SUBJECT: SANTA CLARITA DISTRICT 3 GENERAL MUNICIPAL ELECTION

RECOMMENDED ACTION
City Council receive presentation and determine whether to move forward with the election for
District 3 with only one candidate listed on the ballot, or adopt a resolution canceling the election
for District 3 and appointing Jason Gibbs, the sole nominee for District 3, to the four-year
District 3 Council seat term which begins in December 2024 with an estimated cost savings of
$120,000 for the City.
BACKGROUND
At the close of the nomination period on August 9, 2024, at 5:00 p.m., there were no more
candidates than District 3 offices to be elected on the November 5, 2024, General Municipal
Election ballot.
Pursuant to Elections Code § 10229, on August 14, 2024, a "Notice That There Are Not More
Candidates Than Offices To Be Elected," was published in The Signal, a newspaper of general
circulation, and La Opinion. The notice was also posted on the City website, all three Santa
Clarita libraries, and at City Hall, in both English and Spanish languages.
The California Elections Code sets forth provisions to cancel an election and appoint the
person nominated to the office when the number of nominees is equal to the number of
offices to be filled at the election. When Santa Clarita's nomination period closed on
Friday, August 9, 2024, at 5:00 p.m., there was one qualified candidate for the
District 3 Councilmember office: Jason Gibbs.
One of the following courses of action may be taken by the City Council, pursuant to
Elections Code § 10229:

1) Appoint to the office the person who has been nominated
2) Appoint to the office any eligible elector if no one has been nominated
3) Hold the election if either no one or only one person was nominated
Should the City Council appoint the nominee to office, the attached resolution may be adopted to
confirm the appointment and cancel the election; the nominee would take office and serve
exactly as if elected at a municipal election; and the term of appointment for the four-year term
would begin December 2024. Cancellation of the District 3 election will result in approximately
$120,000 savings in elections costs otherwise payable to the County of Los Angeles.
If the City Council does not vote to appoint the nominee by August 22, 2024, the election for the
District 3 office will be held.
ALTERNATIVE ACTION
No actions other than those outlined in the report have been identified by staff.
FISCAL IMPACT
Adequate funds have previously been appropriated as part of the Fiscal Year 2024-25 budget to
conduct the November 5, 2024, General Municipal Election; however, should the City Council
appoint the nominee to office and cancel that election, the budget will be reduced accordingly.

THAN OFFICES TO BE ELECTED
NOTICE IS HEREBY GIVEN that pursuant to Section 10229 of the Elections Code of the State of
California relating to the General Municipal Election in the City of Santa Clarita to be held on Tuesday,
November 5, 2024, as of the close of the nomination period on August 9, 2024, there are not more
candidates than the following offices to be elected.
City of Santa Clarita, One (1) Member of the City Council - District 3, Full Term of Four Years
The person so nominated is Jason Gibbs.
Section 10229 of the Elections Code allows one of the following courses of action to be taken by the City
Council:
1) Appoint to the office the person who has been nominated.
2) Appoint to the office an eligible elector if no one has been nominated.
3) Hold the election if either no one or only one person has been nominated.
The City Council will meet on August 19, 2024, to either make the appointment or direct an election to be
held. The person appointed, if any, shall qualify and take office and serve exactly as if elected at a
municipal election for the office.
If, by the 75th day before the municipal election (August 22, 2024), no person has been appointed to the
office pursuant to (1) or (2) above, the election shall be held.
If the City Council makes an appointment pursuant to Section 10229 of the Elections Code, the City
Clerk shall not accept for filing any statement of write-in candidacy which is submitted after the
appointment is made.

QUE CARGOS A ELEGIR
POR MEDIO DEL PRESENTE SE COMUNICA que, de conformidad con el articulo 10229 del Codigo
Electoral del Estado de California en relacion con la eleccion municipal general en la ciudad de Santa
Clarita que se celebrara el martes 5 de noviembre de 2024, al cierre del periodo de presentacion de
candidaturas el 9 de agosto de 2024, no hay mas candidatos que los siguientes cargos a elegir.
Ciudad de Santa Clarita, Un (1) Miembro del Concejo Municipal - Distrito 3, Mandato Completo
de Cuatro Anos
La persona nominada es Jason Gibbs.
En virtud del articulo 10229 del Codigo Electoral, el Concejo Municipal puede tomar una de las
siguientes medidas:
1) Designar a la persona nominada para el cargo.
2) Designar a un elector que reuna los requisitos para el cargo, si no se ha nommado a nadie.
3) Celebrar la eleccion si ninguna o solo una persona fue nominada.
El Concejo Municipal se reunira el 19 de agosto de 2024 para realizar el nombramiento o para ordenar
que se celebre una eleccion. La persona designada, si la hubiera, debera reunir los requisitos necesarios y
ocupar el cargo y desempefiarse en el mismo del igual modo que si hubiera resultado electa para el.
Si para el dia numero 75 antes de la eleccion municipal (22 de agosto de 2024) no se ha designado a nadie
para el cargo segun to establecido en los parrafos (1) o (2) precedentes, se llevara a cabo la eleccion.
Si el Concejo Municipal realiza un nombramiento en virtud del articulo 10229 del Codigo Electoral, la
Secretaria Municipal no aceptara la presentacion de declaraciones de candidaturas que no figuren en la
boleta pero por la cual se pueda votar escribiendo el nombre (write-in) que se presenten tras el
nombramiento.

WHEREAS, pursuant to Section 10229 of the Elections Code of the State of California, m
as of the close of the nomination period on August 9, 2024, there are not more candidates than
offices to be elected and that Section 10229 of the Elections Code allows one of the following z
courses of action to be taken by the City Council:
1) Appoint to the office the person who has been nominated
2) Appoint to the office an eligible elector if no one has been nominated
3) Hold the election if either no one or only one person has been nominated; and
WHEREAS, a notice of the above facts was published in The Signal, a newspaper of
general circulation, and La Opinion on August 14, 2024, and posted on the City website, all three

NOW THEREFORE, the City Council of the City of Santa Clarita, California, does
hereby resolve as follows:
SECTION 1. Pursuant to Section 10229 of the Elections Code of the State of California,
the following person is being appointed to the office to which he was nominated:
City of Santa Clarita, One (1) Member of the City Council — District 3, Full Term of Four Years
Jason Gibbs
SECTION 2. The election scheduled to be held on Tuesday, November 5, 2024, as the
same pertains to the aforesaid office is now canceled.
SECTION 3. Jason Gibbs shall qualify and take office and serve exactly as if he was
elected at a municipal election for that office.
SECTION 4. The City Clerk shall certify to the adoption of this resolution.
