BACKGROUND The City of Santa Clarita's (City) Director of Emergency Services (City Manager) proclaimed a local emergency within the City on October 10, 2023. Per Chapter 2.40 of the Santa Clarita Municipal Code, Ordinance No. 89-6, whenever a local emergency is proclaimed by the City Manager, the City Council should take action to ratify the proclamation. On October 24, 2023, the City Council adopted Resolution No. 23-83, which ratified the City strike by the , in accordance with state and local municipal codes. In correlation with the emergency declaration, the City Manager entered into emergency contracts with Transit Systems Unlimited, Inc., and Silver Ride, Inc., to provide critical services, including Access Services (ADA), Dial-A-Ride, school transportation, and select local routes. On December 3, 2023, the Union voted to approve a proposal submitted by MV Transportation, resulting in a four-year labor agreement and officially ending the strike. The bus drivers, dispatchers, mechanics, and call center staff returned to work on December 4, 2023. As a result, the contracts with Transit System Unlimited, Inc., and Silver Ride, Inc., were terminated and MV Transportation resumed normally scheduled transit operations on Monday, December 4, 2023. FISCAL IMPACT There is no fiscal impact as a result of adopting this resolution. ATTACHMENTS Resolution - Terminating State of Emergency Page 2 Qbdlfu!Qh/!73 8/b RESOLUTION NO. 23-_ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, TERMINATING THE CITY MANAGER'S PROCLAMATION OF EXISTENCE OF A LOCAL EMERGENCY IN ACCORDANCE WITH THE CALIFORNIA GOVERNMENT CODE AND SANTA CLARITA MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1: The City Council finds as follows: A. The City of Santa Clarita (City) provides public transportation services for persons , including those who are elderly, disabled, or otherwise require Transportation. B. The City itself neither employs nor supervises such drivers; they are solely MV employees and not public employees. MV employs drivers who are members of the Local 572 bargaining efforts ending the labor strike that began October 9, 2023. C. Providing Public Transportation is a significant part of protecting public health and as contemplated by both Government Code § 8558(c)(1) and Santa Clarita Mun personnel, equipment, and facilities. Moreover, this condition does not arise from a labor controversy between the City or any of its employees; it is a failure to perform a Public Transportation agreement by MV. D. On October 10 and October 17, 2023, the City Manager declared the existence of a local emergency. E. SCMC § 2.40.060 provides that in the event of an emergency, the City Manager may rces for the preservation of life and property and to reduce the effects of Unlimited to provide Public Transportation services during, and until the cessation of, failure to perform its contract. F. CA Government Code § 8630 and SCMC § 2.40.060 require that the City Council take action to ratify the local emergency. On October 24, 2023, the City Council adopted Resolution 23-83 which ratified the local emergency. Accordingly, the City Council ratifies and reaffirms the exercise of emergency powers undertaken by the City Manager since October 10, 2023, including, without limitation, executing Agreement No. 0CA6DE0C-902E-41BB-B456-0F53F2DD8FBD with SilverRide, Inc., for emergency Dial-A- Ride services. SECTION 3: The local emergency caused by the bus drivers strike is terminated. SECTION 4: Severability. If any part of this resolution or its application is deemed invalid by a court of competent jurisdiction, the City Council intends that such invalidity will not affect the effectiveness of the remaining provisions or applications, and to this end, the provisions of this resolution are severable. SECTION 5: Electronic Signatures. This resolution may be executed with electronic signatures in accordance with CA Government Code § 16.5. Such electronic signatures will be treated in all respects as having the same effect as an original signature. SECTION 6: Recordation. The Mayor, or presiding officer, is authorized to sign this resolution signifying its adoption by the City Council of the City of Santa Clarita and the City Clerk, or her duly appointed deputy, may attest thereto. SECTION 7: Effective Date.
