SUBJECT: SUMMARY VACATION OF AN EASEMENT FOR SANITARY
SEWER PURPOSES AT SHAPELL - PLUM CANYON
APARTMENTS (WHITES CANYON ROAD)
DEPARTMENT: Public Works

RECOMMENDED ACTION
City Council:
1. Adopt a resolution for the summary vacation of an easement for sanitary sewer purposes, as
described in Exhibit "A" Legal Description and shown on Exhibit "B" Exhibit Map, of the
attached resolution.
2. Direct the City Clerk to record the certified original resolution in the Los Angeles County
Registrar -Recorder's office.
BACKGROUND
The sanitary sewer easement to be vacated was originally dedicated to the City of Santa Clarita
(City) on Tract Map for Tract No. 73858, recorded on December 18, 2020. The 10-foot-wide
easement, as shown on the attached Location Map, is located within the Plum Canyon
multifamily apartment project approved by the City Planning Division on December 30, 2019,
under Master Case No. MC19-171. The easement being vacated is no longer necessary as the
sanitary sewer serving this project has been relocated and a new easement has been dedicated to
the City under a separate document recorded on July 7, 2025, as Instrument No. 20250480303.
Per Division 9, Part 3, Section 8333 of the California Streets and Highways Code, the legislative
body of a local agency may summarily vacate a public service easement if any of the following
conditions exist:
The easement has not been used for the purpose for which it was dedicated or acquired
for five consecutive years immediately preceding the proposed vacation.

2. The date of dedication or acquisition is less than five years, and more than one year,
immediately preceding the proposed vacation, and the easement was not used
continuously since that date.
3. The easement has been superseded by relocation, or determined to be excess by the
easement holder, and there are no other public facilities located within the easement.
City staff has determined the easement as described and shown on Exhibits "A" and "B" of the
attached resolution has been superseded by relocation. Therefore, staff is recommending the
easement to be summarily vacated by adopting the resolution.
ALTERNATIVE ACTION
Other action as determined by the City Council.
FISCAL IMPACT
The resources required to implement the recommended action are contained within the City of
Santa Clarita's adopted FY 2025-26 budget.

RESOLUTION NO. 26-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA,
CALIFORNIA, SUMMARILY VACATING AN EASEMENT FOR SANITARY
SEWER PURPOSES ON TRACT MAP FOR TRACT NO. 73858 FILED IN BOOK 1425,
PAGES 77-85, INCLUSIVE OF MAPS
WHEREAS, the easement being summarily vacated fully meets the requirements of
Division 9, Part 3, Section 8333 of the California Streets and Highways Code, which states: "The
legislative body of a local agency, or any public officer or employee authorized by the legislative
body as provided in subdivision (a) of Section 8335, may summarily vacate a public service
easement in any of the following cases: (a) The easement has not been used for the purpose for
which it was dedicated or acquired for five consecutive years immediately preceding the
proposed vacation. (b) The date of dedication or acquisition is less than five years, and more than
one year, immediately preceding the proposed vacation, and the easement was not used
continuously since that date. (c) The easement has been superseded by relocation, or determined
to be excess by the easement holder, and there are no other public facilities located within the
easement." The current owner requests that this easement be vacated; and
WHEREAS, under Division 9, Part 3, Chapter 4, of the California Streets and Highway
Code, no public hearing is required and no public hearing was held.
NOW, THEREFORE, PURSUANT TO THE PROVISIONS OF DIVISION 9, PART 3,
SECTION 8333 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF
CALIFORNIA, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That it is hereby found and determined that the sanitary sewer easement, as
described in Exhibit "A" Legal Description and as shown on Exhibit "B" Exhibit Map, attached
hereto and incorporated herein by this reference, which real property located in the City of Santa
Clarita, County of Los Angeles, State of California, fully meets the requirements of Section 8333
of the Streets and Highways Code, which states: "The legislative body of a local agency, or any
public officer or employee authorized by the legislative body as provided in subdivision (a) of
Section 8335, may summarily vacate a public service easement in any of the following cases: (a)
The easement has not been used for the purpose for which it was dedicated or acquired for five
consecutive years immediately preceding the proposed vacation. (b) The date of dedication or
acquisition is less than five years, and more than one year, immediately preceding the proposed
vacation, and the easement was not used continuously since that date. (c) The easement has been
superseded by relocation, or determined to be excess by the easement holder, and there are no
other public facilities located within the easement.", and such easement is therefore vacated.
SECTION 2: That within the easement to be vacated, there are no public utility facilities
that would be affected.
SECTION 3. That the City Clerk of the City of Santa Clarita, California is instructed to
record the certified original resolution in the Los Angeles County Registrar -Recorder's office, at

which time the easement summarily vacated will no longer be a public service easement.
SECTION 4. The City Clerk shall certify to the adoption of this resolution.
