RESOLUTION 25-66
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA,
CALIFORNIA, APPROVING THE THIRD AMENDMENT OF THE AGREEMENT FOR
THE PROVISION OF GARBAGE, RECYCLABLE MATERIALS AND ORGANIC WASTE
COLLECTION SERVICES BETWEEN THE CITY OF SANTA CLARITA AND BURRTEC
WASTE INDUSTRIES, INC., FOR SOLID WASTE COLLECTION SERVICES
WHEREAS, the City of Santa Clarita (City) is empowered under Section 7 of Article 11
of the California Constitution to make and enforce, within its limits, all police -and sanitary -
ordinances and regulations not in conflict with general laws; and
WHEREAS, in partial implementation of Section 7 of Article 11 of the. Califonf ;
Constitution, California Public Resources Code Section 40059 authorizes the tRy to determine_
all aspects of handling of solid waste that are of local concern, including the frequency of "
collection, means of collection and transportation, level of services and nature, location, and
extent of waste handling services; and
WHEREAS, City entered into that Franchise Agreement with Burrtec Waste Industries,
Inc. (Burrtec) for the Provision of Garbage, Recyclable Materials, and Organic Waste Collection
Services (the "Agreement') dated July 1, 2023, and amended by that Second Amendment to the
Agreement dated July 1, 2025; and
WHEREAS, Section 48.01 of the Agreement provides that any amendment of the
Agreement must be in writing and signed by the parties; and
WHEREAS, the City and Burrtec desire to amend the Agreement to modify rates.
WHEREAS, Burrtec therefore submitted a rate adjustment request per Section 6.04 of the
Agreement for an annual CPI adjustment. After review of the request provided by Burrtec, the
City and Burrtec desire to amend the Agreement by adjusting the maximum rates as outlined in
Sections 6.04.1 of the Agreement for rates beginning January 1, 2026.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA,
CALIFORNIA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The "Third Amendment of the Agreement for the provision of
Garbage, Recyclable Materials and Organic Waste Collection Services Between the City of
Santa Clarita and Burrtec Waste Industries, Inc., for Solid Waste Collection Services"
(Third Amendment), a copy of which is attached hereto is hereby approved. The City
Manager is authorized to execute the Third Amendment on behalf of the City.
SECTION 2. The City Clerk shall certify to the adoption of this resolution.

RECYCLABLE MATERIALS AND ORGANIC WASTE COLLECTION SERVICES
BETWEEN THE CITY OF SANTA CLARITA AND BURRTEC WASTE INDUSTRIES, INC.
FOR SOLID WASTE COLLECTION SERVICES
THIS THIRD AMENDMENT TO THE AGREEMENT FOR THE PROVISION OF
GARBAGE, RECYCLABLE MATERIALS AND ORGANIC WASTE COLLECTION
SERVICES BETWEEN THE CITY OF SANTA CLARITA AND BURRTEC WASTE
INDUSTRIES, INC. FOR SOLID WASTE COLLECTION SERVICES, (Third Amendment) is
entered into this day of _ 2025, between the City of Santa Clarita
(City), and Burrtec Waste Industries, Inc. (Burrtec).
RECITALS
WHEREAS, the City is empowered under Section 7 of Article 11 of the California

WHEREAS, Burrtec therefore submitted a rate adjustment request per Section 6.04 of the
Agreement for an annual CPI adjustment. After review of the request provided by Burner, the
City and Burrtec desire to amend the Agreement by adjusting the maximum rates as outlined in
Sections 6.04.1 of the Agreement for rates beginning January 1, 2026.
NOW, THEREFORE, the City and Burrtec in consideration of their mutual promises,
amend the Amended and Restated Agreement as follows:
SECTION 1. Exhibit 1 of the Amended and Restated Agreement shall be
