SUBJECT: SUMMARY VACATION OF SLOPE AND DRAINAGE EASEMENT
LOCATED AT 26313 GOLDEN VALLEY ROAD (DRINKPAK
INDUSTRIAL BUILDING)

RECOMMENDED ACTION
City Council:
1. Adopt a resolution for the summary vacation of an easement for slope and drainage purposes,
as described and shown on Exhibit "A" Legal Description and Exhibit "B" Exhibit Map, of
the attached resolution.
2. Direct the City Clerk to record the certified original resolution in the Los Angeles County
Registrar -Recorder's office.
BACKGROUND
On December 15, 2003, a slope and drainage easement was granted to the City of Santa Clarita
(City) as Instrument No. 03-3782236 to support the construction of Golden Valley Road. On
June 6, 2023, the Planning Commission approved Master Case 22-074. This approval allowed
for the construction and operation of a 174,000-square-foot industrial building located on Golden
Valley Road south of Centre Pointe Parkway, as shown on the attached Location Map. Through
the development of the site, which included re -grading the slope and installing an alternate
drainage system as outlined in the approved project site plan, the slope and drainage easement is
no longer necessary. Therefore, staff is recommending the unnecessary easement be vacated.
Per Division 9, Part 3, Section 8333 of the California Streets and Highways Code, the legislative
body of a local agency may summarily vacate an easement if any of the following conditions
exists:
(a) The easement has not been used for the purpose for which it was dedicated or acquired

for five consecutive years immediately preceding the proposed vacation.
(b) The date of dedication or acquisition is less than five years, and more than one year,
immediately preceding the proposed vacation, and the easement was not used
continuously since that date.
(c) The easement has been superseded by relocation, or determined to be excess by the
easement holder, and there are no other public facilities located within the easement.
City staff has determined that the easement as described and shown on Exhibits "A" and "B" of
the attached resolution have been determined to be excess by the easement holder, and there are
no other public facilities located within the easement. Therefore, staff is recommending the
easement be summarily vacated by adopting the resolution.
ALTERNATIVE ACTION
Other action as determined by the City Council.
FISCAL IMPACT
The resources required to implement the recommended action are contained within the City of
Santa Clarita's adopted FY 2025-26 budget.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA,
CALIFORNIA, SUMMARILY VACATING SLOPE AND DRAINAGE EASEMENT
LOCATED AT THE SITE OF THE APPROVED DRINKPAK INDUSTRIAL BUILDING AT
26313 GOLDEN VALLEY ROAD
WHEREAS, the easement being summarily vacated fully meets the conditions of
Division 9, Part 3, Section 8333 of the California Streets and Highways Code, which states: "The
legislative body of a local agency, or any public officer or employee authorized by the legislative
body as provided in subdivision (a) of Section 8335, may summarily vacate a public service
easement in any of the following cases: (a) The easement has not been used for the purpose for
which it was dedicated or acquired for five consecutive years immediately preceding the
proposed vacation. (b) The date of dedication or acquisition is less than five years, and more than
one year, immediately preceding the proposed vacation, and the easement was not used
continuously since that date. (c) The easement has been superseded by relocation, or determined
to be excess by the easement holder, and there are no other public facilities located within the
easement." The current owner requests that these easements be vacated; and
WHEREAS, under Division 9, Part 3, Chapter 4 of the California Streets and Highways
Code, no public hearing is required and no public hearing was held.
NOW, THEREFORE, PURSUANT TO THE PROVISIONS OF DIVISION 9, PART 3,
SECTION 8333 OF THE CALIFORNIA STREETS AND HIGHWAYS CODE, THE CITY
COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. That it is hereby found and determined that south of Centre Pointe Parkway
an easement for slope and drainage purposes, along Golden Valley Road, as described in Exhibit
"A" Legal Description and as shown on Exhibit "B" Exhibit Map, attached hereto and
incorporated herein by this reference, which real property located in the City of Santa Clarita,
County of Los Angeles, State of California, fully meets the requirements of Section 8333 of the
Streets and Highways Code, which states: "The legislative body of a local agency, or any public
officer or employee authorized by the legislative body as provided in subdivision (a) of Section
8335, may summarily vacate a public service easement in any of the following cases: (a) The
easement has not been used for the purpose for which it was dedicated or acquired for five
consecutive years immediately preceding the proposed vacation. (b) The date of dedication or
acquisition is less than five years, and more than one year, immediately preceding the proposed
vacation, and the easement was not used continuously since that date. (c) The easement has been
superseded by relocation, or determined to be excess by the easement holder, and there are no
other public facilities located within the easement," and such easement is therefore vacated.
SECTION 2. That within the easement to be vacated, there are no public utility facilities
that would be affected.

SECTION 3. That the City Clerk of the City of Santa Clarita is instructed to record the
certified original resolution in the Los Angeles County Registrar -Recorder's office, at which
time the easement summarily vacated will no longer be a public service easement.
SECTION 4. The City Clerk shall certify to the adoption of this resolution.
