HomeMy WebLinkAbout2024-11-26 - RESOLUTIONS - AMEND EASTSIDE B&TDIST CONST FEEPER RESOLUTION NO. 24-72 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, APPROVING AMENDMENTS TO THE EASTSIDE BRIDGE AND MAJOR THOROUGHFARE CONSTRUCTION FEE DISTRICT WHEREAS, the City of Santa Clarita is authorized to enact and impose fees as a condition of approval of new development to defray the fairly allocated actual or estimated costs of constructing bridges and major thoroughfares, as set forth in Government Code Section 66484 and Santa Clarita Municipal Code Section 17.51.010(D); and WHEREAS, on March 26, 2002, the City Council adopted the Eastside Bridge and Major Thoroughfare Construction Fee District (Eastside District) which establishes the amount of "District Fees" that are required to be paid by new development within the "District Boundaries"; and , WHEREAS, the Eastside Bridge and Major Thoroughfare District was developed to provide an equitable financing mechanism for the new development to pay a fee based on the fairly allocated costs of providing the necessary roadway improvements that benefit new development. This type of funding district imposes a fee in proportion to the estimated number am of vehicle trips generated by the new development; and WHEREAS, the fees currently collected are not sufficient to construct the portion of highway improvements identified in the Circulation Element of the City's General Plan as providing a benefit to new development within the District Boundaries; and WHEREAS, the City directed the preparation of the Eastside Bridge and Major Thoroughfare Construction Fee District Update Report, dated November 2024 (Eastside District Update Report) incorporated herein by reference, to document the costs to fully improve those major roadways identified in the City's and County's Circulation Elements that provide a benefit to new development within the District Boundaries, including bridges, intersections, and interchanges; and WHEREAS, the total estimated cost for Eastside District improvements as identified in the Eastside District Update Report is $228,897,247; and WHEREAS, Eastside District Update Report documents the basis for including an annual adjustment "inflation factor" to keep pace with fluctuations in construction costs based on the Los Angeles Regional Construction Cost Index, subject to a 5 percent cap of any annual increase or decrease; and WHEREAS, proceedings have been instituted for these improvements under Section "` 17.5 1.01 O(D), Major Thoroughfare and Bridge Fees, of the Zoning Code of the City of Santa Clarita, California; and Page 1 of 5 WHEREAS, the Eastside District Update Report by the City Engineer identifies the boundaries of the District, the improvements to be built, the estimated costs, the method of apportioning costs to the area of benefit, and other applicable information. The Eastside District Update Report has been filed with the City Clerk of the City of Santa Clarita; and WHEREAS, the formation of the Eastside District was a joint effort between the City of Santa Clarita and the County of Los Angeles; and WHEREAS, a portion of the property included within the Eastside District boundaries is within the City of Santa Clarita and a portion is within the unincorporated area of the County of Los Angeles; and WHEREAS, the formation of the Eastside District required mutual consent of the governing boards of the City and County; and WHEREAS, the Eastside District Update Report has been presented to and duly considered by the City Council on the 26 h day of November 2024; and WHEREAS, it has been determined that the establishment of the District Fee pursuant to this resolution does not constitute a "project" as defined in the California Environmental Quality Act (CEQA) guideline 15378(b)(4), in that the District Fee establishment is a financing mechanism that does not involve any commitment to any specific project that may result in a potentially significant impact on the environment; and WHEREAS, there is an identified need for the additional improvements identified in the Eastside District Update Report to serve the circulation needs of new development expected in the area of benefit; and WHEREAS, the improvements, including roads and bridges listed in the Eastside District Update Report are identified in the Circulation Element of the General Plan of the City of Santa Clarita; and WHEREAS, any future subdivision within the Eastside District will benefit from these improvements; and WHEREAS, the fees authorized by this resolution, as identified on Exhibit "A," are based on estimated impacts per unit of development for residential land uses and estimated impacts per gross acreage of development for nonresidential land uses, and they are not based on square footage of each unit. The square footage is not an appropriate metric to calculate the District Fees for the reasons summarized in the Eastside District Update Report. The fees are calculated for each land use category based on the proportionate impact of the estimated peak - hour vehicle trips on the system as identified in the Los Angeles County Circulation Plan and the City