GRANT FUNDS WHEREAS, the Congress, under Public Law 88-578, has authorized the establishment of a federal Land and Water Conservation Fund Grant -In -Aid program, providing matching funds to the State of California and its political subdivisions for acquiring lands and developing Facilities for public outdoor recreation purposes; and WHEREAS, the California Department of Parks and Recreation is responsible for the administration of the program in the State, setting up necessary rules and procedures governing applications by local agencies under the program; and WHEREAS, the applicant certifies by resolution the approval of the application and the availability of eligible matching funds prior to submission of said application to the State; and WHEREAS, the grantee will contract with the State of California Department of Parks and Recreation to complete the project scope funded by the Land and Water Conservation Grant - In -Aid program. NOW, THEREFORE, the City Council of the City of Santa Clarita, California, does hereby resolve as follows: SECTION 1. Approves the filing of an application for Land and Water Conservation Fund assistance for the proposed Via Princessa Park; and SECTION 2. Certifies that the applicant has reviewed, understands, and agrees to the General Provisions contained in the contract shown in the Grant Administration Guide; and SECTION 3. Agrees to abide by 54 U. S.C. §200305(f)(3) which requires, "No property acquired or developed with assistance under this section shall, without the approval of the Secretary, be converted to other than public outdoor recreation use. The Secretary shall approve a conversion only if the Secretary finds it to be in accordance with the then -existing comprehensive statewide outdoor recreation plan and only on such conditions as the Secretary considers necessary to ensure the substitution of other recreation properties of at least equal fair market value and of reasonably equivalent usefulness and location." and SECTION 4. Certifies that said agency has matching funds from eligible source(s) and can finance 100 percent of the project scope identified in the grant application, of which up to half may be reimbursed; and SECTION 5. Certifies that all projects proposed will be consistent with the park and recreation element of the City of Santa Clarita general or recreation plan (PRC §80063(a)); and Page 1 of 2 Packet Pg. 42 7.a SECTION 6. Agrees to comply with all applicable federal, state, and local laws, ordinances, rules, regulations, and guidelines; and SECTION 7. Delegates the authority to the City Manager, or designee, to conduct all negotiations and execute and submit all documents, including, but not limited to, applications, contracts, amendments, payment requests, and compliance with all applicable current state and federal laws which may be necessary for the completion of the grant scope.
