SUBJECT: RESOLUTION FOR SUMMARY VACATION OF LANDSCAPE
MAINTENANCE EASEMENT ON KYRA COURT

RECOMMENDED ACTION
City Council:
Adopt a resolution for the summary vacation of the landscape maintenance easement at
21603 Kyra Court and 21602 Kyra Court, as described in the attached Legal Description
Exhibits.
2. Direct the City Clerk to record the certified original resolution in the County of Los Angeles
Registrar -Recorder's office.
BACKGROUND
A landscape maintenance easement located at 21603 Kyra Court and 21602 Kyra Court (Tract
Map No. 52807) was dedicated to Los Angeles County (County) and recorded on October 10,
2000. In Fiscal Year 2012-13, the City of Santa Clarita (City) annexed over 2,400 acres of
inhabited territory from the County, including the Kyra Court properties, located north of Copper
Hill Drive, off of Haskell Canyon Drive.
The purpose of the easement was to provide access for maintaining landscaping improvements.
While the Kyra Court properties are adjacent to Landscape Maintenance District (LMD) Zone
T62, they were not annexed into that zone and are therefore not included in the zone's
maintenance responsibilities. Consequently, there is no funding source allocated for the ongoing
maintenance of the easement area.
Given this context, staff recommends vacating the easement, as it falls outside of any designated
maintenance zone and has no funding source to support ongoing maintenance. The City has
consulted with the property owners, who agree with this recommendation. If the vacation is

approved, responsibility for maintenance within the easement area will transfer to the respective
property owners. A copy of the original easement document, along with a survey identifying the
specific easement area, is included for reference.
Pursuant to Streets and Highways Code Section 8333, the City may summarily vacate a public
service easement if the easement has been determined to be excess and no public facilities exist
within it. Based on these statutory conditions, staff has determined the easement to be excess and
eligible for vacation.

RESOLUTION NO. 25-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA,
CALIFORNIA, VACATING THE LANDSCAPE MAINTENANCE EASEMENT WITHIN
TRACT 52807
THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1: The City Council finds as follows:
A. On or about October 10, 2000, the map entitled Tract No. 52807, consisting of three
sheets, was recorded with the Los Angeles County Recorder's Office in Book 1249, Page
41 through 43 of Miscellaneous Records (Final Map).
B. The Final Map created a two -lot subdivision (Assessor's Parcel Number 3244-115-032
through 3244-115-031) with an easement to the County of Los Angeles for landscape
maintenance services (Easement). The Easement was acquired by the City on January 8,
2013.
C. The Easement meets the definition of "public service easement" in Streets and Highways
Code § 8306.
D. A review of applicable documents, and after contacting other public utilities, shows there
are no public utility facilities located within the Easement.
E. Pursuant to Santa Clarita Municipal Code § 2.26.050(G), the City Council finds that
vacating the Easement is consistent with the City's General Plan.
F. The City may summarily vacate landscape maintenance easements pursuant to Streets
and Highways Code §§ 8330-8336.
SECTION 2: In accordance with the City Council's findings, and pursuant to Streets
and Highways Code § 8333(c), the City of Santa Clarita summarily vacates the Easement.
SECTION 3: The City Clerk, or designee, is directed to record this resolution pursuant to
Streets and Highways Code § 8336 within 10 days of its adoption.
SECTION 4: From and after the date this resolution is recorded, the Easement vacated
by this resolution will no longer constitute a landscape maintenance easement.
SECTION 5: This resolution will become effective immediately upon adoption and will
remain effective unless superseded or repealed.

SECTION 6: The City Clerk will certify to the adoption of this resolution.