of Santa Clarita Circulation Element. Therefore, the District Update Report documents the reasonable relationship between the Eastside District fees charged, and the proportionate burden imposed by each land use category of new development on the improvements to be funded as a part of the Eastside District. The reasonable relationship is based on the estimated number of Page 2 of 5 on" vehicle trips generated by each land use category as summarized on Exhibit "A" of the District Update Report. The traffic model used as the basis for the City and County's circulation elements for this area does not factor in residential square footage to determine peak hour trips, but instead estimates trips on the type of residential unit and the land use category of nonresidential development. Since Government Code Section 66484 authorizes the City and County to impose the District Fees as a condition of approval of a final map, the agencies will not have adequate information at that stage to determine the square footage of proposed residential units; and WHEREAS, a public hearing in compliance with the State Subdivision Map Act has been held on November 26, 2024, requesting written and oral comments; and WHEREAS, such comments did not constitute a majority protest of landowners in the area of benefit, as defined by Government Code Section 66484(c). NOW THEREFORE, the City Council of the City of Santa Clarita, California, does hereby resolve as follows: SECTION 1. For the Eastside Bridge and Major Thoroughfare Construction Fee District (Eastside District), the City Council hereby approves the Eastside Bridge and Major Thoroughfare Construction Fee District Update Report, dated November 2024 (Eastside District Update Report) and its documentation of: (a) the boundaries of the area of benefit, particularly as identified on '� Figure 1 and Attachment A; (b) the description and costs of the improvements to be funded by Eastside District fees; and (c) the method of fee apportionment to fairly allocate costs to new development within the area of benefit of the Eastside District. SECTION 2. The City Council hereby approves the fees for the Eastside District as set forth on Exhibit "A." The City Manager (including a duly authorized designee) shall calculate and impose the fees on new development within the Eastside District area of benefit in accordance with the parameters set forth in the Eastside District Update Report, subject to the requirements of state law including Government Code Section 66484, and subject to Santa Clarita Municipal Code Section 17.51.010(D). In particular, the City Manager will, in accordance with the parameters identified in the Eastside District Update Report: (a) make a written determination of the amount and effective date of any annual adjustment to fee amounts based on the Construction Cost Index; (b) make a written determination that a project is authorized to construct improvements in lieu of paying fees or receive a credit award or cash reimbursement (per Eastside District Update Report sections IV(G) and IV(H)); arid.{c) make a written determination of the fee amount owed for any development project that isa "vial Case", as identified in the Eastside District Update Report (section IV(F))Jf the City -,manager determines that a particular development project is a "Special Case" and Foes nQt111intodie of the land use categories set forth on Exhibit "A," a special fee calculation will bk xerfarmezl to ensure the fee amount is reasonably related to the impacts of any projet: L1ev_elopment 0r6jects that include accessory dwelling units (under Government Code Section G•6324); or hou-sing On, development within a transit priority area or within one-half mile of a conve°niertee retail store (under Government Code Section 66005.1), will be considered non -typical "Special Case" land Page 3 of 5 uses due to a lesser impact on the transportation systems funded by the District Fee, and those one uses will be the subject of a special fee calculation. SECTION 3. Revenue received by the City pursuant to this resolution will be used solely for the purposes identified in the Eastside District Update Report, to fund the designated improvements. SECTION 4. That the Eastside District was formed with the mutual consent of the City of Santa Clarita and the County of Los Angeles, and thereby will become effective only upon approval by the governing boards of each political entity. SECTION 5. That the Eastside District was formed in conformance with Section 17.51.010(D) of the Zoning Code of the City of Santa Clarita and Government Code Section 66484 of the State Subdivision Map Act. SECTION 6. The City Council hereby finds that the facts set forth in the recitals to this resolution are true and correct and establish the factual basis for the City Council's adoption of this resolution. SECTION 7. That the proposed fee rates will become effective 90 days after approval from both governing bodies of the City of Santa Clarita and County of Los Angeles. SECTION 8. That the City Clerk of the City of Santa Clarita is hereby directed to record 00. the adopted Resolution with the County Recorder. SECTION 9.
