VACATION OF AN OFFER OF DEDICATION FOR FUTURE
STREET PURPOSES ALONG SULTUS STREET AND SAND
CANYON ROAD AND ACCEPTANCE OF AN EASEMENT FOR
TRAIL PURPOSES

RECOMMENDED ACTION
City Council:
1. Adopt a resolution for the summary vacation of an offer of dedication for future street
purposes along Sultus Street and Sand Canyon Road, as described and shown on Exhibit "A"
Legal Description and Exhibit "B" Exhibit Map of the attached resolution.
2. Authorize the City Clerk to record the certified original resolution in the Los Angeles County
Registrar -Recorder's office.
3. Authorize the City Manager, or designee, to accept the dedication and grant of easement for
public use and trail purposes along Sultus Street.
4. Authorize the City Manager, or designee, to execute all documents, subject to City Attorney
approval.
BACKGROUND
Offer of Dedication for Future Street Purposes Vacation
The offer of dedication to be vacated, shown in blue on the attached Location Map, is a portion
of Parcel 1 of Parcel Map No. 7909, originally dedicated to the County of Los Angeles on May
11, 1978. The offer of dedication on Parcel Map No. 7909, as described and shown on Exhibits
"A" and "B" of the attached resolution, was for future street purposes. The dedicated future

street traverses through a private residential lot located on the west side of Sand Canyon Road
south of Sultus Street. The existing paved improvements are not within the vacated area. The
dedicated future street is not needed for future public road purposes. The existing private and
public roads are adequate to serve the existing residential parcels within its vicinity.
Per Section 8331 of the Streets and Highways Code, the legislative body of a local agency may
summarily vacate a street or highway if both of the following conditions exists:
1. For a period of five consecutive years, the street or highway has been impassable for
vehicular travel; and
2. No public money was expended for maintenance on the street or highway during such
period.
Both of the aforementioned conditions exist; therefore, staff is recommending the offer of
dedication as described and shown on Exhibits "A" and "B" of the attached resolution be
summarily vacated by adopting the resolution.
In compliance with Section 8340 of the Streets and Highways Code, City staff coordinated with
public utilities and determined that there are no public utility facilities in place that would be
affected by this vacation, and no reservation of easement is necessary for prospective public use.
Trail Dedication
The property owner at 26949 Sand Canyon Road has offered to dedicate an easement for public
use and trail purposes within the property frontage along Sultus Street as shown in green, on the
attached Location Map. The trail easement will allow for a trail segment to be constructed along
Sultus Street, providing a continuous trail connection from Sky Ranch Road to Placerita Canyon
Road.

RESOLUTION NO. 25-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA,
CALIFORNIA, SUMMARILY VACATING OFFER OF DEDICATION FOR
FUTURE STREET PURPOSES ALONG SULTUS STREET AND ALONG
SAND CANYON ROAD DEDICATED ON PARCEL MAP NO. 7909, FILED IN
BOOK 95, PAGES 17 AND 18 OF MAPS
WHEREAS, the offer of dedication being summarily vacated fully meets the requirements
of Section 8331 of the Streets and Highways Code, which states "The legislative body of a local
agency may summarily vacate a street or highway if both of the following conditions exist: (a)
For a period of five consecutive years, the street or highway has been impassable for vehicular
travel; (b) No public money was expended for maintenance on the street or highway during such
period"; and the current owner requests that a portion of the public right-of-way be vacated.; and
WHEREAS, under Chapter 4, Summary Vacation of Part 3 of Division 9 of the California
Streets and Highways Code, no public hearing is required and no public hearing was held.
NOW, THEREFORE, pursuant to the provisions of the California Streets and Highways
Code, the City Council of the City of Santa Clarita, California, does hereby resolve as follows:
SECTION 1. That it is hereby found and determined that an offer of dedication for private
and future street purposes, as described in Exhibit "A" legal description, and Exhibit "B" exhibit
map, attached hereto and incorporated herein by this reference, which real property located in the
City of Santa Clarita, County of Los Angeles, State of California, fully meets the requirements of
Section 8331 of the Streets and Highways Code, which states "The legislative body of a local
agency may summarily vacate a street or highway if both of the following conditions exist: (a)
For a period of five consecutive years, the street or highway has been impassable for vehicular
travel; (b) No public money was expended for maintenance on the street or highway during such
period"; and such offer of dedication is therefore vacated, subject to Section 2 herein.
SECTION 2. That within the street to be vacated, there are no public utility facilities that
would be affected by the vacation.
SECTION 3. That the City Clerk of the City of Santa Clarita is instructed to record the
certified original resolution in the office of the Registrar -Recorder of the County of Los Angeles,
at which time the easements summarily vacated will no longer be public service easements.
SECTION 4. The City Clerk shall certify to the adoption of this resolution.

That portion of the 50.00 foot wide Future Street, known as Sultus Street, together with the
variable width Future Street of Sand Canyon Road, both lying within Parcel 1 of Parcel Map No.
7909, in the City of Santa Clarita, County of Los Angeles, State of California, as per Map filed in
Book 95, Pages 17 and 18, of Parcel Maps, in the Office of the County Recorder of said County,
described as follows:
BEGINNING at the northeast corner of said Parcel 1, said point also being on the westerly Right
of Way line of Sand Canyon Road, 40.00 foot wide, as shown on said Parcel Map No. 7909;
thence, along said westerly Right of Way line, South 19' 2F 14" East 34.09 feet;
thence, South 14' 18' 34" East 291.43 feet to the southeast corner of said Parcel 1.
